we sent letter of intent to marry in 90 days one from me, one from my fiance.

what we did is that we did not write declaration of how we met in person in the last 2 years on a seperate paper.

my fiance, the petitioner, included that in the letter of intent to marry in 90 days. 

so he combined intent to marry in 90 days and declaration of how we met in last 2 years in the same letter

on my side i also wrote the letter of intent to marry in 90 days

should be okay

for the next and updated one you will do for the embassy or your rfe, look up the preformatted one here on vj

Does that vary from place to place?  In the I134 instructions I read, required a letter from your employer, letter from the bank..

 

Taxes were to be sent if you were self employed.

 

varies from embassy to embassy and officer to officer

best to have as much as possible

but tax return copies or transcripts will be necessary, best to always have 3 years on hand of transcripts.. easier to deal with

also a variable is you will need the 125% for your 134 (Hank_)

So, my fiancee and I are in disagreement about what is needed as supporting evidence to send with the i-134. To my understanding, all that is needed is last year's Income Tax transcripts, copy of the W2, Three most recent pay stubs, and a letter from my employer. She is insisting that I need to contact my bank and also get a statement from them with the date the account was opened, the total amount deposited for the past year and the present balance. There seems to be a lot of conflicting information on here. 

a lot of the reason you have conflicting information is due to the fact that every country handles these a little differently

the wisdom piece lends itself to having more documentation rather than risking a delay by having to submit more ####### to an interviewing officer.

if you get the transcripts, that is best... go ahead and order the past three years just in case.

the 134 instructions do list the employer letter and bank letter also

Everything is ready and in COMPLETE order..... But I have added bright orange heavy stock paper as dividers between EVERYTHING.... Personal statements, letter of intent, birth certificate, all Facebook, Skype, what's app chats, all airline hotel and bank statements.....



Good idea or bad..... What are your suggestions friends...... Keep or remove. I also did the two hole lunch for them and have things divided up that way as well..... I'm a bit OCD with organization but, have I done too much. Please advise on the heavy stock paper.



if it makes you happy then go for it

they tear your file apart and put it in their own order anyway

use paperclips.. no staples :)

He does not need a copy of every document in the decree. He needs the document with the court stamp on it. We submitted ONE document to the embassy in Thailand. I don't know if they will accept a faxed or scanned copy so the USC should ask. This doc will be needed at the AOS stage anyway and I know they wont take a faxed copy.

I've worried a bit about this too. My husband is 13 years older than I am. But I'm sure as long as you have enough evidence (photos, emails, affidavits, ect...) then there isn't too much to worry about.

 

They do this stuff daily, I'm sure that they can tell who's real and who's not,  by now. I wouldn't freak over it. Just be prepared!  good.gif

Have had a RFE for a Divorce Decree but in this country (New Zealand) our divorce papers are not called this, they are an Order of Dissolution of Marriage, which I supplied a copy of with our application. I contacted our Ministry of Justice, and they said it is simply a difference in country's legal terminology! But this leaves me with a situation where I a being requested to supply a document I cannot obtain. The Ministry of Justice suggested I go to the Court House, and do an affidavit to accompany my Divorce papers, stating this is what this country has in the place of a decree. Does anyone else have experience with this kind of situation???

these guys at uscis are IDIOTS  .. in several states a divorce is called a dissolution of marriage

IMO I would respond asap with a letter and any applicable copy of NZ official web page speaking to the title of your divorce document. I am not sure if you can get anywhere by calling with this one.

Yes, I have too much time on my hands waiting for the interview. I find myself going over all the packet 3 forms, worrying I missed something.

 

Today I was thinking. My girlfriend provided a notarized document indicating she was never married. But I didn't provide anything. I don;t have anything available to provide.  Did I miss something? How do they know I am free to marry?

it is definitely country specific.  my wife had to get hers from the recorder's office where we got the marriage license in her country

Just to add to this...I've sent off for my UK police certificate.

 

When I called a police station in Sydney to confirm they did fingerprinting there, the guy asked me if I wanted ink or digital. I'm assuming that digital is the way to go but can anyone confirm this? I told him probably digital and he said I need to call the consulate to confirm as different visa's require different types of fingerprints.

 

Can anyone who needed fingerprints for a K1 interview please confirm which ones they were told to get. I'm still leaning towards digital ones. Each time I pass through the USA customs I never have a problem with the digital reader picking up my fingerprints so I'd say it will be fine.

I applied for a K1 Visa I129F followed the instructions here (thank you!) Sent it on 9/11/2013 with Checked cashed on the 12th and an SRC number assigned 09/13 from the Texas.

 

Today i received my (5) 4x6 color photos returned stating that they cannot support my application/petition with photo pictures.  They are standard pictures in the format stated in the guide here.

 

Anyone else had this issue?

the problem is she has a small family so they are not employed or working for the gouvernment, so I couldn't find anyone to sponsor me ..

 

Any USC or LPR can be a sponsor. Maybe you can find friend who will be your co-sponsor. Or if she has cash assets (about $80K) and no job this will meet the requirements too.

If you go to the states with a tourist visa and do AOS you will be comitting immigration fraud. A B-2 visa is for visitors, and not for immigration. Especially when USCIS looks at your case file, and sees a K-1 application, you will have to deal with a lot of red flags that will probaly end in deportation. You will still have to fullfil the I-864 requirements even with AOS.

 

please all the stupid/negative comments leave that for yourselfss ..

 

There is nothing positive to say though: Enter the US on a tourist visa, do AOS will probaly end in deportation and high legal costs. Better do it the right way, or at least find a co-sponsor to finish the K-1 process.

No, when filling the K129-f visa, you must attached all papers, which includes her marriage papers and divorce papers, you must to prove both are single and able to get married, in order for the K129 be approved. She better starts her divorce process now, otherwise this will take even longer than you expect. You must have all paperwork ready in order to start the request, after you mail everything it will take 8 to 10 months for her visa to be completed, and she be able to travel to US.
