K-1 Fiance(e) Visa Process & Procedurespacket

If you filled in your country and timeline, we could direct you to your country-specific instructions (or your country's portal on here, where you could find more information).

As for Germany, the packet three was just one sheet of paper stating the link to the consulate's website and telling you to download the checklist & follow the instructions on it.

thank you, but i want to be ready so what are the documents i need to send to the embassy in packet 3

K-1 Fiance(e) Visa Process & ProceduresDealing with a previous marriage in a high fraud country.

To mimolicious and Ihavequestions, and BeccaBecca, and others, thank you for your responses. I know my relationship. I know what happens sometimes with fraud. Whether Muslim men can marry three wives or four wives in Egypt is really not relevant here. I thank you all for pointing that out to me, and I appreciate your knowledge, but I'm seeking advice on how to overcome the red flags. I am aware of the red flags, which was the point of the post in the first place. No one has actually given me any advice solid about what to do about it and how he can prepare for the interview.

its what i noticd here, when u ask question they never answer you, but they just talk and talk bla bla.

K-1 Fiance(e) Visa Process & ProceduresDealing with a previous marriage in a high fraud country.

Muslim men can marry up to 4 wives, not 3.
You have a long road ahead of you, your case has some very big red flags, the biggest being his children and why he would leave them, the second being he was had a traditional marriage and divorced her to be with you. There have been many cases where men from MENA countries have divorced their wives to marry us citizens and as soon as they hit the day after the 5 year rule, they divorce their us wife and remarry the first wife back home and brings her and the kids legally to the US. I'm not saying this is the case with you, but the consulate is very aware of this type of fraud, it will be an uphill battle trying to,prove that won't happen. Do you have other red flags? Big age difference, different religion, big difference in educational background? The more info you give us the more advice we can give.

you are pathetic

K-1 Fiance(e) Visa Process & ProceduresI-134 Co-Sponsor Proof of Citizenship

Hi everyone,

I lost my job so now my dad is going to be my co-sponsor for the K-1 visa. He is a naturalized citizen, he has the citizenship number but he doesn't have the citizenship certificate anymore. He lost it or misplaced it. Is it okay if we just copy his passport book for proof of citizenship.

What else do I need for co-sponsor?

Thank you so much.

K-1 Fiance(e) Visa Process & ProceduresHELP: How to pay the $340 fee for the I-129F package?

Hey everyone.

Me and my USC fiance are about to send our I-129F package in a couple of weeks. Here are my questions.

1. How to pay the $340 fee for the I-129F package?

2. What to put in the package itself as the proof of the payment?

I'm sorry if this sounds a dumb question, thanks for helping us out in advance.

You need to include a check drawn on a US Bank for $340 made out to U.S. Department of Homeland Security.

The details are on page 6 of the I-129F instructions.

K-1 Fiance(e) Visa Process & ProceduresNOA2 expiration date..

London auto-extends expiring petitions. If that happens, you'll need an updated letter of intent (petitioner to beneficiary).

You should read this complete guide for K1s in London: http://www.visajourn...complete-guide/

If you change your mind about the process you're on and withdraw your petition, it shouldn't affect you negatively in the future. Just make sure you close it off properly (you withdraw by the petitioner writing a letter to the service centre the case is at).

Thanks so much for this! How long can we extend it for in London before we would have to re-start from the beginning?

K-1 Fiance(e) Visa Process & ProceduresNOA2 expiration date..

Hi there,

We received our NOA2 at the end of November and it states that it is valid until the end of February. What happens if I cant get my medical done and forms submitted to the London Embassy in time before it expires? Is there anything we can do?

It has been very difficult because since filing for our K1, circumstances have changed and we are now considering going the other way and applying for my Fiance to come to the UK. If that ends up being our decision, We may still want to move back to the US in a couple of years. If that is the case, is there anything we should do about our current K1 case to ensure that we don't harm our chances of re-applying in the future to go there?

Many thanks for your help!

K-1 Fiance(e) Visa Process & ProceduresMedications

Hi everyone, hopefully some of you know the answer to this.  Does the use of medication by a beneficiary, like bi-polar meds or anti-depressives, have a serious bearing on immigration?  I know that there is a rule about a person being a danger to others, but how do they determine that?  If someone has absolutely no history of violence, has never been hospitalized and does not have a history of suicidal tendency, but is on medication to regulate a light case of bi-polar, will that cause a problem during the medical exam portion of immigration?  Will that alone require him to go for further screenings as part of the medical?

Many thanks!

I just wanted to know that is that it? or do we need to do something else too? If that is it then what is the wait time for the call from the embassy for interview? and what documents would be required for that. I know they will send a letter stating all the documents but still i just wanna be a step ahead :) :)

K-1 Fiance(e) Visa Process & ProceduresWhat is the "Police Certificate" in Packet 3 checklist?

Thanks for the info, everyone.  Part of why I was having trouble is that my packet #3 was lost in the mail, so they sent me to a generic pdf online that just gives a list of stuff, it gives NO explanations on what any of it is.  I have figured out though that it's a criminal record check, so I can get that done.  Thanks again to everyone who helped out.

K-1 Fiance(e) Visa Process & ProceduresWhat is the "Police Certificate" in Packet 3 checklist?

Hello all - I can't find the answer to this in the guides.  I am looking at the Packet 3 checklist I have to sign, and it says to make sure I have "Police certificates from each country in which the applicant has resided for one year or longer".  What is that?  Do I have to get something from the police, and if so, what?  I have no arrest record or criminal convictions, does that apply to everyone, and if so, what is it, what do I ask the cops for when I go to get it, is it just a criminal record check?

Thanks for any help anyone can give me.

K-1 Fiance(e) Visa Process & ProceduresDoes the K-1 have to be used on the next entry to the USA?

Hmmm, I need to cross by air though (we're at opposite ends of the continent), so it's trickier to be turned back.  Ah, I wish the USA was a country where they would just tell you where you stood ahead of time, and I would know whether to come for a visit or just stay home. It's the downside of living in a country where we are allowed to cross so easily.  I've been pulled into secondary frequently, so that doesn't scare me any more, but I would hate to be turned back, or be made to activate the K and then not be able to get back home to work.

Thanks for the info, guys!

K-1 Fiance(e) Visa Process & ProceduresDoes the K-1 have to be used on the next entry to the USA?

I have what might be an unusual question.

Once the K-1 visa is issued, do I need to use it on my next trip to the USA?  I ask because I work in Canada and want to keep my job for now, and if I was to activate the K, it's unlikely that I could get married and then get the green card (that takes a while after the marriage, correct?) before I'd have to head back to Canada for at least 8 weeks to work.  It sounds like, from what I have read on other threads here, that I wouldn't be able to get the re-entry permit issued fast enough either, if I was to try that instead (as that is what I originally thought I would do).  If I waited a few months then I would have time to enter and stay a while, but then that would be a long time between visits, we don't want to be apart for 6 months.

So, can I visit the USA after the K-1 is issued, and not actually use it on that trip but save it to a later trip?  I'm guessing not, but I thought I'd ask and see if anyone here knows.

K-1 Fiance(e) Visa Process & ProceduresI-134F for Petitioner and Co-sponsors..

Alright, so on the K1 guide from this site it states:

4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate:

(A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance
(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available)
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern
(D) List containing serial numbers and denominations of bonds and name of record owner(s).

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form.

We have begun gathering our post-NOA2 documents to be sent to myself (beneficiary) so I can bring it to the embassy. My fiancée (petitioner) recently quit her job and is looking for another one as we speak - and we have decided that even if she does get a job, we will use a co-sponsor.. and with that said we have a couple things we are a little unsure on, and while I've read threads up and down these forums about this subject, I need to ask this:

  1. Does my fiancée (petitioner) have to send all the above mentioned documents, statements, etc., if she has a job that puts her above the 125% poverty line?
  2. What exactly do co-sponsors need to document if they, too, are above the 125% poverty line?
  3. How many co-sponsors can we actually have? Is there even a limit (we currently have two friends who offered up their support)

I really hope you guys can help settle these issues. Thanks in advance. smile.png

K-1 Fiance(e) Visa Process & ProceduresIncluded the I-134 togther with the I-129F

the I-134 is not required for the USCIS process.  The I-134 comes in play at the US Embassy or Consulate at the interview.  You're should be fine as long as you submitted the I-129F with form G-325a with along with your backup documents.  USCIS should ignore the I-134 for the approval process

Thank you very much for you reply. Yes, I subminted  the I-129F  and the G-325A,  and all the supoorting  supporting documents.

USCIS will just ignore the I-134.

Thank you very much for you reply, if the USCIS  ignore it , then I should be fine.

K-1 Fiance(e) Visa Process & ProceduresI-129F Declaration

Well, if you think that's the best way of coming at this. Just that I keep getting conflicting information.

I found a thread on here eventually where people were saying to list the dates of your meetings. Plus, the advice on the step-by-step guide states:

4. Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question '34.a' of the I-129F. Make sure to sign and date it.

I'm not meaning to sound like I know better or even remotely what I'm on about, but I'm getting all manner of different opinions and advice on what to do.

Thanks for the help all. Just to clear up the confusion, I did mean the declaration and NOT the letter of intent to marry.

I've basically written just under a page, highlighting the dates each of us has visited the other since December 2012, and any further travel dates within these periods of time which involved us flying together. I've also included the date of our engagement,

K-1 Fiance(e) Visa Process & ProceduresI-129F Declaration

Hi folks,

Can I first say how much of a relief it is to have found such a site and community! I have learnt so much and had my mind put at ease with regards to many issues (mostly being able to travel to the US while the whole K-1 process is underway -- we all know how unclear or ambiguous already these matters can appear).

My enquiry related to the declaration we're expected to include in our I-129F packages. I have attempted to find examples of such a declaration, basically just for a template of how to go about composing the declaration. Should it be to-the-point and approached from a 'timeline' basis, keeping unnecessary detail to a minimum, or should it read as more of a journal? I don't really know how best to approach this.

Apologies if this has been covered elsewhere, but I haven't been able to find anything on it using my -- albeit limited -- searching skills.

Any help and advise would be absolutely marvelous.

Thanks!

K-1 Fiance(e) Visa Process & ProceduresI-129F: Fiance(e)'s 'Daytime Phone Number'

So, I'm in the process of finalising and printing off all the relevant forms for our I-129F package, and ONE small issue is really grating me.

For the 'Daytime Phone Number' question the available boxes are limited and set out in the American fashion (---) --- ---. This means I'm unable to fit in my 4-digit area code followed by my 9-digit phone number. There is a separate box marked 'Extension' which I have had to make use of to accommodate both the international prefix and my area code.

At present, I have my number marked down in the following format:

(44_) 808-988_ with the extension housing my area code 01433_.

Should I just drop the 0 from the area code and enter my number as:

(143) 380-8988 with the extension marked as +44

I couldn't find this issue discussed anywhere else so thought I should ask.

Thanks,

Mark

(oh, that's not actually my phone number btw)

Evening all,

Me again with another question about a small issue that's causing me to stress out (unnecessarily I'm guessing):

For the section on the Biographical Information form which deals with your parents' details what do I write for my father's 'City and Country of Residence', considering he's deceased?

At the moment I've just put down the place he was living prior to his death. Should I leave this as it is or do I need to state that he is deceased?

Many thanks as always.

K-1 Fiance(e) Visa Process & ProceduresHow to write Alien Fiance Mailing Address in 129F

My fiance lives in Baja California, Mexico. But the I 129F forms seemed geared toward U.S. style of writing an address. On 129F line 3a through 3i is as follows:

3a: In Care of Name____________

3b: Street Number and Name_________

3c: apt suite flor [check box]

3d: City or Town_________

3e: State _____ 3f: Zip Code_____

3g: Postal Code__________

3h: Province____________

3i Country___________

questions:

1) is there a difference between Zip Code vs. Postal Code?

2) How do write a Mexican address that is for EXAMPLE as follows (as an example of mexican ID):

Minie Mouse

Av. Feliz 7777

FRACC VISTA CHULA 99999

TIJUANA, BC.

FRACC STANDS FOR Fraccionamiento (I don't even know what that is).

3) I went to go see her last weekend and we filled out a G-325a (Bio). i had her sing (BUT HER STYLE OF SINGING LOOKS LIKE PRINT AS IT APPEARS IN MEXICAN id). I include the G-325a with the 129f, correct?

4) She is going to email me (which I am going to print at Walgreens) photos of her head shot. How close do they need to be to Passport pictures.

Thanks for the help!!!!!

K-1 Fiance(e) Visa Process & ProceduresMiscellaneous questions: type of translator, photos, G-325a signature, signature on Letter of Intent, engagement

Hey guys, I have a some questions and need your help.

1) What type of certification does the translator need to have? I know someone who is a certified interpreter for an administrative court, will that do?

2) My fiance (that I want to bring from mexico), email me passport type photos so I can have a passport photo shop here print them so I can attach to G-325a. However, she put some small earings on. Will that be a problem?

3) When I went to visit her in Baja Cali a couple of weeks ago, I had her sign some blank G-325a forms that I was going to fill out neatly (she of course provided the info to put on document) when I came to Los Angeles. Was this a good idea? Or should her G-325a form be without her signature?

4) I was reading some infor guide in this site that her signature needs to be in the letter of intent to marry. Can I just send my letter of intent to marry her, without her signature? She only speaks spanish. So it does not make sence that she sign my english letter unless it is translated. Or does she make her own? It is just that I wanted to send package this week, and do not want to drive to see her just to get her signature.

5) i known her for over 5 years. We are getting married when she gets her we have talked about and want to get married, and will get married. But I wanted to do a formal engagement party in Baja so I can propose to her. Does the formal engagement need to happen before I send the package to immigration?

Thanks in advance for all your help.
