Just follow the 2 links above if you want to pay Delbros already.... its your call, we are still giving you advise... If you think you can pay for it before your case reaches MNL then go ahead.. but I advise to wait til its in MNL as Delbros which is the official visa delivery for USEM will sometime verify the case....

You cant do a Delbros Verification until you have MNL case number, which means it has to pass through USEM first. Delbros will not verify without a valid MNL case. You can read it about in USEM website http://manila.usemba.../wwwh3023.html or http://manila.usemba...ov/wwwfdelb.pdf It requires that you have a valid MNL for Delbros to start processing any cases.

Once the NVC sent the file to the Tokyo consulate, I went to the Tokyo consulate website and made the appointment myself.

In hindsight I was really shooting from the hip since my fiancee hadn't received anything from the consulate at that time.

I went to Tokyo to attend the interview at the Tokyo consulate with my finacee.

We took mountains of documents. I think all that did was slow us down since someone had to go through them. In hindsight it might have been best to stick with the basics. But then again, having extra stuff just in case can't hurt.

How necessary is it to punch holes into the documents when submitting the I-130 packet?  It says ?appreciated? in the instructions, but I am afraid I will screw it up or punch the wrong documents.  Do we have to hole-punch every single paper?  Is it just 2 holes at the top?

 

Don't hole punch anything. There have been contradictory instructions on this topic. It's best to just use binder clips.

Some common reasons for a visa denial (at interview stage):

1) The ConOff is not convinced that the couple have a genuine marriage/relationship
2) The beneficiary has some sort of criminal background that makes them ineligible for a visa to the US
3) The beneficiary has some contagious disease or mental problem that makes them a "public hazard", and therefore ineligible for a US visa
4) The beneficiary has breached US immigration rules in the past (e.g. overstayed a visa and/or entered the country undocumented and/or was deported) so they are banned from entering the US for several years, therefore ineligible for a US visa for a long time

There are several other reasons for denial, but these are the most common. Points 2,3 and 4 may give the option of filing for a waiver to overcome ineligibility, but the waiver is not guaranteed either, the process takes months, and it needs to be prepared by an experienced and competent attorney to stand a chance of being granted.

Assuming that none of points 2,3,4 apply to your case, your main burden is to convince the COs of your genuine and bona fide marriage. The good news is that this is fairly straightforward to prove if one's marriage is indeed bona fide.

I am going to have my interview date by March, most likely but our two year anniversary comes on april. since we were married under two years when we applied for CR1. So now we still going to be considered for CR1, a month difference and we do not want a second application and going the process again in the future...we want to finish it here? Do the consulate decide on this or the authorities in the state on board of entry??


You can try and ask the Consulate for an IR-1 and see what they say. Some Consulates have agreed to grant an IR-1 if it's very close to the 2-year wedding anniversary (but normally, no more than just a few days and as long as the intended travel date is past the 2-year mark).
Alternatively, if you can delay your travel to the US until after your 2-year anniversary, then you can ask the Immigration Officer at the border to stamp your passport with an unconditional permanent residency stamp. This has been done successfully by some people here on VJ.
A third alternative would be to try and reschedule your interview for after the 2-year anniversary, in which case they'll have to automatically consider you for an IR-1. But be sure to remind them, because they may still think they're processing you for a CR-1.

You previously said on another thread that you have been denied before, so it's YOU who said it, nobody putting words in your mouth. Then you come back to bite at people who discovered this older post of yours and you go on a tirade about the US and people in America (which, frankly, scared me a bit - if you hate the US this much, why do you even want to come here? Maybe you should get your wife to live in Egypt with you instead).
People are able to go back and see older posts you see, and if you are going to start a new thread without giving all the facts, they are going to get upset because the purpose of this forum is to try and help each other. But if one is concealing information about their case/situation, then they're wasting everyone else's time, which is why people got upset.

To answer your original question: yes, there have been a lot of CR-1/IR-1 denials before, both from Cairo and pretty much everywhere else, even Consulates that are considered lenient. There is no guarantees. Also, being from Egypt, expect to be put under Administrative Processing which can last anything from a few weeks to several months, even if your visa is approved at the interview.
I do wish you good luck, but it sounds like you don't really want to come to America and you hate everything this country stands for (by the way, one of the main reasons people coming from MENA countries are put under AP, this widespread mentality is of concern to the Authorities), so even if you are denied (a second time?) it shouldn't be the end of the world for you. Your wife can always come live in Egypt with you.

I don't understand what you're saying because you are no better than anyone else, so the immigration process applies to you as equally as it does to anyone else. MsHogan, myself and many others on here are just trying to inform you of the reality of the time-consuming process that is immigration. We have no motive to make you feel worse or bad about anything - it is just reality.

And, to be honest, I am sorry you feel that you are so much more important. My case is most important to me sure, but not so important that I feel like I should be pushed to the front of the queue and everyone else should wait. Well, this comes off as an extremely ungrateful and arrogant response. Like it or not, you are not more special than anyone else here trying to marry/reunite with their loved ones.

I'm from upstate New York (Buffalo area) and am very familiar with Canadian/American couples getting married. You can come to Buffalo and marry no problem, that is true. You then return to Canada and immediately file for the I-130. As Canada does not offer DCF, you can wait with your spouse as long as possible, but there will be separation. Right now CR-1 visas take about a year to process. You are going to have to plan for this. If she can prove ties to Canada, she could be permitted to visit you for up to 6 months (based on the officer at her POEs judgment).

Unfortunately, this is just the reality of immigration.

My case was completed in Mid January. I received an email from NVC on Jan 27 saying,

"The NVC has received all documentation necessary...as soon as an interview date has been scheduled, you will be notified...The applicant should NOT make any travel arrangements...until the US Embassy or Consulate General has issued a visa."

Is this for AOS? If so, there's no set timeframe for when you'll receive your interview date. Depends on your local office. We filed AOS on Sept 28, our case went to interview scheduling around Dec 1st & we just found out today we've been scheduled for an interview in March. Took 122 days to get the interview scheduled. For some it's quicker & for others it takes longer. Check out the general/average timelines on this site to get a better idea.

And you? How is to deal with this unusual relationship or lifestyle?

- I work full time. I know my life will change some, because she will be going to school here, and I am going to be taking some post graduate classes. I always think about the future, and always have future plans. It has only been a year for me, so my journey may not be as extended as most. I've never been the type to be out there very much, so for me, my life hasn't changed much. I speak to her on the phone, and my international calling bill is as much as my cell phone bill, yuck. But it is all worth it. May god make your journey end soon and for the both of you to live life together in happiness.

First my sincerest condolences, I know we all have great hopes that a denial will not happen in our own cases or any other case. May God see your journey through.

Second, please don't try to bring him hear on a visitors visa, that will be the biggest mistake. If you want to stay in India a while, get married and do the direct filing through the consulate. If you have to return, then go and get married in India, and start the CR-1 process. Its potentially another year apart, but if you have that love for him, just keep steadfast in the process.
