Line 23: My Current individual annual income is:

So, my question is, how do we determine what the income for this year is expected to be, when the year isnt over yet? Do we basically multiply the hours per payperiod he works, by his wage, then multiply that number by 24 for how many paychecks he receives in a year? (and how do I prove that he does make the amount we claim?)
Also, our joint sponsor receives $400 or so a month from the Department of Defense for disability pay, which I'm told we can also add into line 23. I understand the Consulate may require evidence of the disability pay, so does anyone know what we should use? We can get a photocopy of a letter from the DOD stating he receives disability pay, or we can get bank statements showing the amount being deposited in his account.

The lady on the phone at NVC was not helpful at all (I think she was new,) so I'm hoping someone here will know what to do!

Hi, just a quick question about the employment letter required for the I-864. I'm sending this pain-in-the-butt form in tomorrow, but am a little nervous because our joint sponsor was not able to get a "typical" employment letter. His employer said something about the Privacy Act, and told him he could "order one in", or instead print off a SF50 (I think that's what the form is called.) Anyways, I have the form here in front of me, and it does list his salary, position, hours per pay period, place of employment, etc.
He is employed with the Defense Commissary, so I assume that is why they had to be so careful about issuing an employment letter.
Anyways, has anyone else had this problem, and does anyone know if this will be ok to use in place of the typical employment letter?

Just using James' Shortcut to fill out the DS-230, and am a little stumped about one thing on here:

When I filled out the I-130, and wrote down all the places I had lived, I was new to the whole process, and decided that since I had just come back from visiting my husband in the US for 4 months, that I should include that as a previous "residence."
Now knowing a little more, I know that I didn't actually "reside" here, and that putting that down may have been a little foolish even, since I basically implied that I resided here, when I was just visiting.
Since I have my info straight now, should I just leave that out on the DS-230 and list only the places I actually resided in Canada? Or are they going to look at the I-130 form during my interview and ask why I had left that out on this form?

Ah ok..sorry, I didn't realize you could use either this year's expected income or last years income as long as you provided evidence of how you came up with the number you put on line 23.
My RFE is probably for something silly like forgetting to put N/A in an empty column ( I hear they are very picky about that.)

They issued us an RFE for the I-864 so I'm hoping it wasn't for filling in that line incorrectly :(

Thanks for your reply. I took a look at the link you posted and found a replica of what the coversheet should look like, and emailed it to my husband, who says that is definetely not what he got in the mail.
I think I as well will just wait for it to arrive. Should be any day now, so the waiting shouldn't be too long.

I'm getting so frustrated with this last form. It all started when I called the automated voice system at NVC after sending in our I-864 package and found out that we were getting RFE'd. Luckily, I found out from some of you that it was not really an "RFE" per se, but it was a normal voice message that happens after you send your I-864 in, and they are about to generate your DS-230 package.
So the voice answering system says that they mailed out a letter which describes what info we are missing. We received that already, but assumed that we are still waiting for the actual DS-230 info, so for about 2 weeks now, we've been waiting on this mysterious package to arrive in the mail.
However, this checklist that we have already received is titled something to the effect of "Missing Document Checklist",(I can't describe it better than that, since my husband is the agent, and I've been the one doing all the visa/immigration work, so I'm stuck trying to picture the letter he has while he reads it over the phone.) It does have a barcode with it, so my question is are we supposed to send the DS-230 in with this, or are we still waiting on something else to come in the mail? I've tried calling NVC but they are closed for the weekend, and it does sound like they have mailed something else to us from what they've said over the phone, but I can't see whatever it was taking longer than 2 weeks to arrive so I'm starting to think we've had the package all this time, and just thought it was the RFE letter.
I assume since it has a barcode on this letter, I am able now to send off the DS-230 and its supporting evidence, but am afraid to send it in early in case I am still supposed to wait for some kind of instruction package on the DS-230.

Sorry if my question is confusing, and thanks to anyone who might know what to do :help:

Hi everyone, I just had a few questions about what to expect in the next couple months before my interview for a CR1 visa.
Our case was completed June 18th, and first of all I'd like to know: Do they usually send you some kind of notification in the mail after your case is complete? Also, how far in advance do they send you your interview letter before your actual interview? As for the medical, do I schedule it for myself, or do they schedule it for me?
I pretty much have everything else in order, I even went out and bought an accordian folder today to put all my documents in for the interview (which is still about 3-4 months away..haha)
but if anyone can answer the above questions it would be very helpful :)

Mostly phone calls, a few times a day. My husband has a nice deal with the phone company where his calls to Canada are free, so we have been lucky that way.
Other than that, chat via msn, occasionally webcam, sometimes online gaming together, and we send each other cute things in the mail as much as possible (sent some Canadian souvenirs and some pics from my visa medical a few days ago, which brought a smile to his face :) )

Your profile says you are pursuing a K3, but with the details you have given it sounds like you are getting a CR1/IR1.
Anyways, either way I would wait a little longer for the medical since Montreal is so behind on interviews right now. The CR1/IR1's are generally scheduled faster than the K3/K1's, so usually once your case is complete it is pretty much safe to go get your medical done then. If you are getting a K3/K1 I would wait until you have packet 3, just to be on the safe side.
Just keep in mind medicals are good for 1 year. The waiting list for MTL right now is approx. 4-6 months.

I agree, I think as long as you can read and obtain all the documents without troubles. Do it yourself! You will feel much more vindicated! You can hire a lawyer, if you run into any snags. Just make sure everything is accurate and true.

Hello! Just checking our fellow VJ's approved in Oct.

Our case was finally completed (12/08). It's weird though because i didnt received any RFE and they barely completed reviewing our case. I sent our DS-230 and documents on Nov. 12, almost a month.

But i'm happy though, blush.gif i am just hoping that we can still get a January interview, so my husband can join us on February. heart.gif 6 years of separation is way too much to handle. sad.gif

I called NVC Today and sad sad.gif to say it's more than 2 weeks since i submitted the DS230 documents and it still under review. NO RFE though. But I wonder what's going on?

How's everybody? Just wondering about the status for your I30 approvals.

My petition was approved Oct 17, and since then I've been calling NVC once or twice a week to check if they already received my paper. Everytime I called AVR always says "NO RECORD". On the 24th I called and spoke to an operator he said that they dont have my paperwork yet. Today I called again and AVR still says "NO RECORD" but since i felt so hopeless, I decided to talk to the operator and finally he said that they have my case on 10/23 and today they generated the DS3032 and AOS.

It feels GREAT! good.gif

Anyways, they didn't give me the IIN - they said to wait for the packet that they will mail out. Which is fine, i 'll try again next time. I will just email them DS3032 for now.

I would say, go ahead and submit it. Dont lie about the unemployment. Put your previous employer with the from/to date. It doesnt matter if you dont have a current job right now. When it's approved and asked for Affidavit of Support and you still dont have a job (which i hope not) you can ask someone to co-sponsor her.

So submit it to save time.

I feel for you. I am also worried about my husband. I currently have a job and i am petitioning my husband but i am scared that he will not be able to find a job right away with this economy. He has a very nice job back in the Philippines, a job that he really loves. He had earned a lot of experiences in his field and yet he is willing to sacrifice it for me and our son. I know that he will be so depress if he wont be able to find a job here and I know that it is something that he can not handle because he's responsible and a real provider.

But eventhough i have this fears, i also believe that we should be together. We will find a way to cope-up with this economy.

I told him that he can look for a job in any state, and i am willing to sacrifice my current job for him. Since i've been here in the US before him, i'll adjust.

Have faith ms. island1902, men just wanted to be men. They wanted to be the provider and they wanted to be trusted. He may be intimidated with your status and the laid-off is depressing for him too. Just go for the best option.

Me and my husband always argue about those stuff too (economy, job, etc. ) but come on like they always say to married couples "for better or for worst". He's only reason maybe is he wanted to be with you.

In a lighter note...you had good education, job experience and some job offers, so why fear of not finding a job? smile.gif You will be fine, i mean we will be fine. There's a solutions to every problem. I dont have it though but just so you know we can get through this. Let's stay positive.

hello rshah!

Send NVC a letter regarding NAME CHANGE. That's what i did. In my case, when i petitioned my husband I used my maiden name and when i became a citizen i changed my name to my married name. I just sent NVC a letter to request name change with a copy of my naturalization certificate. Just send them a letter of request with proof (a passport or a certificate).

for clarification on Question 1.

If you were asking about a copy of the beneficiary's passport bio page - you will need it for the DS230.

But if you were asking about your copy of US passport to show that you are a US Citizen, yes - you need to submit that with your i130.
