And that was it. The consul smiled at my husband and said "congratulations: your visa is approved. You can go pay the courier service and have a nice day"

Cool deal! I'll bet his visa will arrive Monday or Tuesday at the latest but I see you guys aren't in a rush to leave.

Hopefully he will have his visa by next week. He asked the ladies at Cargo Express if he could pick up the visa when it's ready and they told him that he can do that. Just to call and they'll let him know where to pick it up. Yes, he works for the PNC. He works in the administrative department in one of the stations in La Libertad. So he has to do an inventory and get a lot of paperwork ready before he leaves. He might actually leave before the year is over. He just has to try to get everything done super fast. If it was up to us he would be here next week!! happy.gif Still we are very happy and really looking forward to finally be together. kicking.gif

I assume his appointment is at 12pm. They begin forming the line to enter the Embassy at 11am. If he's at the front of the line he'll come out around 2:30, if he's at the end it will before between 5 & 6. We got there at 10am and where number 14 in a line of about 40. My wife came out at about 3.
To sum up, tell your husband to get there early and stay in the front of the line!


Thanks, Abiding! His appointment is indeed at 12 pm. I talked to him today and said he is actually planning to be there like around 9:30 to 10 am to see if he can make it in front of the line. The lady at the embassy told him to be prepared to be in there at least for 4 to 5 hours but hopefully he will make it to the front of the line. Well, my husband went to his first interview today. They only asked him some simple questions, like my name, his name, his parents names, if we have any children ( we do, we have a son) and that was it. He was told that his case was completed and all the paperwork seemed to be in order. He received a yellow slip and was told to return on Dec. 17th at 12 pm for the second interview. He was told to eat lunch before arriving because it will take a while. So God willing this will be it and next week we'll hear those magic words "your visa is approved".

Abiding, that was fast! I thought they would take at least a week to deliver the visa. Congratulations!!!

Thanks everyone for the advice! We dread being separated for so long if I had to go back to the U.S., I don´t understand how some of you have done it. I have been teaching English and worked as a telemarketer for about a year where I could´ve asked to be sponsored for a visa, but as I said I didn´t expect to be here so long. If not I would´ve done things differently... Obviously, I will get my parents to co-sponsor me because I have only filed maybe one tax return in five years and not even full-time.

I can´t even get the Madrid Embassy to pick up the phone so I could ask about all the questions I have. Luckily, there´s the internet and this site without a doubt has the best information I have found.

Since our purpose is to live in the U.S. so I can go to graduate school and him work in animation, isn´t it an easier process to apply for the fiancee´ visa as opposed to the spouse visa? At least that´s what I´ve read in other sites. Regardless, I would prefer to get married in L.A. with my family and friends :D

Hi everyone,

I am about to begin the process of applying for the K1 visa for my fiancee´. I am a U.S. citizen and met my Spanish fiancee´ in Spain while on vacation two years ago. I have been living in Spain ever since and have gone back to the U.S. to visit twice. However, I never acquired a visa because I never expected to be here so long. I am worried that my illegal status in Spain may affect my fiancee´ chances of getting the K1 visa.
Does anyone have any words of wisdom?

We are still waiting too. Our NOA1 is dated July 1. We had a touch on September 16 and now nothing. It's really disheartening to see mid-August people getting approved. Ummm...I am not an expert on advance parole, but this does not sound correct to me. As far as I know, advance parole is only available to aliens on non-immigrant visas already IN the States legally. Potential parolees are requesting leave to travel abroad and then re-enter before AOS has been granted. This is why those who enter on immigrant visas (IR1/CR1) and those with multiple-entry non-immigrant visas (K3, for example) do not need AP. The K1 is a single-entry non-immigrant visa that needs to be adjusted for the alien to achieve permanent residency.

It is not available to those who have never been to America, and it is not available at the border. If you want to visit America before or after your I-130 has been approved, you need a tourist visa. Think about it -- why would US immigration give you clearance to exit and re-enter the States before you even arrived in the States in the first place? blink.gif

Whether or not you will be approved for a tourist visa is another matter. You may be eligible for humanitarian parole -- I know little about this, but here is the info from USCIS on that matter: http://www.uscis.gov...00045f3d6a1RCRD

Note the paragraph that states: Humanitarian Parole cannot be used to circumvent normal visa-issuing procedures, nor as an instrument to bypass preference immigrant visa availability or processing for refugee status. Parole is an extraordinary measure, sparingly used to bring an otherwise inadmissible alien into the United States for a temporary period of time due to a very compelling emergency.

Perhaps someone else can shed light on that matter, but as it stands you are not eligible for advance parole.

If you earned money anywhere in the world, you need to file a tax return unless, as trailmix says, it is below a certain (very low) threshhold. I know from experience that London wants these and in fact their insistance on them has caused delays for some UK filers who thought that they were exempt and hadn't proved this sufficiently. When in doubt, file. For those of us abroad it is not that hard, and better safe than sorry.

Looks like these two are eligible for DCF, which can greatly reduce the amount of time waiting for the green card. It also results directly in a green card -- much better and cheaper than a K3. However, the USC absolutely MUST backfile taxes for at least the last three years -- there is no way of getting around this, as it is a requirement for the I-864. Backfiling is no biggie -- a lot of USC's abroad don't realise they're supposed to be filing even though they don't live in the US anymore. (Case in point: me! I hadn't filed in 11 years.) The IRS has a branch in the Embassy, and the guys there are really friendly and genuinely helpful -- I get the impression that they've seen it all. Anyway, the USC can call their office Mon-Fri between 9-12 on this number: 020 7894 0477, and request forms and instructions for 2004-06. They'll need to complete a 1040 and a 2555-EZ (exclusion of foreign income). Very boring and tedious, but not hard and ultimately worth it! It's also possible to visit the office -- no appointment needed.

The second issue on sponsors -- the USC must act as the main (or first sponsor) even if they have no assets or US-derived income. DCF folks are often in this situation, and need a joint sponsor. The joint sponsor need not be close family, or even family at all, just someone who is capable and happy to take on the responsibility. It may be possible to take into account the UKC's assets if they can be made liquid within 12 months, and are equal to 3 times 125% of the poverty line for the size of the household (looks like 3 people here, so that would be 3x$20,750 = $62,550). If the UKC beneficiary's assets exceed that amount, there may be no need for a joint sponsor.

I thought we would go to the USC line, but when I asked the officer which line we should go into (I made it clear I was a USC and he was on an immigrant visa), we were told ALL visas go to the non-USC/GC line. This was the case for Newark, but could be different for other airports/terminals/cranky crowd control officers.

Bruce's POE experience was 2 hours at Newark -- we're not sure what happened but he thinks that they literally "forgot" about him! He watched over a hundred people enter the room for secondary and get processed while he waited, and waited... He was the last person to be processed in the room -- seriously. The whole processing took about a minute, a minute he had to wait 2 hours for! Nothing was wrong with his papers, they just...overlooked him.

We also had to wait nearly 40 minutes to get to the head of the queue in the non-USC/non-GC line in the first place, so factor that in as well. Although plenty of people have shorter times, I would think you wouldn't want to take the risk. 3 hours would be my bare minimum. Heck, I'm travelling to Sacramento next week via Vegas and I'm giving myself 3 hours to change planes domestically!

The medical is actually 200 pounds, not 170. You'll also need to pay for the visa on the day of the interview -- you've filed for a CR1 visa which now costs $400 (you can also pay the equivalent in sterling);you'll also have to pay for the visa to be couriered back to you, which costs 14 quid.

Hmmmm... I'm trying to piece this together from your posts. I'm wondering if this is because you're doing an IR1/CR1 through the NVC -- if I'm not mistaken, unlike the K1s and the DCF folk, you send your police certificate off first to the NVC? (K1s and DCFers just have to bring them to the interview.) Perhaps the NVC is taking a harder line than the Embassy about the validity of the old-form police certificates (which is still puzzling, but looks like they *might* be accepting them until August 15th), and requiring the ACPO certificates without exception.

The other thing is you say your husband applied for the certificate last spring -- is it nearing a year since he received it? If so, they might want one with a longer validity, so that it would be definitely still current at the time of interview (which, of course, you don't know the date of yet).

Just a few thoughts. Sorry you've hit this bump in the road; when you asked earlier this year, none of us had a clue about ACPO certificates, as babbles points out. But it is quite fast to get one, so hang in there!

UK police certificates are good for 12 months when dealing with the London Embassy. Just a heads up.

I would simply fill out the I-134 now (in the present tense) and send recent pay stubs as evidence of income. As of the date he signs before the notary, the information will be correct. Having a joint sponsor as back-up is a good idea too.



I think she's doing a CR1 and has already done an I-864, not an I-134.

Also, there is the possibility of self-sponsorship in London -- not unheard of, and I bet from the sale of the flat you'll probably be sitting on a half-decent sum, given the exchange rate. If you pop in at the UK sub-forum asking about self-sponsorship, you might hear from someone who has done it successfully. You'll need assets worth 3 times the amount needed in income (is it just your husband and you? Then you'll need $52,500 in assets, which is about £27,000). You need to show your bank account reflecting this.

I am fairly certain I have heard of at least one other person going through London who had to do an I-130 interview. You might PM Thomas -- his username is T and M. I know they did an I-130 interview last year.

But seriously, yes, it is possible for him to marry you in the US as long as he doesn't intend to stay. My British husband and I got married in Vermont, but this was possible because we were living together in the UK and intended to return there after the wedding. It would have been possible for us to marry in the UK with no impediment since I had been living there for over 10 years, but we decided to have the wedding closer to my family. After the wedding, we returned to London and began filing for his visa. No problem at all. I would recommend getting a copy of your marriage certificate as soon as possible after the ceremony if you would like to file for a spousal visa right away.

And as mentioned above, the CR1 visa is the way to go. Cheaper and superior to the K3. Good luck!

Oh... and I'm moving this to the CR1/IR1 forum since this is not about a K1 visa at all -- you want to marry before filing.

Simple answer: Yes, but with several reservations.

Very few jurisdictions within the US even allow marriage by proxy -- only four, in fact. It is not necessarily very easy and there is a LOT of paperwork to complete. It is also necessary to consummate the marriage after the proxy wedding, which means you will need to meet with your new spouse before filing and present proof that you have seen each other after the date of the wedding. This would need to be in your spouse's country or another country that you both are able to visit legally.

It's a lot of hassle, really. Again, why not go for the K1?

If NVC did confirm with you it has already been sent out and that you are comfortable with using JSC, I suggest that you go ahead and do so. Anyone who uses JSC need not to wait for the DS230 to arrive in snail mail.
