Hi, I'm in Los Angeles, and a marriage license can be obtained in one hour. The only identification your fiancee needs to show is some government type, like a passport. But in Los Angeles County, only the Downey office performs Civil Ceremonies Monday through Friday. Beverly Hills does Thursday, and the rest Friday only!!! So check. With the license, you can pay someone to officiate. Check the internet on that.

We are planning to go on the Monday she arrives in August to Van Nuys, get the license, then go to my church where my pastor will officially marry us in front of a few friends. Hopefully, we can use the chapel. Then we will take everyone to lunch (hopefully a quick one), and be on our way to the honeymoon in Santa Barbara.

My fiancee and I have just sent our paperwork in so we are a long way from our wedding day, but we are thinking of the logisitics of our wedding. She is from Peru, so one option we thought of, once the K-1 visa has come through, is for me to go down to Peru, where we will have the ceremony with the families and be married and then we come back up the USA and stop in at my local marriage office where we get married again in the USA. Technically this is not legal since she will not be my fiance when we enter the USA but in reality is this going to cause any problems later on down the line since we can pretend to the US govemment that the wedding in Peru never actually happened??

Any thoughts would be appreciated

That was my thought as well. A simple 'mistake' of using an incorrect visa can lead to a lot of trouble - read this gentleman's story - he is in the US separated from his wife and children who are living in Japan because she entered on a K-1 visa after she was already married and is now banned from returning to and living in the US for 10 years. She was found guilty of immigration fraud. The 'inconvenience' of waiting to get married in the US, or of getting married and using the right visa to enter the US is just not worth this risk.


No need to confuse apples with oranges. No, don't get married in Peru before entering the USA on a K1 visa. However, if you want to have a marriage-like "ceremony" in Peru that does not result in a "marriage" that's ok. Just be cautious not to use "wedding pictures" as proof of relationship or mention the ceremony at the interview. If you already have the visa in hand before the non-marriage ceremony, that's safer. You're doing nothing wrong, but don't want to be misinterpreted either.

The example in the story linked above refers to somebody who actually married before being awarded the visa. That's visa fraud, intentional or not.


You say it's okay, but really, are you sure it's without any consequences? Sometimes you are asked at the interview if you have any type of ceremony planned. I am a little concerned total honesty at that point could result in a delay. And what if a guest at the wedding-like "ceremony" decides to call the embassy with the information that the couple got married? It does happen. And what question at POE could result in misunderstandings? I believe there are big risks in having a marriage-like "ceremony" at least in some countries, not Thailand. I don't see how they can be fatal mistakes, though. So, go in with your eyes open.

I meant possible misunderstandings at the border or later when adjusting status. I got a lot of feedback when I posted about having a non-binding ceremony myself, and many people, one of them a former immigration officer, warned me that the slightest suspicion that you are married is enough to get turned away at the door. Since it's hard to prove a negative, that you are not married, if there is any evidence you are, the officer at the port of entry can cancel the visa. Scary, scary stuff. But then, people bringing someone from Thailand do it all the time because it is an accepted custom there to have a ceremony that is only social.

I believe there is some risk involved in having a non-binding ceremony that can cause delays. I can't see how it would risk more than that because, in fact, there is no marriage. It's not like you could file for a k3 visa. I weighed the risks and tried to make the best possible decision. I wish I knew more at the time because I already had put a lot "out there" to my fiancee about a ceremony in her country and it made the conversation difficult when I learned more facts.

Have you researched how long the K3 option would take in Peru? At least with the K3, you eliminate this one worry.

For your own peace of mind and security, I would advise you to choose the option of K1 or K3 and live with it. A non-binding wedding ceremony is a possibility, but has it's own worries. You don't need a "certificate of being single" for the fiancee visa. Just make sure you BOTH state that you are single, free to marry, and will do so within 90 days of entering the US.

The certificate is only needed when you plan to marry in some foreign countries, before the marriage actually occurs.

Both my fiance and I are single (i.e. never married before). The FAQ from this website (visaJourney) does not list "Certificate of being single" as a required item for K1 petition. However, I read somewhere else online, indicating that at least my fiance needs to get a notorized certificate of being single.

Can someone who has already filed I-129F tell me if this is required? If it is required, do I need it as well? If so, where can I get it? Thanks!

Just make sure you have someone checking your mail in case of an RFE (missing one could stall your file for a while). For the affidavit of support, they ask you to provide a letter from your employer with current salary, not just a promise of employment... you should look into that.

Our personal story is along the same lines as the others. Although I am the USC of the two, I was naturalized from France a year ago (got my green card then citizenship via my first marriage --long story short: married 6 years, didn't work, met my now-fiancee, divorced, got my citizenship, applied for a K-1--).

Plus I work for a French industrial group as an executive and I am sent to France 2/3 times a year for business, so we spent romantic weekends in Paris, plus my 3 weeks of vacation throughout the year. On her side, she had 5 weeks of vacation which she spent in LA or in France with me. All in all, we managed to see each other every 4 to 7 weeks for about a week at the time.

Since the NOA2 (10/05) she is here on a VWP for 3 months and she will just have to return to Switzerland for the interview (everything else is done, medical, I-134...) and we will get married as soon as she returns.

For info, my fiancee is currently with me in Los Angeles (originally for 3 months but her interview is in 10 days...) but being from Switzerland, she came via the Visa Waiver Program (EU countries + few others) and wasn't given any trouble thru immigration. It was the 2nd time she came via VWP since we applied and the first time was pretty much the same.

It is very likely different when you have to apply for a tourist visa in your country if it is not part of the VWP.

FYI,

Today it's been 5 weeks since my NOA2 notice of approval. I called NVC and they said that there have been some delays because of the holidays; and that the normal wait period for petitions from CSC is about 6 weeks...(and also, that technically they have 90 days to complete processing..)This is just great of course.....
I also called CSC and talked to a rather unpleasant officer who explained that all I can do is sit and wait tight...they won't even research your case number, since they know there's a backlog anyway...
This is frustrating as hell........

The whole time I assumed after I file my applications with USCIS, I will be able to start immediately assuming things will go through at one point or another. Now, I have second thoughts. Trying to contact a million attorneys but they are taking forever to get back to me.
My question is, say I file my papers next week (June 25-29), how long will it be before I can start working (assuming I send in my I765 with the package)?
And could you please recommend a good lawyer in LA?

Where do you plan to get married? My concern would be if you plan to get married in the US- you might have a hard time convincing the CBP agent that you plan to return to your home country then file the paperwork.


We did just this -- got married in the US, then we both returned to the UK, where we were living already. My husband had no problem at the POE -- he said he was visiting to get married to his American girlfriend whom he lived with in the UK. We were getting married in the US so my family could be there. Then we were returning together to our flat in London and resuming our work and studies. He showed his return ticket. No problems.

Start by reading the guides, and have a look at the timelines of people doing CR1/IR1s through London to get an idea of how long it will take. This is a good example of why it is important to file for AOS as soon as possible after the wedding -- you would have been eligible for emergency advanced parole even if the AOS had not been complete. There was a long discussion on this board recently about whether it is necessary to file for AOS immediately after the wedding; this is the consequence of not doing so in a timely fashion.

Just a quick note to BlessMeIndeed -- the reason why Pushbrk said that none of us is able to say for certain that someone will or will not need an attorney is that we are not apprised of all the facts in the OP's case. It may very well be the case that she does not need an attorney, like the majority of people on VJ. But without access to all the facts, it would be negligent to advise someone not to use a lawyer if it turns out they should. The OP needs to consider if there are any complicating factors -- police record, overstays, removal proceedings, children who need parental permission to leave their home country, to name just a few -- and then proceed accordingly.

I truly hope the OP and her husband don't have to use a lawyer and wish them the best for a speedy process. :)

No, snail mail is always slower than email... USCIS is already backed up from all their petitions .. as long as you can confirm that you have NOA2 from USCIS or NVC, then you are good to go... NOA2 is not needed as the Embassy will have the original petition sent to them from NVC/USCIS. NOA2 is just a notice that the case is moving forward.. All notices are just "reminders" that the case is moving forward... and is like providing status for people who do not keep in contact with USCIS or NVC.

Question, say after I send in my IV documents and later they tell me some documents are missing for example ,,, the marriage certificate was not found,,,, and I know that I sent all of them items requested.....do they really expect me to believe that??? ... and request another copy and might I say ``ORIGINAL`` copy I mean that would be impossible .....???? getting another copy will at least take me a year..??? :blink:


You should of done your part and photocopied what you sent, this way you can assure what you sent to them is what you also have... also it states to send original copy of marriage certificate. Did you not read the instructions?

I am currently working on our i 864 and it seems we lack just 700 dollars from being sufficient...I also have a 401k which today has 108k in it...obviously if cashed out we would be fine for 3 or 5 years depending on what they look at...i'm just wondering if that will be accepted...could also see a small raise before the need to send this in and that would certainly help as well.

My tax return and income from last year was 1k over the limit but that was because I was working 2 jobs at the time but with my health, diabetes i can't work 7 days a week anymore so i found a job that paid almost as much for 5 days a week.

Any ideas if this will be accepted? Joint sponsor is almost impossible to find as most of you know ;(


Even with a rough conservative estimate of getting 50% out of cashing the 401k, you will address the discrepancy very easily.

I wonder if you can figure out your tax rate and also consider the 10% penalty and state that number as your asset.

If that is correct, read up on the DCF sections and info here on VJ and post your questions in the DCF forum. There are some requirements specific to DCF and also specific to individual consulates.

Hi all,
It's my first post here but I've been following the forum for a few weeks now. My USC husband to be (getting married next month)and I were looking to apply for a spouse immigrant visa this summer shorlty after our wedding. We live and work in the UK so we were going to apply at the US embassy in London.

I'd like to ask whether a bad affidavit of financial support (i.e. 0 income in both 2007 and 2008 and no tax returns for those years, and a small income in 2009 because the main sponsor(immediate relative) only started working full time in Aug. 2009) is likely to be a problem to our credibility even if a joint sponsor is used. We are planning to use his mom as our joint sponsor and she makes way more than the 125% of poverty levels, which is good. But given that he has no tax returns to present for 2007 or 2008 due to lack of income (he was an unpaid trainee in 2007 and a student in 2008) and a low income in 2009 due to the fact that he only worked for less than half that year, would that count against our financial credibility/weaken our application? Or would they not care as long as we have a joint sponsor?

Let me say that my fiance has been working continuously full-time for the same company since August last year earning a very decent income. So would it be of any use taking his pay cheques to the interview with us to prove that, because we won't have filed for the 2010 tax year yet?
Just to clarify that all this is UK income though, so it would probably count as 0 US income anyway - and the joint sponsor would be even more necessary. But just to show that we do have some good job prospects and earning potential. I know this won't count towards the approval of the I-864 itself, but maybe will be a plus to our application as whole?

I think for a marriage they'd ask more than that.
Ideally they'd expect you to be living together, but if not, at least to prove frequent visits to each other (e.g. by showing plane tickets, boarding passes etc.), prove that you know each other's families etc. If possible, they'd also want to see proof of "co-mingling" your lives - and that's anything from joint tax returns to joint bank accounts to joint house ownership/joint lease etc.
Pictures, post cards, affidavits from friends and family, phone bill statments etc. can also be used as evidence of a bona fide marriage.
I don't see why money tranfer would be a problem (epsecially if it's from the USC to the foreign spouse, as someone said), but only if presented alongside other strong evidence. If presented alone, it wouldn't be sufficient.
