USCIS timeframe indicated on their website for K-1 Visa is the date the last batch that should be getting results for NOA2. So in this case, all filers before April 29, 2007 should have already gotten some sort of notice for NOA2 whether its approved, denied or in RFE status. Since these are the last batch to receive, of course USCIS will work on future cases such as May, June or July and so forth. I already received my July NOA2 approved notice about 2 weeks ago. So right now the timeframe to receive the NOA2 should be about 4 to 5 months from filing the NOA1. Those are my two cents. Good luck!

When was the last time you called USCIS? If possible just try to get proof from them that your visa was extended when you were here. I know they will have a record for your extension. You will probably need this to show proof you did not overstay and that you left voluntarily to go back to your country. I hope this will help clarify why you changed status so many times. As long it was legitimate to change your status during your stay here in US and that you can show proof that no foul was done, then I dont see it as being a problem. Good luck.

If your salary (gross per year) does not meet the 125% poverty line for two people (which includes you and your beneficiary, and its somewhere around $17200 per year), then you will need a co-sponsor. That co-sponsor should be then able to support all the people in the household (you can use this as a guideline http://aspe.hhs.gov/...7poverty.shtml). Where does your beneficiary live? Some countries do not honor co-sponsorship or more likely to be denied the visa since this causes a likeliness to be a public charge for your beneficiary. Remember, the Affidavit is a legal binding agreement stating your sponsor, who will give oath, that he/she will provide total support for 3 years to your petitioner. The whole purpose of the Affivadit of Support is to prove that your beneficiary once in the US will not be a public charge ie, will not declare bankcruptcy or live off government money. Good luck!

Write it like your writing an essay or letter. One page should be enough, and you can use dates of certain special events. Well I just started from the beginning, how I met my fiance, when we became a couple, journeys in between, how we communicated, when I finally met my fiance, how I proposed to my fiance... blah blah blah. You are just basically summarizing all your evidences that you have into a story... those are my 2 cents.. good luck.

Just answer it with N/A meaning Not Applicable for anything that does not pertain to you. Just dont leave it blank because it shows its incomplete. And pertaining to the citizenship, just check one, its stated on the form to check only one. (At least the last time I recalled).

Its $15 for 4 pics, thats where I renewed my US passport and got additional pics taken for my 129-F application. Again, its guaranteed to be correct or they retake them on the spot. You can go to Walgreens and get them done but Ive seen people post here that they received blurry pics or incorrect sizes and have to retake the photos.

I suggest to take a picture at the US post office. Its guaranteed to be correct as they process US Passports. I always take US passport sizes at the post office as this guarantees me that once is enough and has never failed. Its on a polaroid film so its done in like 5mins and they give you like 4 copies.

Out of curiosity, You already received NOA2? The case is only approved once you get NOA2. If you havent received NOA2 then tell USCIS that you made a mistake on your forms and resubmit the documents to fix the names.

What makes you think using a money order saved you time?


Yeah they still process your case as received as long as your check is there... USCIS does not wait to verify the check clearning (no need to wait for the 7 to 10 days). I personally go with the check and not some money order, so you can track the receipt number.

I would call USCIS as I believe they give 30 days for the first NOA before reporting problems.. Have they deposited your check? Do you have any proof that your packet was in fact delivered? Good luck...

Ask NVC for your case number if it was already sent to US Embassy in Manila. If its already in Manila, then you are already good to go. It takes about 1 month after NVC receives it to file in their system and then send out to Manila. Manila will then take about 1 week before Interview and medical exam dates are released. All forms that you need to complete the rest of the visa is DS-156, DS-157,DS-157K and I-134, all of which you download from http://manila.usemba...v/wwwhniv1.html

For the packet, there is really "no packet", as Packet 3 is just a letter stating that the forms I mentioned above and you can use those forms which they mail out or just fill out the ones on the internet. Packet 4 is a letter stating when you will have your interview at the US Embassy and your medical exam.

My check was just cashed yesterday.

I was looking at your signature and I noticed seeing that the Visa you are applying for was denied.

Hello Guys,

I have a question. I was talking with my fiance earlier that if she gets her K-1 Visa.

If she can come to the US by herself after her Visa is approved.

She mentioned that she has read somewhere (but i'm not exactly sure where) that I have to go escort her to the US.

Is this true? I have not read that its a requirement for the petitioner to have to fly in to the US with the beneficiary.

The problem is I have my work schedule and I am unable to get off work during certain months.

Does this make sense? If anyone can help, thanks.

However, I was just thinking of the "what if scenario".

I know several international students who married US citizens. I do not think that is fraud. Unless it is a fixed marriage. (marriage with no love). It is more convenient because they are already here in the US.

For a tourist visa, I do not think that can be considered fraud, if the two truly love each other.

Hello Guys,

Is the K1 Visa really the best option to bring a fiance over to the US?

I have already applied for the K1 and received my NOA1. So I have about a 4 month wait til I receive the NOA2. (If there is no RFE) Then there are the other steps ahead... I mean its a lot of work and preparation.

However, I am still pondering if this is the easiest / best way to bring my fiance over.

There just seems to be too much paperwork, preparation and time needed to accomplish this.

One of the reasons we applied for the K-1 was because my fiance was denied of her tourist visa. If she was approved, I think we would not have to apply for the K-1. Wouldnt it be easier to go that way? She can re-apply for a tourist visa. Then we can just get married in the US?

Another option also was to apply for a student visa. I have helped an an ex-gf before in applying for a student visa. It wasn't that difficult. There requirements aren't too much as the K-1 and its much faster. Plus the schools are willing to help. (cause they get paid and you have to pay for school every month to keep the students here in the US)

They school just needed a certified bank statement of $20,000 USD for the applicant, a registration fee, copy of the passport and an interview at the US embassy.

What are your thoughts?

This is a pretty crazy, nutts, off the wall idea. And I dont want to sound negative, but your fiance's chances of getting into the US is slim.

Its difficult to go the K-1 route because of the wait and process, but everyone has to do it. Yea, it would be nice for all our fiances to fly over and help us prepare for the wedding right?

All of us here want to be together with our fiances. Sigh...

Some even consider entering with a B-2 and just getting married while in the US (which is illegal, but many do get away with it). much easier than the K-1 Route. Not much paperwork, not much waiting time.. etc.

In any event, hope it works out for you.

As for me spending time with my fiance, I am going to fly over to see her the 4th time this year. I'd rather have her fly here on a B-2, but the chances are on getting that B-2 visa is nearly impossible. (since she has no travel history and have strong ties in returning)

First of all, MRSA is a bacteria, not a virus....totally different things.

Not a virus. Symptoms will only return if you catch the bacteria again. It stands for
Methicillin (an antibiotioc)
Resistant (meaning methicillin wont kill it)
Staph
Aureus (the type of microbe)

Is there a percentage of applications receiving an RFE?

Reason why I am asking is I'm just uhm... yea.. curious.

The selfs employed don't have W2 at least if they only work like that. If they have another work or employer they would have W2 too. The 1040 form is the form that the self employed filed to IRS. And if the self employed has the copy you only can send the copy with the affidavit. And yes, if the sponsor have previous income tax year it's better if you attach them to the I134. The obligatory one is the most recent income tax year, 2007.

I'm excited to receive the official first "touch" the other day. I noticed my name is missing the Jr. Is that something I should call the customer service telephone number about? Is it possible this will delay things? I'm hoping it's not a big deal.

Thanks for the replies. The father was once denied for a tourist visa, so I think the Uncle believes there will be a better opportunity for his brother to be approved to attend his daughter's wedding.


I would ditto the above, if an invitation is required why does not the Uncle do it, or why has he not done it?


Just tell him to bring the wedding invitation to the interview at the embassy and to have proves of ties back in the Philippines: work, house, car, etc...


But, with the K1, it's hard to know a date ahead of time. Our plan is to have her come out as soon as the visa is approved, and so our wedding plans are quite flexible.
