I asked for an expedite when I lost my unborn child and had to have surgery alone. I have no family here where I live as I am here doing my doctoral studies. The USCIS told me that I cannot need my husband (the beneficiary). She said by petitioning for him to come, I am saying that I will take care of him in every way, not just financially. I am not allowed to need him at all. This is what I was told and I was denied an expedite, despite a letter and tons of documentation. My congress person's office said matters of national security only. I have seen others get a medical expedite....good luck!

I would say you should let her do the Police Certificated & Medical after you got NOA2. Coz if you got it before you got Packege3 the document gonna expired. Right now if you wanna get ready just print every Chat , E-mail in paper and print all of your picture that you both take together and mark the date on that thing.

I was told by a person who spoke with an immigration attorney that the k3 is being scrapped and the k1 is now the only way to get the visa. But, not only that, but that my fiancee who is visiting right now and who'd started the k1 with me can marry me right now and just stay to wait out the k1 process. This seems inaccurate to me. Can anyone tell me if there is validity to this because I've read the guides as stated and know nothing about what he's saying.

When we called them they didn't seem to positive about us requesting an extension this late in the game and told us we had to have an attorney send in a notarized statement from us guaranteeing that we'd marry within 3 months of him living here. That's all the data. Does anyone have a story we need to hear?

That and there is no "instant green card". An immigrant visa process, CR1 or IR1 results in LPR status immediately upon US entry but is a months long process. Even those who while visiting, simply change their plans, marry and adjust status face a months long adjustment of status process (also requiring a qualified sponsor) before the green card is in hand.

Extending the validity of the petition is a routine thing. No worries. Get a co-sponsor.

My fiance and I met online in september of 08. I met her in thailand for 3 weeks in Nov of 08. We filled for our fiances visa feb 25th (NOA1). We had many pictures documenting this and plane tickets.

We talk on the phone/webcam/msn about 5 hours a day. I have about 40 hours of talked time on my skype account and I support her every month by paying her bills, which we have logs for that all too, i.e bank xfers and whatever.

We have gone over our pasts quite abit. My past is very complex, living in 8 U.S. states and 4 countries, I dont even really know the right order of everything. We are 2 years apart in age.

I have plans to visit her in the end of july for 2 weeks to meet her family and do the whole dowry thing.

Do you guys see any faults in this plan?

What sprung this question was reading the forums for Thailand's region and seeing all the rejections, almost all were in Vietnam but do you guys see in outstanding flaws?

I finally got the final papers I needed from fiancée, mainly the signed G325A and the letter of intent. I already had a passport style photo of her that we took recently.

Anyways, the questions.

1) As for proof, I just want a confirmation of having good enough stuff. (Completely subjective, I know. I guess I want to know if you would feel safe with this.)

5 photos of us. Dated, located and named on the back. 2 of them will have accompanying copies of dated pairs of ticket stubs. (1 concert and 1 movie theater) Do those matter at all? There's no names on them, but dates and the fact that there's 2 of them.
Her W-2 from when she worked at a nearby restaurant.
A pair of voided checks from Washington Mutual, to show we bank together? Same bank, but different nearby branches.
Named and dated baggage claim ticket stubs from Southwest Airlines from our trip to California.
Paystub showing date and address of other job she had
I also have dated checking statements showing her ATM withdrawls and other random shopping things near me, including paying for rent in my apartment complex.

And for the hell of it, I'll throw in 2 printed emails from GMail between us and a screenshot of a few days worth of Skype calls.

Outside of that, there's not much more I could get unless I resort to letters from friends and family or something.

1b) I can't really think of anything else that has our names together, aside from that one flight. We drove most of the time. Also, is this more about proving she was in my area or with me? It seems like I covered both of them, but not in the same piece of evidence.

1c) This would be so much easier if I could just send video somehow. I can't send a DVD or anything, right? Has anyone tried? I have craploads of videos recorded with my phone. I could easily convert them into something playable. Flipbook?

2) Why are so many people sending in foreign birth certificates and passports when it doesn't seem to be required? Covering bases? I have a scan of her first page, but that's about it. I have a feeling if I get an RFE, from what I read, I'm going to need to get that from her.

3) A standard 9x12 manilla envelope is fine to send this in?

4) Any special Russian things I should worry about? (I guess not right now for the first step...)

5) I've only been employed since February of this year, so I've never filed any tax returns. (Yes, 24, I finished college and spent a year sick) I make about $45,000 annually, not including overtime, plus I'm getting a raise next month. I just bought a new car and have a credit score of 792. I've had the same checking account at Washington Mutual for the last 6 years. By the time of HER interview, when this comes up, should I look into getting my dad as a co-sponsor?

6) Just to be sure, is it ok to write with pen on the G-325As? On what Katia sent me, I used "--" instead of "N/A" on the form and wonder if I should write over it.

I realize our official documents need to be in English (divorce decrees, etc), but I am also sending in some of our emails in as proof of relationship. Most are in Spanish, however. Okay, I know I'm not a K-1, but something very similar happened to me. As part of my RFE, I had to provide details on when my relationship with my first husband ended as my decree absolute was handed down only 11 days before my wedding. (Classy!) I explained that the ex ended it and I moved out of our house four months before I met Bruce, and that my ex was very happy I had found someone to love me again. I was a little miffed about having to do this, because I thought what business is it of theirs whether I was still technically married (although separated) when I was out there dating -- it's not like Bruce is a homewrecker. Then I remembered: oh yes, this is USCIS we're dealing with and EVERYTHING is their business. :angry:

So it's not just confined to China -- even "low-risk" countries like the UK can throw up issues like this.

It makes absolutely no difference if you're both in the US at the same time when you send off the I-129F. I'm assuming you're going to be there under the Visa Waiver Program, which has nothing to do with your application. As long as you leave the country 1) before the expiry of your VWP and 2) before you have your interview at the Embassy you will be fine.

As everyone's said above, going over for a short spell and getting married in the US without the intent to remain is fine. My UKC husband and I went over to the States in December with his mother in tow, and spent four weeks in New England, getting married about halfway through the trip. We didn't bring any proof of ties back to the UK, just return tickets. Neither Bruce nor his mum said anything about a wedding because they were not asked that question -- I believe the question was "What is the purpose of your stay?" and they said to visit friends and celebrate Christmas with them. Stamp, stamp. We all went back to the UK without any issues.

Use your common sense. If you think it helps, bring some proof of ties, but as Daisy points out, don't offer it up unless specifically asked to do so. What you and your fiance are doing is totally legal because you are not planning to immigrate. Hell, think of all the non-USC's who go to Vegas for a wedding and then go back home -- they don't have a problem and neither will you. Congrats! :thumbs:

It's not a photo booth. A photographer (usually just one of the shop assistants) will usually take a snap using a digital camera, then upload it to a computer in the shop. They then use software to get it to the right dimensions. However, the first set of snaps we had done for the G-325As were taken with a more conventional Polaroid-style passport picture camera, like they used to use before the digital photography boom. These were the right dimensions but we both looked shiny and bloated in them! Definitely preferred the digital ones Bruce got for the visa, as he was able to have them retaken immediately when the first snap was a bit duff.

Make sure you remind the photographer you want a US-style photo, and bring the photo guidelines with you if he or she looks confused. A lot of us UK VJers used Snappy Snaps -- in different parts of the country -- and nobody recently seems to have ended up with the wrong size photos using their services.

I don't want to sound like a hardazz here, but I think when you are told to have passport photos of a certain size (2inx2in), you really should make the effort to comply. Now, I know other people have submitted non-standard-sized photos and nothing has gone wrong, but do you really want to risk the delay of an RFE if the person reviewing your petition/application on the day decides to make an issue of it?

Shouldn't be a problem -- I'm a non-exec director of a UK company and have had no problems with being resident in the USA. The various Companies Acts do not prohibit non-UK residents from serving as a director. You'll need to complete a form 288( c ) to update your address details -- Form 288c

Somewhat similar situation -- except I had 12 days between my decree absolute and my re-marriage; we then did DCF through London. I met my (current, and final!) husband 4 months after my ex and I separated, but I didn't start divorce proceedings formally until I was engaged. (More out of laziness than anything else!) So when Bruce and I filed the I-130, we had actually been in a relationship for about a year and half.

I got an RFE for an explanation as to when and how my previous relationship broke down, and when I met Bruce. Although it seemed intrusive and upsetting at the time, I could see how the 12-day interval might raise a few eyebrows. My explanation gave a clear timeline which showed that we had been together for a lot longer than that, and I was able to adduce evidence (bills, bank statements, photos, wedding invites) which showed a real life together.

As Jomo's girl says above, they aren't in the morality business. If you have a bona fide relationship and can prove it, you're fine. good.gif

Just a question. I understand the need for the financial support, but the level is set at $16,000? I am in the process of bringing my fiancee here and decided to get a different job because I didn't think the $30,000 I am making now would be good enough to support her and myself. For those of you that just made the cutoff, how realistically can you support a wife/husband and yourself on that? I'm just curious...I know eventually my fiancee wants to work once she has settled in here, but for the time being, I will be financially responsible for her.


If you ask me, it really all depends on how high maintenance your fiance/spouse will be, and what the living costs are like where you intend to live. I mean, my husband hardly made the cut as well due to having a daughter counting as a dependent and only making $8.50/hr as it is. My father in-law co-sponsored us to make sure we meet the requirements (His income ended up being around the same as yours.)
Anyways, here in NC the living costs aren't that high. We do cut it very close sometimes from paycheck to paycheck, but we never go without anything. If you can set a budget and stick to it, living on a small wage is a no-brainer. Not saying it is something we want or intend to do for long (as soon as I am here permanently I will hopefully join the Coast Guard, and he will be going to college for a computer-related degree.)
I know very well that if we lived in Hawaii or Alaska, it would be an entirely different story since the cost of living there is much higher than where we are.
Needless to say, barely getting by isn't something I would recommend or wish on anyone, but that is how the circumstances are, so that is just what we have to accept right now. (I invented that saying "We may not be rich in money, but we are rich in love!"

Thank you, this is so overwhelming I dont know where to start. Do you have an idea on how long each takes. I would be interested in the less expensive route. lol, So how long on average would the I-130 take (CR-1)

If it helps, I'm going for a CR1, and first applied back in December 2006. I am at the last step now, just waiting for the interview, then I can go.
However, Montreal is extremely backlogged for interviews right now, so it is anybody's guess when they will catch up and start scheduling CR1's faster.
It seems to take approx. 1 year for most CR1's from what I've read thus far.

I've never been denied, but I've been harassed twice and *almost* denied once. As long as you are honest and bring as much proof of evidence of ties to Canada as possible, generally you will be fine.
The last time I entered (a couple weeks ago) the CBP officer actually initially denied me, telling me I wasn't allowed to visit during the visa process, but I politely told him I was sure he was wrong, and showed him a printout from a government website stating I am permitted to visit as long as I can show ties to Canada.
Anyways, I usually bring my whole visa case file (they've only looked at it once so far, and I've crossed 6 times now,) bank statements showing I still have an open bank account in Canada, employment letters on company letterhead stating the time I am planning to be away from work visiting in the US, and the date my employer expects me back, pay stubs, and if you have it, mortgage or rent receipts.

Well finally my REF arrived today and it's not as bad as I had imagined... CSC is asking for "LAST METTING"
......Submit evidence of meeting the benificery in person within 2 year period....Such evidence may include photographs along with airline ticket stubs (the date on the boarding pass the petitioner submitted is incomplete) and recipts (that include the month, day, and year), copies of passport pages that show admission stamps, military order letter...etc.......and any other evidence that you feel will help the USCIS to determine evidence. The following DOES NOT constitute evidence of meeting: disc, video, emails, letters, phone bills and greeting cards and itinery.....

My original evidence of relationship included a 8-10 pictures of my fiancee & I together (with dates printed on the back) and a few copies of phone bills, that was basically it! Why do they want pictures again? I never send them any boarding passes as they wrote that the date submitted is incomplete? As I mentioned earlier, Cuban filings are rather complex and much of evidences other applicants use is not an option for Cuban petitioners. Most travelers discard items before re-entry to the US. eg. credit card reciepts, tickets, boarding passes....I however, can furnish copies of my frequent flyer statments for the past 2 years that include dates and flights for our meetings but I wonder if this would be satisfactory enough? I called the airline today but copies of ticket stubs or boarding passes are not saved and I purchased the tickets directly from the airline so there is no travel agency to help furnish any kind of receipts. I can furnish credit card receipts indicating the payments to the airline, would this work?....As far as passport stamps, I have none and unfortunetly, that is not an option for me. I greatly appreciate if you could think of any other proofs that I could use to satisfy the requirement and get this case moving and hopefully get it approved? I would greatly appreciate any assitance from you..... Thanks, Ischia

Im also approved as of today, Nov 9, 2007 and USCIS updated my statutus and approved my petition. So now what? My fiance is in the Philippines, and I dont know how long the US Consulate in Manila will take before any packets are sent. Anyone with experience in what to do and what I can do before interview time? This has probably been asked for petitioners who have fiance's in the Philippines, but Im still gonna ask, can I request my fiancee to get her NBI clearance and medical exams done before packets are sent? I havent yet filled out I-134 for the Avidavit of Support, when do I turn that in? My salary also decreased since I filled up my G-325A form (quit my 2nd job), but its still higher than the 125% poverty line, do I have to inform UCSIS about the salary change or just file it under I-134? Any help would greatly be appreciated.

Yes, the letter "Notice of Action" is your NOA1 as this is your first Notice.
