K-1 Fiance(e) Visa Process & ProceduresI'm smiling in my passport style photo. Will I get an RFE?
Use separate forms and put "see attached" for all your addresses. Always use current on top then next current and so forth til the oldest is the last one, just like a resume (employment wise) where you put your current one on the top. On the "See attached" form, make sure you specify the number question it is assigned to. Sign and date it at the bottom for any loose forms. All 4 forms must contain the same exact information, so yes you will have to write it or type it out (print it out) 4 times... I dont think you will get an RFE for your photos unless USCIS is that strict on photos, youll just have to wait and see but I doubt it...If you havent sent out your K1 application yet, just retake your photos to be on the safe side. I bet you got like $20 to spare for passport photos (considering thats the most it should cost you) instead of taking a chance on your RFE notice.Might as well fix any problems now then wait later and have it fixed.

K-1 Fiance(e) Visa Process & ProceduresAlready have a tourist visa - worth filing the K1?
QUOTE (Tarumba @ Aug 28 2008, 12:00 AM) <{POST_SNAPBACK}>
I am already doing it, so I suppose there's no going back. But since the beginning, my fiance would get really weird looks from attorneys when he said I already had the tourist visa, and had had a working visa (work experience program for university students).

Sometimes I wonder, is it really worth it? I mean could i just have gone to the US, gotten married and that would be it? I mean, was it silly of us to do it the long legal way?

FYI... I know this isnt technically news but you should read this, from:
http://en.wikipedia...._to_Get_Married

According to the latest video released by Siam Legal - Tourist Visathe US Embassy will reject an application for a US Tourist Visa if they believe that the applicant is either not going to return or wanting to enter the United States with the intention to marry. This being the reason why in Thailand the tourist visa has a rejection rate of more than 90%. Many couples do attempt to bypass the requirements set out for the K1 Visa by applying for a tourist visa. This however does create legal problems when the spouse attempts to adjust their status later. There are criminal penalties for the K1 Visa sponsor and the possibility of deportation for the holder as it may be viewed by USCIS as fraud.

Some may choose to attempt a tourist visa as they believe that they may not qualify financially under the K1 Visa requirements, however there are different financial requirements for each State in the US as their poverty lines differ. Active duty military personnel as an example also only need to meet 100% of the poverty line where as others need to meet 125% of the poverty line. Another reason is that those who are self employed usually do not fully understand that if they do not meet and exceed the poverty line of their State, the assets they own does count towards meeting their financial requirements. Siam Legal - K1 Visa Requirements

A person traveling to the United States to marry a U.S. citizen with the intention of returning to his/her place of permanent residence abroad may apply for a visitor (B-2) visa, or if eligible, travel visa free under the Visa Waiver Program.[4][5]

Write N/A if he doesn't have a Social Security Number. A# is the Alien Registration Number which appears on your Visa (at the bottom, the A# appears to be part of the annotation, but actually its not) and at the I797 Notice of Action sent to you when your petition for your fiance was approved.

K-1 Fiance(e) Visa Process & ProceduresWhat are "touches"?
You wont get many "touches" for K1 filers in USCIS. Most of them dont even receive a touch as after you get NOA, you wait like 6 months before getting transferred to NVC which may or may not receive a touch then after it leaves NVC (after a month), its out of the system in USCIS and goes to your local embassy. Most likely you will get a touch if you have an RFE (which is something you dont want to have).

K-1 Fiance(e) Visa Process & ProceduresDocumentary proof of having met in person in the past two years
You have to show proof you physically met in the last 2 years..if not your petition will be sent back to you and denied... I wrote a timeline story from how we met, where he lived, where I lived, important dates when we said we were a couple, dates when we had "anniversary celebrations", we were together for 3 years prior to meeting in person. Told that we chatted everyday via Yahoo messenger so we knew each other faces even before meeting in person. Told story when we first got our "snail mail" cards, Xmas greeting cards, birthday cards, annivesary cards... Story of how we physically met, date of when we met, how my fiance met my family and how he stayed at our home for his 2 week vacation. How we spent a special vacation together..and how he proposed to get married. Told even how Mama wanted assurance that we will get married, (told her in front of family, Aunt, Uncle, bros and sister). Told date of when he left, plans of where we will live once we get married. Dates are very important. Do not be vague so your petition will be genuine... Get some copies of phone bills with your numbers attached, snail mail envelopes if you sent them, photos together meeting...

K-1 Fiance(e) Visa Process & Proceduresbeloow 25 yrs old if female
Depending on your country legal age limit to get married. If your country requires you to be 25 to get married, then you need to be at least 25 years old to get married, and if you are below this age then you need parents consent. If you dont get parents consent then your marriage can be void null..like it never existed. Same thing if the age limit to get marriage is 18years old.. if you are under 18 and the law requires you to be at least 18 to get married, then you need marriage consent from parents..

If you want to get it right, read this http://www.visajourn...mp;page=k1guide, which is the K1 guidelines, on every page of VJ forum under Guides link, between Portals and wiki. Its the guidelines to K1 visa. All your questions are detailed there, including evidences of relationship. K-1 Fiance(e) Visa Process & ProceduresUSCIS number
It would be a waste of time to call if your case does not fall outside the processing times listed in the USCIS website. First, you will be put on hold for like 20 to 30mins before speaking to someone and then the representative will dicate exactly what you already know and is listed in their website when you check on your case. Forgot to mention, NOA2 takes about 6 months, if you are petitioning from the Philippines. By your timeline, you have about 1 to 2 months to wait..

Check my timeline, we filed about the same time give or take 2 weeks and we had our NOA2 in Nov, giving us over 5 months.

K-1 Fiance(e) Visa Process & ProceduresAbout to file I-129F - few questions
1) Where you took your oath, is your place of issuance. Even a county is fine. I remember going to INS (called at the time) in LA, CA to get my picture taken for my USC papers. I put Los Angeles as this is where I believe it was issued. If you dont have any clue, on your USC document, there should be your current address at the time that you had your USC issued to you. Use that address and find out the nearest Immigration office from USCIS which does USC applications and place that on your Place of Issuance. I wish I knew where you were from so its easier to tell you what to put. And yes, check box it.

2) Your A# is on your Certificate of Citizenship, and starts with A. You were still documented as an "Alien" when you first arrived in the US. You just wasn't an illegal alien, or at least we hope not, coz if you were, you wouldnt be a USC. Hope that makes sense.

K-1 Fiance(e) Visa Process & ProceduresQuestion 10 on the I-129F: Birth Cert number AND Passport number?
If your petitioner was born in the US, then he would have a birth certificate number, if not put N/A for (not applicable). For place of birth, and date of issue of birth certificate then fill those info in..

If your petitioner was naturalized by parents then most likely he will have Certificate of Citizenship. Meaning, he was born outside the US, and his parents became US Citizens and as a dependent he would have gotten a USC document too. If he was born in the US and filed for N600 then he too would have a Certificate of Citizenship. US passport although proves US Citizenship is NOT the "Certificate of Citizenship". If he does not have this "Certificate of Citizenship" then put N/A. Most USC do not have their "Certificate of Citzenship" as it is a waste of time and money to file for one (USCIS charges like $460), especially if he/she was born in the US and has birth a US birth certificate.

K-1 Fiance(e) Visa Process & ProceduresMoved:
You dont need to notify if you fiance is already approved for a visa. I had the same thing done, I moved a month before my fiance arrived in the US. I didnt conact any agency as there was no need to since the petition was done. USCIS doesnt get any update on addresses after NOA2 (only before NOA2 is approved do you notify them, call them and you can hear the automatic message). NVC doesnt need your address as your petition is based on the addressed where you currently lived at the time of your petition. Same thing goes for Embassy. Since your fiance already received visa or got approved, no need to notify them. They dont send you any documents anyways.

Only when you apply for AOS, is the only time you resubmit your address, and just put your new address in.

"Photocopy" is a process of scan and print. The result is the same if done in one process or two.

I know.. if he wants to take the two process or one process. its still the same. You can scan it then print it or you can copy it.... If he asks what the options are, then I will say both are fine. I can read English. Thank you.

K-1 Fiance(e) Visa Process & Proceduresproof of an ongoing relationship
QUOTE (nmh @ Sep 14 2008, 08:08 PM) <{POST_SNAPBACK}>
Hi. I've sent my I-129F 4 months ago to the CSC. I told my fiance that we will need to have proof of an ongoing relationship such as e-mails. She has not sent any e-mails during this time, for me I got tired of sending without a response. We have only used IM 3 times and the last time was almost 2 months ago. When I do call I always use a phone card so no phone bill. As far as I can tell she will not use e-mails and has not made a great effort for us to chat online. For some reason she does not comprehend the importance to show proof of an ongoing relationship or even her required paperwork for the interview though I have asked her many times to look at the required paperwork to understand what she will need. The only thing she knows she needs is a police clearance from two countries Korea and now UAE. She is a citizen of the Philippines. She has not gotten this police clearance as well. My question is this, if we have very little proof of an ongoing relationshop how might this affect the interview at the embassy? Thank you.

If you have little proof of relationship, then yes you can be denied your Visa. If you havent already gotten an RFE for not not evidence of relationship.
The whole point of a K1 interview is to prove that the relationship is bonefide and have proof of evidence to back it up.

I am 99% sure that only the place of birth has to be the country where the interview needs to be.

Or, it has to be in a country where they are citizenship to. (not the place of birth)

The interview will have to be in Sri Lanka.

I applologize for going off topic on my previous post. But here is my advise:

1. Its difficult to say, but do not be surprised if USCIS sends a request for further evidence of your relationship. I would travel to see your fiance as much.

2. I don't think that will be a problem.

3. CR-1 best. K-3 second.

pushbrk is right, but most importantly, are you sure you want to go with marrying someone who also tried to marry two other Americans on in 2003 and 2005.

I think you should really think twice. Its already a few strikes before you.

I believe you can apply for the K-1, K-3 as many times as you can.

Recommend you to go see a lawyer about this. My 2 cents.

K-1 Fiance(e) Visa Process & ProceduresHow was the chances of having NOA2?
Good question! I believe I either posted a question like this or asked / pondered on the possibilities of this matter.

The answer is, Yes, absolutely! The NOA2 does not guarantee anything. It just saying that your petition was approved and that you can file for the K-1 visa. This is like the first step. USCIS will send your paperwork to NVC (national visa center)... and they will give you a MNL Case # to be forwarded to USEM. And yes, it takes months to get that, depending if you are from CSC or Vermont. (CSC usually is more backlogged)

Now what things can go wrong during all this time...

Well, Like what Chris said.... There can be a number of things. Like... If your fiance does not pass document verification.... (NSO will check if she has been married before etc) (this is before the interview or after the interview)
If you did not pass NSO DOC VER check, no K1 visa will be given.

Also, you need to be able to provide an affidavit of support. Getting sponsors for that if your income isnt enough.. etc. Look for that at the K-1 Visa Guide before the interview.

Plus, there's a Medical Check up at Saint Luke's... Checking if you have AIDs/HIV positive. or Tuberculosis.. etc.

Lastly from what I can remember, there will be more checks with USEM in Manila for documents and your relationship. Your fiance will have to go to the interview (with or without your precense).. ETC.

Now, if any of these were missing or invalid. Then you cannot be issued a K-1 Visa. or it expect it to be delays.

Looking at your timeline, if you do not get any RFE's, you might receive you NOA2 by December/January.

I suggest right now since its just the beginning of October, that you just sit back and relax.

Sign up for USCIS website for your case # so you will be updated if there are any updates on your case.

Also, check on visajourney... it helps if you know whats going on and about...

Good luck! Any questions, send me a PM.

I am not allowed to need him at all. This is what I was told and I was denied an expedite, despite a letter and tons of documentation.
