OP, the plain answer is "No". Even if your petition was approved and everything got sent to the embassy, you cannot be approved based on your reasons for not meeting in person. For one, you lied about religious differences (most likely an outright denial of visa without any questions). Second, financial reasons will be a denial since your fiance(e) must be able to financially support you.

Agreeing with all the other suggestions to withdraw the petition and meet in person before reapplying.

2. That is not true. A K-1 visa is valid for 6 months from the date of issuance. There is no "1 month rule" at all. You have 6 months to enter the US and 90 days from entry to marry.

I just want to ask, if my interview is set for 1st week of February 2013, is it alright if i go for medical by end of December? or should I just go for medical by 1st week of Jnauary 2013?

Another thing, lets say my I got the Visa Approval on February 2013 is it ok if I'll go to US by 1st week of April? I've been thinking about this because if i'll get my K1 visa by February i'll be filing my resignation from the company where i'm currently working, but i need to file a 30 days resignation notice (as per company policy). Once the 30 days resignation period is over, i'll have to wait for few days (or weeks) before my company could process my gratuity. clearance & employment visa cancellation so that I could finally be allowed to fly back to Manila where I am planning to stay for at least 2 weeks to visit my family before flying to America and be with my Fiance. Is there any rule which says that once the visa has been issued, the person who has that visa should immediately go to US?

1. Check with your embassy, but I believe most, if not all, medicals are good for at least a couple of months so you should be fine - especially if you already have your interview date!

2. You are given 6 months from the time the K-1 is issued to when you have to enter the US on it so you will be fine to go over in April.

2.) My case is still under initial review. My I-129F package was received on November 7, 2012. I am currently in "Initial Review" stage. The latest update I have when I type in my receipt # is that: On November 14, 2012, your Alien Registration Number was changed relating to your I129F, PETITION FOR FIANCE(E. My question is, around when should I be expecting an RFE or a NOA? I don't mind waiting, I just want to know. I am an American male, petitioning for my Female Japanese Beneficiary.


1. It's not. Some people never even get a ring.

2. You have about a 6 month wait at least from the date of your NOA1. Check out Igor's list under "Immigration Timelines" to get a better idea of what the service center you're at is currently processing.

Hello Everyone

I am so happy that VJ exists because I have SO many questions and know that I can get answers from the experiences you have/are going through. We are just starting out on this journey and getting ready to put together our I-129F so that we can send it out and join all of you in what I understand is an exciting but a bit stressful venture. We are ready to do what needs to be done so that we can continue our life together in California.

I really am feeling a little stupid asking all these questions but I did try looking up answers and didn’t get the answers I needed, so I am hoping that I can get them here from some of you that have gone through this. I just want this packet to be perfect so that it goes straight through without any problems. I think off the bat we have red flags because of our age difference and the fact that he was denied a student visa about 9 months ago because of the guarantee. Any information or advice will be greatly valued.
OK, here go all the questions:

Birth Certificate – I read that I should make a copy of the front and back of it but my BC has nothing on the back so do I need to include a copy of the back if it is blank? Also should I include my fiancé BC too?
Passport – Is it a good idea to include a copy of my fiancé passport?

Divorce Degree – Do I have to make a copy of the entire divorce agreement or just the first page and the back page that has the judge’s signature on it?

G-325A – I read that we are supposed to sign and date this form but I don’t see where there is anything that says signature. I see a place that says print so is this where we sign or can we type our names and write in the date?

I-129F – I am confused on where to send the packet. I live in California so do I send it to the Dallas lockbox and if so do I send USPS P O Box address or can I send it to the express / carrier delivery address? I have seen something about the California Service Center and not sure if maybe this is where I am supposed to send it because I don’t live in Texas where the Dallas lockbox is located.

Proof of Relationship – I am worried because we communicate 90% of the time through Yahoo messenger / video chat, we use this because it is so easy and I get it on my phone and I pad so where ever we are we can communicate. We don’t have too much in the way of phone bills since we talk on chat and only use the phones to call and let it ring once to let the other know we are on line. As for texts we have some, we have a couple e-mails and some facebook chats. We have enough of other stuff like things we have sent to each other and the receipts from the post office. Is this going to be a problem for us? If so are there any suggestions on what we can do?

I-134 – Can I use my family support that I am getting from my divorce agreement if it is a substantial amount and way over the amount needed for the 125% poverty level? I do not work and have not worked for 14 years because I have been home raising my daughter. If I can use the family support where do I put the amount because I don’t see any where that stats something like that. I do see a place if you’re self-employed.

On #7 of the form would I write unemployed?

On # 11 I am not sure what this is and what I am supposed to write here. I thought that the 1-134 form is to make sure that you intend to support your fiancé, so do I check intend and the say I will support him with any and all monies needed to live here in the US? So confused!!!!
What am I supposed to write after – as amended in the blue area under – Oath or Affirmation of Sponsor?

Signing / dating papers – where I have to sign and date anything such as cover letter, letter of intent and declaration of how we met etc…. can I just put the date next to the signature on the bottom of the page and write it in instead of typing it in? because I need to send these papers to my fiancé and have him sign and date but I want to send them to him now and have him sign and date and then return but it takes time and I want to date it the same as he dates it. Maybe there is an easier way to do this if so please let me know.

I had read that we should sign all papers in blue ink, is this true?

Ok now that I have written a novel and you’re falling asleep I hope that there is someone out there that can help me out with these questions. I hope I don’t look too stupid because I really am not!!!!

I highly recommend reading the guides as almost all of these are answered in there. But here's my shot at the ones I can answer from my experience.

1. I included a blank copy of the back just in case. So basically a blank sheet of paper with a sticky note. Who knows.

2. Foreign BC is not required at this stage.

3. Passport is not required, but if you have stamps from visits it is a good idea to include those and the identifying page.

4. No advice on divorce decree.

5. Send it to Dallas. It gets rerouted by Dallas to either California or Vermont.

6. Send everything you've got. Boarding passes and passport stamps are primary evidence, then pictures together. Everything else is secondary evidence. My fiance and I use FaceTime almost exclusively, but we sent a few emails and iMessage logs and Facebook screenshots just incase in additions to our passport stamps, respective visas (I studied in the UK and he studied here which is how we met), and a bunch of pictures.

7. No advice here.

8. The I-134 isn't submitted until you're at the interview stage...so no worries yet.

9. We wrote dates in. In BLACK ink, which is the recommended. Not blue.

I'm sure I will miss some, but off the top of my head, these are the fees I can think of as far as filing goes. There will be additional fees for police certificates, you may need certified copies of birth certificates or divorce decrees, and there's the medical as well. These will vary by person and country.

I-129F filing fee - $340.00

I-485 AOS fee - $985 + $85 for biometrics

There are also forms you may file so you will be eligible for employment and so you may travel outside the US while waiting for your greencard, there may be fees for these, but they are waived if you apply along with the I-485.

There are also fees paid by the beneficiary

I don't know if they may vary by country, but here's the link to the london embassy where I found our fees. You can probably look at the embassy page where you are filing and find out your exact fees.

I believe there is also this new immigration fee, although I'm still confused about whether it is charged for K-1 applicants or not, but it won't hurt to add it in just in case.

I recently filed my ki visa application in february. I have not seen my fiance since june 2012. I usualy seen him every year in june, but this year we were thinking of holding off on out yearly trip because we anticipate him being here in sept or october.
Also we wanted to set aside the money we would use to go toward the funds needed for his future AOS.
Will the USCIS look down upon our case if we dont see each other in more than a year?


As others have said, you'll be fine as long as you've met in the last two years. That fills the requirement so long as you have call logs/email/etc. to prove the relationship is ongoing.

Bear in mind that him being over here by Sept/Oct is pretty optimistic from a February filer. You'll be lucky to have your NOA2 by September at the current rate and then it's another 2 to 3 months until the visa is in hand.

Haiti seems to be the only country regularly expedited. Everyone else is processed by USCIS as a first-come-first-served (in theory) without country preference :)

While it's technically not necessary, it is highly advisable for the co-sponsor to be related closely to the USC - especially because Manila is a high fraud embassy and, from what I've seen on VJ just for the last few months, is already a tough embassy to convince to take on a co-sponsor.

Nothing happened on July 18th - that's just the date that they've been "processing" for 2 months now. Basically, applications that were received after July 18th are not be processed yet (there are a few that have come through, but not many at all)

thanks for the replies, we want to get married at a beach house with a private beach. The place has to be reserved in advance because it is always booked as much as a year in advance. I wanted to try to make a gamble on it. There is a weekend open in August.

I also heard that the guayaquil, ecuador office has been known to ask about wedding dates, asked to see wedding invitations, etc... It is one of the most difficult consulates so i also thought it would be a good idea to have it planned with wedding invitations. but maybe have only a few of the invitations made and printed, even just print a few on my computer. then if there are more delays I won't be out much, just the cost of my own paper and ink. But if there is a longer wait time that would mean having to find a different place to be married.

anyway, I am overthinking everything as I have to keep waiting for so long. I just want this process to be over!!!

looking at the times it seems like
5 months to process i129f - that would be by the end of March
then NOA2 and by the time the guayaquil gets the info and processes ,, maybe May or June
Then interview in July?
Then to US in late July/early August?

if all goes smoothly, are those estimates about right? Since we have 90 days to get married I wonder if a September wedding would be better to plan?


It is averaging longer than 5 months right now - especially if you are at California Service Center. I would be cautious and not expect a NOA2 until end of May at current rates...if not later than that. That would not make your August wedding possible, unfortunately :(

Thank you everyone. Yes we fully intended to be honest as we have nothing to hide. However, I want to be fully prepared with evidence to back ourselves. I think I'll do just as everyone says and make sure my fiancee has the original itinerary plus the rescheduled one and any other confirming proof. I knew that her overstay would be in their system which is why I want to be fully prepared with an answer and evidence of good faith.



They MIGHT have a problem with it. During the volcanic eruption a couple of years ago, flights to/from Iceland (and other countries) were cancelled for a month or more. There was a huge problem because a lot of Icelandic travelers overstayed. Their overstays were not waived and it did count against them.

I do not mean to be a negative here, but just want you to be prepared for that. She didn't overstay long enough for a ban or anything, but be prepared that they may not understand fully.

Just to clarify, I was not insinuating that meeting in person would make the relationship stronger than online relationships. However, when an organization's (USCIS) job is to determine whether relationships are genuine and try and reduce the instances of fraud, there has to be certain situations where the chance of fraud is minimized by the details of the relationship in question. It was just food for thought.

It's just so hard to identify fraud. If you're childhood friends, that can raise more eyebrows than dating for one year. If you met through a mutual friend, that could be a set up. Everything can be fraud. Proof of meeting is important, obviously, but there are other strengthening aspects of a relationship. At first I didn't understand how some couples had only been with each other offline for a week, but it happens that they are much more legitimate than the couple who have been off-and-on dating for the last ten years (in the eyes of the USCIS).

You don't have to justify any reason for the family, just wanted to point out that it looks stronger.

I'm a freelancer and I'm going to submit tax returns, an affidavit, and pay stubs from recent gigs. I'm having a co-sponsor additionally with a steady income. This is all secondary to my fiance self-sponsoring, but that's an option only allowed at London.

Hey Mat! France seems to accept co-sponsors regularly, but have a read through the embassy reviews to get a better sense of that.

Self-employment is a fine option if the tax returns demonstrate income above the threshold. You have to use an I-134 for the K-1. Usually family of the USC looks stronger than friends.

What embassy will you be going through? It's usually recommended to have a copy when you go through the embassy, but some strongly prefer it while others have never asked for it.

Oh great! I did my research before sending the petition and I was under the impression that K1 was a faster process. :( My fiance is currently in New Zealand aboard a cruise ship and will be going home to the Philippines the end of this month and he was thinking of just getting married in there.


Technically, the K-1 is slightly faster. It used to be a bigger difference. If you were to get married there, it would just mean restarting the process for the CR-1 and prolonging the wait, sadly. All of us waiting on the K-1 are just as bummed about the wait as you are, but this is a great community full of people ready to support you guys in the process.

Hi there. There is almost no way that you will have your visa by June 25. Right now the California center is taking 7-8 months to process, plus you have 2-3 months after USCIS approves you to have the interview and actually get the visa. It is best to plan to not have your visa until the October-November.

If you switch to the CR-1, it will still be until the end of the year, best case, until you would get that so it's probably best to just wait with the K-1.

Mar 26 - Apr 6, 2013 - first visit to PH
Apr 13, 2013 - sent all the requirements to the company which we availed the services.
April 15, 2013 - we received an email informing the the company received and check all the docs if there is something missing.
April 15, 2013 - they sent our docs to USCIS.

my fiance will be coming for his 2nd visit on June and he will stay for almost 40days here.

Hoping that we will get the approval fast


Fiance is divorce and he got the divorce decree with the signature of the " clerk"


The process is taking a very long time now. July filers are still waiting. I can't say if the short relationship is a red flag, but I would assume it might raise a few eyebrows.

Okay, well its just an NOA1 at the moment, not a K1. I realize that legally you can't get married and then enter on the fiancé visa because the former status would no longer apply, and I know about the required procedures to obtain a green card abroad after marriage.

I was just wondering whether it was in fact possible after an I-129F was filed. But it sounds like you're saying, that as long as a formal revocation is made then everything should be fine! (assuming all other standard procedures are complied with)


As long as you know you'll be giving up the K-1 route, then you're fine. Just wanted to emphasize that you can't use it after marriage as many people don't realize that. But it sounds like you're good. Yes, as long as you formally withdraw it should be fine.

But do realize that you'll have to wait about a year after filing for the new visa. If you get married in the summer in Korea, your fiance will not be joining you until summer 2014. If you continue now on the K-1, your fiance should be getting here around Christmastime this year if everything is approved.

This mainly goes out to any long time members who may have been around the K1 scene back in 2001, nevertheless, does anyone think or have any reason to believe that the Boston attacks will have any effect (besides passage of a new law) on the processing times of K visa petitions already filed?

And (in case you're wondering about part 2 :blush: ) are there any risks, concerns, or things I should know if we decide (which we kinda have) to get married in Korea this summer instead? I lived over there for a year and the embassy is usually very prompt and makes the process very easy from what I've been told, but will the previous I-129F petition subject to us to any other scrutiny, either at the embassy or at the POE?? You can't get married in Korea and then enter the US on a K-1 visa. You have to enter the US on the K-1 and marry within 90 days. You'd have to refile for a IR-1/CR-1 if you get married, which will put you to the back of the line. Oh, and withdraw your I-129F.

About 3.5 years for us. Started dating in the US, but about a year and half of us living together/dating was in the UK.

While we're apart (a lot for the last year, due to work and visas), we keep in touch by FaceTime and iMessage primarily. We decided to file during his last visit here in November 2012 even though neither of us had previously had any intention to get married - at least for a very long time. But, obviously, we couldn't be happier now.

Your fiance has to be the one to file for you, and I believe the check must be drawn from a US bank. 

 

Ask in the Italian specific region forum about the sponsorship for a better answer, but if his current job is above the poverty line and he can provide a letter from employer and recent paystubs in addition to tax returns, he should be fine.

Obviously, you are in quite a sticky situation. I think your best route might be to involve and immigration lawyer as this is quite complicated. Here's what I can offer you for advice. 

 

1 and 2. You are legally married - recognized by both the US and UK. If you end the relationship, get a divorce. If you don't, then stay married.

3. You will not be allowed to enter on the VWP because of your overstay. You will have to apply for a visa to visit, and your overstay may be questioned. Because you overstayed by less than 180 days, you should not receive a ban.

4. See answer 3 - you'll need a visa and will have to obey the conditions of that visa.

5. You would be able to apply for an IR-1/CR-1 as a spouse, as you are one. However, be advised that your relationship will be questioned given the chaos that ensued after you entered on a K-1. Your overstay will also raise red flags. Again, a lawyer might be preferable here.

^This is what I was going to say. Certain states allow for special passes or driver's license to get into Mexico (or Canada), but if you don't have that then you can't get back in from Mexico.

I believe you can go to/from the Caribbean still with just an ID and your birth certificate, though. Someone correct me if that's changed!

As stated above, the wedding must take place within 90 days of her entering with the K-1 visa and it must take place in the US. After you're married, you'll apply for for AP, which will take about 3 months, and she will not be able to leave the US until AP is in hand. 

 

If you want to marry in Canada, you can do so and then file for a spousal visa afterwards.

thank you for the replies we are just finding it very difficult being apart after living together in England and me just comming back from sspending a month in states.i would like to plan another visit soon but we are not rich and my fiance is worried if say i visit him in june.its not going to be to long before everything is sorted and we wont have had enough time in between to save to fly back once my visa is sorted.neither of us has been married before or has kids . I've been told this can help the processing  being  quicker although i  dont know if thats true

 

It's not quicker if you have kids/were married. It's not slower. That does not factor into the processing times and would only be brought up at the interview stage. 

 

I can sympathize with your situation. I lived with my fiance in London for a year and a half, but left last May when I couldn't pursue another visa. Going back and forth is hard. He visited for two weeks in November (when we decided to get married) and I just visited him for two weeks in London at the end of March. He'll be visiting again in August for another two weeks before the visa gets approved (we filed in December and are hoping he will have his visa by mid-October). Both of us save for the trips and not much else at this point!

 

If you filed in February, then best case you'll here by end of September (if you don't have an expedite), but plan more for Christmastime.

As the first response said, be prepared for a 7 month wait before hearing back from California and another 2-3 months for the UK embassy stuff to process. So, estimate about 10 months from filing to getting your visa in hand.

In JFK they have a "fast lane" for people who have short connections where they let you through passport control without waiting in the long line, but you still need to get your luggage and then run through to checkin again (there is transit checkin right after you exit customs).

 

I don't know if they have a fast lane in Atlanta.

 

Nope they do not! I missed my connecting flight because of immigration in Atlanta two trips ago because immigration was taking so long (and I'm a US citizen!). They were good about rebooking me for a flight a few hours later into a different airport near-ish my destination.

I have not yet submitted the I-129f yet but I am just thinking ahead to the I-134. Is there such a thing as too much information? I have 8 years of tax returns and 7 years of W-2 forms and I have all my paystubs for 11 years of employment with the same company, and I have 16 months of bank statements. I meet the income requirements so I will leave the real estate section blank. I am just wondering how much info will they need. Is it necessary to send them everything? How many years back will they need?

 

Definitely not necessary to send all of that stuff. Send the last 3 years tax returns and W2s, two most recent paystubs and perhaps the last 6 months worth of bank statements (not really a form of verification - though a letter from your banking institution detailing how much is in your account and pattern of withdrawals/deposits is preferred if you can get it). If you can get a letter from your employed stating your job title, your salary, your start date with the company and whether or not the position is permanent then that is another great piece of evidence. 

 

Don't send 11 years worth of stuff though - they won't look at that. And, unless I'm mistaken about Vietnam, you will not actually send the forms so much as the beneficiary will bring them and supporting documents to the interview.

Also it would not have mattered how I worded it VJ is a wonderful resource but many people on here are very rude and unChristlike when we are all in the same boat. Hard on the newbies we are asking out of ignorance to the more experienced people which is the way it should be...tolerance I see! Honestly, your post was not very clear when it comes to it's sexist/gendered language. Being respectful and correct wording is very important - especially on the internet where it is hard to deduce intent from words alone. I am not trying to berate you or anything, but just wanted to make you aware that your post was worded in a way that was offensive to some readers so that you might better understand some of the hostile responses and approach a post with a bit more delicacy next time. For example, ask if the USC or the beneficiary filled out more paperwork rather than assuming couples adhere to stereotyped gender roles. 

 

Also, most people on VJ are not rude - it's the opposite. Most of us on here are eager to help, supportive and patient with one another. Many of us may not be Christlike, but there are hundreds of religions and non-religions to appreciate on here. Yes, some people can be rude (whether naturally or because of a bad day), but they are not the majority on this forum.
