Removing Conditions on Residency General Discussion	I-751 April 2013 filers	Quick question - as far as sending the paper do I need to use paper clips for bigger bulk of papers or just put them all in order(Which they are)and send them? Cheers I've heard people do either. Personally what we did, we included a checklist listing everything included in the envelope in the exact same order it was put together, and we also marked each set of documents (e.g. lease documents, bank statements, insurance statements etc.) individually with post-its, so that the Case Officers can hopefully tell where a set of documents finishes and where the next one starts. I know other people have used paper clips, and nobody has said they had any problems by doing that. So it's entirely up to you how you want to organize your material to make it easier for them. Removing Conditions on Residency General Discussion	I-751 April 2013 filers	HELP!! Me and my husband just sent in our entire I-751 packet and left out the payment check. We are both so freaked out!! I am wondering what we should do. Should we wait to see if they just send it back? I mailed it priority (2-3 days) and I am wondering if I should overnight the check by itself with a letter explaining the situation and hope that it gets there before the packet. Does anyone have any idea what is the best thing to do?? They'll most likely return your package as incomplete and will not issue you a NOA until you submit a complete package. It shouldn't take long to get the package back, I would think a week or two max. Once you get the package back, you can resubmit and include the payment. I would think the best thing to do would be to wait for the package to be returned to you and resubmit, otherwise there may be confusion and delays over your case. I will be sending my package at the end of the month - I have a question I don't have personal checks I just have the regular checks that the bank gave me when I opened my account (it doesn't have my name printed on it). do you think that they will accept these checks or will be better send a money order. Thanks I haven't heard about checks like that. I know most banks order them for you on the day when you open a checking account and you get the checkbook in the mail 2-3 weeks later. Not sure why your bank didn't follow that procedure, but maybe they have a different policy. In any event, if I was you I'd do a money order just to be on the safe side I've done plenty of money orders through the Post Office and they only charge a $1.05 fee as opposed to most banks that charge in the range of $6-10. I would just double check with USCIS (call their Customer Service number) that they'd accept a money order from USPS, though I don't see why not.	Christi85	Female	Greece	2013-04-08 21:33:00

I tried and i got the message.. Wonder if it takes a few days to show up.. Your case can not be found at this time in My Case Status. Please check your receipt number and try again. If you need further assistance, please call the National Customer Service Center at 1.800.375.5283. I haven't. I think though it doesn't show until after they send the biometrics appointment letter (that's what the NOA letter says anyway). So it may take a few extra days for it to appear. Removing Conditions on Residency General Discussion	I-751 October 2012 filers	Hi can anyone pls tell me whether the RFE(If need be) will be an email notification or only via hard copy USPS.I ail be out of my residence for the next 5 weeks and wont be able to check the mail at all. Many thanks. RFEs are normally sent in the mail. If possible, I would arrange with someone to check your mail on your behalf once a week or so while you're gone. However, even if you're gone for 5 weeks and you got an RFE on the very first day of your absence, you would still have enough time to respond after you're back, as they usually allow 90 days for a response. Removing Conditions on Residency General Discussion	I-751 Aug 2012 filers	We really need help now...I and wife just got request for evidence this morning.....and all we sent before was just our statement of Account since we don't have much together in our name...we change our house twice since we got married.The first two house was in my wife mom's name because credit reason.....we just got our own house this January 2013..we never file tax together because.Only what is in my brain now is our Account or my school record that show little about her....Am just confused...please guy,I really new help!   At the very least you need to send in explanation in writing of why you are lacking all the evidence you mentioned. You said you have a joint bank account: send statements covering at least every quarter of the time you have had this account together, although, to be on the safe side, I would send every month at this point, since you don't seem to have much other evidence. Have your wife's mom sign an affidavit saying that you lived in her house. We lived with my mother in law for over a year after we moved to the US, and we sent a signed and sworn affidavit from her saying we lived with her which is why we couldn't present a lease in our names for that period of time. However we had a lot of other documents showing joint address and finances even during our stay with mother-in-law, e.g. joint bank and credit card statements, joint car insurance bills, joint health insurance, joint car registration and car owned by both names etc. Since you now have your own home, send a copy of the house deed or lease showing both names. I don't know why you didn't file taxes jointly. That you should have done since it's one of the easiest things to do that can be used as evidence, plus filing jointly usually gives you higher tax credits. But anyway, you can't undo that now. Do include a written explanation of why you have not filed taxes jointly.   Other than the above: do you have a car that you own together? Do you have joint car insurance/health insurance/renter's insurance? Are you the beneficiary in any employer sponsored benefits your wife is receiving (e.g. retirement plan, life insurance, health coverage etc.) or vice versa? Is either of you the emergency contact for the other person at work/school/doctors etc? Can you send a few affidavits (I would recommend notarized) from people who know you and can attest to the bona fides of your marriage? Any proof of trips taken together?   Best of luck! Removing Conditions on Residency General Discussion	I-751 Aug 2012 filers	could be the adjudicator wants to do the easy ones first That's the assumption I've always gone by, but that's a personal theory. If a case is more complicated or has red flags it makes sense that they might be sitting on it for days/weeks/months, possibly waiting for their manager's opinion on the adjudication, maybe waiting until they can block off enough time to look at it in depth etc. Whereas a straightforward case is as easy as them ticking a few boxes, signing, putting a stamp and sending it on its way. Again, this is just my personal interpretation. Another explanation is that not all cases with the same filing date get assigned to the same worker, so whereas some Case Officer might be working on applications really fast, another one may be taking longer, or it could be as simple as one Case Officer is on vacation for a week or two, so they come back and have to catch up with a backlog, thus the delay. I doubt there is any real discrimination involved, although if the immigrant is coming from a country known for high rates of immigration fraud, I wouldn't be surprised if they wanted to look at this application a bit closer than others, causing some delay. If it was identity fraud (i.e. someone changed your address with USCIS by filing an AR-11 form pretending to be you) then it must have been someone who had access to your green card and possibly your passport, since AR-11 requires you to fill out your A-number, date of birth, country of citizenship, as well as the last time you entered the country and your port of entry. So they must have had access to all this information to fill it out accurately and submit an AR-11 which would pass for genuine. For the above reason, I'm leaning more towards the clerical error explanation - i.e. some USCIS admin person mixed your address with someone else's, or someone else submitted a change of address and mis-typed their A-number so it came to be your A-number, or something like that. Before throwing money down the drain with an immigration lawyer, I'd suggest contacting USCIS to ask what can be done to remedy the situation. Most likely they will be able to issue you a new card, possibly with a new A-number, and should be able to investigate whether immigration fraud has been committed by the occupant of the other address or whether it was a mix up. I don't see a reason why things should get ugly since they've already approved your petition, and I'd hold off hiring a lawyer for now. I'm sure it's happened to them before and they should have ways to remedy problems like that. Also, do make sure your case has indeed been approved. It is a bit strange that you didn't receive an email notification (though not everyone does), but the information on approval date etc. should definitely be online. If there is no approval date online etc., it makes me wonder if it's just a system glitch on their end and there has been no approval/card production yet. Keep us posted on what happens. Had this gut feeling from before we even put our ROC packet together, which held all the usual evidence, that we would get one. So, as I posted before, sending more evidence of our good faith marriage out in the mail tomorrow. At least I know that they are working on our petition. I honestly thing we got a RFE because of our move. We both submitted change of address forms in the manner we were supposed to, I just think it was "the flag" lol! I seriously laughed out loud when John showed it to me today. I'm not bummed one single bit because like I said, at least we know that someone is working on it! (someone update the timeline for me? my laptop doesn't format it right! thanks!) Just curious: why do you think you got an RFE because of your move? I assume you moved after you filed ROC and they did not have any documents proving that you're still living together in the new address? We're about to file ROC ourselves and we moved just over 2 months ago, so before ROC, but it never occurred to me that they would see a move as a reason to RFE if both sponsor and immigrant filed the required paperwork. We're submitting copies of the change of address forms we filed with them, as well as 2 months' worth of documents in both names coming to the new address (utility bills, joint bank statements, joint car insurance etc.) and hopefully that will be sufficient to convince them that we are still living together, just at a new address Anyway, sounds like you're confident about your evidence, and from what I've noticed, once RFEs are responded to, approvals tend to follow within 4 weeks max, sooo...you can be cautiously optimistic that your journey is soon coming to an end Edited by Christi85, 01 April 2013 - 07:28 PM. Also, you need to send a check for $590, which includes the application processing fee and the biometrics fee. As for accompanying documents, you need to send as much proof as possible that your marriage to your US citizen spouse is real and legitimate. The documentation needs to span the ENTIRE period of your marriage. Documentation to send in should include as many of the following items as possible: -Copy of lease or mortgage in both spouses' names. If no formal lease is available, or if living with relatives, a sworn affidavit from your landlord/host relative is a good idea, to explain the lack of a formal lease. -Copies of statements for joint bank accounts and/or credit cards. Make sure you send in the entire statements and not just the first page, as they like to see some activity in the accounts. One statement for each quarter for the entire period you have been married is recommended. -Copies of joint financial obligations, such as utility bills in both names, car insurance, life insurance etc. Again, one statement for each quarter of your marriage is good. -If you have a car and it is owned jointly, send a copy of your car registration and car title. Do the same with any other assets you may own jointly. -If you have kids, include a birth certificate for the kid/kids. -If one spouse is listed as a beneficiary on the other spouse's benefits (such as health insurance, 401K, life insurance etc.) send a copy of those policies as well. -Copies of joint tax returns since you became a permanent resident are a must. IRS transcripts are preferred (you can request them from the IRS for free). -Any other proof you may have showing marriage legitimacy, such as a will listing the other spouse as the beneficiary; listing the other spouse as an emergency contact/next of kin on medical or emergency situations; if you have kids, proof that both parents are listed as emergency contacts etc.   These are the main documents and you would be fine with those (or a majority of those). Some people send pictures together, letters and cards from friends and relatives addressed to both and things like that, however these are only considered secondary evidence and should only be sent to accompany the items from the list above, never alone (otherwise an RFE or even a call to an interview is a certainty).   About the affidavits: again, these are optional and only serve as secondary evidence. Just ask 2-3 friends and relatives of yours who know you as a couple to write an affidavit for you attesting to the legitimacy of your marriage. Just be sure that everyone who signs an affidavit for you is a US citizen or a US Legal Permanent Resident. Affidavits don't need to be notarized, but many people (myself included) think it is best to have them notarized anyway for extra credibility.   I hope this helps some. Best of luck! Only sudo and I have received NOA1s and bio appointment letters from CSC and we filed very early in April. It seems like there has been a pause ever since. I don't know what's up with CSC. They used to be super prompt with NOA1s and bio appointment letters. But it shouldn't be too long now. Removing Conditions on Residency General Discussion	I-751 April 2013 filers	Hi all, adding myself to the VSC list... looking at the dates on this list, I don't feel as nervous now about not having received my NOA1 yet (check hasn't cleared either).  Still a bit anxious, though, as we moved from California to New York last August and did the USCIS online change of address, but we received a letter reminding us to petition to remove conditions at our old address a couple of months ago (we still have family there).  I'm worried that our change of address didn't go through (even though I printed out a confirmation) and that we might have problems filing at VSC per our new address.  Probably just need to give it some time though!  Any thoughts/suggestions would be welcome!         The exact thing happened with us when we filed change of address back in January. They sent a reminder letter to our old address about 2-3 weeks after we filed (and printed out the confirmation). I wouldn't worry too much, I don't think it means much though it doesn't make sense why they do it like this. But then again, it was USCIS that sent me a "Welcome to the United States" package to our old address a year and a half after I first entered the country as a permanent resident Just keep proof that you filed for your change of address. We sent it and saw confirmation that it was delivered on April 19th. They have not cashed the check or sent an NOA. It has been over a week, already. Should I be worried? My current Green Card expires May 24, which is less than a month from now. Is this just a normal delay due to government cuts?   Nope, they have 30 days in which to send you the NOA1, so no need to worry yet. Removing Conditions on Residency General Discussion	I-751 April 2013 filers	Yes, now you wait for your biometrics appointment letter and yes, I believe you can start tracking your case online.   Re tracking case online: please read my response above. The case number is not on the NOA1 but rather on the bio letter. There is a receipt number on the NOA1, but it's not the one to be used on the online system. You can try it and it will give you an error message. The actual case number is on the bio appointment letter and this is the one that is used for online tracking.
