I just saw this morning that CSC cashed our check today (2 days after our application got delivered) but I haven't received the NOA letter yet. Is that normal that they cash the check first?

We mailed our I-751 application today instead of yesterday (Please update KASH2011 :-)) via USPS Priority Mail. Wish us luck (and 'grats to those who already have their biometrics appointments already).

 

Just wondering, how do you guys get updates on your applications? Do you receive text messages and emails just like the I-130 and AOS application updates?

Joining this group. We will be filing our joint i-751 application on September 29th. My husband's Conditional GC expires on October 30th.

 

Just one quick question, do the affidavits need to be notarized? We will be getting two affidavits (one from my dad and one from my husband's bestfriend/bestman) for our application.

We are getting ready to file for IR-1 this week. We live in Brazil and I (US citizen) have a bank account back in the U.S. The instructions say that those who live abroad need to contact the nearest Embassy to what payment options there are available. Given that I already have an account back home, can I still send a personal check? Thanks

 why file DCF when there is clearly a different option.. talking about complicating things.


Sweet mother of god, DCF is perhaps the LEAST complicated option here.

I have experience filing DCF. It is a good and economical option for the OP. You don't seem to have much knowledge in this area, but instead of listening to people who do, you're being rude and antagonistic.

Getting DCF in London and never visiting the US in the meantime is probably cheaper than filing ROC, getting 2 reentry permits, flying to the US for fingerprints, etc.

 

But it is OP's choice.

DCF has historically taken about 5 months from submitting the I-130 until interview. There are outliers to be sure, but you can be assured it's straightforward and pretty fast. Having lived together in the US as spouses will only count in your favour as well.

You previously said that visiting often is time and money consuming. but filing for spousal visa every few years isn't?

Now you're making stuff up. Right now, there is only one mooted move to the US, not multiple moves. Flying back and forth, maintaining multiple residences, etc. is much more money than filing for an IR1 visa. And the amount of money required for filing for multiple visas is still less than flying around and living apart.

OP is a he? did you read the first post? she said "husband got offered a job". nowhere does it say that the OP is a he.

Your reading comprehension is poor. He said he did not want to be referred to as a "she" since, well, he's a man married to another man. 


I just want to add, to help you make your decision, that you CAN file ROC from abroad.  You would be responsible for flying to the US for your fingerprints, and interview if you should have one.

 

You can get reentry permits, which allow you to be outside the US for 2 years.  The reentry permit you get now would expire when your GC does, though.  Then you would have to get another reentry permit.

 

If that seems like something you want to do, you can do that.  Good luck.

What if she goes through all that trouble, gets a 10 yr card and then they have to move again. giving it up all over again?

Big deal! Immigration should not dictate his life. (You seem to have repeatedly missed the point that the OP is a he.) He's in a position of strength -- he can obtain an IR1 visa and have an unrestricted green card upon return. If the couple move again, they do it again.

Abandon the GC, move to London, file DCF when you're ready to return. DCF in London has always been quick (2007 graduate here myself) and fairly painless. Make sure your husband maintains domicile in the US by keeping his driving license valid, maintaining bank accounts, voting from abroad, filing taxes, etc. It really isn't a big deal, and the expense of you flying back and forth and maintaining separate residences far outstrips the cost of filing for an IR-1 visa via DCF. 

 

You and your husband's happiness and togetherness are far more important than immigration issues here. When you move back, you'll have no need to remove conditions and you just wait another three years for citizenship. This is uncomplicated. Now go have a wonderful time during your time abroad. :)

I would think, if you want to change your last name, you'd have to change it with Social Security first and have a new SS card issued with the new name. Then get your driver's license updated with the new last name.

 

My wife went with making her maiden name into a middle name. It's up to you if you prefer the hyphenated last name. It might be easier to finish the I-751 first and then change your last name.

 

My wife also registered our marriage with her koseki and updated her status with the LA Japanese consulate and her new Japanese Passport has her new last name (my last name).

It was a little more than a week ago when my wife and I were looking at the list here and wondering when we would be approved. For some reason I felt inclined to reassure her that we would definitely get approved on Friday. It just felt like it would be our day.

 

On Friday we were in the Chicago museum of science and industry as part of our weekend trip to Chicago. We were sitting down and lightning and loud noise were being generated up above as part of a demonstration.

 

As the lightning struck, I got a text message. It was from the USCIS. Our petition was approved. Friday turned out to be our day after all.

 

And now we wait for the actual card to be in our possession. Then we can make our travel plans to Tokyo for the end of the year without any worry. This will be my 19th trip to Tokyo in the last decade, which is amazing to me since I never imagined I would visit Japan let alone so many times.

 

Once we get the new card it will be the end of our USCIS journey. We've decided that my wife will keep her Japanese citizenship which will allow me to get a Japan spouse visa in the future, in case we ever decide to move to Japan. 

 

Lastly, best of luck to everyone still waiting for approval. I hope everyone's petition is approved as quickly as possible.

We received an RFE letter today. I knew it!! Hahaha
It is dated February 10th. (Can somebody update the chart for us, please? smile.png )

We are going to call and ask them what we can provide, because we don't have any of the things they listed.
We don't have a joint account, we don't have any car payments, the lease and all the utility bills are on my husband, we don't have any children at this point, we don't have joint credit card.

Only thing we can think of right now is to have our neighbors to write a letter.
Or just tell them that they are always welcome to visit us, and schedule an interview with us?

Anyhow, not having the things they listed is just how we are, so we will have to see...

Did you by any chance register your marriage with the Japan consulate? I think it was called konintodoke or something similar. That's one evidence you can include if you have it.

O.M.G guys, I received a couple text messages, saying to check case status due to an update. Here is the message I saw.

On January 17, 2014, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

I knew we would soon start seeing approvals, did not think I would be among the first.

 

 

This is excellent news!! So it has begun !!!

 

When coming back from Tokyo a couple weeks ago we got a few "this card is going to expire in a few days" comments and even showed the one year extension letter to the airline staff in Narita.

 

We're REALLY looking forward to getting the 10 year card so we can avoid this.

 

Of course this was nothing compared to the nightmare of using advance parole. That time they separated us and my wife had to go through questioning in a separate area.

Also, I just wanted to say that I didn't mean to imply that I should get special treatment just for taking a few more trips. It's just that we'll be in Oklahoma for 2 more months and I really wish we can finish this process before going back to CA. I'm not looking forward to changing our address in the middle of the process and have something get delayed if we have to reschedule an interview, or worse, something gets lost or mishandled due to address change.

Still waiting for my check to be cashed... and still waiting for NOA1. Hopefully we hear something this week, because if we don't, we're going to have to make an infopass appointment or something to see about an extension as his green card expires on the 26th of this month. :|


Did you send your package with a tracking number (i.e. do you know when it was received?)
The date on my NOA1 was 4/3 (the same day when it was received, according to USPS tracking), but our check wasn't cashed until 4/8.

NOA stands for NOTICE OF ACTION. its a letter the USCIS mails to you letting you know they're processing your application. It will also extend your expired greencard for a Year. There is nothing you can do to get it faster than others. it depends on who gets their hands on your application and how quick they start working on it! its just luck!.. so good luck to you Posted Image


That is correct, however the NOA1 and the biometrics appointment letter are in most cases received within a month of filing I-751. So it's safe to assume that the vast majority of people will get their letters within a month of filing. If not, a call to USCIS or an InfoPass appointment may be in order, in case the letter has been lost in the mail etc.
It seems like California tends to be a little quicker in that department, with NOA1 and biometrics letters received within 2 weeks or so of filing, whereas Vermont tends to be on the slower end of this timeline. Yet, with both Service Centers, the vast majority of filers get their letters within the above time frame.
Then for the actual adjudication of the petition, it is indeed pure luck. Some get processed quicker, others are processed slower and there isn't much (if anything) one can do to speed it up.

I think you are a little confused. Read the instructions at the bottom of the list again and everything will be clearer.
The NOA1 is an unofficial name for the letter USCIS sends you confirming they got your petition and that your green card is extended for another year past its expiration date, work and travel authorized.
The date you see on the list is the date of receipt ON THE LETTER (so the date the application was received by USCIS), NOT the date we received the letter in the mail. I sent my package on April 2, it got there April 3 (Southern California to Southern California, s it was quick). They issued the letter apparently on the day when they received it, and I got the actual letter in the mail on APRIL 8, even though it was issued April 3.
If one lives in a state that is far away from their Service Center, then it could take a week or more for the letter to reach them. Don't worry too much. You only filed a week ago, my guess is you will be getting your letter later this week or early next week sometime.

I called it this morning! I just checked my mailbox and my biometrics appointment letter was waiting for me there :thumbs:
My appointment is on Monday 5/6 at the USCIS office closest to my address. So they've provided 3 weeks' notice.
Not sure if I should update the info on the list now or wait until after the appointment is done and over with. I intend to keep that appointment. I don't expect an early walk-in to speed things up in any way :no: so might as well go on my assigned slot and keep things as simple as possible.
I can also confirm that the application number on the letter is different to the one on the NOA1. So I assume I'll be able to use that to track progress on my application online from now on.


And yay, I was able to track my application online!! :dance:
Of course it says "Initial Review" and of course I expect it to remain like this for the next several months :hehe:
Now that we are past the quick phase, let the slow phase begin :lol:

How does the email notification thing work?

My husband and I mailed our i751 on 04/06/2013 to CSC.

I just tried tracking my package:

I don't believe I gave my email address to USCIS anywhere. So I haven't received my NOA1. I was curious if I could submit my email address somewhere on the USCIS website to get the receipt number or do I have to wait till I get the hard copy?


You need to go to USCIS website and sign up for an account online. You will need to wait until you receive your biometrics appointment letter in order to have a case number. Then the online system is supposed to send you an email notification every time there is a change in your case status, however many people have received their approvals in the mail without the online system ever getting updated. My understanding is, there is no email notification for the NOA1 (at least I didn't get one and like you, I didn't give them my email address anywhere in the petition). It is just a letter in the mail. You should be getting it some time this week or next week.

Does anyone know how long it takes for the biometrics appointment letter to show up after filing the petition? And how much advance notice it gives? I've noticed that most people have their biometrics within 4-5 weeks of filing I-751, and since it's already 2 weeks of our petition tomorrow, I'm wondering if I should be expecting to get the letter this week.

Thank you Christi, my current bundle has Post-it on every section of doc/evidence and also a paper clip holding them together except for our tax papers which is like over 185 pages it too big for a paperclip and hence I was curious. I sure ill take your advise "NO STAPLE" checked that! ;-)

Quick question - as far as sending the paper do I need to use paper clips for bigger bulk of papers or just put them all in order(Which they are)and send them?

I've heard people do either. Personally what we did, we included a checklist listing everything included in the envelope in the exact same order it was put together, and we also marked each set of documents (e.g. lease documents, bank statements, insurance statements etc.) individually with post-its, so that the Case Officers can hopefully tell where a set of documents finishes and where the next one starts. I know other people have used paper clips, and nobody has said they had any problems by doing that. So it's entirely up to you how you want to organize your material to make it easier for them. Just don't staple anything.
