OP, they do state that they don't want you in a jacket. Also, remember that the background has to be white - I've personally known people who've had to get their redone because of background issue.

I even got mine redone before sending in my I-129F because the color was off slightly, making me appear slightly green. Better safe than sorry!

I would get an interview as soon as possible, but let the Embassy know when your baby is due. Unfortunately, she won't be able to travel until after she has the baby because she won't be allowed on the airplane (even if she were leaving now). Once she has her K-1 visa, she will have 6 months, but the embassy can always extend it given the circumstances.

Also, she shouldn't be traveling for at least 2-3 months after the baby is born (until the baby's immune system is strong). So many sick people are on planes.. So the earliest she could travel would be about July 2011.

I just heard the same story from my Cambodian friend. His cousin's fiance failed twice at the interview. The first time they tried doing it all by themselves.. The second time, they hired a lawyer. But even he couldn't help. The guy at the embassy just didn't believe - period. I wonder what's up with the Cambodian embassy? Why is there such a high rate of denials?

I suggested they get married and try filing for the spousal visa..

Greetings everyone! I am back to find answers after petitioning for my ex-husband some years ago. If a fiancé is currently in a country, perhaps overstaying a visitor's visa/trying to gain residency documents, other than the country of citizenship, would he have to return to his country of citizenship/origin during the K-1 process? I guess I know the answer, but I was hoping to get some confirmation.

Yup, I know how u feel. We did the samething because we wanted our families & close friends to be there on our special day of marriage, plus it was waay cheat for the kind of wedding we wanted. To be safe & honest just do the CR-1, but for sure it's gonna be a challenge because you will have to make that sacrifice due to the longer time apart as a married couple. There will be some proceedures you will have to do regarding doing the offical wedding over there, not sure how it goes in India but in Philippines there's a process starting with going to the US embassy, then down to the city hall which we were getting married in, etc. Of course fees & time applied. So it's better you have your fiance getting going on it before you arrive but you will have to appear in person for the US embassy swearing & signing of paperwork which is the first thing you gotta do when you arrive in India. I only stayed 2 weeks & everything(paperworks & wedding stuff) was really tight & nerve racking, 1 week is gonna be tough to do it all.

I've been separated from my soon to be ex (roll on Jan 28th!) for nearly 8 years. We are filing our K1 the day after my decree absolute becomes available, because I am confident that the London embassy doesn't give a hoot about it. It's simply not a high risk embassy for visa fraud and they focus their energy on making sure you are not going to become a burden to the state.

I want to be able to date my letter of intent the day after, so there is no question of when precisely my decree absolute came into force. For example, if I signed the letter at 9am and was granted the decree absolute at 10am, I was not free to marry at the time of signing. Just not worth them being able to question it at all.

Only people with specific experience of the issuing embassy can reliably comment on whether a waiting period between finalising the divorce and petitioning is advisable.

Don't assume that just because it is not a high fraud country that a question may not still be asked, either in the form of an RFE or at the interview. I married my husband 12 days after I got my decree absolute because my divorce proceedings suffered from serious delay and we had had to postpone the ceremony twice. I had been separated from my ex for a long time at that point and had been living with my husband for a while when we got married. I was still asked in the form of an RFE to explain the timeline of when my former marriage began to break down, when I met my current husband, when I filed for divorce, who initiated the divorce and why there was such a short time in between the absolute and the wedding. Yes, there is a difference between filing for a CR1 via DCF like we did and filing for a K1, but be mindful that this is not necessarily a cakewalk. It won't be an impediment, but be aware there might still be a question asked! :star:

Missy -- my husband and I got married on holiday in the US (I'm the US citizen). We were living together in London and decided to get married in the US so my family could be there. When he went through immigration, he was asked the purpose of his trip. He said he was on holiday with his American girlfriend, and that we were getting married and then returning to London together 3 weeks later. He showed them his return ticket and they were satisfied. He was clear and truthful about the purpose of his visit and had no problems.

It's not a biggie. The idiots at the POE stamped my husband's CR1 with an I-551 stamp saying we entered the US a day before we actually did. We didn't discover this discrepancy until we filed for lifting conditions, and we decided to go with the date on his green card over the actual day we know we entered because it was just too much hassle to argue with USCIS over this point. Since it took under two months to lift conditions, we figure it was a non-issue.

Just highlight the discrepancy. Include the NH stuff if you feel it helps.

I assume that the friend was referring to his partner as his wife because he had married her after arrival on a K1 visa, at which time of course her status would have been that of fiancee. At the time of the conversation, she would of course been his wife, although he could have referred to her as his "then-fiancee", but surely this is overkill.

Marie, if your heart is truly set on this job and you and your fiance intend to settle for a few years in Brussels, do not waste your time and money on a K1. I know he's already filed the I-129F, but if you wish to have your wedding in the US, you may do so on the VWP so long as you return to your home country before your I-94W (the green form you fill out to use the VWP) expires. This is usually 90 days. As others above have said, bring plenty of proof you intend to return. My husband and I were living together in the UK before we were married but came to the US for our wedding -- no problem with this as we made it clear we were returning to London.

If you two want to move to the US when your contract is up (or sooner), as long as your husband has been a legal resident of Belgium for six months, you will be able to file for a CR1 visa via Direct Consular Filing (known on here as DCF). This is usually a very quick process -- not sure how long it takes for Belgium, but it can be significantly faster than if you filed it via the US. Filing for a CR1 would also make you work-authorised upon entry to the US, and you would be a permanent resident. And you and Joel can stay together through the process.

If you filed for the K1 and then moved back to Belgium, you would essentially be flushing all the fees you just paid down the drain. You would not be eligible to apply for Adjustment of Status, so you would not get a green card. When you two moved back, you would have to start all over again with a new visa (the CR1 -- forget the K3, they're practically obsolete and have pretty much NO advantages).


My advice would be, if you take the job, to write off the expense of the I-129F. :)

The only thing I would warn you about is the US has a thing about people who are married to USCs but aren't immigrants or in relationships with USCs and they tend to make it very hard for you to spend time with your SOs family because they cannot believe that anyone would not want to live in the US.


What do you mean by this? I was married for 10 years to a non-USC, and we lived abroad that whole time. We never had any problem with him coming with me to visit my family for holidays. Nor was he ever asked to show any proof that he was returning to the UK with me. They asked him the purpose of his visit, and he'd say "To visit my in-laws with my wife."

It's not that uncommon. Quite a few people have done just this via the London consulate -- they were in the UK on student, work or other visas, and were not required to return to their home country for the interview. London is just an example -- I've seen it done at many other consulates as well.

If in any doubt, contact the consulate for verification, but in general yes, it is possible.

It is more than possible to enter on the VWP, get married and return to the UK. It is exactly what my husband did (although I was returning with him). He was asked on entry what the purpose of his visit was, and he said "to get married to my American girlfriend who lives with me in London, celebrate Christmas, visit with friends and family, and then return to London with my American wife." They asked for his return ticket, he showed it, and was let in. It's good to be prepared with evidence that he intends to return to the UK. I know more than a few people who have done just this with NO hitches. Good luck and congrats on your upcoming wedding!
