I know not everyone who applied for a K1-K3 Visa arent all members of VJ and have timelines,

But, looking at those statistics... there is 75% less applicants for AUG, SEPT, OCT, NOV per month than April, May, June, July months to both CSC and VSC.

I wonder if the petition starting Aug will go more quickly? I guess we'll just wait and see.

We will soon get our NOA2's... I'm hoping before the end of January, thats is whats scheduled (estimated)

I read this whole thread again today. I just quickly browsed through and I'm glad that there is an AUGUST Filer UNDER CSC.

This thread is actually quite specific and special because almost all of us waited 6-7 weeks until receiving the NOA1 and getting our checks cashed.

There is only about a handful of us who have posted replies.

I wonder where all the AUGUST FILERS ARE UNDER CSC.

There has to be more than just a handful of us.

My I-129F packet was received by CSC in Laguna Niguel, CA on August 22nd 2007.

It has been nearly a month and I have not yet received the NOA1.

Also, the check I used for payment has not even been deposited by USCIS.

I called the 800 number and asked if there was a delay on the NOA.

I was told that there has been delays and I cannot inquire about a specific petition not unless I have not received a notice after 90 days.

I am surprised to see that others are in the same situation here.

I thought that the NOA1 usually is received in 2-3 weeks.

I keep checking the mail and my online banking to see if there's anything. but nada.

Yes, waiting is hard, but it is also a time of excitement and anticipation. I love texting and our nightly phone calls. There are classes I'm cramming at night now so I'll be at the top of my pay scale before she arrives, it's all working out really well. I love her and I believe there is a purpose to our waiting, so I am trying to make the most of it. It's been amazing to me how much our relationship has deepened and strengthened during the months we have been separated and I'm certain it will strengthen our relationship when we are married.

I wonder if I will get an NOA1. They received out petition on June 19th and cashed the check on the 22nd. I was able to get the case number off the back of the check. Luckily all the numbers were "mostly" readable. After setting up my account with USCIS, I got their notice that they sent me something in the mail (NOA1). Whether that is true or not, I won't know until next week.


Don't hold your breath, I have been waiting for 3 weeks for the NOA1 they supposedly sent (May 29th)... it may never come, but as past posters said, it is not needed for the rest of the process.

Based on your timeline, you probably wont see anymore touches for another 2 months. It sits on a shelf until the backlog ahead of your case gets processed. If you can track your case online and know your case number, you really dont need your NOA1.

I guess, just that I am a bit afraid that the NOA1 would come with a RFE that I'd miss and that'd delay our case, unless the page online tells that a RFE has been sent as well?
For info, I was told by the first agent on the phone that I could find my case # on the back of the check but none of the numbers I could see online (thanks BofA) would make sense, so my second call to the USCIS was escalated and after few verification questions (name, address, name of the fiancee...) I was given my case#.

Since I sent in my I-129F almost two months ago and have not heard anything and because it had been over 30 days since CSC cashed my check - I decided to call the 800 number.

I was told that because of a computer glitch and backlog, almost no NOA1s were mailed out for applications received over the past 2 months. Can you believe this BS?!

They told me to wait another 30 days for the NOA1 to arrive.

So...3 months to (hopefully!) get an NOA1 in the mail. This is crazy!

PS: At least I get to go visit my Sweetie for a couple weeks in July =)

OK, that can then explain why I have not received my NOA1 in the mail when our case was received on May 29th (going on a month of swearing at the postman not delivering the UCSIS envelop...). I have not been touched by CSC since June 1st, just getting nervous and frustrated...

Any other late May (it took them 3 weeks to open my mail and cash the check) with more progress??

we sent in May 14...never received NOA1 either...called and they said they never received I-129f...we found out later they had...called last week and customer service basically said not to worry about it since we had receipt number now that we can track by...we are waiting on the NOA2.

I sent in my initial package and they received it (check cashed) may 18, I finally got a noa1 just a few weeks ago but I gather they are sometimes behind sending the actual letter out.

I had expected to get my noa 2 by now.


When I log-on to my case at the website it shows only that it was initially received while many people report here all these "touches", mine has nothing.


Not being a smartass (just realized the 7word rule is automatically enforced) this time, but our timelines are very similar (my NOA1 date is May 29) and I have not had any touches since June 1st. We are indeed in the same boat like many others. Hopefully not for long... Our turn is basically coming, since they are not processing the files in the order received but rather by "batches of similar receipt periods". Looking at the latest approvals, their NOA1 dates were within 20 days in May, some early some late. So our turn is coming...

It means that the guy really did look at your case. Everytime your case is accessed at USCIS, the website update shows when it was accessed. From experience (my case was touched the day I called and yesterday, just due to that call), it does not mean anything except that someone looked at your case. This time, you asked to have someone look at it, so it is just a "false positive". Do NOT get over exited about it... welcome to the club...

So like I hinted at above, this means there are several people, inc. Buck and Natalia, who have been approved and this is neither reflected by touches or by updates on the USCIS case status website.

So either you get a hard copy in the mail - and those of us who have waited for NOA1s once or thrice know what a pain this can be - or you randomly call one day and you are told that you just got approved. It is strange how many people have been approved within a day or two of using the RFE trick, no? Some approved just before the call, some just after.

Conclusion? those of us who filed in May or early June could be approved any day now, or we may well have been already.

Ok I couldn't hold it anymore and I called the CSC for the RFE trick. Piece of advice: don't say "my lawyer said that I got a RFE" if you DON'T have a lawyer no0pb.gif the lady on the phone called my bluff, cut me off and told straight out "you don't have a lawyer on that case, sir"... mmm well mmm so basically I took a begging tone and asked if I could get some info since I never received a NOA1 and all of that, it's been more than 4 months. So she checked and it appears that I have been adjudicated to an officer on Sept 23rd!!! So I guess I could receive some news, hopefully positive SOON... All hope is not lost. Some news is still news...
Just felt like sharing the experience.

Here are some observations based on comparing NOA2 approval times on the VisaJourney website and our own personal experience:

I am in the same boat, application filed on May 8th (140 days ago) it was received on May 29th (119 days ago, 3 weeks to open a fre@king envelope...) and my last and only touch was on June 1st. Even after 3 phone calls, nothing was touched (I now doubt they even looked at my case when I was on the phone with them...)... I do hope, especially with the last progresses, to have my approval by the end of this week (as my ever moving VJ Timeline is telling me) and if everything goes according to plan, the love of my life with leave the US embassy in Bern to jump into the plane on October 20th and the wedding ceremony (administrative, casual) is scheduled on October 27th. Pretty ambitious I know... That's why I am a bit anxious...

Therefore the tax returns quoted by a lot of people throughout various thread are not needed, are they???? The I-134 only states 2 out of 4 of the following are necessary to prove the 125% of poverty minima: bank statements, letter from employer listing salary, assets or tax returns for self-employed people.
I am (not completely, but I'd rather be sure than sorry --and not late) a bit confused by the ones mentioning the 3 years of 1040's, W-2's and the like, likely referring to the I-864...

Could someone confirm?

wait... sadely they've given you the classic run-around. It took NVC 30 some days (check my timeline) to receive our file but then just a couple to process it. It may be sitting in the mail room at Laguna Nigel or in the one in NH, or even be in transit in between, but long waiting periods between NOA2 and NVC are not uncommon...

It will come soon, and then it can work very fast.

Yoohoo,

here is the end of the tunnel for us. We let the Bern, Switzerland, consulate honor the veterans and we called them this morning. Nice people, they received our file and our interview is scheduled for November 26th, at 11am!
Since we have everything (medical..), we just need to fill out couple more papers, bring everything and that should go fine.

Sibylle found a round trip from LA, since we have been together for 3 weeks already, to Zurich for $670, will stay 10 days to finalize the last things and we can get married before Christmas!!!

Our case was sent by NVC to Bern, Switzerland yesterday (11/5)!

For kicks, I checked the USCIS page (which is not my homepage anymore) and our case is still pending and hasn't been touched since 10/09, date they sent the hardcopy of my NOA2... go figure.

The US has an "economic interest section" in Cuba and not an embassy (communist regime, embargo, Bay of Pigs...) and it is hosted by the Switzerland embassy in Havana. That's as far as my reliable info, the rest is just interpretation of the tense diplomatic situation. It could be that Cuban fiancé(e)s are treat differently as a political gesture against the communist regime there. Someone had mentioned before that it was similar to a sort of asylum treatment, even if it remains a I-129F procedure...

You Are right! Cubans are getting approved very quickly, some in just days. I have posted a thread explaining my understandings as to why the quick approval. Cuban Fiance(e)s are not treated as political gesture....Your analogy of "sort of asylum" is not true...K-1 applicants are treated the same as any other applicant from any other country. The processes are just the same, if not a bit more problematic as the Cuban government tries to make it more costly and difficult for any cuban to leave.



Well, I agree that Cuban K-1 applicants follow the same type of procedure than the applicants from the rest of the world, BUT they get approved in days when the rest of the world takes months. It therefore shows that Cuban applicants are treated differently and I only inferred that it *could* whistling.gif have to do with the nature of the political regime in Cuba and the historical tensions between the US and the Cuban regime, possibly to avoid retaliation against applicants trying to leave. Hence my suggestion of a political gesture to speed up the process for them. Even if the hurdles remain the same (standard I-129F), Cubans jump them faster...
Until we get an official explanation, we're just going in circles with a debate over semantics...

Interview cleared this morning!!!

She called me right when I woke up. Smooth interview in Bern, Switzerland, the officer just checked the paperworks and the new documents needed after the NOA2. He asked her to redo the passport pictures (wrong size) so she came back 1/2h later with the correct format and voilà!! the visa is in the mail!

We will get married on 12/10, the day after she flies back!!!
Now let gather everything for the AOS and reentry permit applications. When you think you're done with USCIS, you go right back at it!!!

Our interview is scheduled for Nov 26th. My fiancee just need to bring everything and fill out couple more papers and we should be one step closer from being finally married!

For info, I learned yesterday that our file was sent to Bern, Switzerland the day before. 31 days after NOA2

Since we have done all (police, medical) things required (low volume of emigrants from Switzerland, we got the package 3 before by just asking before the NOA2). We just need to negotiate an interview date, since my fiancée is in Los Angeles with me...

I also am glad to hear that I don't see any consequences to my actions; I'm off to drink a fifth of gin and eat a whole Sara Lee cake then.
