Hello everyone,

My fiancee owes 200k on her Credit Card and hasn't paid in 6 months. Will this affect our fiance visa?


A little thing like whether it's USD or other currency really can change a sentence. Not that it has any impact on this thread, but a couple more keystrokes to give relevant information really goes a long way.

I just bought airfare for my New Year trip to Tokyo so I got over the equivalent of 200K pesos on my card just this month alone. :whistle: I wouldn't sweat it at all.

TX lockbox received application Monday morning....And I just received the NOA1 e-mail this morning!! I guess this means my fiancee should start collecting evidence etc for the interview, correct? Is there a check list that I can send to her so she can start collecting all the documents for the interview? Is interview the packet 3 thing everyone talks about? Any help would be appreciated. Hi! Sorry to disappoint you, but the NOA1 is just a confirmation that they've received your petition and nothing else. It means they have it in their files and when its turn comes they'll process it. I believe they first have to forward it to the relevant Service Center too.
This takes 3-6 months by current timsecales and the approval letter is the NOA2.
I suggest you take a good look at the Wiki on the top of this page to familiarise yourself with the whole process.

Like others have said, it won't expedite the process or anything and you could be heavily pregnant before you could travel to the US (if the airlines allow it). BUT (and I'm surprised nobody else mentioned it) I think it is very positive with regards to proving that you have a genuine relationship going on with your fiance. What's more compelling evidence than having a baby with your fiance to show that the relationship is real??

I don't have an answer to your question I'm afraid, but it sounds extremely harsh to me to deny someone on the grounds of trying marijuana once at the age of 12, especially as 15 years have passed since and the person has not done it again. It would be a different story if you were a regular drug user or had done it e.g. last year as an adult.
I honestly don't know and I hope that someone who knows better can advise, but a waiver on this occasion sounds much more reasonable to me.

Do you have a lawyer to consult? It could help.

How about if it's just a wedding/ religious ceremony only--without a civil wedding & no papers signed?


In the UK a religious ceremony is still a legally valid wedding. A civil ceremony is not required for the marriage to be recognized legally. Couples in the UK who wish to get married can either have a civil or a religious wedding and they'll be considered legally married either way. Papers are signed in either case. This applies to most church weddings and to weddings performed under other religions as long as the premises where the wedding takes place (e.g. mosque, synagogue etc.) holds a license to legally solemnize weddings.

To the OP - you could get married before being granted the K1, but then the procedure would have to be cancelled (as you wouldn't be a fiance anymore) and you'd have to start afresh by filing for a CR1 (spouse) visa. If you already have a K1 pending, I strongly suggest sticking with it, as doing the above will definitely add considerable delay to the process, which translates to an additional 8-9 months apart from your loved one. Like others have said, if at the time of the K1 interview you are married, your K1 visa will be denied and you'll be instructed to apply for a CR1 spousal visa instead. Which means, 6-8 months for the K1 (plus all the money you've paid to get it) will have gone down the drain.
Just to stress: don't even consider lying about being married (if you do get married in the meantime), as they'll eventually want to see your marriage certificate when you file for adjustment of status in the US, and then the discrepancy in dates will be obvious and guess what - you'll be accused of material misrepresentation and will be denied adjustment of status in the US!!!
I know it may be a major hassle, but better change wedding plans if necessary rather than putting the visa process at risk, because this may put your future life together at risk. I suggest sticking with the K1 since you've started the process, waiting until you get it, then having a simple civil ceremony in the US within 90 days of entering on the K1, which will allow you to file for AOS, and if you want something more elaborate you can plan a big social event-type wedding for later on.

No, they don't deliver on weekends, only Monday through Friday.
Also, I never got a text message. I only found out that my visa was due to be delivered on the next working day through the online tracking system (it is only updated after the visa has been processed and handed to the courier company).
It usually takes 3-5 working days between a successful interview and visa delivery, however occasionally there are cases where it takes 7-10 working days for processing and delivery, especially at periods with bank holidays etc.
So my advice would be not to book flights until he has the actual passport with the visa IN HAND.

P.S. As you can see in my timeline, it took 4 working days for my visa to arrive.

Ok, I thought you'd already had your medical for the K-1. Apparently not.
You will have blood tests as part of the medical, so no need for another one now.

If asked on the questionnaire, I suggest you tell them the truth about the condition and that it's now inactive etc. It's also a good idea to bring with you your past medical report in case they ask to see it.

I would think that since it's inactive, it shouldn't be a problem. So I wouldn't worry too much.

When you went for your medical, did you declare your condition to the physicians and explained that it's inactive etc?
Because it's inactive, and especially if this can be medically proven from your tests, I would think that there's a good chance they might let it go and approve you anyway. Besides HIV/AIDS is not on the list of "public hazard" conditions anymore, so Hepatitis B may be treated more leniently too nowadays.
That said, I hope that you have already told the physicians at the medical about your condition. If you didn't and in case they ask for previous health records etc. when they find the infection in your tests, you could be blamed for misrepresentation, which is actually quite serious for COs and could get you in trouble.

My Fiance failed her interview May 18, 2010 in Phnom Penh Cambodia. The interviewing officer found evidence to lead him to believe the relationship is a sham etc.etc.etc. So after futal attempts I gave up trying to find the real reason of the failed interview. I forwarded a mountian of evidence showing proof of our relationship to the USCIS to be approved. But it appears it just a cursor of events to the Embassy in Phnom Penh. I've been told to try the Fiance Petetion again, this time be available at the interview date over there.
So any experience with 2nd, 3rd attempts?
Success rates with refilings?

My last visit was January 2010 to Cambodia, so I know I have until Januray 2012 to file. Just dont want to raise any red flags or shoot myself in the foot by refiling.

Your suggestions are appreciated.

I did all the filing myself and found it very easy and simple, here in the states. The problem is over there at the Embassy.

It looks like K3 and IR-1/CR-1 are the options if you are already married.

Your I-129F sounds like it has more than enough to go. You probably did this also, but I imagine putting the date on the back of each photo along with the location may be a good idea.

OP, it looks like you did a great job with your packet! I don't know if they will stay on there but just for my OCD and wanting to be organized, I placed little sticky tabs that were labeled at the bottom of the petition for quick reference to my cover letter. Like I said, I don't know if they will STAY on there but it was worth the shot!

First of all I think you did an excellent job with your packet! You should also include your boarding passes as primary proof of meeting. The airline tickets are nice, but it doesn't prove you actually were on the plane, just that you bought the tickets. A boarding pass proves you were on that plane and that you actually went. Your relationship proof (from item 6 to 11) really isn't needed, although it won't hurt. Keep in mind you don't want your packet to be too large. I don't know if it would really make that big a difference, but for me I'd be scared if I made mine too large and they skipped over mine to do a smaller packet.

I had about 10 photos with my packet as well, and I put them all in a ziplock bag, and I stapled the bag to a sheet of paper. I actually used 2 bags to document pictures from 2 different visits, and I labeled each bag as such.

To keep my papers organized, I just used paper clips. I didn't fasten anything. I just put all my papers in a priority mail envelope at the post office and mailed it.

My packet was around 40 pages. The only proof I included in my packet was: boarding passes, itineraries, hotel receipts, passport stamps, cell phone bills indicating calls made, money transfer receipts.

I am currently searching for boarding passes (and he is too), but we both tend to chuck these. Luckily, I have baggage receipts from luggage on my last flight and we both have passport stamps from our visits.

I'm trying to keep mine to about 40 pages, as well! Most of our email convos are only 1 page since we primarily use FaceTime and iMessage to communicate :P I think that page amount is a good number to aim for :)

Hi Everyone! I've been combing through VJ for the last month as my boyfriend (from the UK) and I decided to get married on his November visit to me and we now have the pleasure of going through the K-1 visa process. Extremely glad to have found this site as I was originally planning on blowing my savings on a lawyer...but no longer!

Anyway, I'm assembling the I-129F packet and here is what I am including (in the order I currently have it):

- G-1145
- Cover Letter
- Personal check (think it's $340)
- I-129F form
- I-129F question 18 supplement (there just wasn't enough space!)
- G-325A and passport photo in plastic bag (Petitioner/Me)
- G-325A and passport photo in plastic bag (Beneficiary)
- My US birth certificate copied front and back
- Letters certifying intent to marry (Both of ours)
- Proof of having met/ongoing relationship in the following forms
1. Airline tickets for my trips to UK (and one set of baggage tags)
2. Copies of passport stamps and UK student visa (mine)
3. Airline tickets for fiance's trips to US
4. Copies of his passport stamps
5. Photos (12 in total) from first trip together in 2010 through recent visit in Nov 2012
6. Affidavits (two) notarized by myself and my fiance detailing our relationship
7. Affidavits (two) notarized by each of our mother's as witnesses to relationship
8. Emails back an forth (approx. 1 conversation for each month for the last two years)
9. Text history excerpts from 2010 until now
10. FaceTime screenshots of video chatting
11. Facebook screenshots of relationship status/interactions


Now for my questions!

1. Do you think, from your experience, this is enough/an accurate packet?

2. How should I include the photos? I couldn't find any photo pages (tried a Staples, Rite Aid and CVS) so right now each "visit" is in its own plastic baggie and labeled.

3. Can I double hole punch at the top and put the fastener in? Or do I just fasten it with a clip?


Sorry for the length - I just tend to get extremely detail-oriented with these sorts of things and this time it's extremely important to me!

1. The form expiry date at the top right says "August 2012" but I pulled it off the official website. Is this a problem?

2. If my employer addresses won't fit, I wrote them on a separate piece of paper and labeled it with the question. Is this correct?

Do not trim. A4 is okay. (it's not one inch longer than US legal... A4 is a bit longer and thinner than US 8.5" x 11)

My I-129F is basically ready to be sent off, but after getting the packet of my fiance's stuff, I realized that all of his paperwork was on a different sized paper (A4 from the UK). It's approximately one inch longer than US legal and I was wondering if I should submit it as is, or "trim" the ends off of the A4 pages (there's no content on the excess space).

Suggestions?

I really didn't know if it was too much, but the lawyer said he thought it was ok. If they were pissed that I sent too many pages, wouldn't they send that back instead of the photos? Could that really be the problem?


I don't think it'll be a real problem, but it might have just made you stick out a bit. And since Facebook and Skype aren't primary types of evidence (they are secondary at best and often used as proof of "ongoing" relationship rather than having met in the last two years), that might help explain why they looked into your photos and everything so much. Again, I am not saying this is fact but judging by previous threads and stories, this is a potential reason for your delay.

yes, I did label everything as you mentioned above. I was pretty thorough. I did notice that my fiancees passport photo was one of her looking at an angle rather than head on..that could be the passport photo problem, but once again, why return them without explanation? Shouldn't they just ask for the correct one. Secondly, this does not explain why they returned my photos. Some were date stamped on the front, and all had names dates and places hand-written on the back. The way the letter is worded, they make it sound like the format is't correct to be placed in their file folder. All in all I sent 400 some pages, including all the required form, affidavits, and FB and Skype records as well as hotel and bus trip receipts. I just don't know what to do. I feel like i got singled out in some fluke because i did everything right except for that one passport photo is at an angle. I wish I could know whther I should expect a I-797 notice of action with receipt number or if I should be sending things in more blindly without a number. Is there anyway I can contact them at the local dallas or lewisville , T office and speak to some people actually working on it? Is this 800 number really my only course of action? I just get lost in an endless trail of phone transfers and have to repeat my story to each new clueless person who answers. Should I just start the whole process over? This is really ruining my holidays.


As much as it sucks, it does seem like dealing with the 800 number is the way you have to go unless you were given another number. You can't really "start over" without withdrawing your current petition, which would require the receipt number so you're going to have to endure the headache of the 800 number. Naturally, the holiday timing is super unfortunate as well.

400 pages? Four hundred? That sounds like an excessive amount. Most people here seem to be between 40 and 70 pages on average.

It sounds to me that you did "too" much. I don't believe I129F instructions say to put photos in little bags. I would wait to see if you get NOA1 and number. Remember, don't send too little stuff and don't send too much stuff. These folks are looking at reams and reams of stuff all day long. You can't "flood" them with things and photos and stuff. Stay calm, Get it done,, You will be fine... Relax and get ready to wait and wait and wait. Mike


In the I-129F instructions and the guides here on VJ is advised that you put the passport photo in a Baggie and attach it to the G-325a for each person.

Photos are also suggested to be in labeled baggies or photo sheets.

I disagree about "too much". Unless you're submitting 100 pages of emails or something excessive, the more primary evidence supplied at first limits the chances of an RFE or denial.

My lawyer insisted they only needed one passport photo of us each, but as I tied to tell him we need two identical of each of us. So I understand why they would have a problem with that. But the letter only said that the "items were not in the right format" ...no real explanation of what to do. I figured that out after a while. I have no clue why they sent back my evidence photos (This was about 20 date stamped photos of me and my fiancee together in India last summer. They were in a sealed ziplock bag that was 2-hole punched and inserted into my packet. They didn't tell me why they returned it. Most importantly. I don't have a receipt or case number...no I797. If they rejected the whole thing, wouldn't they have informed me? I don't know if I should mail the photos back (passport photos corrected) with my name and a letter and hope they put it together...or if I should hope and wait that they will send me a receipt number so I can send these materials back with a number. I am so at a loss and the people on the toll-free number had no clue. I even wrote to the Dallas Lockbox support, but got no reply yet.


You only do need 1 passport photo each at this stage (according to the G-325a instructions on the USCIS website), so it's weird that they would say you need two.

I wish I could give you advice, but it sounds like you did everything as you should have so I have no idea why they were returned. Maybe try calling the toll free again tomorrow and just asking if you should send them with a letter and your name or if they can give you a receipt number? It sounds very strange that this is happening to you and I'm very sorry for it.

I spent months putting my packet together to the exact instructions for my I-129F packet. Today, received a package from USCIS. It contained the ziplock bag I had placed my passport photos of myself and my fiancee as well as the ziplock bag of photos containing my photos of evidence that she and I were together. The package was accompanied by a letter that said "Dear Sir, we are returning those atiems because they are not in a format that can be put in your file folder for an agent to look at during this stage of the process". The letter gave no receipt or case number and only told me to call the USCIS toll free number if I had questions. A got the run-around all day. I am miserable and terrified that the government has lost my packet with all of my affidavits and original material. FED EX confirmed delivery of my packet to the Texas office on the 12 of December. I have not yet received a I797 notice of action, so I have no ID number or case number. I figured out why they returned the assort photos, but still have no idea why they returned my evidence photos.

So, the question is what do I do next. Someone suggested that I wait until I receive a I797 then resend the photos with my receipt number. Yet, I am afraid they will not send me a I797 because of the missing or inadequate materials. If I just send the photos in with my name and without a receipt number, then they are sure to be lost. I am very seriously troubled about this. Can someone please give me some advice or let me know how I can remedy this? If they did not return my entire application packet, but only a few items, does that mean they will still send me a i797 and just request those missing materials...or is my application lost altogether. Please help. I'm missing my fiancee so much, and this is making my holidays miserable not knowing if all our hard work has been lost in the bureaucracy. Anything??

Then when I realized it didn't have enough time and I had to send away for my birth certificate, I didn't think to look back. That makes me feel much better! :) I'm just triple checking everything to make sure that I don't do anything wrong. I appreciate your reply!


No worries! I was freaking out about that too, at first. I realized the night before I was going to send off my packet that my original birth certificate is MIA. Thankfully, I had multiple copies stored from playing sports and such and apparently have an official transcript of birth, which I sent off with my copies :P

Hello all,

I'm filling out the I-129f form and I'm almost finished. I had to send away for a copy of my birth certificate because I couldn't find my original and my passport had less than 5 years left on it. This may be a stupid question, but please indulge me if you would: Under birth certificate it asks for the Birth Certificate #, Date issued and State. On my birth certificate, it has Date registered (which is shortly after my birth) and Date issued (which was last week.) The literal part of me says to put last week's date, but I didn't know if anyone else had sent away for a copy and come across this and how they had handled it. I could put R:__/__/__, I:__/__/__ but I don't know if they would know what that meant and I don't want to mess anything up. I also don't want it to throw up a flag that I'm 40ish years old with a birth certificate issued last week either.

Has anyone dealt with this before?

The London embassy is an exception. You CAN self-sponsor in London. Almost all other embassies don't allow it.

Hi Everyone,
I have a question regarding the Proof of Financial Support for K-1 visa. I have been reading website after website trying to learn as much as I possibly can. I have read the instructions that go along with the Support Affidavit I-134. On one immigration attorney's website, he had something listed that I had not seen before. He says that I need to show 3 years tax filings as well as current pay stubs. The instructions for I-134 says if self employed, show last years tax filing. My challenge is that for the past few years I have been non-employed working as a volunteer teacher and doing missionary work. I returned to full employment for 2012. Will my inability to show stable employment for the years through 2011 hurt my chances of being approved? How many years did each of you have to show for the K1 visa?

You won't have to file the I-134 when you file the 1-129F (judging by your last thread, I assume you haven't done that yet). You file the I-134 later typically at or right before the interview. You should submit your last three tax years regardless of employment during that time. Additionally, since you're newly employed submit some recent pay stubs and a letter from your employer (if possible). If you haven't filed your I-129F you will almost definitely have this year's tax forms by the time you need them - so that's good!

Check with the embassy you're applying through to see if they accept co-sponsors, if that is something you want to look into!

This info is all pretty general, as I'm not at this stage myself yet, but have been fervently studying the entire process for a couple of months now and consulting with various lawyers.

I recommend calling the airline and checking with them to be sure and avoid any problems. I know when I fly domestically in the US, I can't use my license because it only lists my first name as "S" (New York State is weird sometimes) and they always require me to use my passport.

On the fees website its listing the K1 as $240 but I recently remember seeing it listed at like $390 or something along those lines.
I know fees change but does anyone know what I need to make it out for?

This is my checklist.

Contents include:
- Payment in the amount of $
- I-129F
- I-129F Supplement: Part B, Question 18, explanation of meeting in person
- G-325A and passport style photo (Petitioner)
- G-325A and passport style photo (Beneficiary)
- Birth certificate & US Passport (Petitioner)
- NBI Clearance & PH Birth certificate (Beneficiary)
- Letter certifying intent to marry (Petitioner and Beneficiary)
- Proof of having met in person in the past two years
- Proof of ongoing relationship


sub question ~ my proof of Having met and proof of ongoing relationship are really the same thing, pictures, and copies of my passport showing my stay.
She has lived with me for the last 6 months in the serviced apartment the company rents for me.

I don't really have copies of receipts from hotels or trips because the one we took was before I knew I should keep them.

You're not paying the K-1 fee yet - you have to pay the I-129F fee. The fee for the I-129F filing is $340 (I just filed it and got my NOA1 this past week and my check has been cashed for that amount).

Proof of ongoing is more like texts, emails, phone records, etc. If you've been living together, and you have proof like joint name on a lease, that is good to show ongoing relationship too.

That's what we're working on now, printing out all her bank statements and highlighting the direct deposits for both the retirement and the substitute pay and she's also getting a letter from the school district where she's working. I'm beginning to feel a little better about it now. I was concerned they wouldn't allow her to combined both incomes. We also have her tax returns from 2010 and 2011. We won't have 2012 because of course we won't have filed yet. She won't file her taxes until April and I (well God willing) pray we have our NOA2 in the coming month.

I also forwarded him the link regarding self-sponsorship, that's interesting and something he might be interested in. Thank you both for your input. I think i can sleep now. :-)

Yes, they do look at your income but completely separate from your mom's. You will be the PRIMARY sponsor and she would be a co-sponsor, income will not be combined. As far as your mom's income, yes being retired and drawing monthly as a substitute is fine. They will of course want to see PROOF of this, whether in a letter from her retirement and/or monthly pay stubs from subbing. If she has them directly deposited, it would also be valuable to take her past 12 months bank deposits page from the bank. They will still need her income tax transcripts too, to show how much she claims. You will need this as well, for yourself, as well as proof of whatever income and/or assets that you have to claim. Both you and your mother will each fill out your own I-134 signed and dated.


Yes, both should fill out the I-134, but London is peculiar, so you should only submit your mom's and withhold your own unless directly asked for it. London does allow the primary sponsor to be someone other than the fiance in many cases - it's a unique embassy.

And if you go the self-sponsorship route, don't submit any of the 1-134s unless directly asked.

I don't make enough money to support my fiance' by myself and my mom wants to co-sponsor, she is a retired teacher and gets a check every month from that as well as earns a monthly check from substitute teaching. Both of these together put her over 125%, is that ok? What exactly do they look at? Do they consider my income at all? The support part of the process is what is giving me the most stress of all of it. Any help or advice or suggestions from anyone who has already been through the interview in London would be most appreciated.

She's probably telling you that because co-sponsors may or may not be accepted by your embassy. Some embassies allow co-sponsors, some do not, and very few (like London) accept self-sponsorships.

Hopefully some VJers who recently went through your embassy can give some more insight into this.

It tells me that it received my petition on December 21st and that I've been mailed a hard copy.

And then it has a few paragraphs of talking about what they do, like background checks and stuff....can I ask why you want to know?

I am recently divorced. We were married Nov 19, 2011. and the marriage did not last more than a year. I was told that there is a new rule that says you have to wait 2 yrs to be able to petition another filipina. Is that true? I'd like to go back over to the Philippines and see if I can find something more worth my time. I mean, I know alot of signs that I choose to ignore the first time and I think if I were able to try atleast 1 last time, I'm very confident that it is very possible and I am MORE THAN WILLING to try again. First off, it's pretty disconcerting that you would refer to a person as a "something" and it sounds like you are treating this like a shopping trip. I hope that this is just poorly written!

Second, you're previous marriage will probably raise red flags given its short duration. I don't know if there's a real rule, but like TJandJR said, try asking about it in the region specific forum.

Hey there! I did this just as extra "evidence" because I wanted to include everything. My fiance and I each wrote one on our relationship and my mother and his mother submitted one each. We had all of them notarized officially ^.^

OK. It took me a while just to figure that out, because I thought they were the same thing. It wasn't until 3 or 4 emails into my correspondence with the various CIS offices that I finally made the connection. Now I'm figuring out how best to fix the error.


No worries! A lot of people make that mistake because of the awkwardness of how it's listed on the official websites. Hopefully someone experienced with the banking procedure you used can advise you on that because I just wrote a check from my US bank :/

Hello, everyone. I browsed these forums while I was preparing the I-129f forms for my fiancee's application, but it looks like I should have been asking questions as well, because I hit a few hiccups, and now I'm not sure what to do. Here's the situation:

I am currently living in Zhejiang Province, China. My fiancee is living in her hometown in Sichuan Province.
In early December 2012, I paid the $240 visa fee listed on the Beijing Embassy's website via China CITIC Bank.
I included a copy of that receipt with the forms for the I-129f when I sent it on December 9.
The forms arrived at the Texas CIS center on December 11. It was rejected on December 20 because of problems with the fee.

As I understand it, my mistake is that the I-129f submission fee and the visa fee are two different things. Is that correct? If so, do I still need to use the China CITIC payment for the actual visa further down the line?

Luckily the forms were sent to my family in the US, and they have the checkbook for my US bank account. Should they just write a new check for the correct amount and send it back?

My name is Sean and im new on this site, I've recently became engaged and now starting to apply for my K-1 Visa. I just have one question.

Last year i was given a police caution in the UK (where im from), i wont go into detail as it was a stupid mistake. basically i had to sign a letter to accept the caution, but I'm wondering will this affect me in getting a visa through the K-1 process?

OP, they do state that they don't want you in a jacket. Also, remember that the background has to be white - I've personally known people who've had to get their redone because of background issue.

I even got mine redone before sending in my I-129F because the color was off slightly, making me appear slightly green. Better safe than sorry!
