The reason why you must file separate petitions for your wife and stepson is because the CR-2 visa (the visa your stepson would apply for) is not a derivative visa. In order for him to be able to apply for it, it needs to be on the basis of an approved standalone I-130 petition filed on his behalf.



What visa type did you come here on? As I previously stated, the CR-2 visa is not a derivative visa type; your post implies that it is which would be inaccurate and unhelpful to the OP.

My husband and I were married in my country and my daughter was 15 years old that time. He put my daughter's name on that Section C and he didnt file a separate petition for her. We went to USA together since she was minor that time.

I'm starting the process of filling out the I-130. There's a few questions that seems strait forwards, but not to me (lol)

On line 17 section C
What exactly they want to know? My wife says just put me, our daughter and her son (and there relationship to each other), but I think there asking to put her, our daughter and my stepson and there relationship between me and them. Which is right? Her or me?

When I type in our names, should I start with our last names first through out the app? Or ? Also, if I type our last names first, should I put a comma to separate our last names from the rest? (Example: last name> xxxxxxxx, first name> xxxx middle name> xxxx).

When I put her LONG DANG phone number on line on line 19, I put it as it is on my phone with the + and - and ( ). It does not show the whole numer as it would be seen as a whole unless you scroll side ways to see it whole. Is this ok? I tried two deferent ways and its always the same.

Thats for the beneficiary of the petition. If the I-130 petition is for wife then the names should be her children. Put the Name and Last name, then relationship if SON or DAUGHTER their birthdays and Country of birth.

I have no idea how long is the phone number but if it will not fit you can just hand write it using black ink.

The TSC got ALL our paperwork, the Intent letters from BOTH of us was first thing we did..we sent so much paperwork in that it was overkill..maybe We should've taken ALL our pics with a Newspaper held up next to us like a kidnapping to show the date.!!!...lol

Okay, if you sent them in, they were overlooked. It happens -- not the first time I've seen it. The answer is to send them whatever they want. The correct answer would be "We intend to marry within 90 days of my fiancee's entry to the US, as per the terms of the K1 visa." Give them a timeframe you'd like it to happen in by all means.

 

And sorry if I seemed insensitive in asking -- we got an RFE too and I lost my cool biggie style. I understand what you're going through.

It seems not, which is why they are asking. They want what they want, the way they want it.

Which is completely understandable, even if it's wrong. I remember losing my cool when I got an RFE, but we handled it and the process creaked back into life. It's an emotional process, and blaming the process instead of understanding that one might have overlooked a necessary aspect of the application is expected. The answer is to fix it after having a chance to rant. :)

Just to clarify -- you sent them letters of intent to marry, not just plane tickets, hotel receipts and an appraisal?

How is the government to blame when the OP failed to follow the written instructions and fail to provide the required evidence?

Instead of the generalization that it is the government's fault when someone gets an RFE and mischaracteres it as a rejection/denial, let's focus on why people get RFEs. Generally, it's the failure to follow written instructions.



I'm stunned at the number of posters here who appear to be alluding to circumventing immigration law.

I think that they are just trying to by time, judging by other comments made about the service centers.  Partly understaffed, partly uneducated ( about the process) and overloaded.  All of the illegals got to go to the front of the line while all we "legals" got pushed back, thanks to somebody's president.  You know him, the one that nobody said they voted for!

If they did not submit their letters of intent, it is not the fault of the service center. Your political rant is not necessary.

Compare first the NOA2 for your NOA1 dates on the timeline and see how many people have NOA2 dates already.

I sent my I-129F petition to USCIS, and it went to the Vermont Service Center. I got my NOA1 on June 27th, but haven't received NOA2. I've been checking their processing times on the website, and they just recently updated their dates - the processing timeframe is listed as July 2nd! Did my application get lost / overlooked? Or is my NOA2 possibly en route? I signed up for electronic notification, and nothing so far. Any help / tips would be appreciated, I'm kind of freaking out ...


NOA2 is the long wait like 6 months.. really. So you should be getting your's anytime soon. Check other people timelines from date submitted on their NOA1 and you will see many don't have their NOA2 yet.

For point 2. Yes you put the Tunisian address if he has lived there for more than one year as it does not state a timeframe. Whether or not he has lived there 50 years ago or 5 years ago, it just states last address for more than one year. Now if it had something like last five years, then you wouldnt put his Tunisian address because that would not fall under the 5 years.

Honestly, it could all be a mix up and/or a clerical error.

However, I remember reading that it's possible for the consulate to send back an approved 129F for whatever reason.

I'd wait a bit and then contact CSC to see whether the Tokyo consulate sent your 129F back to them. Then you can figure out if any issues need to be rectified. I know that's not the best scenario, but the whole process takes so long anyway that the impact should not be much.

When we talk assets here they put savings and what one has in the bank I have $5000 in my bank now my husband can send me another $5000 and I can borrow another $5000, but that's it.
My sister owns an apartment here in Morocco she won't say no if I asked her to put on paper that she is willing to support me; but is that even doable? And if it is then what do they mean by "assets that can be liquidated in 12 months"? Does that mean the apart has to be sold?


Unfortunately your sister doesn't qualify as a joint sponsor as she's not living in the US. Yes, the apartment would ideally have to be sold to be claimed as an asset or at least show proof that it's on the market for sale. However, since it's your sister who owns the property, it's not very likely that this would be accepted anyway. The assets would have to be in your name or your husband's name or a qualifying joint sponsor's name.

Now, with regards to what assets are acceptable: bank savings are preferred, as they're readily convertible into cash. Stocks, bonds etc. can also qualify as long as they can be cashed out within 12 months.

You say you have $5,000 in the bank, that your husband has another $5,000 in his, and that you could borrow another $5,000, so potentially $15,000 in savings which is a good amount. The important question now is: does your husband earn any income? If he does and he just falls short of the sponsorship requirement by a couple thousand $$$, then $15,000 can actually be enough to help him qualify.
So, he needs an annual income of $27,563 for a household of four. If for example his annual income is $24,000, he'd be $3,563 short of the required income. In this case he would need assets that equal
3x $,3,563 = $10,689, so the $15,000 in savings would be more than enough in this scenario.

I hope this makes sense.

Ok, I've just looked at the I-864 instructions.

Like I said, the joint sponsor needs to meet the income/assets requirements by themselves without combining them with those of the principal sponsor. The only exception is if the joint sponsor is a household member (i.e. lives in the same house as the main sponsor), in which case a I-864A is required.

Regarding the number of joint sponsors, the instructions only say that up to two joint sponsors are allowed. However, the way it's phrased makes it sound like a second joint sponsor is only allowed if there are more than one intending immigrants and the first joint sponsor isn't sponsoring all of them. A second joint sponsor would then be required to sponsor the rest of the intending immigrants.

Do you own any property in your country? If you did you could sell it and claim the money from the sale as assets on the affidavit. You would need 3 times the difference between the 125% of the poverty line for your household size and your husband's income.

Does your husband make any income at all? Any chance he could change jobs and get one with a higher salary that would qualify? Does he get any other income, even non work-related? Pension, public benefits, disability benefits? Does any of you have any savings in the bank that could be used to supplement his income on the affidavit (the 3x rule mentioned above applies to any assets used). Also, keep in mind that you could use up to two joint sponsors in addition to your husband. However it seems to me that their income/assets need to qualify by themselves and can't be added to each other to qualify (can someone confirm this please?), unless one of them is a household member. In the latter case, their income/assets can be combined with those of your husband's through form I-864A.

Don't despair and keep trying and thinking through your options. Remember that if YOU have any income, it can also be used on the adffidavit, as long as it continues from the same source after you move to the US. Same goes for any assets YOU may own. The I-864 is quite flexible in terms of requirements, and there are many options to get around it.

My starting point is always to go on Orbitz and get a ballpark figure for the best times to visit. When I flew from NY I was able to get round trip for around $600-$700 on average, though I flew on Iceland Express once for $400 roundtrip...but they were a horrible airline. I don't believe they fly to America anymore. IcelandAir is really good value and I find that calling them sometimes helps get a lower fare - they're nice. And you can take 2 bags on their flights for no extra charge.

Now that I'm in Los Angeles, it's a bit more expensive. Average flights seem to be about $900-$1000 as I'm looking for April. My fiance came over in november for about $900 roundtrip via Air New Zealand and they were lovely.

I've also looked into getting a cheap $200 flight to NY and then jetting over from there, which can cut $100 or so off of it, but is a bit more of a hassle.

But yeah. Just check Orbitz to get an idea and then go to individual sites. Sometimes I've found that Orbitz really does have the best offers tho!
