Wow, I can't imagine not hearing from my husband longer than 8 hours, after a few days I'd be worried.
Does she not know any of his family or friends?
I would assume something really aweful had happened or he just abanndoned her.
If I was her I would do what ever it takes to find out what happened to him, then go from there.
She's not eligable with out him anyways am I correct?

He's a US citizen. He can petition a spouse, just like any other US citizen.

His pension and Social Security retirement income should be qualified income for an affidavit of support. There are a few VJ members who've reported that they couldn't get the US government to count their SS retirement income. I don't think anyone here was able to figure out why. Maybe because it's not taxable. There's no law or policy that says income must be taxable in order to qualify as income for an affidavit of support. There is, however, both law and policy that says that consideration of an affidavit of support begins with the most recent tax return. If the most recent tax return shows sufficient income, and if the sponsor's situation hasn't changed since the tax return was filed, then the sponsor's affidavit of support is considered sufficient. Anyway, that probably doesn't matter in your dad's case because you said his income was below the threshold.

Once she's in the US and has a green card then she'll be eligible for Medicare, but she'll have to pay full premiums in order to get it. She can't get free Medicare because she didn't earn it on her own, and she hasn't been married to your dad long enough to qualify through him. Premium Medicare is expensive. It might take most of your dad's income to pay for it. However, it's still a lot cheaper than private health insurance.

Your dad's a big boy. He doesn't really need your approval to do this, though he'd probably appreciate your support. He wants to be happy at the end of his life, and he apparently thinks his new Korean wife will help him do that.



He is USC, and he is inlove and wants to be happy with his wife.
I agree with JimVaPhuong, he needs your support.

Not sure why you'd apply for K1, fiance visa if she is your wife. As Harsh_77 said "when you guys were married, does not matter traditionally or married in court – for immigration you are married."

As you already know they will be asking a lot of questions, she just needs to be prepared and answer all questions truthfully, with confidence and proof of on going relationship.

I believe everyone on here is trying to help you. It may seems as some are reacting to your comments as being alil rude and somewhat harsh. I had to stop myself from thinking wow is this lady really like this, when it came to some of your comments too.
I feel sad for your babygirl and the situation that your in. Any child whether hers, your or mine deserves the best health care available.
Try to think about others aswell, and not be so quick in disregarding their situations.

You still have a few months before the interview. How about a few more visits. I know it's not financially realistic but maybe you will feel more confident about your decision. If the visa is approved you have 6 months for him to enter on it, and another 90 days to get married. There is time.

 

That said, my husband and I were together for 2 years before we started the visa process. We were together for 3 before I moved here. I still feel like I didn't know him as well as I would have liked to before marrying him but that is the nature of the beast I guess.

At first this thread sounded like a sad person shocked by their lover's sudden change in behaviour. Now it just sounds like you have no love or trust for this man and are preparing for the inevitable demise of your relationship all while planning your marriage.

Talk about contradictions. I hate to say it, but if you go through with bringing this man over to the US and things go poorly for you, you deserve it. Nearly everyone here has warned you about bringing this man over. We may not all be correct in our reasoning but not even you, his fiancee, sound sure about marrying him and I think that is enough for all of us to tell you that you should reconsider your decisions (or lack there of).

Marriage is about love, trust, and accepting someone for who they are. It is not about devising failsafe strategies and arming yourself with information in case things go awry.

I believe the medical exam is valid for one year from date of examination but I am not sure, you may want to post that question in the regional forum for Canada.

You cannot have your medical exam in Arkansas. It has to be done by one of the approved physicians listed by the consulate where you will be interviewed.

Now that is really good advice. I do not have any legal constraints whatsover - immigration or otherwise. I had a B1 multi-entry to the US before the VWP, to Silicon Valley in San Jose with a former employer. That saving would come in handy. The issue is that I'd like my wife to file the I-130 petition in the US after my departure. She may not be able to take over if anything unexpected came up ( believe me, I know her...). She would be crying for help. I will go through the I-130 and its requirements closely, we will file without a lawyer is we can DIY it.

Another question - how long do you have to know your partner before getting engaged/married to qualify for a CR-1?. Does the duration matter? Are a few months OK?


Hopefully nothinig out of the ordinary will come up if you are well prepared. You can be of help by collating the documents. I kind of know what you mean that your wife will be crying for help. :) because my husband hates filling forms and stuff like that. :angry: . When we wanted to file, I visited him in the US and we went through all the requirements together carefully and filled all the forms together. Took us days as we wanted to be really thorough. Went as far as sealing the envelopes my myself all he did was pop it in the post after my departure.We had no problems at USCIS, we got approval without an RFE.

For the NVC stage the bulk of the work will be done by you not your wife, her main responsibility will be the Affidavit of Support. You will send the DS3032 and the DS230. As mentioned before, if you read and follow the instructions thoroughly there should be no problem. And if you have questions the VJ global family is there to help. :D

A few months is ok, the duration is not what matters, its what you can show for the duration that matters. Good luck!

Delta has made lots of money out of us with the SYD-ATL daily. We'll go though the civil wedding and then file the I-130 for CR-1 after I return. Why do you want to hire a lawyer at all? :o I personally think its a waste of money if the intended immigrant has not had any trouble with the law before, immigration-related or otherwise. As long as you have the patience of reading and following instructions thoroughly you should have no problem processing this yourself. Keep the $4000 for visiting each other while the CR1 is being processed...

I'm trying to assemble my I-130 packet and note that the form G-325a has to be filled out and signed by both my wife and myself.

She's in the Philippines now and I'm in the USA so I'm not sure how to achive this. Also, a passport-style photo is needed I see.

Any help with this? Thanks in advance.


Get her to download the form, sign it and send to you. A signed original is required. Get her to send the passport phto(s) along with it. I dont think there's a shortcut for that...

Hi, we've got our NOA2 on Aug 17 and luckily got the hard copy after 3 business days.
I hope you got your MNL # by now :) We got ours 4 business days (post NOA2)
Once you're assigned with MNL #, pay the $240 or 10, 360 php (per Aug 24 currency conversion)fee to BPI and schedule an interview. Don't need to wait for the hard copies from the Consulate, all required forms are accessible online.

I sure hope so. My hardcopy NOA1 was May 10th, even though I didn't get the actual hardcopy for nearly a month after because of their screwup on my mailing address. I just hope they send it to the right address /this/ time right away.

Yep, we're still here!

We'll be around when the VSC gets their #%*@ together and starts moving on your petitions. It was pretty sudden the way the CSC started moving so the same thing can happen at the VSC. I'm praying for you guys!

We're stuck until the end of November anyway since Jordan won't be back to Cananda until Nov 18th. So the best we can do is schedule the medical and interview after that date. He now regrets taking this contract, but he needed to go to work so he didn't go crazy waiting. When he signed on the CSC was taking 5 months, we never dreamed it would happen that quick. Unfortunately there is no way for him to leave early, not without jeopardizing future work.

Soooo.....we're still waiting! :whistle:

I hope so! Been going a little crazy lately. It's been 2 long months since I've seen him and now that he's working we only get to talk 3 days a week. 3 weeks from tomorrow I fly out to join his ship in Tampa! Still seems too far away.

I know others have been apart much longer, so I really shouldn't be whining and my heart goes out to those at the VSC. It's just some days are harder than others. Thing is, he won't be back to Canada until Nov 18th so we can't schedule an interview before then anyway. But it would be nice to know my petition was approved rather than rejected. I'll take an RFE at this point!

I need to keep busy or go for a run...

Sooo happy for everyone who's getting approved here....just kinda wish it was me too!
