Some people attach too much importance to this "TOUCH" thingie. I'd say ignore it and concentrate on sending the right documents and hope for a timely NOA2(USCIS approval).

IR-1 / CR-1 Spouse Visa Process & ProceduresOriginal documents

Saw a cute cartoon yesterday with a dog saying to its master, "If you wanted that ball, why did you throw it?" If you wanted your originals back, you needed to offer copies in their place. They don't make copies for themselves and give the originals back.

I can speak for myself, i DID go with several copies of each document and OFFERED and the "nice" lady did NOT agree to switch them and give me the originals back, for whatever reason.

IR-1 / CR-1 Spouse Visa Process & ProceduresOriginal documents

So i have a question. I just had my interview yesterday at the dublin us embassy and i got approved. But when i was at the counter going through the paperwork. The lady told me i would not be getting my original documents back (birth cert and marriage cert).
So i am just wondering if anyone else had this said to them or if anyone did get their original documents back???

Thanks for your help :)

Happened to me, my originals were not returned to me at the embassy. Everything was sealed in the brown envelope. I tried getting them back at the port of entry, no luck there either. I applied to get them back by filing a G884 downloaded from the USCIS website. I got everything returned to me after a couple of months.

Yep, travelled through Dublin hassle free 4 weeks ago. I have received social security and green cards. I changed address at the POE and was worried somethingmight go wrong but it didnt.

No problem with visits as long as you spend the normal allowed time, do not overstay. Be truthful if questioned by immigration officers on entry.

Well, review is not an outright denial. If you are being denied you will be given REASON(s) for denial. You can call or write stating strongly that your relationship is not solely for immigration purpose and that you are willing to provide any further information to support that claim during the 'review process'.

IR-1 / CR-1 Spouse Visa Process & ProceduresBackground check question

Speaking from experience, I didn't have to get any form from USCIS. I wrote submitted a letter to my local gardai station requesting the certificate and stated its for US immigration purpose(they will expressly state this on the issued certificate too). Having said that, I went through this over 3 years ago, I am not sure whether things have changed. I seriously doubt that the requirements have, because this page doesn't have any thing about getting a form from USCIS: http://www.garda.ie/...age=2742&Lang=1

Be sure to follow the instructions on the site: Listing all addresses, include photocopy of ID etc.  I did get the cert less than a month later. The site actually states it takes 3 weeks to process.

If you took photocopies to trade for them and ASKED for them, your original "certified copies" would have been returned...

I took photocopies and I ASKED and they said NO.

IR-1 / CR-1 Spouse Visa Process & ProceduresBiggest Mistake of My Life?

Hmm, so you don't think my "flag" is as big a deal as I'm making it to be? I'm just scared of getting rejected because of it.

As others have said, it depends on what they wrote up when they turned you away. My fiance had to sign a "Withdrawal of Application for Admission" when he tried to visit (no intent to get married, just not enough ties to Canada for him) We just got approved for our K-1 Visa on Monday. The incident did come up in the interview but we were told "it's no big deal, happens all the time" and then he told us we were approved. We were so worried it was going to be an issue, but it wasn't.

Hopefully that is all you had and not a "denial for misrepresentation"

Hi all, I've been trying to find the answer to my question for over a month now, no luck....
Sorry if this question has been asked 1 too many times. This is my first post, and I hope with the answer to this question we can finally submit this petition! :)

Do we have to submit a separate I-130 for my daughter who is 11, and pay another 420.00?
I thought by putting her on the same form, on the second page, C. Information about your alien relative
17. List husband/wife and all children of your relative.

That would put her under the same petition as I am under?

Thank you in advance,

No, that won't work. Recently a I saw a case where person adopted abroad at birth got an RFE for the birth certificate in the original country.

Here is some info on getting the required documents from Thailand. http://travel.state....l?cid=9660#docs

Good luck.

Thank you, I tried Calling Royal Thai Embassy in Vancouver and they said that Thai Gov didn't issue BC for people born in Ref Camps!

I think I read somewhere that I could.

IR-1 / CR-1 Spouse Visa Process & ProceduresTravel while Visa is in progress

You can call the US Customs Chief in charge at least 2 days ahead of your planned trip and explain what you would like to do; be totally honest. Ask if you can be given a parole, This is a one time entry for $6 for a defined period of time. Bring all your ties to home with you when you present yourself, you will have to go in and get fingerprinted etc. I have done this and crossed over many times while we were processing our CR1.

Never lie, if you get caught it will cause new problems for your immigration process.

Good Luck

Thank you, do they give you a certain amount of time or can you go for weeks? (Holidays in December)
Also you said you crossed over many times does that mean you went through that process every time?
Thanks again :)

Good evening,

I understand that one can still travel to the States while the Visa is in Progress.
With plenty of evidence to show that I am not intending to live. My question is will the POE officer know that I have a Visa pending?
If not should I mention it or not?
I live in Vancouver Canada, not to far from the USA Boarder, and I'd like to go see my hubby for the Holidays.

IR-1 / CR-1 Spouse Visa Process & ProceduresUnavailable Birth Certificate
I was born in a Refugee Camp in Thailand, back then the Thai Government did not issue Birth Certificates.

Here's what I found to be helpful for me, and I thought to share it with whom ever is looking for the answer to this very question.

:) Everyone on here has been so helpful.
Thank you!

Unobtainable birth certificates

If your birth record is not obtainable for any reason, a certified statement must be obtained from the appropriate government authority explaining why your birth record is unavailable. You must also submit secondary evidence such as:

•A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)
•An adoption decree for an adopted child
•An affidavit from a close relative, preferably your mother, stating the date and place of birth, both parents names, and your mother’s maiden name.
Note: An affidavit executed before an official authorized to take oaths or affirmations must also be provided. More specific information is available from the NVC.

God Bless!

IR-1 / CR-1 Spouse Visa Process & ProceduresImmigrant visa apporved and then cancelled by CBP officer

This is my first time posting here. And I think that my story will shock many of you.
I am a US citizen. My husband a Canadian citizen. I made the biggest mistake of my life by filling his I-130 myself and not hiring an attorney. I did not know that I need to fill out a change of status form because he was currently living in US. Make a long story short, our interview letter came and so we went to Montreal, Canada. Everything went fine. His case got approved. I flew back home to US. A week later he got his passport with the immigrant visa stamp. He went to the airport in Montreal to fly home. A CBP officer started questioning him about when was the last time he entered US, and how he got to , why his interview was in Montreal and not Vancouver and many other questions. They questioned him for 6 hours and finally canceled his visa and told him that he has to go file a waiver because they feel that he lied on his application.
I have two little kids at home who miss him like crazy. Financially,we are falling apart. My beautiful life has been destroyed. Can a CBP officer do this? Can I appeal this?

Awe, thats sad...I'm sorry...

How long was your hubby in the States for?
if he was already in States you could of just applied for change of status, then his interview would of been done there in States, but they would interview both of you. This process is confusing I know...
Perhaps you can call Uscis and see what you can do from here on. I do believe CBP has a right to refuse at anytime as a Visa still does not guarentee you entry.

IR-1 / CR-1 Spouse Visa Process & ProceduresBirth Certificate for Korean Citizen
Hi there,

I have the same problem.
I called Thai Consulate to ask about the BC and they told me that Thai Gov did not issue BC to persons born in refugee camps.
I kept searching and found out that all you have to do is get the Korean Gov to send you a letter saying that your Birth certificate is unavailable because they do not issue BC, instead they issue the family tree thing.
Then have your parents write a letter stating that you are their child and that you were born in Korea.
I wrote a post up here for others in my situation.
Hope this helps. If not contact me and I will find you the link.
:)

Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresEvidence of relationship

I am trying to gather the evidence to send in with the i-130 packet (other than the marriage certif). All I have are photos from our civil ceremony, a couple photos with his family and our friends in Mexico, cell phone and house phone records with some ridiculous international call charges, I can make copies of my passport with stamps from a couple trips to Mexico to visit my husband, I have airline ticket stubs if those would help. Are any of these things that I just mentioned not even worth sending? I can gather some affidavits from family and friends to, how many of those would be good to send in? Any tips would be greatly appreciated. Thanks!

Hi there,

Send everything, the more you have the better. Also show evidence of on going relationship.

IR-1 / CR-1 Spouse Visa Process & ProceduresDivorced, or married to two people or what?
Hello Members,

I hope everyone is doing well and I wish you all best of luck during your Immigration process.

Just when I think we've gotten all our documents together and ready to mail out soon, we've encountered another set back.
I'm really getting frusterated and angry. My husband and I have been married for 8 months now and we're eager to start this process.
I was just in the States spending time with my husband and his family for Thanksgiving.
While I was out there I asked my hubby to take out his documents so we can make copies of them. We searched his file cabinent and he could not find it.
I then told him it was ok, that we could go back to the place where we got his Birth Certificate.
He then text his exwife and asked her if she had a copy of it. (they're civil, and has been divorced for 15 years)
This is what he got out of her.
She said she does not have a copy, and that she has to get it from the court.
He said that she filed for divorce in 96', got papers for him to sign, he said he signed it and she was going to file it, since she worked at the court house.
At that piont I started to really get angry. (thinking she probablly didn't even file)
Many things running through my mind. He was worried too, but did not let me see that. I kept pressing him to find out more...
Then she said to him you know what this means right? He said NO. Then she says you guys will have to get married again.
#######, what the hell is going on??? Seems shaddy right?
I don't understand, she has her life, they don't even speak unless its about their son who is practically and adult.
My husband asked her to call him so he could further understand what she is talking about. She said she was going to look into it for us. Really?
I'm so mad. My husband doesn't think the County would issue us a Marriage Certificate if he wasn't divorced, but now I am really worried.
Could he be still married to her and not know it?
He plans on going to the Vital Statistics place tomorrow and try to see if he can get a copy of the Divorce Certificate.
Either he gets one or not will tell us what we're facing. Or does he have to call the Supreme Court?
My heart hurts....
Please if anyone knows what else we can do to find out, we'd really appreciate it.

Wow, I can't imagine not hearing from my husband longer than 8 hours, after a few days I'd be worried.
Does she not know any of his family or friends?
I would assume something really aweful had happened or he just abanndoned her.
If I was her I would do what ever it takes to find out what happened to him, then go from there.
She's not eligable with out him anyways am I correct?
