I am losing my faith in immigration lawyers when they all keep saying her B1/B2 will be null and void if we get married in Mexico and then file for the IR1/CR1. They then have been suggesting that we marry under the B1/B2 in the US which many of you have been pointing out would qualify as visa fraud if she did not go back to Mexico immediately since she used the B1/B2 to immigrate.


Many many immigration lawyers(not all) are just in it for the money and they dont care if they get their 'clients' in moe trouble for the future with somesilly advice. Why do you even need a lawyer? As long as you are patient and can read instructions then you are good! I had a valid B1/B2 visa when we started the CR1/IR1 process and I continued to use it to visit the US until the Immigrant Visa was issued. So your fiancee will be fine to visit until the end of your visa journey. The only thing is that its totally up to the officers at POE to decide whether to let her in or not. Two words: STRONG TIES.

We just received our NOA2 yesterday (well the email anyway) therefore of course this is hot off the presses. I have gather just about everything I think they will be asking us for and am curious to when should my husband send for his police certificate. I just want to be ahead of the game and have everything ready to mail once we are prompted to pay our fees. It will take two weeks for him to mail me the certificate and I am not sure how long Lagos takes to produce the certificate. Can we request it now so when we get a case number and the fees are paid I can just mail it out without waiting for him to then file it and mail it? Or must we wait for a case number to then request the police certificate?


Yes you can have him request the cert now IF you are sure you have everything else ready i.e. you will be paying AOS bill and IV bill in quick succession. The reason I said that is because Nigerian Police Certificate has only 3 months validity. The good news is if he is 'connected' he can get the cert from Lagos in one day.

Once these payments are in PAID status, will make the AOS and IV packet to NVC as stated. The QUESTION is; would I get something from NVC that says send us such and such documents?


Once the invoice reads PAID you can print off your cover sheet and send the relevant forms and documents. You dont have to wait for it to be requested, just make sure you understand all thats required so you dont end up getting checklists from NVC. Congratulations and good luck!

Seriously there is nothing to worry about. Since most of the original docs were sent to NVC you wont be needing much more.If your husband has been previously married you will need to take the original marriage termination docs with you to the interview because this is not usually required at NVC stage; they only request marriage termination docs for the beneficiary at NVC.

You should be set with his latest tax returns(and that of the co-sponsor if you have one). Relax!!!

Many people have told me that the police cert and Medical expirations vary by country, thus why it would be an Ireland question, if it's true.


Each of those documents have 1 year validity, that I am sure of. What I am not sure of is whether they are required to be valid at POE, I thought they are just for the approval and issuance of the visa. Now you got me worried because mine wont be valid at POE in July. I didnt think it mattered... :unsure:

True you cant have too much! Let her take as much as she can, just to be prepared but dont dump everything on the consular :blush: . If she is asked for further evidence then that way she is ready; rather than regretting she brought too little. I had all of those things you listed but the consular did not ask to see even 1! But the joy of getting an approval far outweighs the pain of hauling my huge bag of evidence back home untouched!:D

as mrs o says u have to go back...if that's correct i don't know but what's the point then? might as well do the k1. I'm not the expert on this...but as far as I know entering the US as a tourist (maybe other visa types as well?) with the INTENTION of marrying is visa fraud.

I specifically called the embassy to ask about this when I was going to get married in the US and they said I dont need any special visa if I dont intend staying there and they refered me the website. Hello All,

I have read the dangers of entering the US on a tourist with intent to marry and then apply for an AOS. But what if she marries and leaves? Does anyone know or have any experience with this scenario?

1) entering the US on a tourist visa,
2) getting married in court
3) leaving before the tourist visa expires
4) applying for a CR-1

Is this a viable option or would my spouse's case still hold a high probability of getting rejected?

Thats the exact route I took. There was no problem with the CR1 processs. I have my visa in hand. Nothing illegal about getting married on a tourist visa as long as you return to your country of residence to apply for your immigrant visa.

Be prepared to present every shred of evidence in your possession to show that your marriage is genuine. They will be suspicious, thats default with cases like this, thinking she wants another route into the states.

First things first, G325A is not required for the children. One for you and one for your wife, thats all.

For any other form for the children, their mom can sign for them. I signed for my 2 children aged 9 and 11. I signed and wrote (MOTHER) beside my signature and we had no problems.

My husband(overboard) sent DS-3032 via e-mail today. I have an invoice for AOS processing fee. I tried to pay it online but it wouldn't let me. Any idea what I'm doing wrong? Thank you




If the DS3032 is not processed yet you can't pay the AOS fee online, even though you can see it. You'll need to wait for a while, could be as little as 3 days or even up to 2 weeks before the 3032 is acknowledged
