We went to get our passports photos done at Walmart as well. Their photo printer was down, so they just gave us the digital copy and sent us to another store to have them printed. It would probably be faster to have him get a digital copy, email it down, and you take it to the store to be printed.


What was upsetting is that we were done and ready to send the packages. I know a few more days isn't going to make a difference overall but it seems to now. He asked at 3 different drug stores for the digital file (I already confirmed that Costco would print it properly for me) and they all said they couldn't do it. Really??? Very hard to believe and very frustrating, especially with today's technology. Worse case is I'll bring one back with me and we'll send the package then. I just hate to lose a whole week.

We just hit a snag already. I had everything ready to go other than his passport style photo from him that he sent "overnight" (two days). Well we just found out that it's held up in customs with no estimate as to when it will clear. It's just a photo! Good grief. :angry:

You are looking at at least 6-8 months before the I-134 is necessary. I suggest waiting and having more up to date information once it's needed. :)

Hi, my name is Patty and I'm new to this forum so go easy on me. I may ask stupid questions until I figure out the "Search" function here.

My fiance is Canadian, Jordan, and we've been together for 4 years and got engaged this March (yay).

I hope to be sending my I-129F package today. I've checked it many times to the checklist provided here on VJ (very helpful) and have a freind checking it now. I'm waiting for his photo (passport style) to arrive today.

My first question is about the I-134 Affidavit of Support. Someone (don't recall who) said I need to fill this out. I don't know when or where I'm supposed to send this. Should I include a copy with my I-129F package? Or wait for someone to request it?

Yep, you just use the employment letter and recent pay stubs to prove your current income. No need to list any assets at all if you make more than enough with income alone. Seems weird to leave parts of forms blank since all the others for immigrations say not leave any questions unanswered, but in the case of this form, it is perfectly okay to leave the whole assets sections blank. :yes:

No. If you meet the income requirements, you don't have to provide any information about stocks, bonds, assets or anything. Simply include your income and back it up with supporting evidence and you're good to go!


Whew! Thanks! I have stuff spread out in seveal accounts and wasn't looking forward to contacting all those institutions to get formal letters, etc. One less thing to stress about.

I already have my letter from work and my Tax docs out and ready...even though I have a long wait. :blush:

Do I list what is in my 401K? Or is that considered assets that are not accessable? My income is well over the requirement and I've been at the same company for 24 years so do I really need to list all my stocks, bonds, assets, etc?

I sent mine via FedEx to Lewisville, TX per instructions. It arrived overnight (FedEx confirmed it) I recieved an email a few days later and my check was cashed the same day as the email arrived. However it took almost 4 weeks to get my hard copy NOA1.

Pay the $5, it will be worth it to know for sure.

Thanks! I was an emotional wreck back when this thread came up. Beating myself up horribly for leaving a couple stupid blanks on my form. I did call and they said it was best to wait for the RFE so after that and reading all the discussion here, I decided to wait. I was SURE I was going to get one or my package was going to be rejected. It's stupid to stress so much over something so little, but I did.

Anyway I was beyond thrilled to see that I was approved and no RFE. The package as a whole was solid, so I guess they were able to overlook one little mistake. My fiance had been telling me this all along. I did do my research but I pulled it together quickly (6 days) and wished I had taken another week to more thoroughly check it.

I concur with LeftCoastLady. From my own perspective, I knew that I would drive myself insane doing the "coulda...woulda..shoulda" and trying to "second-guess myself" manners of thought, waiting and worrying right after I mailed the initial petition. From my own life experiences, I realized I had to submit a petition that was as "bullet-proof" as I could make it the first time. For me, it just came down to basics, have a plan of action, be patient, read and heed all of the instructions very carefully. When I completed the petition, I put it away for a couple of days, then went back and reviewed the entire document for errors of omission and commission. When I submitted my petition, I was satisfied and confident that I had done the best job on it that I could. The result.....NO RFEs !!!!

They do need to be prepared in case it does not get matched up. Sometimes people send evidence before receiving an RFE, and it never gets put with their petition. Not saying that's going to happen, but we have to realize that what happens to some, doesn't happen to everyone. No harm in a phone call or a letter. All you're wasting is some time and the money for a postage stamp.


Exactly. I can't see the harm in trying. Worst case, I get an RFE....same as if I did nothing.

this is NOT true. I contacted the USCIS by phone after my NOA1 because I made a mistake on one of the questions. The advised me to send a letter stating what the mistake was and they told me the address to send it to. I did not receive any RFE after I sent the letter, and our petition was approved after only 3 months.

In the instructions, it does state to answer ALL questions, even if the answer is "no" or "N/A".

Leaving something blank has caused RFEs, so I would not be surprised if you received one. Just have to wait and see.

Hopefully, it ends in a quick RFE (or none at all) and not what happened in that thread you'd posted. What a ridiculous waste of time for one unanswered question! That's the first (and only time) I'd heard of something like that happening.

Also, Since I checked "single" in question 6 for him I didn't see the need to place anything in question 7. So that is another blank.

How can I contact them in advance? Can I do this once I receive NOA1??

One year into our relationship we drove his car (a convertable) down from Vancouver to So Cal. It took us 3 days and included a stop in the Napa Valley and a drive down the Big Sur Coast. I tell people that's when I knew I was in love with him. It was a wonderful trip!

Hi! Welcome to VJ!

My Fiance is in the same boat (literally, haha) as he works for Carnival. We're wondering the same thing. We will be getting married in January and adjusting status soon after. His current contract ends Nov 18th. I'm okay with him not going back for a few months but his agent is really pushing him to go back sooner. We will be meeting with him next month when we're in BC for his interview. Hopefully we'll be able to find out more at that time.

There are two ships that are local to my home so he's going to ask if he can work on one of them. In that case can he just join the ship? Who knows. Before he's always had to be flown in from Canada to join a ship in a US port.

But I am not sure if that will affect as well in the visa approval because I haven't scheduled yet.Since you already did.Just hope and pray that it will be approved. We did the same. I did not discover Visa Journey until I was almost ready to send the petition. I spent months agonizing over this. I had the original signed docs ready (I flew up to Canada (for a visit) and got them after I discovered they were supposed to be original) to go if the RFE ever came but it didn't. We were approved with no RFE for the petition or the Visa. We got lucky and maybe you will to. Just be ready in case the RFE comes.

This is a ridiculous statement, well for anyone with common sense.  Especially in a relationship that developed long distance.  How can you possibly know someone well enough to not protect yourself?

 

I was very much in love with my ex when I married him.  We were very happily married for over 10 years.  12 years in he developed a gambling addiction and put us in a lot of debt over the next 3 years.  When we divorced I had to cover half of the debt HE created and he walked away with half of everything I owned, including a large chunk of my 401K.

 

Am I more careful this time around??  You bet.

Hi, I'm new here also and this is my first post!

I believe you're misunderstanding the requirements.

The reason why one would need to withdraw a K-1 petition and apply CR-1 is if they get married while the K-1 petition is under review...BEFORE the issuance of a K-1 visa. If you get married before the K-1 is issued, you no long have a fiancé(e) to petition for, since that person is now your spouse, so you need to then petition your spouse instead.

As for the 90-day requirement, you're required to marry within 90 days AFTER the beneficiary arrives in the US with the K-1 visa, so no contradiction there!

In your case, your best chance to waive the two year requirement is to attempt to exhaust every option to see each other in person. If you're denied entry to his country, then why can't he visit you? If you can't go to each other's countries, then why not meet at a third country? Also, your lawyer says you can't go to Jordan, but it seems you're making plans to go see him now.

 

As you can see, it will be hard to convince USCIS to let you waive that two-year requirement. I don't think they would do it for you.

 

Your best bet is to wait until you get a denial for your current petition, then refile for a K-1, or as bigdog said, get married and file for a CR1/IR1 after you see him again. As an October filer, I don't think you should withdraw your petition. Just wait for the denial, and maybe drop your lawyer.

 

Other than that, I think you have plenty of evidence for your relationship. Wish you lots of luck!

My response to 18 is somewhat similar to the second one.

 

I also submitted itineraries, photos, and a copy of my work permit, but for me, only as secondary evidence. I couldn't really see the work permit proving that I was actually somewhere. You need strong primary evidence. If you don't have ticket stubs, perhaps you and Han have credit card statements with purchases that show you were together in the same place or city?

 

The good news is, all those dates you listed are within the past two years, so technically, you only need to prove you met on one of those occasions. Also, if you have evidence for all those trips, you might as well send those as well. It would help build a case for your relationship.

The obvious reason for the denial is her answer to question 2, that he filed the petition prior to meeting her and so he was not able to supply sufficient evidence that they met within 2 years of filling the petition, such as photos or plane tickets. It is important that USCIS know that you physically met at least once before filing the petition and that you physically got engaged. Falling in love and getting to know each other via the phone or internet alone is not sufficient for the USCIS. 

 

What do you mean by physically getting engaged?

Did you meet in person in last 2 years before filling? - oh, I think this is the technical side...he filed it before he comes here in to meet me. but we thought that since they would asked for RFE, that would be ok already.

 

That alone would be a reason for denial. I don't think it matters, at this point,  if there is anything else missing. Do not appeal, as they were correct to deny you.

 

Refile and file correctly. Check the guides on this site. That will be your biggest help.
