IR-1 / CR-1 Spouse Visa Process & ProceduresIdentity mismatch finger print

My husband went through a successful inteverw but was caught during the finger print and was asked to bring a proof of Identity before 2005 becos he's been to the US embassy wit different name on a passport arnd 2005..

The counselor asked him which is his real name? the one he used during 2005 interview or the one he is using now. he told the counselor the one he is using now, so the counselor ask him to bring a proof of this current name before 2005. I pray the approve his visa.

You do need the prayers, good luck!

As for me, it was taking a long time to get one of the required Police certs and I forwarded the NVC docs without it but then I got a checklist letter asking that the Police cert be sent. My case wasnt closed until they got it.

Our case was complete on Feb 3, 2011. Just want to know if there is anyone who has recieved an appointment at the Nairobi embassy this year (2011). How long after the case complete until the actual appointment date? Also, how did your medical and appointment go?

You might be able to get more answers from regional discussion forums. You can also check your country portal and check members timelines. Good luck.

Oh, so sorry to hear that! I doubt there's anything you can do though...Was it NVC's idea to switch you to Dublin or you requested it? In any case NVC shouldnt have switched you knowing your husband is not resident in the republic.

:ot: I may have seen your husband yesterday when I went for my medical. I heard a guy telling the staff at the clinic that his interview is on the 15th...

:ot2: Sorry about this glitch, hope things start moving along again soon enough.

IR-1 / CR-1 Spouse Visa Process & ProceduresIR2 visa for a child

IR2 visas are issued to children who DO qualify and DO NOT qualify for citizenship upon entry to the USA. Those who qualify receive citizenship automatically but if they want a certificate of citizenship, they file an N600. Those who don't qualify, can file an N400 when they become eligible, usually in five years.

Yep they qualify the same time as the natural parent which is technically 3 years, being married to a USC.

I believe the Child Citizenship Act of 2000 applies to children that enter the US with IR3 or IR4 visas. IR2 will be eligible for citizenship at the same time as the natural parent.

please does any one know if they need the petitional previos divorce degree or just the applicant, please somebody help

Marraige termination documents for both petitioner and benficiary are needed to file I-130.
The beneficiary's only will be needed for the DS-230.

Will be handy to have copies of both at the interview stage though.

Yes you can, just be prepared to show that you have strong ties to Canada and you'll be back to wait out your immigrant visa process.

Once you have your NVC case number, its ok to send the DS 3032, no need to wait for anything from NVC first.

Yes, it sponsored. Actually I used to have B1 visas from the same company before.
Thanks for all! Things moved fast last days and now
the other question, can somebody apply for B1 after NOA2, I mean during NVC and waiting CR1 interview? Is it ok by law to have two applications for immigration and non-immigration visas at the same time?

there is nothing unlawful about it. The worst that can happen is to deny your Non-IV application because of your immigration intent.

IR-1 / CR-1 Spouse Visa Process & Procedureswondering!!!

hello Guys!!!
my wife filled an I-130 three months ago, and we still wating the aproval from USCIS!!
-Approval is taking an average of 5 months
my question is , will she have to pay for other fees after the approval from uscis,??
-There'll be further payments at NVC stage - AOS fee($88), IV application fee($404), your medical exam will also cost, this varies from country to country
and, another thing, can she file the rest of documents the NVC needs from here?? cuz, probably, by the time they approve the I-130, she will be over here with me!!! any ideas please??
-Where they originate doesnt matter as long as they contain the required documents, can be sent from the US or home country.

My first checklist response didnt get registered into the system for about 20days after it was 'received'. I got a second checklist and the Automated voice system kept saying I'm missing a document right until the day the case was closed! So I'd say give it a few more days...

The date for his intervoew after case is closed will depend on how busy the consulate in Israel is...

Yes, understandably its awkward asking this kind of responsibility from other people but sometimes you just have to bite the bullet and do it. Like messybrownhair said, its better to be safe. I'm sure you'd rather ask for help than have your application unnecessarily delayed or even denied.

K-1 Fiance(e) Visa Process & ProceduresQuestion on Fiancee interview - Australia

Hello

While waiting for NOA2 - Nov 2010 filer, I was inquiring on whether the petitioner (me) is required to attend the interview along with the beneficiary (the fiancee) in Sydney Australia.

I've read that it depends on Embassies/Consulates. This would help me plan my vacation/visit if NOA2 is approved.

Thanks

d

Your presence is not required, but I've heard of cases that the CO was in doubt about the relationship that (s)he asked the beneficiary to return on another date with the the petitioner...

You may want to post your question in the Australia regional discussion as well.

K-1 Fiance(e) Visa Process & ProceduresFiling Abroad

Please tell him to wait before selling his house or leaving his job. This process is very time consuming and unpredictable. I would not do nothing until I had the visa in hand. Once you get the visa it is good for like 6 months to travel. So he would have time to get things together far as his house and job. It would be a very bad feeling if he did not get the visa right away and then he has given up everything with the hopes of getting the visa in certain amout of time. Each country time frame may be different. Hopefully someone from Denmark tell their experiences so you can get a general ideal. It took a total of 6.5 months for us to get approved. Had a small delay which we are currently working on. Visa was approved at interview 2 weeks ago, but when he went to pick up visa he was told had a old active passport from a visitor visa he applied for 5 years ago. Had to get old passport cancelled before they will issue the k1 visa. Im telling you this because their could be some obstacles that may slow the process down so be patient and dont make any big chanages before you are sure you have the visa.

:ot: Hmmm this is interesting. I currently have 2 passports. I have a nigerian passport that still has a valid tourist visa in it and I am going to get my immigrant visa on my irish passport, does that mean they will cancel the tourist visa first? I was hoping to make a quick visit to the US on that before my final move to the states

:ot2: Amanda the average time from NOA1(notification of receipt)to interview date in Denmark will be totalling about 7 months: 5months at USCIS then additional time for transfer of docs to NVC and then to embassy. Interview date will also depend on how busy the consulate is over there...

Your location at the moment should have no impact on your application as long as the package gets to the right location. Make sure all the necessary documents are included else if you are missing something and you get an RFE, the letter will be posted to your US address and you wont see it for the 3months you are away! I believe you have enough to show you have US-Domicile even though you are away on holidays?

The I-129F approval is averaging about 5 months so its not likely the process will be over before you return to the US. Usually the fiance(e) is not required to attend the interview but I have heard it increases the chance of being approved if (s)he is there.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresUgghh, original signatures??
Original in the USCIS/NVC sense means actual pen on the paper they are looking at. I've heard forms are returned if the signatures are not original ones.

As an aside, still expecting a package from a month ago from the UK? At this stage I'd consider it lost. Have him mail another set, the sooner the better. He can have it registered. I know it cost like €6 from Ireland using the post office, nothing fancy like DHL or UPS.

K-1 Fiance(e) Visa Process & ProceduresHelp on Interview Day ASAP (K1 visa)!!!!!

Hi Good pple (VJAYS :) ).i need help from those who went through the US consulate in nigeria for assistance about their interview (K1 to be precise)....

1. Dress code on that day, how formal should it be?
2. How much or how less is one's supporting document
3. In a situation whereby one's petitioner was kinda married before, but now they're no more, they separated since 2008 but the divorce was finalised in 2010....4months later she filed for me,wouldn't it kinda raised a red-flag or sometin ?
4. she has visited me 2tymes in d last 1yr but we cant lay hold of any of her flight iteneries, except pix and copies of pages of her passport to show that she was in the country in the last 1yr, what do we do in that situation? she is coming for my interview too as well , at least i wil have that one in hand, what else do we need to convince the COs that we r real? :(

I saw you posted a question in the Interview review section? You cant get answers there...

K-1 Fiance(e) Visa Process & ProceduresIf fiance has K-1 Visa, can she enter USA on Tourist Visa first?

Hi everyone,

We guess my fiance in Taiwan will have her K-1 visa sometime early this summer. At least we hope. She might be chaperoning a school trip for students to come to the USA later in the summer. If she has her K-1 visa, can she enter on the tourist Visa and save the K-1 for next time when she's ready to come to be together?

Or will they only accept the K-1 visa the next time she comes into the US?

thanks all!

If she has tourist visa when the K1 is being issued the tourist visa will be cancelled, so the scenario you are envisaging is not possible, she wont have both visas at the same time.
If she has only the tourist visa on entry thats fine. If she has only the K1 its activated and I dont think she'll be coming back with her students...

Hi Everyone,

I know this should be in the Ireland portal but I can't figure out how to post there :( We have oour interview thursday and it says i need a 12x14 envelope.. how big is this envelope? i don't know if its in inches or centimetres!! inches would be huge.. are they looking for a huge one or just an envelope that will fit your passport in it?

thanks for the help!:)

Its huge alright!

Its not just for your passport, its also for your submitted documents and the envelope you will take unopened to POE, so we are talking inches here. You'll find the envelope (or something very similar in dimension) at Easons bookshop in town.
