AOS in this case refers to 'Affidavit of Support', not 'Adjustment of Status'.

My Joint sponsor filled in the I-864 July 2010. I have had to wait to turn it in due to crazy circumstances and I have all her information from months ago (pay slips, and application). I'm about to send everything in and I noticed on the top of the I-864 form it says expired 10-31-2010. I looked at the new form and it is EXACT same thing, just with 10-31-2011 as the expiry date. So.... Will I have to have my co-sponsor re-fill in the information with the "new" form? Also, do you think I should get new pay slips or will her old ones work.

I believe you should be fine with the 2010 edition. Even the USCIS website still quotes the 2010 edition and still accepts ones from 2006 and 2007. http://www.uscis.gov/i-864

As per payslips, do get the most recent ones from her. And even the info she filled in the form 6 months ago, are you sure nothings changes since then. I will advise you have her fill this over again just to avoid an RFE... a form with a signature dated 6 months ago...

1) Does your co-sponsor have to live with you? Would I have to live at my parents to use them as a cosponsor?

No, you dont have to live at the same address as your consponsor(s)
2) Would one of them submit for both names, and use only their income? My parents both work and I believe file taxes together. So would I include their joint three tax returns? Would my co-sponsor on one form be both of them?

If the income of just one of the them covers the requirements then only one of them need be a co-sponsor and fill out the AOS form. The one person will send their tax return even if the other person's name is included.

3) Bankruptcy. My parents are now financially secure after getting some things figured out, and have the money in their bank and steady jobs, but have been in bankruptcy for a year. They don't check credit of co-sponsors, correct?

I am not sure about this.

4) If I changed my address and no longer lived with my co-sponsors (if I had to live with them to have them as co-sponsors), is that an issue if I changed my addy later on?

Living at the same address is not an issue. You dont even have to be related to the co-sponsor(s)!

Certified copies are NOT THE SAME as notarized copies.

Certified copies of the documents are the copies given by the issuing bodies. In most countries the certfied copies are what is referred to as originals. No photocopies. All will returned at the interview stage. Of course make copies for yourself and keep before sending the originals off.

I was in the exact same situation. I sent everything off without the Police certficate and wrote that I would send it on when I receive it or bring it along to the interview but this wasnt ok with NVC. I got a checklist from NVC asking for the Police cert to be sent. So in the end my case was just stuck there until I got the cert and sent it. My case was closed after they got the cert.

So you might as well just wait and send the IV package after you have everything. There's nothing stopping you from sending the I-864 though, so it can be reviewed in the meantime. Good luck!

You can send the DS3032 by email, no barcode needed. Just an email(FROM THE BENEFICIARY) to NVC stating your choice of agent.

How does this work now? Do I fill out my forms (affidavit of support, tax returns, and whatever else is needed) and send it to my wife, and then she includes it with her forms? Or how this works from now on?

Also, I was wondering if any further evidence of our marriage will be asked for, or this is all over with I-130 approval? Is she going to need to submit any evidence with NVC package, or maybe take some to her interview once it comes that far?

**The Affidavit of Support(I-864, and supporting docs:tax returns, pay stubs etc) is to be filled out by YOU the petitioner(and the joint -sponsor if you will be needing one)
**The IV package (DS230 form) is to be filled and signed by YOUR WIFE, the beneficiary.

Your AOS cover sheet and IV Cover sheet will each have an address that the package must be sent to. If the addresses are the same, yes you can send them both at the same time but obviously you will need to separate each package and attach the appropriate the cover sheet for each.

You say the I129F is on its way, it is rare the I129F will leave NVC however I strongly suggest you have your wife interview for the CR-1, even if it is slightly after the I-129F interview

Yes you are right canadian_wife,129F is pathway to K3 which is no longer used. I believe the 129F will be adminstratively closed and the I-130 continued.

When USCIS approves I-130 they will forward to NVC(also in the US)
When NVC has finished processing they will forward your case to the US Consulate in your country.

We have got all other Forms/ requirements in place and ready. I can submit Original BC as it is during Interview. My follow up question is. Did you get your 1-30 from approved without it? Is there any Filers out there who can assure us of this experience?


I am the beneficiary and I got my I-130 approved without my birth certificate at USCIS.

HOWEVER, it is one of the required civil documents when you get to the NVC stage. You will need to send it with IV/DS-230 package it but if you know it is not acceptable as it is, you will save yourself valauble time by requesting another one from the relevant body in your country of birth. You have approximately 5 months(without expedite) between submission of I-130 and the approval and forwarding to NVC.

From what I've heard from most other consulates, it doesnt make a difference bringing your USC child. But then we are talking about Almighty Lagos consulate... :whistle:

Will I receive the I-864 package even though we haven't payed the Immigrant Visa Bill yet?


You dont need to get a 'physical' package from the NVC. Once you have paid the AOS bill, a cover sheet should be available online for you to download and print and include with the package to be sent.

There's no clear-cut answer for this one. The approval or otherwise is at the discretion of the CO at the embassy. She will have to have strong ties/evidence to show that she intends to come back and wait out the I-130 process. She can apply but no guarantees...

Going though Lagos you don't want a CO asking where your spouse was born and you failing because it is wrong on the forms.



I believe its the other way round. The USC wife put down the wrong info for the NIgerian hubby. Sure Hubby knows where he is born but if his answer differs from the forms then there's trouble...

Better to correct the wrong info at NVC. Write a cover letter explaining the need for the change.

I think you are right to be confused. I'd advise that you contact USCIS and make some enquires. Your case might be getting mixed up with someone else's. Yes they do have their generic letters, but it would relate to your case. Getting the text you described when you are at NVC is out of the norm for IR1/CR1.

Just to add my two-pence worth.

A few years ago when I first got married to my husband, I wasnt a naturalised irish citizen then, I only had my nigerian passport. AFTER we got married I applied for a TOURIST VISA and it was approved. I was truthful about everything, I wrote in the form that my husband is a USC residing in the US. On the day of the interview the CO asked why I was only applying for a tourist visa and not the immigrant visa, I told her I wasn't ready to immigrate yet but I want the opportunity to visit my husband regularly.She wanted to establish that I have strong ties to Ireland and I showed proof of my job and property ownership and that was the end of the interview:approved. I must mention that it wasnt a first-time application, I had visited the US a number of times before on a previous tourist visa.
It is possible to apply for and be granted a tourist visa when married to a USC but be ready to show strong ties to home country.

My husband went through a successful inteverw but was caught during the finger print and was asked to bring a proof of Identity before 2005 becos he's been to the US embassy wit different name on a passport arnd 2005..

The counselor asked him which is his real name? the one he used during 2005 interview or the one he is using now. he told the counselor the one he is using now, so the counselor ask him to bring a proof of this current name before 2005. I pray the approve his visa.
