OP, dont think you should bother with the Dublin route. I just returned from a trip to spend thanksgiving with hubby in the States.I travelled with Air France so no pre-clearance. At POE (LAX), I answered every question truthfully: here to visit hubby, staying for a week, case at NVC etc. I wasnt asked for further proof and was granted entry.

There is no problem with travelling while your I-130 is pending.

I travelled to the US a couple of times while my I-130 was pending. I have travelled once after my I-130 was approved(I'm at NVC stage now). I was truthful at all times saying I was visiting my husband. They usually ask if I'm in the process of moving permanently and I answer that YES, but this is just a visit.I wasnt asked for further proof on any of the occasions.

Having said that I had a lot to prove that I was returning although I was never asked to show these. So my advise is be fully prepared to prove you dont have the intention of staying beyond your visit, just in case you meet with a particularly difficult office.

**I am a dual citizen (VWP country and Non-VWP country), I always travel to the US with my Non-VWP passport with the US B1/B2 visa in it.Reason: Visa holding visitors have more rights at POE than VWP passport holders.

Financial Evidence usually has something to do with your Affidavit of Support. Unfortunately you wont know the specific information thats missing until you get the letter or you speak to an operator. The operator lines are open now, start dialling. Good luck!

It does take about 2 weeks at least to review the checklist response, sometimes more.
Interviews are usually scheduled around the 2 nd week of the month so if your case is closed before then, you may get an interview date, if not you get your interview scheduled the following month.

I have visited the US a number of times since the start of our CR1 journey. I have dual citizenship and I have a valid tourist visa on my non-VWP passport and I have always travelled with the tourist visa since I learnt I have more rights at POE with a visa than travelling under the VWP. I have been lucky enough that each time I tell the officer at the POE that I am just visiting my husband, they believe me and let me in.

I will advise that she has STRONG evidence to show that she intends to go back to her native country and that the trip is just a visit. Having said that it all depends on the officer at POE.

Hi all,

Today I discovered that I had placed in the wrong order my wifes names (first, middle, mothers last name and fathers last name) on our application. I had the parents last names listed in the wrong order. All correspondence from USCIS and now NVC references her name in the wrong order, different from our marriage certificate and her Passport.

I plan on calling NVC tomorrow but I am wondering if any one has had this happen before and God forbid has had to start the entire process over or is it a simple change?

Something similar happened to me except it wasnt my fault but NVC's. The names were right in USCIS but by the time the case was transferred to NVC it was entered into t he system wrong. When I called I was asked to send a photocopy of my passport that shows the correct spelling and order. They rectified the mistake once they got the documentation.

I'd say make a copy of the marriage cert and passport and send in to them with an explanation. Remember to add cover sheet with the case number.

Any kind of medical evidence has to come from the consulate approved physician. When you go for your medical exam your pregnancy will not go unnoticed! Or you can let the doctor know you are pregnant and you want to be sure he will indicate that in the report.

The marriage cert is just the basic. You need at least one more additional eveidence. Below is taken from the I-130 instruction leaflet:

NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may evidence that bona fides of your marriage:
E. Documentation showing joint ownership or property; or
F. A lease showing joint tenancy of a common residence; or
G. Documentation showing co-mingling of financial resources; or
H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or
I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or
J. Any other relevant documentation to establish that there is an ongoing marital union.


On the USCIS site it says that "you should send proof" etc.I don't get it what wrong with this lawyers,i'll say to my husband to call her and see what's going on

this is 100% correct. i tried getting my wife a tourist visa TWICE and both times the interview abruptly ended after the consul found out she was married to a u.s. citizen. :thumbs:


Well, there is no harm in trying. I currently have dual citizenship, one non-VWP country and one VWP country. Before I got my Irish citizenship and after marrying a US citizen I still applied for a B1/B2 visa on my non-vwp passport and I got it, and yes I told the officer that interviewed me that the purpose of the visa is to visit my husband. She asked whether I was planning to immigrate eventually I answered yes but that I wanted to be able to visit pending the outcome. She asked for evidence to show ties to Ireland in the mean time and I showed I still have my job, own a property and other business interests and she approved the tourist visa. I got my VWP passport after that but I dont even use it when travelling to the US because from what I heard travelling on a tourist visa grants you more rights at POE than the Visa Waiver Program.

That could be a good idea. At first we thought I could enter the US on a WVP for 3 months while the visa is processing, but now that we know it takes about 6 months to process, we might consider staying here until the VISA is ready.

Just to prepare your mind it could take longer than 6 months, the USCIS stage alone is avergaing 5 months now. You still have the NVC and embassy stages after that.

May I ask how you managed to convince them? How did you prove your intention of returning?


I have to say my case has been one of the exceptions rather than the norm. When I get to the officer as usual they will ask the purpose of the trip and how long one is staying. My answer has always been "To visit my husband and I'll be staying for the next..." 1 week or 2weeks as the case may be. I think once I have been asked if I have started the immigration process and I said yes, the other times no further questions were asked :dance: . At no time have I been asked to show evidence that I will be returning to Ireland. Although at all times I had documents to show IF they had asked: Return ticket, letter from employer, docs to show I own a home back home etc.

HAVING SAID THAT, this is just MY OWN EXPERIENCE. I have read several times on this forum of people being questioned and grilled for hours before being let through :bonk: , and of some being turned back at the port of entry :crying: .

I will end again saying there is NO GUARANTEE.

As mentioned earlier you can attempt a visit but there is no guarantee of entry.You have to satisfy the officer at POE that you have intention of returning. I have visited my husband a number of times in US since we started this CR1 journey and thankfully I have had no problems.

If you are going as a tourist and you intend to return, and you have evidence to prove this, then you can 'attempt' there is no guarantee you will be let in at the port of entry. If you enter on a tourist visa with intent to immigrate it is visa fraud

All the original civil documents would be requested at the NVC. If you send all the docs to NVC you'll be taking minimal docs to the interview because NVC will forward your stuff to London at the interview stage. You'll just need to take copies of whatever you have sent and then your passport,passport photo, medical exam results,additional eveidence of your marriage...

Do you live in the same house with your father and brother? i.e. household members.

If your father is the joint sponsor, whether he fills I864 or I864a depends on whether you live in the same house.

I have some questions about the form I-864 Affidavit of Support form. I am currently a student and I am not employed. I will be using my father as the sole sponsor. My questions:

1) Is my father the one who has to fill out the I-864 Form?

2) My father has to sponsor two people(my spouse as well as my brothers spouse) and I do not think that he can sponsor them both just with his income alone. My father owns two houses, a certificate of deposit, and savings. Will these assets count towards the income requirement? (Remember he will be trying to sponsor two people).

The reason I am asking this because I do not want to have my application delayed because of the sponsor part.


First things first, whoever is the petitioner has to be a sponsor even if they have ZERO income, then they can now get a joint sponsor. If you are the petitioner for your spouse, you are the sponsor and your dad will be a joint sponsor and you both have to fill out separate I-184 forms.
