I know the logistics... it just gave me something to do....lol... As for the all the difficulties of documents filed..all we had to do was send in my divorce certificate nothing complicated...

I know ours will be soon.

I-129F - $340
Interview Fee - ~$300
AOS - $1010
Work Authorization - $380
Plus travel fees to the interview/medical

AOS - $1070
Work Authorization - free if applied for at the same time you Adjust Status (also pretty much useless to apply for before you adjust status)
Medical (Vancouver consulate) - $350 or $300 if pregnant
Vaccinations - ~ $50.00 +
Passport photos - ~$40
Long form birth certificate - ~$40
Criminal Record Check - ~$40

I had a few other expenses like developing photos/taxi to medical but that was all about $100.

On all of your forms for K1 petition you need to make sure that you tell them you were denied entry from the US. It will probably ask you why and if your story is exactly how you say, you should answer something like "Lack of ties to returning home". When you travel, you need to demonstrate that you will be returning to Canada, which obviously you didn't have any evidence of when you were refused entry into the US.

You may want to ask other VJers about what you should write exactly. Just don't lie and say you weren't refused entry because that would be even worse when they found out.

Once you get your visa you shouldn't have much (if any) hassle crossing the border.

That's kind of a personal question that you and your fiance will need to talk about and decide for yourselves.

Things to consider:

- you'd have to have 125% of the poverty income for 3 (you, fiance, child) if the baby is born before your K1 is complete.
- you'd have to be financially prepared to pay for the expenses of a child on top of the fees for K1/AOS/Moving.
- the baby could be born before your fiance(e) reaches the US.
- you'd have to be able to afford medical insurance for your fiancee and child to cover the cost of birth in the US (expensive)
- you'd have to be able to pay for all dr. visits before the child is born.
- stress of K1 process might be overwhelming when pregnant

You could either postpone the interview or go without the certificate. I *believe* (but could be very wrong) that if everything else goes okay they would just delay approval until they get the certificate (kind of like people who interview before they have their medical).

Your best option would be to call or email the embassy and ask them what you should do.

Okay, I only read page one but I think a lot of these replies are way off.

Could he have cold feet? Yeah, it's a possibility.

HOWEVER:

My fiance and I have the very same concerns about our financial stability. The economy in the US right now isn't very good. My fiance lives in California where (last time I checked) it had 11.9% unemployment. That's insane!

Right now I work super hard managing a store and make a decent income that could support both of us rather easily. If he had a job we could be quite comfortable. Instead, I'm planning to abandon that and move with no job security and he doesn't have much job security either. I think these are very LEGITIMATE concerns that you should not necessarily see as "him having cold feet".

Your fiance sounds like he wants to provide a good life for you and your children and is apprehensive bringing over an entire family where the only income he has is his own. Will you get a job? probably, but that won't happen immediately and he's worried about it. Talk to him about finances and budgeting. Talk about how much money you're going to bring over. Talk about your plan for getting a job. If you have good communication with each other I think you will both feel a lot better.

I've already answered your question twice.

Will they deny you outright? Probably not. They will probably request your 2010 tax return and delay visa approval until then. In that case, your fiancee would have to return with the proper information and they would look it over and approve you (or deny if it did not meet the requirements).

Since you have no idea what your accountant is doing, I would get a letter from him explaining why your tax return has not been filed. As others have mentioned it just plain looks bad if you are beyond the time in which you can file. You need to demonstrate that you have attempted to file. Still, I think you are negligent in not knowing what the heck is going on with your tax return.

There is no "definitive" answer to your question but I have done my best to answer it a few times now. Good luck.

Your friend might also want to wait for a little while before she decides on withdrawing her petition. Her fiance has 6 months from the date of issue to come and she might change her mind. If it expires/is withdrawn they would have to start all over again from scratch....

I believe that she would need to withdraw her petition by writing a letter to USCIS and explaining the situation. If they change their minds about getting married in the future it shouldn't be a problem to re-file for a K-1 visa and withdrawing the K1 shouldn't have an impact on his chances of getting a tourist/work visa in the future.

Others may have more definitive answers but to my knowledge this isn't a huge issue. They might question them if they decided to file for a K1 at a later date but I'm sure if they explained the situation it wouldn't be a problem.

You need:

MMR - 2 shots to complete the series (so 2 shots in your lifetime)
Varicella - 2 shots to complete the series OR NONE if you had chicken pox
Tdap - 1 shot every 10 years
Influenza - 1 shot ONLY if between October and February

If you have not had a Tdap shot within the last 10 years you need to get it again.

Thank you duke and gary for your help. I will send a fax to the embassy to request for the extension of the validity of the approval notice that was sent by the USCIS. Better to send a fax than just talking to an agent at the embassy. :)


It is very simple to e-mail the consulate *in my case, anyway*. My advice is to keep it VERY simple because it took me 3 e-mails (the third e-mail being about 1 sentence long) to get the correct response. Here's what I sent (I followed their format for how to communicate with them via e-mail though it may be different for other consulates):

Thank you for the information. I booked my interview for October 7, 2011 and would like to confirm that my application will be extended automatically. Our letter says that it expires September 29th, 2011.

You asked the same question in another thread, and another member directed you to a similar thread. You should read through that one, I think it will help you a lot. You basically need a letter from your doctor or psychologist saying you're being treated and that you are unlikely to self-harm in the future. I'm not trying to scare you, but you have to understand they want you to be safe and able to cope with a life altering transition. If you are getting help it should work out in your favor because you were brave enough to seek help, which demonstrates that you *want* to get better.

It is still an on-going condition that they would need to be aware of at the medical. You need to bring medical records of any on-going conditions/prescriptions/treatments.

Medical is very simple. Blood test, Xray, and a physical exam by a doctor. They are mainly looking for communicable diseases (ie. Syphilis, HIV, etc) or other reasons that may make you at-risk for being a burden to the US government. If you're healthy you have nothing to worry about.

Everyone's is different. You really only need to describe your "meeting in person". It should be pretty brief. My fiance wrote the following on our application:

"Holly and I first met while playing an online video game. Originally we were just friends who occasionally played together. However, over time we spent more time with one another. In late 2008 we became close friends. In January of 2009 I made a joke that I should come up to Vancouver and we could spend a weekend together, eventually this joke turned into an actual plan. My first trip to meet Holly began in June of 2009 after my classes had ended for the semester. I drove my car up the west coast. It took three days of driving to reach the border and soon I made it to her apartment. From the moment we first met one another in person I knew this girl was special. I had originally planned to stay there for only two weeks, but two weeks quickly turned into five. Having a card from your Influenza is fine as long as it shows the date and the dose. You can only get Tdap at the travel clinic downtown Vancouver. *However* since you had your last Tdap shot in 2006 you are covered (you get Tdap once every 10 years). Just make sure you bring proof that you had your Tdap shot in 2006. If you want to be absolutely sure e-mail Woking Medical and ask them if having Tdap done in 2006 will make you covered for that immunization but every person I spoke to before my medical said once every 10 years.

I don't really recommend going to the travel clinic because they gave me my Tdap shot in the wrong spot which caused me to get a welt the size of a baseball (NO JOKE) for a month!!!

Misuse is defined as "abused" in the dictionary. It's asking the same thing. Hence the reason they need to change this question. It's misleading. I don't think OP's fiance "lied" he answered it as it was worded. Pretty sure if it asking if he "tried" drugs he would have answered yes.

Again, I'd bring the letters and have a good explanation for why he answered no. Asking for legal help isn't a bad idea since clearly some people think this question is straightforward.

My point was it's completely different to ask someone if they've "tried drugs before" or "misused or abused drugs". As long as you explain the situation to their satisfaction you should not have any issues. You can fund the process, but you would need to send her money for sending in the petition. The rest of the steps are all things you can pay for yourself. (My fiance and I split it up with him paying for the petition and me paying for everything else because I make more money)

Yes, you will need a co-sponsor if your fiancee falls below 125% of the poverty line. Yes, it is still a K1 visa. You cannot sponsor yourself.
