Best bet is to go to her and engage there. Your going to keep getting denied if your not even engaged, they don't care what her family thinks because the visa is for her and you are the only other person that matters in the filing.

you will have to file I-90 for a replacement under lost or stolen GC before you can apply for naturalization. I don't think a police report is necessary, I didn't do it and i got another GC just fine and just got my naturalization.

I just read the original post again and realized the nonresident filing options don't apply in this case. My apologies.

 

If you qualified to file married-joint in previous years, unless you separated for 6 months in 2012, your wife is not eligible for HOA in 2012. Was she advised to file HOA?

Why would one file HOA instead of Married filing joint? The standard deduction is higher

From what I've learned, it's not black and white. Everyone has different situations/factors that dont always situate them into the norm, so I'm not able to say why one would choose this way or that.

 

I encourage anyone to not only file their taxes with firms they trust and have good records (or to be well-informed if they are filing themselves), but also be in contact with IRS directly with any concerns or questions. This way there's no guesswork.

You might be able to file as head of household, if you are married to non-resident alien. See here:

(I do not remember whether it applies in any case, or only if you lived abroad - I guess should be in any case)
However, if your spouse did not have any income to report during the year, then filing married filing jointly is usually better for you then filing as head of household

As for the main topic of the tread - honestly, a laymen person, without too much tax and general law experience, with probably not perfect English, in a stressful situation of the interview, is offered to make a complicated yes/no decision on the spot in 1 minute about whether to withdraw the application.. Based on the suspicion(!) of the immigration officer that he either probably did tax fraud or probably was in fact separating from his wife. I find the whole story unsettling. To me it sounds as if he was simply intimidated into withdrawing.
Now, it might be that his situation is clean, or it might be that suspicions of the immigration officer are correct, but that is a different story.





 

Oops, just saw that you had posted it already! I am currently a nonresident alien, living in the US with my USC husband, not employed (obviously), with a qualifying dependent. If the op's case is similar to ours they should not have had any problem.

 

Unfortunately, this rule isn't widely known. Until we were informed of this, we had no idea we qualified for the benefit. Maybe the IO wasn't aware of this either.

You are considered unmarried for head of household purposes if your spouse was a nonresident alien at any time during the year and you do not choose to treat your nonresident spouse as a resident alien. However, your spouse is not a qualifying person for head of household purposes. You must have another qualifying person and meet the other tests to be eligible to file as a head of household."

I have confirmed this with several tax filing agencies as well as IRS directly - it is not widley known, unfortunately (probably due to the amount of abuse it would get?). The link above is direct from IRS website. There are instances where a USC married to a nonresident alien can file head of house. If you fit the criteria, maybe print out the page, contact IRS to get verification on your tax situation specifically, and see if you can get anything directly from them printed out to provide as evidence towards your immigration case.

Well first hiccup in this process, so needing a little advice. 

 

We filed back in September, had a smooth approval on November 12th.

 

Took some time getting to the consulate however due to the delays we've all been seeing with USCIS forwarding.

 

Anyways, my fiancee just finished her health check in Osaka as required, and is scheduled for her Visa interview on the 10th or the 17th of March, which is currently tentative.

 

The problem is that our approval is only good from 11/12/2013 - 3/11/2014.

 

How do we go about getting an extension? Do I need to contact USCIS, or does she need to contact the Consulate in Tokyo?

 

Please let me know.

Not true. The visa expires 6 months after the date of issue. They will write an expiry date on the visa itself. For example: I had my interview Oct.7, 2011. My visa was issued Oct.10,2011. My visa expires April 10,2012. My medical was Sept. 14th, 2011.

Your lawyer is suggesting immigration fraud. Moving back to the US with the intent to get married is considered fraud. I wouldn't do it.

And yes you do have little knowledge of waivers so it would be best not to tell someone you highly doubt they could get it. 70% are approved in Mexico.

This is confusing. Why did you file the the I-130 if you're planning to move to Canada? If you move to Canada he is not eligible for a green card because he isn't living in the US. You cannot maintain a green card while living in another country. It's not possible.

If you decide to move to Canada you will probably have to wait out his ban. Depending on how much time he has accrued illegally in the US he could face a life-time ban not just a 10 year ban. If you stick it out in the US and wait for your I-130 to be approved and get his green card he can eventually get citizenship. If you move to Canada this makes this pretty darn unlikely.

I guess you need to weigh your options. Move to Canada and possibly never be able to move back (or wait at least 10 years). Or, wait it out in the US for a few years until he gets citizenship. I highly doubt a waiver would get approved in your case, but I can't say much about that since I have very little knowledge of Waivers.

I understand people's responses may sound "hostile" but most people are trying to help you. If you doubt what people are saying do some reading on what could happen if you decide to go through with your plan.

The instruction says "If a final decision has been issued, submit form G-884 to the USCIS office or Service Center that took the last action on your case" The last correspondence I received from USCIS was my Green Card which had the receipt number SRC#########.



Can someone please confirm whether I should be filing this form at the Texas Service Center and which address I should use.

It wont hurt if she brings in documents showing ties to the UK. The USC husband can also bring a few docs to show he lives in the UK and is just visiting the US.

Their case should not raise any eyebrows at all.

We were approved yesterday! We are thrilled and believe it's nearly all over but we do have a little delay. We had a co-sponsor (my father in law), when we spoke to the NVC they asked my wife (USC) to send her birth certificate as proof of relationship between her and her dad, which we did. We even phoned a week later to check everything had arrived and everything was okay and were told that everything was fine, present and correct.

Yesterday at the interview they asked if we had evidence of co-sponsors US citizenship, which we did not. The guy that gave me the interview gave me all the required details, DX Courier telephone number etc and assured me that it does not take long once they receive the certificate and passport.

So excellent news, we were surprised just how easy the interview was. I had 2 question!
