So I got married - yay!!! Now preparing for AOS - yay more paperwork!

Rant: I got my 2nd vaccination for Varicella done AFTER my medical so now I have to get a civil surgeon verify my immunization record. Lowest price I've been quoted is 70$. I wish I waited.... Every Dr's office I call tries to get me to pay for a physical/blood work/x-ray.

Question 1: Has anyone found a civil surgeon in the Los Angeles area that will verify my Vaccination record for UNDER $70?

Question 2: When we got married we got a "Customer Copy" paper that says "License and Certificate of Marriage" -- is this enough to use as our Marriage Certificate or do we have to wait the 6-8 weeks for them to mail our certified copy? (Yes, I am aware that we may get an RFE if it is not a certified copy)

Well I bought one I saw on that website after going through a few different plans. I decided to get up to April 30th just in case it takes me a little while to find other insurance but most plans give an option to extend if you need to. Hooray, one less thing to worry about! Thank you again :)

We're going to wait 1 month until we get married and I believe after that I will be added onto his work's health insurance but I'm going to do some research because I want one with a good maternity plan.

So I'm having some trouble finding medical insurance to cover me during that awkward phase when I am no longer a BC resident, and don't have American Health insurance..

Where did you guys get your coverage? Every time I try to get travel insurance it asks if I am a Canadian Resident covered by MSP. In my mind, my residency expires when I leave Canada. I also called and cancelled my MSP (ending Feb.29). I'm considering telling them I won't be leaving until March 31 (to give me time to get health insurance in the states), but I feel like I'm playing a dangerous game assuming they will cover me when technically I am no longer a resident.

What the heck do I do? I'm leaving on Sunday or Monday.

I wore what I used to wear to work as a Manager. I guess you could call it business casual - leggings, tunic, baggy sweater and some knit boots.

Just wear what you're comfortable in. As long as its clean I'm really sure it doesn't matter!

Edit: I also wore a big scarf. Now that I think about it less is better: they made me take off my scarf and sweater because it was bulky I guess. That added some more time to the process.

yeah just make sure to put the date in of when you met.

We met in Hawaii in January of 2010 - for example. Just make sure you include a date within the last 2 years (since you met originally in 08). Ie.

"we met in hawaii in january of 2008. We have since started a long distance relationship where we visited back and forth. Our most recent trip was when XXXX visited me in Vancouver in February 2010"

- I saw you mention something about the olympics so I'm just assuming :P

Holly and I first met while playing an online video game. Originally we were just friends who occasionally played together. However, over time we spent more time with one another. In late 2008 we became close friends. In January of 2009 I made a joke that I should come up to Vancouver and we could spend a weekend together, eventually this joke turned into an actual plan. My first trip to meet Holly began in June of 2009 after my classes had ended for the semester. I drove my car up the west coast. It took three days of driving to reach the border and soon I made it to her apartment. From the moment we first met one another in person I knew this girl was special. I had originally planned to stay there for only two weeks, but two weeks quickly turned into five. We went camping in Tofino, visited her cousin in Victoria, and I met her father, brother, and grandmother in Salmon Arm. Since that first trip we have regularly visited one another every three to four months. Holly agreed to marry me when I proposed to her in July 2010.

*It just needs to be a very simple statement. Always best to go with the 5 W's (who, what, when, where, why!). Our "how we met" statement is probably more elaborate than even they want it to be!

*Sounds like they want primary evidence ie: boarding passes, passport stamps, receipts etc. I believe you can get a record of your trips if your passport hasn't been stamped but I can't remember how. You should try to look back into your visa credit card statements or something and see if you can find any charges at that time.

It takes at least 3-5 business days for the waybill to show up (at least it did for me). You simply log into the same website you booked your appointment on. If you leave them with your e-mail address at the interview it should email you updates on the status of your visa/passport.

You can get them done at the same time. If they aren't given at the same time you need to wait 1 month between each. You need 1 shot of MMR and 2 shots of Varicella if your titre test shows you are not immune. If you don't get both Varicella shots done before your medical they will mark your form as incomplete (this happened to me).

I am planning to send proof of my second shot along with my I-693 form when I file for AOS. If I get an RFE then I'll see a civil surgeon, but other VJ members have said they've done it without getting an RFE.

Yeah, the questions get tiring from friends and family, but they mean well. When it actually came time for us to get married people only got a month and a half notice and my whole family came. It made me feel super special :)

Vancouver emailed me packet 4 (its basically just instructions on how to book your interview). They normally mail it to you though. I annoyed them into emailing it.

I probably can't expect packet 4 yet because I still need to send them the checklist, but hopefully that won't take too much longer. I've been corresponding with someone at the consulate (they are indeed quick) and mentioned that I faxed it in, hopefully they'll confirm that they received it.

Oh, they don't confirm the DS-230. I thought you meant the whole packet 3. They will confirm by sending packet 4 via mail once they receive your checklist.

If you're still there go withdraw some money and get the receipt. I find it hard to believe you've done nothing that would act as proof. Receipts for anything will work. Go see a movie together. Go to dinner together. Use your visa somewhere. It isn't very hard.

If you're driving, submit receipts from gas stations along the way including the city your fiance lives in.

If you absolutely have no proof, you need to start saving EVERYTHING. Even if you just buy a bottle of water. I'm still saving everything for when I file for AOS. It's habit now *just in case* they try to question things.

The medical is a joke. They take your blood, take a chest exam (undress from the waist up), and then the doctor basically looks you over (in bra and undies). They look in your ears/throat and move your arms and legs a bit, listen to your chest. Then a simple eye exam + height and weight.

You are able to book your interview date yourself. It does not book it for you. You can have your medical the same day as your interview. You would just need to go back and pick up your medical results at 1pm and return to the consulate. When I had my medical a guy did that and it was fine.

I would rather do my medical the day before my interview. Woking medical only books on Wednesday. I would do a Wednesday Medical/Thursday Interview but that's just me.

It took about 6 weeks for me to book my interview after I had my medical. I could have booked it sooner, but I didn't want to book it until after I had my medical. Wait times depend on how many people are being interviewed, so it is hard to say how long it will take you.

It takes about a week or 2 to get your passport back. You can pick it up at a DHL location or they can send it to you for an additional fee (adds a bit more time to get it if you choose this). There are more detailed instructions when you book your interview.

In that case, she should probably also find out if there is a waiting period in her province for health coverage to kick again in Canada. Some provinces have a waiting period.

She never told them she was leaving so her address is still in BC. I told her a while back she needed to cancel it but she didn't do it.

Okay, this is kind of a weird one. My best friend's husband just got a job at a university in California (yay!!!). My friend is about 5 months pregnant. His job begins in August, and she is due sometime in September. Unfortunately, he just found out that their health insurance will not start until October 1st. She's not sure what to do at this point. I'm trying to research getting insurance but I have no idea where to start since she is already pregnant - would insurance places even cover her?

Her other option is to have the baby in Vancouver. She still has Canadian health coverage. I'm just concerned about how long it would take her to come down here once the baby is born. Would she not have to get a passport/visa for the newborn? She would rather have the baby here in California so she can be with her husband, but they don't want to pay thousands of dollars.

What are her options?

I'm reluctant to speak in absolutes but I'm fairly sure that income requirements are waived for Canadians sponsoring spouses. I can't find it written on an official website anywhere but forums for US to Canada immigration seem to be agree on this. I could be wrong though, I'm not really familiar with it.

You need to look at it from the government's point of view. They want to be CERTAIN that your spouse will not leech from the system. They don't know you or your spouse, nor do they really care. They just want to know that if your spouse leeches from the system they can hold someone accountable. That someone needs to be making enough money TO BE ACCOUNTABLE. So yeah, it looks better if they have been working a steady job for a few years. Your mother would probably be fine though since she worked most of her life and paid her taxes. They do know life happens. Worst case scenario they would issue you a RFE (Request for Evidence) and make you get a different sponsor if she wasn't making enough money.

This really isn't my business, but are you sure you are ready to get married and go through all of this legal stuff? Sounds like you are both in school at the moment and both of you rely on family to support you. My husband and I did the same, but didn't start our paperwork until I was finished school and he was really close to finishing school. I busted my butt for an entire year (almost 2) working and saving money before we filed BECAUSE this is expensive and BECAUSE my husband was in school. I lived in Vancouver (expensive) and still managed to scrimp and save close to 10k before I moved here. I only have about 6k left (been here since February) and I've only paid for the wedding/visa stuff/Groceries as well as a few random purchases. Please don't take this as being judgmental, I just want you to know (from someone who has gone through this) that it is a long, stressful, and expensive process. You're worried about a co-sponsor but you need to be worried about how you will support yourself and your wife once she moves. I refused to move until my husband got a good full-time job. I didn't want to give up my decent paying job to come down here when he was working part-time. I wanted to be with him but I also want to be financially able to support myself. I almost didn't move because he was slow to get a job, but in the end it all worked out and he got a job that can support us both. That said, you haven't said much about your plans (nor is it my business), I'm just concerned for you, that's all.

The deciding factor in all of this is what's easier, and what's going to actually allow us to be together. We're both completely willing to move. All that matters is being together. How different is the process if I wish to become a Canadian citizen rather than my honey becoming a U.S. citizen?

Most people here don't know too much about that. I believe one member (Colleens [?]) recently moved back to Canada with her American husband so she may be able to provide more information. However, from the research I did when we were still considering our options...
It takes a longer time to become a Canadian resident (I believe processing was something like 20 months!). That said, I believe you can live in Canada while it is processing (but you wouldn't be able to work). You would still need to prove that she can financially support you or find a sponsor. So really it's the same thing. I believe www.roadtocanada.com (?) is the website that would have more information for you.


I must stress again: weigh your options, read everything, and make sure you are READY (financially/emotionally) to go through with all of this. It is tough. Is it worth it? Of course.

My love is planning to visit, once again, for six weeks. This will be the first time that she's visiting without a return ticket. We ARE NOT married or engaged yet, and she also packs very, very light(one bag). The reason we got her a one-way ticket is because we planned on purchasing tickets to travel back to Canada together so that I could spend time with her and her family before I need to get to college in August. Is there any chance she'll get rejected since she only has a one way ticket? I've been worried about this, but she swears it's fine. She just plans to tell them she's visiting her best friend in Indiana and going there for tourism and plans to return with me in about a month or so. So, that's my first question.

NEVERRRRRR lie or misrepresent ANYTHING to a border officer. Your partner needs to tell the TRUTH about her visit. What has she been saying on other trips? She needs to say "I am going to visit my boyfriend." If she says she's going to visit a friend that is a lie. It makes your life a million times more difficult when you tell the truth, but it's much better than getting banned or turned away at the border. The best thing to do is arm yourself by bringing proof of ties to Canada. Each time I went to visit my boyfriend/fiance I always told them that was what I was doing. Each time I brought: a bank statement, letter from my employer stating I was on vacation, a copy of my lease, and a return ticket. I learned the hard way that you "have no right to enter the US, since you're not an American citizen" (yes, they actually said this). I was interrogated, pulled aside into a tiny room, and asked a BILLION questions (this was before I even met my husband!!!). It may be uncomfortable for us, but they are doing their job. So, a return ticket is a good idea but it is not necessary as long as she can prove she can pay for a return ticket home and is planning to return to Canada.

You can get married however you want, whenever you want, as long as you are both free to marry. What you need to get married depends on your state/county. You will need to look that up on your own. Just google it or phone your local Registrar's office. All I needed was my passport (government issued picture ID) but that was in California.


How soon will I need someone to be able to sponsor my honey? I take it that that's on the form?


According to the CR-1 guide on Visajourney (please read! http://www.visajourn...tent/i130guide1), you need the I-864 for the interview (which is after the initial petition is approved). So probably in 6 months after you file your I-130. I could be wrong because I am not completely familiar with the ins and outs of a CR-1 visa.

-She visits during June and July
-We get married while she is here
-I file for the I-130 when she goes back
-She plans to spend pretty much the entire process in Canada, with attempted visits(we'll try our hardest, but if DOES get declined, how soon can she attempt to cross the border again?)

They will probably tell you, but I don't think there would be much point unless she had more proof-of-ties to Canada. I never did a CR-1 visa so I can't answer the question about the interview but the interview is trying to make sure you have a real marriage.

FINALLY: Once we're married, what effect will this have on our lives? Aside from our marital status changing, what else is going to change? (I mean, legally.. taxes, etc) Since we won't be living together, is much going to be affected, or does that not really start until we live together?

It really only changes once you start living together. You can change your status to married if you want (my husband did that at work so they take less taxes off because he is supporting me [not eligible to work yet]). I believe you can file taxes as Married, filing separately but that is something you can search for on VJ because it is asked every year around tax time.

If you file for a K1 visa, you AND a co-sponsor fill out an I-134. When she adjusts her status (form I-485) you AND a co-sponsor would both fill out for I-864. This basically shows the government that your fiance(e) will not become a public charge (use food stamps, medicaid, etc.) If they so use any of those social welfare programs, the government, based on your sponsorship, can turn around and recuperate the money from you.

Here's my real world example:

In February of 2011 my now husband was working part-time and in school getting his teaching credential. He had part-time income in 2010. When we filed for my K1 visa my husband AND his father both filled out form I-134 (Affidavit of Support) to sponsor me. My now husband made 8k in 2010 and his father made around 70k.

Now we are filing for Adjustment of Status (form I-485 aka green card) and my husband now has to fill out form I-864 for my sponsorship. He now makes $30k+ so we can file on our own. My father-in-law wanted to fill a form out anyway, so both my husband and my father-in-law are sponsoring me. Although he's making a nice gesture (he literally insisted), they will only look at my husband's I-864 because they only use one sponsor if their income is sufficient.

If you're filing for a CR-1 visa, you AND a co-sponsor will need to fill out form I-864. You AND your co-sponsor will be legally responsible for your fiance(e). Your co-sponsor needs to make 125% of the poverty guideline INCLUDING the co-sponsor + your fiance(e) + any additional dependents.

Anyway, this is probably just confusing you even more. Definitely look at the guides. I found it really useful to write everything we needed in a list and I made a list of pros and cons as well. It will help you decide.

You most certainly can get married in the US but your fiance(e) or wife will have to return to Canada to wait it out.

First: you will need to earn (or have a co-sponsor who earns) 125% of the Federal Poverty guideline for their family size (how many people they support/live in their home). So, you need one US citizen (doesn't have to be a family member) to fill out form I-134 (Affidavit of Support) [K1 Visa] in order to sponsor your fiance(e). You do not need to be employed. You will also need someone to co-sponsor your fiance(e) once you get married [or file a CR-1 Visa] by filling out an I-864. Form I-864 is legally binding - ie. they are responsible for your fiance(e) for 10 years or until they have worked a certain number of years. Be sure you have someone who is willing to do this for you. Loans/savings don't count as much as income. I believe you need 4x the amount of assets (so if you need to prove you earn $20k a year you would need $80k assets).

Student visas are difficult to get mainly because she would have to prove she had the means to pay for school. The problem with your plan is that you have the *intent* to marry. So yes, having your fiance(e) come there in order to live with you and get married (eventually) is considered, as you put it, "working the system". I would call it visa fraud.

Trust me - I totally understand wanting to live with your future spouse right away but sadly that isn't how this process works. Once you have the *intent* to marry, all of your plans still have the *intent* to get married. Say she did get the Student visa and somewhere down the road they found out you guys had brought her there in order to get married using the Student visa.... bad news. The likelihood of that is really small, but it is a possibility all the same.

Just file for the K1 or CR-1 and get the process started. Honestly, the 7 months or so you will need to wait will allow him or her to tie up loose ends in Canada and visit friends and family. It's not fun but its better than having your family torn apart for committing visa fraud.

I would recommend doing a lot of reading on this website. There are guides to the different kinds of visas. There are comparison charts. Read, read, read. You're wasting your time trying to work around the system. Sorry this sounds a bit harsh, but part of the reason we all have so many hoops to jump through is due to people trying to beat the system. I am sure your intentions are good, and you will do things legally and honestly once you are properly informed.

They may question him at the border. Dui aren't taken lightly. I know people from seattle who try to come for a weekend visit and got turned away. Its like 1st time 5 years, 2nd is banned. That's what they said. Maybe apply for a waiver before he tries to go to US.
