K-1 Fiance(e) Visa Process & ProceduresWe Got Out K-1 Visa, But They Didnt...

well, I went to the site as suggested. However, it says "There is no information on the DHL Waybill Number at this time." I guess it takes a few days to show up.

Yes, I had my interview on Oct. 7 and nothing showed up until Oct.13. It may have taken longed because we had a Canadian Holiday during that time period. Not sure. But it did take about 3 business days for anything to show up.

K-1 Fiance(e) Visa Process & ProceduresWe Got Out K-1 Visa, But They Didnt...
I got an email from the Embassy and DHL with a tracking number which they called the Waybill number. It was emailed to the address I had on all of my forms.

You can also log on the website you used to book the interview to get the waybill number once your visa is ready. (for me, anyway)

K-1 Fiance(e) Visa Process & ProceduresDo I need a intent letter for k-1 interview ?
I would bring one just in case.

I was not asked for one at my interview, but it is one thing VJ suggests bringing so I did.

K-1 Fiance(e) Visa Process & ProceduresLetter of intent had an error....
They never asked for my fiance's letter of intent. If anything, just show proof you had a lawyer help you with the papers and explain that he made the error and submit the new (accurate) letter of intent.

Your fiancee will sign a form that is pretty much the same thing as a letter of intent at her interview. (or at least I had to at the Vancouver Embassy)

K-1 Fiance(e) Visa Process & Procedureswho in their right mind would sign the I-864????

The subject was about the specific requirements of the I-864, not a general discussion about who is sacrificing what. The question of the legal obligations that come from the affidavit is a valid one, and anybody signing it ought to fully understand what it means. Marriage isn't a trivial undertaking, and anybody getting into it should know precisely what it means in case it does not work out, because half the time, it doesn't.

PS - that Canadian health care isn't free.

Thanks for letting me know what the subject is, since it is becoming so convoluted in mudslinging that it's hard to tell the difference. I totally agree it isn't trivial and that people should know what they're getting into. But it sure sounds like people are planning their divorce before they're even married. It's ridiculous.

PS. Canadian health care is free below a certain income. Above that level it is heavily subsidized.

K-1 Fiance(e) Visa Process & Procedureswho in their right mind would sign the I-864????

Unfortunately, 50% of couples get divorces. The reality is, very few of the immigrant fiances hightail it back to their country after divorce. You just said it, you'd hightail it back to where you get free health care. Well, in the case of most the place they will get free health care is right here in the US... at the USC's expense potentially for the rest of their life. A ludicrous risk for a USC to take on... especially one that doesn't make a high income or has known his/her fiance for a limited period of time.

My point was that a lot of us are giving up things like free health care, jobs, and other services that are invaluable in order to join our fiance(e)'s in the US. We will have to work even harder to start over by getting new jobs and making new connections. We will have to make new friends, find new places to live, and be far away from part of our support system.

All of those things, to me, are huge sacrifices to make in order to join the person I love. It stings a bit to see people talk about this like they are the only ones making any kind of sacrifice. Both the USC and the beneficiary make sacrifices to be together.

Sounds like being bitter and/or exercising poor judgment causes most of the suffering the USC endures from divorce.

K-1 Fiance(e) Visa Process & Procedureswho in their right mind would sign the I-864????
Seriously?

This thread is getting kind of insulting.

I work my #### off every day. When I'm not at work I get calls from my employees and stress about not being at work. I bust my butt to save every penny so that I can contribute when I move for as long as it takes me to get another job. The only reason I'm giving up my job is to move to the US because I love my fiance. If we divorced, I'd probably high tail it back to Canada to get my free health care.

If the USC has the slightest fear about signing this for a fiance(e), I wouldn't suggest getting married.

Not all of us are leeches that want to exploit our American fiance(e)'s. Does it happen? Sure. How some of you are talking about it is offensive.

I think if two people are getting married because they love each other this is not an issue... Does ###### happen? Yes.

If you're this worried about it, you probably don't have a solid relationship to begin with.

K-1 Fiance(e) Visa Process & ProceduresUS Citizen Marrying a Canadian

Thanks for the prompt reply. They will be applying for the K-1. All she needs to do is go to Windsor, take a test, and come back to the US to continue her undergraduate studies.

Does the border INS patrol--coming back to the USA--typically ask all young females with a student VISA, "Are you entering the US with the intent to marry?" Will they be searching FACEBOOK or other Internet sites to see if there is any hint of her being engaged or even dating?

If she is returning to continue her studies then there shouldn't be a problem. Usually they ask "What is the reason for your visit?". She would just have to show she is going to school.

You might want to ask others if the K-1 is the right visa for them to get. As far as I know she could simply adjust her status from her student visa after she marries. Again, I would wait for other replies because my knowledge of that area is lacking.

Is she on a student visa?

If she leaves the US and returns on a student/B2 visa with the intent to marry and adjust status that is where the problem is. There are others that have much more information and knowledge about this, but my understanding is that she would not be allowed back into the US on the same student/B2/other visa with the intent to marry.

K-1 Fiance(e) Visa Process & ProceduresBit scared now, advice needed
I never had any RFE's but my understanding is that they will send an RFE if they think you didn't submit enough evidence to "prove" your relationship is real. As long as you submitted photos, plane tickets, etc with your petition it will probably be fine.

They never looked at any of my evidence at my interview, but all interviews are different. I brought everything I had from our original petition up until my interview.

Don't stress. It's a bit overwhelming at first but once you get sorted for your interview you'll think it was easy

K-1 Fiance(e) Visa Process & ProceduresBit scared now, advice needed

Having read some other forum posts (which be embassy depependant) it seems the initial petition should have HAD ALL proof of relationship. It had a lot but as much as we would have sent had we thought for a second it needed it ALL. I am the beneficiary and will be attenting London, i thought we got to take more documenatry proof then of our continuing relationship for them to consider, is this true???? heeeelllpp!!! :) I have LOADS to show them but just need a chance to :)

Just bring proof of an ongoing relationship to your interview. (plane tickets, pictures, chat logs, etc.)

If your petition does not have enough evidence they will send an RFE, and in that case, just provide them with what they ask for.

K-1 Fiance(e) Visa Process & ProceduresNicaragua embassy asking for items that are impossible to acquire

So today, 8 long months after sending in an I-130, my fiancee had her interview. The interviewer asked her why all the photos are dated from 2009 and 2010. She explained that before 2009, we were only friends. We have photos of us from 2005, 2006, 2007, and 2008, but nothing kissing or hugging; just standing next to each other smiling. Apparently a two year long courtship in which we lived on the same street for three months and have spoken on video chat every day since isn't enough for the embassy.

I'm confused, did you file an I-130 or a I-129F??? Cuz if you're not married and you filed a I-130 that might be your biggest problem...

Yes, there should be this clear maple leaf triangle thingy, then Jack Shewchuk's signature and to its right is a stamp that says "Vital Statistics Act" and below it "Certified extract from Registration of Birth filed at Victoria, BC, Canada...

Just make sure that your parents names are on the bottom because they do want your parents names on it (I think it says this in the description of the birth certificate in packet 3)

The BC ones have a big seal on the top right side of the certificate. I live in BC and before I got mine I called them and read the description of the type of certificate the K1 visa wanted and they sent me the appropriate one. If you're not sure you could always call them and ask. I'm not really comfortable showing off my birth certificate online though, sorry :x

Besides, I think they're different for each province.

I asked my fair share of questions that I now realize are quite obvious and people were gracious enough to answer me. I try to answer others' questions in order to help but yes, some questions seem quite obvious (ex. filing fees, address to send petition to..)

I guess that's why this website is here. We all gain experience and slowly but surely guide others through as we progress on our own Visa journey.

I am very grateful for the help I have been given, and as long as people show the same gratitude and respect, I have no problem with the questions being asked.

If you can't afford to visit each other semi-regularly due to expenses it raises a big red flag, in my opinion.

How will you afford AOS, vaccines, travel to the US, wedding, living together, food, kids, emergencies.... etc.

I'm not exactly rolling in money (neither is my fiance) but we made an effort to visit at least every 3-6 mos for 2.5 years. All with school, work, and family commitments. Have to go without sometimes to make things work, but that's just life.

They ask you for addresses you lived at for the past 5 years. They needed the postal codes for each address, which was a major pain in the butt considering I rented at different places during university. You don't have to worry about living in different cities though because a) they take your addresses, b) the check is country-wide.

K-1 Fiance(e) Visa Process & ProceduresOath during K-1 Visa Interview
Yep there's an oath. It's about a paragraph long. I didn't have to recite it, I just had to hold up my right hand and agree. It went something like this:

Interviewer: "So who are you going to marry?... oh #######, I forgot I have to read you an oath. Okay, don't repeat this, you just have to agree at the end okay?"
Me: "okay"
Interviewer: *Reads the oath thing*
Me: "Yes, I promise I'll tell the truth"
Interviewer: "No, no, no... Just say 'I do'.. It's good practice."
Me: *laughs* "I do!"

My interview was sooooooo informal though. The guy stopped half way to compliment how great my teeth were. It was bizarre. I wanted to say "you do know I'm here for a FIANCEE visa???" lol...

That said, it wouldn't surprise me if they made other people repeat it back.

Sidenote: Couldn't she just take a translator to read her the oath in her own language?

VJ actually suggests bringing the entire original I-129F petition you sent in. I never got asked for anything from mine, but I followed the advice anyway because it gave me the peace of mind that if they did ask for something I would be able to grab it.

My fiance and I used this page to collect stuff for my interview, and obviously brought everything the consulate had on its list:

K-1 Fiance(e) Visa Process & ProceduresAny ideas on what next?

We filed in May and were approved In September (NOA2). 5 months to the day. Now I don't know where the paper work is. It's been a month and we've not heard anything. I am assuming it's on it's way to London but when I've called the premium number as given by the lawyer, who deals with immigration law, then they have no record of it. How long before we hear something for the next stage.

I have a child from a previous marriage which is why we used a lawyer. My ex is hardly a standing citizen and rather than miss anything we wanted to go down the professional for that reason only. Hopefully that will not appear to be UNUSUAL CIRCUMSTANCES. As for any other reason why we used a lawyer I don't think that is relevant to my question.

Waiting about a month to get anything further is not unusual. You should receive a letter soon telling you your case has been forwarded to the embassy. It took us about 1 month for this to happen (US - California to Vancouver). It might take a bit longer from the US to UK.

In the meantime you should begin preparing for your fiance's interview.

http://www.visajourn...content/k1guide --- scroll down to "What to do once your petition is approved." and also look up the different packets on your embassy's website.

K-1 Fiance(e) Visa Process & ProceduresAny ideas on what next?

Hi

We filed our notice for an I129F which was received on the 3rd May. We received a notice of approval on the 30 September. We've not heard anything. We're doing this via an attorney in the States. They don't know anything. I've called the premium rate number and they haven't got a record of our case. I don't know what to do. It's bad enough that our lives are up in the air but I don't know where our paperwork is or where we are at.

Any ideas?

Was the NOA you received on September 30th your NOA1 or NOA2? NOA2 would say that your petition was approved/denied. NOA1 pretty much says they received your application. It is really weird if you filed May 3rd to only have a NOA1 in September.

If you received NOA2 on Sept. 30th (and approved) your case is being forwarded to the Embassy you selected.
