That's fine, but not necessary. You do not qualify on last years income. You qualify with current income. There is no need at all for the government to get money they did not earn in order for her to appear to make more than she did.

For example, lets say you were self employed all of 2010 and do your taxes in February and write off ALL your income and show a loss. THEN in March you get a regular job making $45,000 per year and fill out the I-134 in April. What is your current income in April? $45,000 per year. What does last year's loss have to do with anything? Nothing. Or you can show a profit in April from your business when you do the I-134. The number of people that get visas approved now when they had very low income the year before is huge... alomost all students, for example. Student last year, employed in a job this year. Making $40,000 this year...-0- last year. No problem.

Seems like the OP has it well under control. She should answer that she is self employed and combine all her forms of income to arrive at the statement of her current annual income and then attach documentation of each.

I would advise her against paying more in tax than needed.


Since I've done this before I would have to disagree. If you are employed by someone else this makes sense but for self-employed you have to establish that you have constant income. Being self-employed you can lie through your teeth about what you make and they know that. If I didn't have a job I could write down whatever I want for this year and it's unprovable until you file my taxes next year. So If you show a good amount of income for the previous year makes it more believable when you tell them your unprovable income for the current year. Self Employed gets cash and 1099's.

We've hit a major major snag and things may have to be called off because of it. Even though I work 7 days a week at 2 jobs and get a hefty child support payment a month, I still don't make enough for a family of 4.

I am self employed. This year I will make about $23,000.00. I also work another job that I make about $15,000.00 a year at. I also get $1600.00 a month in child support. Yep, sounds great doesnt it? Here's the problem:

1. Because I am self employed I have to count my income as what I make AFTER business expenses. Well, when you are self employed there are A LOT of expenses. So that cuts that income in about half.

2. My ex pays my mortgage every month instead of giving me the cash directly. It's a verbal agreement we have. He has written a letter stating that he is obligated to pay me $1600.00 a month but in lieu of cash, he pays the mortgage. It has been signed by both of us an notarized. But because of this I cannot count his support as income.

3. Even though I technically make over $50,000.oo a year I still don't make the $125% over poverty to support a family of 4.

4. I am an only child so I have no siblings who would co-sponsor. And my parents are retired and wouldnt even cosign a car loan for me. They've always been the type of parents who insist on me making it on my own.


My fiance and I are devastated. If anyone has any suggestions, please help. I don't want to lose this dream because of this.

Hi, I'm self employed and I had to go through this. It's almost the end of the year. Take most of your expenses and throw them out the window for this year's taxes and get yourself above the 125% poverty line. You'll pay more in taxes, but your love for each other is strong so it won't matter. File ASAP in January or February and there you go. If you can't afford the extra taxes make a payment plan with the IRS. I've done this many times and they have never given me a problem. The government is not going to care if you give them more money. You're not obligated to report all of your expenses, just all of your income. If you do this you'll have no problem. I've done it with great success. You'll have your future spouse's income when he arrives here. Live your dream!!!

I got an RFE from the NVC for "Original Birth Certificate", "Original Marriage Certificate" and "DS-2019 from Prior VISA"

I guess the certified copies weren't good enough for the birth cert and marriage cert, and Wife had to dig up a DS-2019 from 2004/2008.
Now all those docs have been at the NVC for 2 weeks. no AVR update, no trace of NVC doing anything except for my FedEX delivery confirmation.

They sure are taking their sweet sweet time with this.

Right now. I would say another 5-7 months atleast for march filers. If they start approving soon, then this time would be less than 4 months if everything goes right without any RFE.

So we're looking at sometime around (big emphasis) end of October to end of December. :)
I hope I don't have any RFE's since we're working with a professional. The main reason we went with a lawyer is to prevent any delays. :thumbs:

Your husband can send in the documents himself, no need to wait on lawyer, once the casefile is at NVC. IMO, using a lawyer who wants to wait on postal mail from NVC ACTUALLY slows down the process - usually 3 to 6 months .

If you'd like to tell your husband to 'submit them himself' - just remind him - it doesn't matter if the documents come from him or the lawyer, at NVC stage.

Husband has a DS-230 that you signed ? He can handle the I-864 himself.

Addresses on 'where to send' are in the coversheets, to be printed from the online payment portal website.

I tend to have violent reactions to news similar to yours, suggesting a PARTIAL refund from any attorney, due to attorney's ignorance. When he refuses to pay the partial refund, is great reason to file in small claims court. IMO, you have enough fodder to prove that the lawyer is wrong, and a judge would make the award to your husband. Don't worry about this now, just remember it's something else to be done (if you want), later, after you are in the USA.

Sorry to hijack this thread with a lengthy post, but I'm new to this and I just want some clarification. (and also say not ALL lawyers are stupid)

From what i'm grasping from this toppic, the OP is frustrated because her lawyer is waiting for a written notice from the NVC before taking action to submit the supporting docs?
Which means, the supporting docs can be sent before the notice is in hand?
If so, I see how this could expedite the process, but by much as 3-6 months? how?
When exactly after my NOA2 can I submit the required documentation to the NVC?

I am working with a lawyer. I am just making sure I'm educated on the process so I don't just follow the lawyers advice blindly. This is how I was able to make an educated decision and switch lawyers. My first lawyer wasn't only expensive, unavailable, and would not listen to what I had to say because I wasn't the "expert", but strongly suggested we do a K-3 because "it's faster".


My current lawyer is VERY pleasant to work with. Her legal assistants are always answering my calls and questions, appointments are conveniently available after work, has 100's of immigration AND deportation cases under her sleeve, and she knows exactly what I want. When I presented my case to her she said "Criminal history? no. Bad Financial? no. Legitimate marriage? yes. This is a PIECE OF CAKE!" I gave her all the required information, all i had to do was signed the dotted lines, and I don't have to worry about RFE's. The piece of mind she gives me is worth the money.

I still visit VJ and other sites because I want to educate myself on the whole CR-1/I-130 process. Where can I go exactly to read up on the 'tips and tricks?' (exact timing and timeline of these events and procedures)? OP, how did you know you can submit forms before the notice arrives?

So initial setup cost me $200 and the monthly is about $100. But even if my wife was living here with me I would be paying for the same thing(change intl text plan to domestic) minus Skype. So really it only costs me $10. I use the 3G data network to make skype calls so it doesn't use any of my mobile minutes.

Once she moves over, her iPhone will have skype so she can talk to her parents back home.

Good morning VJ amigos! I have a couple of questions.

My Lawyer recommends I get a Bank Letter from the institution whom I bank with. Is this really necessary?
I've been gathering all other required documents and information, but I thought I didn't need a bank letter unless I was near the poverty line.
Can I submit my pay stubs instead? The reason I ask is because my bank tells me it will take approximately 2 weeks for the bank letter to be delivered. I don't want to wait that long.

Previous years tax information. I've also been told to get a tax transcript for 2009, 2008, and 2007. Problem is I didn't file taxes in 2007 because I didn't work (in college was student), and I only made about $10,000 working part-time in 2008. I work a full time job since May 2009. Lawyer believes I may have to get a co-sponser. Why do I have to have 3 years of income history to show I'm capable of supporting my wife and she is not going to be a burden to the government welfare system? My monthly paystubs shows I make over 400% above the poverty threshold!

I understand my lawyer is erring on the side of safety, but I don't want to delay this any longer than it needs be.

Can someone offer me some advice?

I had an appointment with our lawyer on Friday and We filled out the I-864. She told me she will fill out the DS-3032 and get it in the mail same day.

So my question is, what is the current trend in processing time at the NVC like? I see some people that were on the ball have an interview date already, but I can't really figure out how long it's taking the NVC to case compete.

Can anyone help me? I want a rough estimate of when the NVC case complete will be. Is it likely to have an interview date by christmas?

P.S. what else do I have to do now? we were told get ready for medical, and start scrap booking some evidence of our relationship for the interview.

We have yet to receive the letter for detailed info, but I am proactively trying to gather info so we aren't as delayed in the end. I don't think we will be able to find the original IAP-66 or VISA forms.

I am currently looking into a similar situation as well.

my research tells me it all depends on the amount you are sending. The lower the amount, you are better off with westernunion or moneygram.
If the amount gets higher then you are better off going with a bank.

This is because the money transfer services like WU and MG make their profit from the exchange rates. They have ####### exchange rates, but cheap service fees.
Banks on the other hand have reasonable exchange rates, with high fees.

I would just do the math and see which would be the better option.

I've been pretty much hands off through the whole process of our CR-1 because we had an immigration lawyer. However, with the wealth of information available on this website I feel that I can do the rest on my own.

What's the next step after POE? I know there is the removal of conditions during 90 days before the 2 years, but other than that I have no information. Is there a separate forum for ppl after POE? Can someone point me in the right direction?

Portland I know U feel caught in the middle with the drama of hubby and baby mama.....like many was sayin I dont beleive this woman is ova him and so she doesnt want nothing to do with you no matter how much u help. Also just the thought of u raising her child (whether its a better life or not) is making her upset....no mother would want to lose their child, but since it would have only been for a few months at a time i dont see the problem. Maybe you should take ur daughter on trips to see her grandmother, spend the holidays there.....try to spend as much time possible without having to move. I started bleeding. Scared me bad. The Kaiser nurse said to go to the closest ER. I drove myself and they hooked me up to all the monitors.
Baby's heartbeat is okay, no contractions, they did an ultrasound and everything looks okay. The bleeding stopped and they sent me home and told me to take it easy until my regular pre-natal appointment on Monday. sad.gif


I am so thankful that baby is okay, but right now all I can think is they are not going to let me go to JA and see Astley.
I cry every time I think that... I know the baby is most important, I know that... but it's been 6 months since I've seen my man and I am scared.
I just want to curl up in his arms and know it will all be okay... I hate that my country won't let him come see me. I hate that he is so far away.
I hate that the embassy won't respond to me and there is NOTHING I can do but lay here and take it.

Hey Yardies,

I know yall probably think I forgot all about yall, but I been busy. Between work, church, and spending time with ryon its hard to keep up on here...I sometimes pop in anonymously{sp}....but I wanna thank all of you for the B-day luv. Ok so its been a month and 4 days since Ryon got here, he got his social and since yesterday he has been workin at Golden Krust...He is soooo happy cause he was tired of not workin and being in the house while I was at work. Im happy for him even though its a minimum wage job its something for him to do. We will get married on 1/22/10 until then I am gathering everything I need for the AOS stage.

I know I've missed A LOT but I wanna congratulate everyone that has been approved, im rooting for all the upcoming interviews, JAP congrats on the beautiful healthy baby girl u were blessed with.
