US Embassy and Consulate DiscussionI-864 question
You know, that's a good point.

I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.

I have attached photocopies or transcripts of my Federal tax returns for my second and third most recent tax years.

Hmm. I guess checking both boxes there is the right choice, but... they really need to fix this part of the form. It's funny, we both have an issue with different parts of the first checkbox. I don't reel right checking it because I haven't filed for the last three years, but I don't feel right not checking it because I AM attaching my most recent year's tax return, and I don't know if I should leave the 2nd and 3rd lines blank or "see attached letter" or what. *scratches chin*

Yeah, not too many options on that question! We'll figure something out. :) What's your "other"?

US Embassy and Consulate DiscussionI-864 question
On the I-864 (Paris asks for it in packet 3 and then takes the I-134 instead, so I'm preparing it just in case) Question 25:

I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.

It's true that I'm attaching my most recent year's tax return... but I didn't file the 2 years before that. In 2004 I had no income and in 2005 my income was only, like, $90. The instructions say to write a letter indicating why I didn't file so I did that. How do I handle this question? I'm guessing I don't check the box since only 1 out of the 2 statements is true for me. Then do I only fill out the line that says "most recent" and leave the next 2 lines blank? Or on the next 2 lines should I write "see attached letter"? Or what?

Thank you guys. The research specialist (weird title for a DHL person, sounds like someone out of Jurassic Park... or you ever play Zoo Tycoon Dinosaur Digs? :P) called back and spoke with my parents twice today. They said there was really bad weather in Ohio for 2 days so the plane couldn't leave. They had my parents fax a copy of our waybill to them (they didn't have a copy of it?) and they forwarded the fax onto England and France. They said all computer systems have been updated with an alert on our package so it'll pass through as quickly as possible. They also said they'll be monitoring the shipment status and will call us tomorrow at the first sign of anything that could cause an additional delay.

 My dad told them my fiance has a hearing at the embassy on Monday. I told my dad it's an interview, not a hearing, and it's on Wednesday, not Monday. He was very relieved. I'm glad he told DHL what he did though!

So the plane left at 9am EST, it arrived in England at 9:25pm EST. Hopefully it'll get from England to France tomorrow. :)

I can't wait til this is all over. Reading on VJ for 11 months before mailing out my petition I knew it'd be stressful... but I never imagined it'd be THIS stressful. But my fiance's under more stress than me, the poor guy keeps worrying that he'll screw something up at the interview and the visa will be denied. So I need to get myself together for him.

I shipped out my stuff to France for my fiance's interview Tuesday. I was promised it would arrive in France today. TODAY! I tracked it and it's still in f'ing Ohio. I called and all they could tell me is it's in Ohio and it's beyond their control. THEY WORK THERE, OF COURSE THEY CAN CONTROL IT! I went off on the rep and told her I was promised it would be there today, I paid $85 so it would be there TODAY, IT HAS TO GET THERE TODAY! She said she'll put in an inquiry and have a research specialist call me back. His medical is Tuesday, his interview is Wednesday! I'm stupid to have put it off so late, stupid stupid stupid, I should've gotten this stuff together for him WEEKS AGO! Uggggggh. I shouldn't have done that.

I don't know what to do. I could call them during my lunch break and flip out on them again but by then it'll be 7pm his time. I could put together another letter of intent, I-134, and I-864 and mail it out by some sort of insane express shipping tomorrow but... ugh. THEY SWORE UP AND DOWN IT'D BE THERE TODAY! I was stupid to have left it so long. I should've done it much earlier.

And now I get to go off to work where lunches have been mandatorily cut in half until further notice. *sigh* I'll read this when I get home. If you have any suggestions on how to kick DHL's butt to get it there sometime soon please let me know. Ugh the stress of all of this is really killing me... BS at work, the stress of his interview in 6 days, the stress of finding an apartment, the stress of not being together in 14 months, I just... I'm trying to be strong for my fiance but... I'm sitting here crying like a baby.

My fiance works for a shipping company in France and just got off the phone with DHL. They told him to call back at 5pm his time because they may have more info. She told him it's 2 - 3 day shipping. I was not told that. I was promised it would get to France today. She told him that he'll get it tomorrow. As long as it's in Ohio, like it has been for 2 days, I don't believe that. He'll call them back at 11pm, I'm telling my parents to not let down easily when they call my house back.

Our embassy asks for the I-864 as well, but then they end up taking the I-134. My suggestion is prepare BOTH and send BOTH to the interview. You can find the I-864 in the download section under adjustment of status forms.

I wore a shirt and a medium length skirt.... but we don't want your boy to wear them of course.....

 Funny considering, as a friar, he wore what I referred to as a dress... of course my now-fiance-then-friar-friend was always quick in reminding me that it's a HABIT, not a dress... I'll just tell him my VJ friend told me to tell him he needs to buy a kilt for his interview.

My fiance asked me to post for him and ask what he should wear to his interview the day after tomorrow. At first he was going to wear a suit and tie, but I talked him down to nice pants and a nice shirt. He's wondering which one of us is right, or if neither of us are right and he should wear jeans. What did/will you do?

US Embassy and Consulate DiscussionMy Fiance's visa interview is on Tuesday!
Excited and anxious at the same time, I know the feeling, my fiance's interview in Paris was only 4 days ago! We were so worried... and it was a breeze, no problems at all! Your honey's interview will go just fine, you'll be together soon. :D And yeah, I've read on here a couple times about people asking if a prior turn-away at POE for not having enough ties to the home country would cause trouble... and the answer was always no. So I don't have any personal experience with that, but from what I've read, it's common and won't cause any trouble at the interview. Just don't lie about it - tell your fiance to give an honest answer if they ask!

US Embassy and Consulate DiscussionOne last question from me today, form DS-230
We followed the policy of "better to be prepared and not need it than to need it and not be prepared." I loaded him up with 2.5 pounds of paperwork organized into a 13-pocket folder. A few forms and 4 questions later he left the embassy. But that's the better alternative over him walking out of there after hearing "you'll be approved AFTER your fiancee ships [x] across the ocean to you." So fill it out and just have her bring it with her so she has it with her in case they ask. ;)

US Embassy and Consulate DiscussionEmbassy sending back photos
When my fiance got his visa in the mail from Paris embassy he also got the brown "do not open envelope" and... the photos I submitted with the I-129F. Do all embassies do that? I hadn't heard of that before, neither of us expected to get them back. :)

US Embassy and Consulate DiscussionFedex not delivering on time
Call FedEx and demand they do something - now. I mailed my financial docs to my fiance last minute by DHL. The day they were supposed to arrive in France (only a few days before his interview) the package was still in Ohio. I called DHL and they said it was kept there for reasons beyond their control. I told them that wasn't good enough and it needed to get to France that same day. She kept saying things that didn't satisfy me and I got really upset and refused to get off her phone til she did something about it. She said she'd have an investigation started and someone would call me back.

Needless to say, it had gotten stuck in Ohio because of an ice storm. They put my package on a plane 2 hours after I got off the phone with them, they flagged it as urgent so all points it passed through would see it right away. It got to England that night, on a plane to France the next morning, and into his hands that afternoon.

Would it have worked out so well if I didn't raise a stink? Take it from a customer service rep - probably not. The annoying callers who insist get the best treatment in the end. ;) Demand a supervisor if you need to, threaten to require a full refund for not getting what you paid for, etc. if conventional politeness doesn't get you what you need.

Edit: Oops, just read your comment update now. Well, that's good that they're doing something. Stay on top of them. If it's not released from customs this morning call them to get an update. ;)

CanadaCanada & Fiancee visas

It is true. Canada as a country does not have a fiancee option - only a spousal option. They used to have a fiancee option but discontinued it when the immigration rules changed a few years ago due to abuse of the fiancee status from many who used it to come to Canada, then disappeared into the woodwork without marrying their Canadian sponsors. One positive thing though, the spousal option does cover 'common law' relationships and 'same sex' couples, although the evidence required to prove the relationship is obviously significant.

I think this is exactly the information they were looking for.

Oops. Sorry! Since this is the K-1 fiance visa forum I assumed the question was about US visas. ;)

Do you mean immigration to Canada ... or immigration to the U.S. from Canada?

Thanks! I can't believe we've been married a year already, it went SO FAST!

And aww Nico, I know what you mean. VJ was my main source of support during our time apart because, while others tried to understand, only the people I met on VJ totally understood. After someone posted something similar to what I just did, I kept reminding both him and I, "once we get through this it'll be like a nightmare in the past and it won't be so bad" and it helped strengthen us to push through. I have to admit, a big part of me doubted what I was saying, I figured that was the experience of some people and wouldn't be the experience that we had. It's pretty funny to be the one saying it now!

K-1 Fiance(e) Visa Case Filing and Progress ReportsJust stopping in to lend some support!
Hi! I don't know how many people are still here that will remember me. Well, our first wedding anniversary is coming up and so I just remembered VJ and thought I should come back to encourage you all a little!

We spent 15 months apart while waiting for all the preparations to be ready for the K-1 and then the filing time and whatnot. People on VJ told me that, once they were together, it all felt like a distant nightmare and a different lifetime... and that made me feel better, even though I wasn't sure how true it'd be for us. Well it's true for us too. laughing.gif We've been married for a year but we feel like we can't remember one day without each other. Yes the 15 months apart was torture... there were so many days where we felt like we just couldn't do it anymore, but yet we knew it was worth it to push through. It might take forever, or it might just feel like it's taking forever... but it'll all be over, you'll be together, and then it'll just be a nightmare in your past. So no matter how long it takes, don't giveg up - you can get through it!

K-1 Fiance(e) Visa Case Filing and Progress Reportsgetting harder everyday
Humm, how we made it through our 15 months... he bought 2 webcams and mailed me one, so that we could see each other. He'd leave it on when he went to bed so he could see me til he fell asleep. His lunch break happened to be when I was waking up with the time difference, so he was my alarm clock, and we'd talk for a while when I woke up. Then my lunch break was when he'd just gotten home from work so I'd call him... and then we'd put on the webcams when I got home, which was usually around midnight for him. Some nights, too, instead of the webcam we'd talk on the phone til we both fell asleep. He had a plan where he could call unlimited anywhere in France and North America, so leaving the phone on the entire night til one of us rolled onto it and it shut off wasn't an issue.

I'm a creative type so, for special days, I'd make a scrapbook page and mail it to him. I also scrapbooked photos of his 2 visits, and momentos that I saved from them. Any jokes we made up online or on the phone I'd scrapbook sometimes too. Then when he was missing me he'd look through it... sometimes when he missed me he needed to distract himself, sometimes he needed his fill of good memories instead.

For the times that I needed to distract myself, I have a stamp collection... thousands and thousands of stamps to be organized. laughing.gif Love it! I like making graphics online, too. Exercise is always good too, some form of that, maybe with some headphones and music to keep your mind from wandering. Basically find hobbies that fit you and that you can put all of yourself into, so that the next time you look up it's like oh wow that was two hours!

You'll get through it!

CanadaHow did you organize your documents for interview?
We didn't go through Montreal, but I will tell you what we did...

A file envelope with different sections-

One for all USCIS stuff-originals

NOA1
NOA2
I-130
G-325a's
Marriage Cert.
Birth Cert's (his & mine)

One for NVC stuff (except my 864 and our co-sponsors 864 and 864a)-copies

DS-3032
DS-230 Pt I and unsigned Pt II
Another separate file for the 864's (tax transcripts, employer letter, tax release form)
My sister's 864 stuff
864A

One for all Embassy correspondences and supporting evidence-copies

medical, police report, embassy letters, interview invite
bank statements, bills, e-mails, airfare tickets, mobile phone bills, cards, letter, wedding invitation

Incidentally, this may have been overkill-but I would rather have been overprepared than under.

Good luck with your interview !!!

Middle East and North AfricaMissing Info/Incomplete 864/ds-230???
Hi All,

I have had a SERIOUSLY bad day. Sad. lonely, missing my beloved and tired-bad combo !

When I came home from an overbooked day at work, I decided to phone up the NVC to see if anything has gone on with our case since Thursday...
They received the last of our paperwork on April 24th.

When I phoned up, I was informed via automated response that a "checklist" was sent out yesterday. Apparently, there's some missing/incomplete info. I was devastated. I know I dotted all my "i"'s and crossed all of my "t"'s... I am so upset...I figure it will cost us yet another week or two sorting this out...I thought we were in the last lap of this miserable stretch.

So, knowing I'd find some strong shoulders here-I decided to post my lament.
I found a thread from Legaleagle-the same thing happened to her, Mary and Angel this week...when Mary and Angel spoke with operators, they were told that their cases were complete...

Is there anyone else that this has happened to??

I pray that this is the same problem for us and when I call them Monday, they will say that our case is complete as well...

Please send us some good energy...we really need some today. :(

Thanks.
