Hi Lew,

If they share a US address together, and it's both of their legal addresses- they must file the I-864A, as well as an 864 for him and her.

My sister rents an apartment in my house, and was our co-sponsor. She and I share NO financial ties-no bank account, and we're completely independant of each other financially. However, they will look at the address, and they will ask that US income is combined on your wife's 864.

My 864 was kicked back to me in late April to make this correction, and as a result of this "mistake"-we were held up for 3 more weeks between mail to and from and finally, completion of the case...

Good Luck !

Hi...

I would check out the USCIS webiste to see what the dates are for spouses of LPR's and see where you stand in that time frame. Seeing that you're an LPR, unfortuately, your status will not be upgraded to priority until you become a USC.

Now, if you file for K3, she will have to obtain EAD and AP, and adjust later. Although it may be better for you in the end simply to get here here, and work out the rest later.

If you stay with the CR1, she willl not have to adjust, and she will not need EAD or AP. All of that will be taken care of with her green card.
From what I have seen, it takes a bit longer, but the benefits are that you will be done with the process until you have to life conditions in 2 years.

See what works out better for you both...

Unless you have a problem, don't bother with a lawyer. Not worth it !

Good Luck !

Yeah ... looks like it's just us 3 for now...In a perfect world, we'd be sailing right through...but I have come to expect no favors or mercy from this process...when it's all said & done, I will need someone to throw some cold water on me to make sure I am not asleep and dreaming-LOL !

I looked for that embassy e-mail, and to no avail. It's not in their website or anything !!!
I will keep hunting, and will pass it along if Yodrak doesn't beat me to it. ;)

Hey There,

My case only was completed today, but I have been wondering the same thing myself lately...

Wish I could help more, but I am not seeing many CR1's on the list...lots of K1's on the "London Embassy" thread... I also wonder how IMBRA will affect things as well when the K1 backlog begins to happen...

Have you tracked the package from the DHL tracking thing-y that Peter posted? Once you find it has gotten there, e-mail them and tell them that you are ready to proceed.

I know how much you miss her, as I miss my dear one as well.

Hope it goes fast as lightening for you !

All The Best,

Rose

Hi Lorrelle,

I must get my butt to work, and won't be back until 6pm (NY time), but would be happy to step up, scan them in and send them off to you this evening.

You may want to have them earlier than that, so if you have any other bites at a more reasonable time frame, I would surely understand.

Hi...

Call DOS...202.663.1225 Tell them what's happened, and they can contact LND to perhaps get another one sent out.

I wrote you regarding the medical on another post...but, all you need is your case number and they will book it. They did it for my hubby 2 weeks ago, and he had his on Wednesday. We didn't have an interview date when we booked it. All we had was a case #
Call central booking and they'll set it up.

Hey everyone Im new to visa journey. I just married my husband in Egypt on October 20th. I want to start the visa process. Im under the impression i need to fill out the I130 for us what else needs to be included with that?? and what other things do i need to do also?? I was told we can either wait for his visa to be accepted or denied. or i can take the reciept from filling the I130 and file the spouse visa so he can come to the us and then file the I485 to change his visa to permenant. does even sound right??

Which is the better option. having him just wait in Egypt till we have word on the I130 or filing for the spouse K3 visa, and filing for the change of status when he gets to the US?

I dont really know what is the difference, im still trying to make sense of this Please give me any advise you have smile.gif

Listen people if you go online and get this lawyer from AP Visa.. Do it. I went with an Egyptian lawyer over here and he totally screwed me up. When I first filed I did not know a single thing about anything. I filed an I 130 with this lawyer and I filed it in May 2007 and am still waiting. I have a friend which went on AP Visa and she had her fiancee here in 7 months.!! It does not matter if you are married there already. This guy Alex will do it all for you. Check it out. I wish I went this way. Mention to him Marcy referred you.

Hello everyone in Administrative Processing/ Review:
My Husband had his interview date September 2,2009. They requested more information and rescheduled an appt. on Sept 15,2009.
After the interview the American woman said he would get his vise in a couple of weeks.
Well I we waited like 2 months. I started getting nervous and called Washington DC to see what was going on. All they could tell me was that the case was in Administrative processing and that they would contact me when it was finished. They will not tell you why it is in AP or anything. After a couple of more weeks
I decided to call my congressman's office and asked for the person handling immigration issues.
The woman asked me to fill out an information release form with supporting documents and fax it to her.
Within a week she called me and told me that my husband was issued a visa and that it will be sent to him shortly..
So I would suggest to anyone in AP to call their congressman's Aide.... maybe they can help you instead of waiting and wondering what is going on. Maybe I was just lucky...(not really I waited 3 months) but I think it helped.
Hopefully my husband will be here soon.......just waiting for his passport back now.
Good Luck! heart.gif rose.gif rose.gif

thanks so much for posting this on here it really helps a lot ,, wish your husband get his passport soon then go to be with you ,, i will tell my wife about that ,, i done my interview in OCT 22,09 then they told me i'm under AP then on DEC 6 they sent me an e mail telling me that the case is pending consular officer's review but the dos still saying its under AP so we waiting to see whats going on ,, best of luck to you .

You guys are awesome. :) Here's round 3:

I would like to take the opportunity to explain my past income. I graduated from high school in 2003 and entered into college full-time. I was also a part-time missionary for approximately 2 years. I started working at my current job in a permanent, full-time position in October of 2006. It pays $26,000 per year – well over 125% of the poverty guidelines for a household of two. I now have medical and dental insurance, both of which I will add my fiancé to after we’re married.

I'm typing up a letter to send over to my fiance for his interview explaining why I didn't earn over 125% of the poverty guidelines til 4 months ago. I'm going to tell him NOT to volunteer it, just to keep it with him in case the consular officer gets concerned about my short working history and questions it. Better safe than sorry. ;) Can you guys tell me if this is good? Any corrections/suggestions?

US Embassy and Consulate DiscussionAm I missing anything?
Yeah I was told on another post that I didn't need the bank letter - didn't know that before! Ah well, it'll just be another one of those things that I send but tell my fiance not to hand over unless they ask for it.

I put photos together in 3 pages of a sort of scrapbook style. A few people on the K1 forum said they did that and it went over well with the consular officer. *shrug* Figured it couldn't hurt, it was relaxing after tearing apart the entire computer room looking for missing evidence originals just to realize I was only missing an e-mail print-out of something! :bonk:

Thanks guys! I have a question. My bank letter was written on January 22nd and my balance was nearly $2000 lower at the time. I don't have the time to get an updated bank letter, that one took about 2 - 3 weeks to get with all of my bank's games. Do you think a print-out of my online account with a little note saying "Since my bank letter was written my balance has gone up. Here is a print-out from my account to show my current balance" would be a good idea? My account only says "Account balances for Angela", it doesn't say my last name, so I'm not sure if it would mean anything to them as it could be any Angela's account.

RosaMystica7FemaleFrance2007-02-16 23:12:00
US Embassy and Consulate DiscussionAm I missing anything?
So guess who's pulling an all-nighter to get stuff out by DHL tomorrow to get to France before her fiance's February 28th interview? Oops. I'm making a checklist of everything I have to put together tonight. Am I missing anything?

- Letter of intent
- Copy of entire I-129F packet
- Originals of everything sent in the I-129F packet
- Certified copy of my birth certificate
- Copy of NOA2

Financial stuff:
- I-134 and I-864 (packet 3 from Paris specifies the I-864 but at interviews over the past few months they've been taking the I-134 instead)
- Letter from my employer
- Bank letter
- I've got all my paystubs from the last 4 months... I'll figure out a decent number to include.
- I filed my 2006 taxes electronically and chose the option where you have to sign to confirm it, so I'm including a copy of the statement I signed before I mailed it off. I have my W2s, too.
- Letter explaining that I was a student and missionary so that's why I didn't make above the poverty guidelines til October 2006.

Evidence of on-going relationship:
- I'll be going through our e-mails/chat logs and will send him a file to print out so I don't have to send that.
- He requested his phone bills weeks ago and never got them. So he'll be printing what he can off the internet and picking through them to find the ones with the most amount of hours spent calling me - both house and cell phones. I figure there's no need in getting my phone bills because he does all the calling (I ring his phone twice and he calls me back).
We don't have anything other than that... we've never done much with snail mail because we communicate so often daily.

Am I forgetting anything? I feel like I am, probably just because there's so much stuff.

You know, that's a good point.

I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.

I have attached photocopies or transcripts of my Federal tax returns for my second and third most recent tax years.

Hmm. I guess checking both boxes there is the right choice, but... they really need to fix this part of the form. It's funny, we both have an issue with different parts of the first checkbox. I don't reel right checking it because I haven't filed for the last three years, but I don't feel right not checking it because I AM attaching my most recent year's tax return, and I don't know if I should leave the 2nd and 3rd lines blank or "see attached letter" or what. *scratches chin*
