Hello Friends,

I have been riding the tail of London and the DOS like a witch on a broom for the last few weeks...e-mails, phone calls, etc- with a request for an interview. I explained that Mr. Bruce and I had all of our doc's sorted and that we had gone ahead and booked his medical (which was this last Wednesday). I also asked them to please consider us for a late July date, as we would like to have a family holiday before our son returns to school.

I woke up this morning, and there it was-an e-mail from London granting us an interview for July 28th at 11:00.

So many of you have helped us with tips, information, and support. Those of you who have been through this gave us so much insight and it is greatly appreciated. Honestly, we would have not been able to wrap this up as soon as we had without your help and experiences. :yes:

In my opinion, and to the best of my knowledge-once the divorce is final in the US, (and she is immigrating to the US) , it is the American consulate she is dealing with-not Philippine law ...in the US, she would be indeed be considered divorced once it's all finalized and stamped by a judge. If you go the CR1 route, marry in the US to allievate problems...

I would consult a lawyer to be honest with you, just to make sure what I am telling you is correct...just contact the Bar Assoc. in your state, and they will fit you up with an attorney for a consult at a resonable price. We paid $25 for ours, and she showed us the way-after that, we handled things on our own.

A 1099 is like a W2 for those who are self-employed, or an indie-contractor.
If you are employed by someone else-you will only get a W2.

You only need the most recent tax submission, and you no longer need notarization

Yes, they can fill it out now and have it notarized to save time.

Phone the NVC in 10-14 days and listen on the automated response systen to find out if the packet for the 864 has been generated.
As soon as it has, you can send yours and their's in.

The I-134 is for a K1 and I believe a K3 as well. Since you are doing a CR1-all you need is the 864 for you and one from your co-sponsor.

Oh, yeah -you will be fine with the transcript ! That's even better !

I messed up on the "household size" Q.
Here's the story: my sister was our co-sponsor. She rents an apartment within my house and is actually considered a "household member" in the eyes of NVC. Even though we share no financial ties, we do share the same address and according to them- a residence. So, the RFE that was requested was actually a request for correction on the size of our household. I failed to include her the 1st time, even though she and I filled out an 864A. I should have known better with all of the researching I did ! I still want to smack myself over that one ! :lol:

It cost us a month longer of being apart for that little mistake of mine.
If you check out our timeline, it was relatively short for a CR1. I used all of James' shortcuts, had all the paperwork done and would turn it out the very day that I would find out it had been generated by NVC . I feel we could have been in and out of NVC in 6 weeks had I not made such an error and the bloody RFE hadn't been issued.

Hi,

We had this happen as well, and I had the sponsor sign it before it went out.

An 864 isn't something I'd leave up to chance and luck-like everything else in this process, all "t"s should be crossed and all "i"s should be dotted. You never know if your case worker is having a good day or not...

The last thing you want is an RFE and a hold up for something that can be avoided. We had an RFE on our 864 for a different reason. (I stupidly filled out a question incorrectly) While it sat on someone's desk for a week, and between mail & such-it cost us another month.

At this point it's better if you "issue the RFE" to your gran for the signature rather than them doing it...

Is it possible for you gran to fax you a signed copy to cut down on time?

We are a successful James' shortcut couple-I have to say, they were a HUGE timesaver.
I used both plain HP paper and Staples brand-no problems with either one.

If you're concerned over the NVC paper having a watermark on it-do not fear.
You're fine with plain white paper.

I am so sorry to hear of this...Take a few days to regain yourself. Rest, eat and be good to yourself.

After you are feeling stronger-realize your inner strength, and fight like you never have before.
Do not accept this... Challenge it.
Do some research. Get legal advice.
Phone your senator, your congressman, and do EVERYTHING YOU CAN to fight this.

He is your husband. You are his wife. This is your life.
Fight it with all you have.

Do not accept this denial-regardless of circumstances-there HAS to be a way to appeal this.

I wish you all the luck and strength there is in this world.

Ahhh Cool !

The one with the EAC-XX-XXX-XXXXX is the one that will be your case #. It may be a bit too early to be in the system yet, but you never know...


We went through Vermont too. I had my NOA1 within a day of them cashing the check. If I recall, I kissed it. :)

Good luck with everything. I would HIGHLY recommend using James' shortcuts when you get to NVC.
Feel free to PM me if you need any info regarding them. Apart from me screwing up a question on the I-864, we got through NVC rather quickly by using them.

Do not worry about a death certificate for your dad. Mine passed away several years ago, and there was no proof of his passing required. I wrotedown when he passed away-not sure of date, so I put month and year. All was fine. No worries my friend !

What they mean by the "additional names" is other legal surnames names used in the past or present via marriage, divorce, adoption, or perhaps different name used on a professional license.
Anything legal is what they're looking for.
The small nuances of a mispelled name aren't worth your time writing down. In fact, they could prove confusing... In the beginning, it is rather intimidating when filing out those forms...take a deep breath and carry on !

Hi,

You're fine with the copy for the initial paperwork to the USCIS. You will however, need the certified copy for the interview.

I sent a copy when I filed for our I-130, and got my hands on the certified one this week. My attorney did not send it with the judgement either. When I called my attorney to request it, his paralegal made it seem as if I were asking for her for the holy grail...Given that it took over 1 year for them to take care of an uncontested divorce, I decided just to go to the courthouse myself !
It took 5 mins and the cost was .50/per page.
All you need to do is go to the city/county that the divorce was filed in, show I.D. and you're good to go...

I missed your post re:wrong information...

My husband messed up his mum's birthday year on his G-325's...as long as they have supporting paperwork, they should be smart enough to figure it's a simple human error.
Worst case, they send you the paperwork to correct, which you can turn out back to them the same day or the day after and you'll be back on track.

Good Luck, but I think you'll be fine.

Don't fret about the RFE too much...
I had one a few weeks ago on my 864-a STUPID mistake on my part, as well as unclear instructions on theirs...

In any event, I got the checklist within a week, corrected it that night and sent it off the next morning priority mail. They rec'd it in 2 days, and we're back on track.
Sure it does suck, and it holds things up a bit, but call the NVC and try to find out what's missing. Then, do your legwork as soon as they tell you what you need to fix it. When you have the actual RFE in hand, do your thing and turn it out the same day or the next day.

It happens, and when it does it's a bummer-but keep the faith, be proactive and keep the ball rolling along.

From what I have heard, you are fine as you got your NOA1 before the dreaded date.

Does this surprise me? Not at all. It's been my experience that most paralegals do most of the work, and are so burnt, they can't see straight 1/2 the time.

Get for a refund and do your AOS yourself. How can you know they won't screw something up again ? My thinking is, if you want it done well-don't trust anyone else but yourself.

Sorry that you had to go through this, but glad you got it sorted.
