K-1 Fiance(e) Visa Process & ProceduresWe have started our long journey....
Congrats on starting your journey, Moonie! Just sit back and relax... if there's anything CSC needs from you they'll ask for it, and there's nothing you can do about it til then anyway. Did you pay by check? If so, watch your online banking account. When the check clears you can view the back of it and get your reciept number, then you can set up an online account with USCIS to check your case status.

At least we found Visajourney.com, right? I'm sure everyone reading this post understands that it's difficult to find empathy when dealing with a K1 visa.

I have to disagree with you on that one. That is what VJ is all about, people that went or are going through the same process as we are, and are willing to share their knowledge to help us, lend us a shoulder to cry on when things get tough, cheer us when we get tired and share our happiness when we complete each step of the way.

I took that sentence as meaning it's difficult to find empathy among our friends/families because they don't understand what we're going through. They can try, but they don't really know... but everyone on VJ is going/has gone through it, too, so the folks here on VJ can understand in a way that our friends and families can't. I could've taken it the wrong way, though. :)

You're not un-informed, you're new, welcome to VJ. :D You already got your answer, I just wanted to pop in and say that!

In my controls it's on the left side, under "Personal Profile". Click "edit signature" and type away. There's tools there to change fonts, sizes, colors, etc.

K-1 Fiance(e) Visa Process & ProceduresGetting Ready to Send I-129F Packet please review..

1. Check for $170.00

Not to sound stupid, but make sure you sign it! I've read about people getting their packet returned because their check wasn't signed.

4. Statement of "How we met" attached as continuation of question 18 of I-129F

If you want us to proofread it feel free to post it. I had the VJers here proofread mine, and also a letter I have to include for my fiance's interview. There's some good editors here!

5. Letters of Intent from both of us. (Her is a printed scanned image, she has the original, will we need the original before her embassy interview? Grrrr, can't believe I didn't have her do that when I was there.)

Needs to be signed by her doesn't it?,,,, in ink.

Yup - original is needed there.

6. Proof of meeting, and ongoing relationship: Pictures from January 2007, February 2006 of us together in Philippines. Boarding passes for my flights, and for our flights within the Philippines. Hotel receipts. Ferry boarding passes. A few specially selected emails printed, spanning our two years. Vonage activity report showing over 2000 phonecalls between our phones. Engagement ring receipt. Receipts from flowers and gifts sent to her over the last 2 years. (Should that cover it?)

Proof of ongoing relationship isn't needed at this stage, it's needed at the interview. ;) You can send the Vonage, e-mails, and flower/gift reciepts if it makes you feel better, but it's not required now.

Can you make photocopies/scans of your passports to show your passport stamps? Did you ever use a credit card/debit card/ATM while in the Philippines? (If you did you could use your transaction history as proof as it would place you in her country.) On the back of the pictures write both of your full names and, if you can remember, the date and location of the photo.

8. Passport Photo of me, being taken tomorrow./10. Her passport photos.

Make sure you write your full names on the back of each photo. ;)

9. Her G-325A (dated and signed) plus attached page showing her complete addresses, since the addresses would not fit in the little boxes.

Are the attachments signed and dated by her? How many copies of the attachment do you have - 1 or 4?

Oh, and make sure you make a copy of the ENTIRE packet before you mail it off.

K-1 Fiance(e) Visa Process & ProceduresA dose of perspective for me
Awww, what a sad story in that article. The picture of them hugging goodbye reminded me of our last goodbye. You're right, it's been torture being apart for 14 months, but at least our lives aren't in danger, and we both don't have to move to a completely different country because neither of our countries will accept us. This is a good reminder of while my situation is bad, it could always be worse.

K-1 Fiance(e) Visa Process & ProceduresVISA APPROVED!!
Thanks all! :D Hoo we're so relieved!

3 months start to finish. Some people have all the luck. Congrats.

I like how you have to make comments like that every time I celebrate something good that happens. I'm sorry you have to wait so long, but it's not my fault, I don't even agree with the way the workloads between CSC and VSC are so unbalanced, so don't take it out on me. ;)

Congrats my dear! We all knew it would be a success, and you were all worried! (F)

 True enough!

Congratulations!! I flew home from Paris this morning, and wanted to check in on you to see how it went today. That's fantastic!! You must be so excited!

Aww! :D Yeah, this is VERY good news for you! You guys don't have ANYthing to worry about! Painless medical, a really funny doctor with a good sense of humor, no objections to getting the vaccination supplement, no looking at evidence of ongoing relationship, no tough questions - it's gonna be a breeze for you two! Larig told me that after their interview but I was still worried, so take it both from me AND Larig - Paris is an easy embassy, you guys have nothing to worry about!

Yep, I knew it ! I knew it!! :D Whew... not I can uncrossed all of my fingers and toes for a while... that was pretty exhausting... :P Congratulations!!!.... and good luck on finding the apartment!!! hehehe....

*scratches chin* How'd ya walk around with all yer toes crossed without falling over?

I've been watching for this ALL DAY! What's up with making us wait so freaking long? Sheesh! :P

Congratulations!

I was in work silly! :P  I found out at 9:30am when I listened to his voicemail in a bathroom stall (no cell phones allowed on in work unless there's an emergency). There's no internet access at or near work, so I posted as soon as I got home.

It only took 3 months? Wow... I'm hoping mine will be quick too (I'm hearing it will b/c it's through Vermont) but I don't want to get my hopes up, just in case. :S

Oh it'll be quick, you can hope. Did you send off your petition yet? If not, just triple check everything and do your best to prevent an RFE. If you don't get any RFEs you should be out of VSC within a month, if things are still the same as they were when I went through. I don't know about the Canadian side of things though.

K-1 Fiance(e) Visa Process & ProceduresVISA APPROVED!!
 My fiance's interview this morning went well! They took the I-134 even though they ask for the I-864 in packet 3. They didn't look at one shred of evidence - photos, chat logs, phone bills, nothing. They asked him 3 questions: what's her name, what kind of job does she have, and what do you plan on doing once you move. He got the last vaccination he needed and went back to the doctor, when he asked for the vaccination supplement she told him that she was going to give it to him without him asking. Sheesh, talk about easy! Hopefully it'll be that easy for me to find an apartment so he can move here ASAP! :D  Thanks for all the help and patience everyone! :D

K-1 Fiance(e) Visa Process & ProceduresErr, one more question. About NOA2
Ask on the regional forum if anyone has a free number for your embassy. I know with Paris embassy it's like 12 euros, or something like that, to call. But someone here discovered a free number for them.
RosaMystica7FemaleFrance2007-03-04 14:45:00
K-1 Fiance(e) Visa Process & ProceduresErr, one more question. About NOA2
I'm glad you found the NOA2! :) The timeframe I don't know the answer to, I bet someone else here will be able to help you with that though. Could your fiancee call the embassy tomorrow to ask?
RosaMystica7FemaleFrance2007-03-04 13:53:00
K-1 Fiance(e) Visa Process & ProceduresErr, one more question. About NOA2
The letter that you have, does it say your petition is being forwarded to such-and-such embassy and have a barcode on it, signed by the Bureau of Consular Affairs? If so that sounds like the letter I got from the NVC.

I did send my fiance a copy of the NOA2 for the interview, they didn't ask for it. But as was said, the original is defnately needed at the AOS. I suggest you tear through your house and try to find it by the time AOS rolls around. :)

K-1 Fiance(e) Visa Process & ProceduresMust you change your name?
Works for me, too. I wouldn't be hurt if I didn't have an engagement ring. I don't even like diamonds, to be honest. I'm not much of a jewelery person. I don't even know if I spelled jewelery right, actually...
RosaMystica7FemaleFrance2007-03-04 18:52:00
K-1 Fiance(e) Visa Process & ProceduresMust you change your name?

I kept my last name when I married. My husband had no problems with it - and neither did USCIS. I included a short statement with my AOS application about why I was keeping my own name and we were approved without an interview:-).

Hmm, does that mean I should include a statement saying I don't want the first 3 letters of my last name to be a-s-s? I'll have to figure that out when the time comes.
RosaMystica7FemaleFrance2007-03-04 18:07:00
K-1 Fiance(e) Visa Process & ProceduresMust you change your name?
I'm planning on keeping my own name, at least for now. My name has a funny meaning in Italian and I'd miss not having it anymore. Besides, the first 3 letters of my fiance's last name are a-s-s! "How do you spell your name miss?" "A-s-s..." No thanks! We thought of hyphenating, but MyName-HisName has the same rhythim as Snuffulufugus, and HisName-MyName still starts with a-s-s! We thought of combining our last names, but going back to point one, I'd miss the funny meaning of my first and last name together. We joke about this all the time, it's one of our funny things at the moment. He hasn't offered to take my last name yet, I think it'd be a blow to his ego, and his family wouldn't exactly be happy. Like someone else said though, I like the sound of Mr. and Mrs. So-and-so. We've decided to keep our own last names and figure it out when kids come into the mix!

So yeah, I, too, am glad that it's not considered a red flag.

K-1 Fiance(e) Visa Process & ProceduresK1 interview tomorrow - fingers crossed!

14 months?!?!?! Wow... Anywho, GOOD LUCK!!!!!!!!!! I cant imagine how excited you are!!!

Yeah, 14 months, it's been hard. We've been saving away every cent we can to move him here. 5 months ago we were both broke - he was in debt, I had $0. Now we've got enough to move him here and have a few thousand extra left over in the bank. We knew spending money on a visit would set back when we could afford to move him here. So we figured better to be temporarily apart longer and move him here permanently sooner!

He's in the embassy NOW! RIGHT NOW! I'm hoping I'll find out the result before I start work in 55 minutes... if not, he's gonna text me and I'll check my text messages in the bathroom so I don't have to wait til my lunch at 1:30 to find out.

Thanks guys! 9 hours and 12 minutes left! :o

Someone please tell me why they cant ship the overload of CSC petitions to VERMONT!!! ARGH - Filed in November and interview date in February...I want to cry.

I don't need any help feeling bad about that. ;) Yes I know most CSCers don't even have their NOA2 by the amount of time it's taken us to get to the interview. Yes I feel bad about that. Yes I feel it's unfair that they don't even out the workload. I think the list of states going to VSC compared the list of states going to CSC is stupid and the government should really even it out. But... there's nothing I can do about it, and it's not my fault, so there's no sense in making me feel bad about it while I'm going through a lot of stress and excitement and worry with my fiance's interview. ;)

K-1 Fiance(e) Visa Process & ProceduresK1 interview tomorrow - fingers crossed!
My fiance just got out of his medical, other than needing 1 more vaccine all went smoothly and quickly. (The physical part of it was only about 10 minutes!) His interview is at 1pm his time tomorrow, 7am EST. I can't believe it came so fast! It feels like just yesterday that we realized we'd have to wait two whole gigantic months til his interview... and now... it's here! :o People here told me it'd fly after NOA2 and I didn't believe them... well... wow, it flew! Guess who still hasn't secured an apartment? ME! Oops. I have to put together the chat logs/e-mails that my fiance will print tonight (hah, last-minute-Angilla, I'll never learn) and then I'll have to get to work on the apartment hunting. I just can't believe it! 14 months since we've seen each other - and since we first started planning to file the K1. Finally over. Finally! My poor fiance really started to panic about the interview last night, I calmed him down... now I'm the one nervous, and I can't show it cuz it'll make him nervous! So instead I figured I'd ramble here! And make myself late for work like I always do on VJ!

So anyway, please everyone, fingers crossed and prayers said tomorrow. Let's bring my baby home!

K-1 Fiance(e) Visa Process & ProceduresCould this be true?
Not to be a party pooper, or sound stupid, but did you double, triple, and quadruple check that you didn't make a typo in the case number?
RosaMystica7FemaleFrance2007-03-03 12:01:00
K-1 Fiance(e) Visa Process & ProceduresWhat problems have I caused myself?
As far as the sickness thing... to be honest, the way you worded it sounded like you found out that she has a STD or something and you dumped her because of that. In my opinion, mental illness, depending on the illness, can be another ballgame... if it's one that can put your childrens safety at risk, I understand, and I would imagine that would've been a difficult decision for you to make.

Anywho. I don't really think it's our place to judge why the poster dumped his ex-fiancee and his character because of that decision.

:ot2:

Sooooo, about whether or not that petition will screw things up for your next petition whenever the time comes for it... like fwaguy said, you'll need an IMBRA waiver after the second petition. So if you file for the new lady, make sure that you really want to bring her here. The visa process is too expensive and stressful to have to deal with a 3rd time anyway. Learn from this experience, take your time and get to know the new lady for who she really is, and DON'T RUSH IT ;).

No, if you're unemployed you have to state that. Even if you're writing past jobs and you were unemployed for a few months between two jobs you need to state that unemployment. There can't be any gaps in the 5 year record you have to put there.

Rebeccajo - if he writes "unemployed - disabled" (or just "unemployed") in that section will that affect if he gets approved or not? Or no because it's not their job to judge that at this point in the process?

K-1 Fiance(e) Visa Process & ProceduresTrying to marry a french citizen, don't understand times

Yeah, we can do that. It just sucks that I can't mail off the stuff tomorrow.

Better to wait a week for the required forms than to have the case delayed for a month because of a RFE.

Heh, she told me to move their because immigration is so easy.

My fiance said he met a few US citizens living in France and they had told him immigration isn't all that simple. We never looked into it further because I don't speak French, unemployment is high and it's even higher for foreigners, I don't like most French food, etc. He's lived in the States before, he's fluent in English, he wants to go to an American college, etc. It just worked out for him to move here.

I don't know what the poverty guidelines are

Here you go. So if your grandma's household is herself and her husband, she'll have to be making 125% of the poverty guidelines for a household of 3 - $20,750/year.

I only say the number because I read a case in one of the guides where the person was denied because they were on disability (I'm on SSI).

They're only concerned with making sure the immigrant won't become a public charge. If your sponsor meets the requirement, you shouldn't have a problem.

Should she have a job or is stating she plans to work as well as going to university enough?

My fiance's response to that interview question was, "Marry my fiance, take the first job I can get once I have working papers, and live happily ever after!" to which the interviewer laughed.

Best of luck! My fiance has his interview in Paris next week, and the process for us has been pretty easy. We started in October when we mailed in our I-129F, got one RFE, and it was approved at the end of December in Vermont.

Woohoo it's getting close! Good luck to you both!

K-1 Fiance(e) Visa Process & ProceduresTrying to marry a french citizen, don't understand times
Oops, missed your other questions because we posted at the same time.

Can you just make copies of the form? She's in France now (well back on a plane), and for her to fill it out and sign it and mail it to me will slow things down by at least two weeks.

Nope, they need original signatures in ink. A photocopied signature will lead to a RFE (see next paragraph). Can she afford the money to ship it by a faster method? I ended up having to DHL stuff to France at one point.

RFEs?

Whoops sorry. RFE = Request for Further Evidence. If you forget to include something, or they need further clarification on something, they'll send you a letter asking for you to send them the additional information that they require. This will cause a delay in your case while they mail you the RFE, you collect the required info, and you mail it to them.

What are the reasons a visa won't get approved? I read the official reasons (which are obvious), but I don't know if there are more. I am worried about the statement of support.

Look at it this way. The employment situation in France is horrible and France is being loaded with immigrants. They want as many people out of the country as possible. If they're going to deny a person from leaving, they're gonna have a dayum good reason for it. ;) Does your sponsor make 125% of the poverty guidelines for their household plus 1 more?

What do they ask at the interview?

They asked my fiance 4 questions: what's her name, how did you meet, what does she do for a living, and what do you plan on doing once you're in the States. They didn't look at a single shred of proof of ongoing relationship. He was in the embassy for an hour and a half and most of that time was spent waiting to be called in.

K-1 Fiance(e) Visa Process & ProceduresTrying to marry a french citizen, don't understand times
If you fill out the form electronically (go to the download section of the site), when you complete the first page it'll fill the other 3 out for you. Print all 4 pages, sign and date each page. Then have your fiancee do the same, all 4 pages. Each page has the same information on it, but each page goes to a different place at VSC - so they need 4 pages each with original ink signatures on them to go to each place.

K-1 Fiance(e) Visa Process & ProceduresTrying to marry a french citizen, don't understand times

Can you tell me about the medical exam?

It consists of 3 places: 1 place for bloodwork to be drawn (checking for HIV and whatnot), 1 place for a quick chest xray, and 1 place for the physical exam. The doctor that does the physical is awesome, very sweet lady with a great sense of humor. The physical took about 10 minutes for my fiance and was mostly yes or no questions. A concern I see a lot on this board is do they have to examine the, erm, private regions. Well, I don't know about for women, but for my fiance they did not. ;) All 3 buildings are pretty close to each other, within walking distance. What else do you want to know?

Yes, you both need to fill out all 4 pages of the G-325a.

How do you fill out four pages when there's only two people involved?

You fill out 4 pages, your fiancee fills out 4 pages. The 4 pages are identical, they just go to different places once they're processed.

If it only takes three months, then we don't care. She has to finish university and that ends in June. I just saw on the Vermont page they are processing applications back from August 20th 2006. Why is it saying that and people are getting it in 2-3 months?

Vermont and California have very different processing times. People going through CSC generally take 2 - 3 months just to complete the USA side of the process. People going through VSC generally take only a month. Why the Vermont page says that is beyond me. In actuality, VJers going through VSC are getting their NOA2s in a month or less. Unless a RFE is involved, that could slow things down. Maybe the case being processed from August 20th has had multiple RFEs? ;)

You have to go to Paris for this? Not the embassy in Marseilles?

Nope, this is Paris. ;)

K-1 Fiance(e) Visa Process & ProceduresTrying to marry a french citizen, don't understand times
Another Frenchie, yaaaaaaay! Welcome! Come join our France/America couples post!

Take a look at my signature, we also went through VSC and Paris embassy. It basically took 3 months til he had his visa in hand. Paris embassy is a cinch - the medical is a breeze, the interview is a piece of cake, no problems no hassles!

Yes, you both need to fill out all 4 pages of the G-325a.

As long as your co-sponsor makes 125% of the poverty guidelines for their household PLUS one more, you'll be fine. Paris requests the I-864 and then takes the I-134, they're sort of confused in that matter. So make sure your sponsor is comfortable filling out BOTH forms. We didn't want the embassy to take the I-864 so when they asked for "financial documents" my fiance played stupid and handed them the I-134, they took it without any problems. In the past at other VJers interviews, they offered both and the embassy chose the I-134. But still, packet 3 specifies they want the I-864, so you'll need to have that at the interview just in case.

There's no fee you could pay to speed up the process. Sure she can come visit on the VWP, she just has to go back for her medical/interview. If she's going to come you may want to get her here before you send out the petition - it's a bit more risky to cross the border with a K1 petition processing. She'd need to bring proof of strong ties to her country (i.e. bills, letter from employer stating the date she'll return, etc.) and even then the border patrol officer COULD turn her away if they decide she doesn't have a good reason NOT to decide to stay here and never leave. So if you want her here during the process (especially if you want to bring her here for 3 months), I suggest bringing her here and then mailing out the petition a little while after she arrives. ;)

I think I got all your questions. Please do come over to our France/America couples post and join the fun. I posted my fiance's medical/interview experiences there, and we'd all be glad to answer any Paris-specific questions that you have. :)
