K-1 Fiance(e) Visa Process & ProceduresIssues getting visa for my Mexican fiancee?

Thanks. Just was curious because I hate waiting especially something like this. I'm trying to time this thing perfect.

There's no such thing as timing things perfect with the USCIS. You can use the information here to guess how long it will take, but you can't really know for sure.

K-1 Fiance(e) Visa Process & ProceduresMY QUESTIONS REGARDING I-129

I put his parent's address, 'cus he'll stay there until I'm close to arriving, then we're renting a place of our own. I'll update the address once we start the AOS.

That's a good way to think of it... rather than "I have nothing else to put so I'll just say he's gonna live here." I WILL be staying here right up until it looks like he'll be coming, then like you, I'll get an apartment for us both.

K-1 Fiance(e) Visa Process & ProceduresMY QUESTIONS REGARDING I-129

aselano: I put my parents' house, since I'm in the same exact situation as you and staying there too (hehehe staying, I can't even bring myself to write "living" as I got back here a few months ago and will freak out if I'm here much longer). I think it was Yodrak or someone else knowledgeable who told you to put TBD, since that is technically the most truthful answer.

I still don't get why.

Why not attach an explanation? I attached an explanation about Rey's lack of middle name after the G325As, just to be clear.

Thanks! I have to add an attachment for my I-129F anyway... his 3 middle names don't fit in the box provided. So maybe I'll just answer it on the same piece of paper, marking the two seperate questions clearly. *scratches chin*

Given that the people who process are not all that smart, I would simply put your parent's house. I would be afraid that if you put TBD they will lose their minds in confusion (first trying to figure out what TBD means) and would send you an RFE to provide an explanation. Go for the simpliest route here - they don't know it's your parents house and they don't need to know that you are planning to get an apartment later after you save enough money - and truthfully, I doubt they care.

What about the option of explaining it briefly on an attachment? "His future address of residence is currently unknown. I, the American fiance, will secure an apartment for him prior to his arrival in the United States." Something like that?

If that'd be bad for some reason then I'll just give up and put my parents' house. :) I don't really feel right putting it, though.

K-1 Fiance(e) Visa Process & ProceduresMY QUESTIONS REGARDING I-129
I have a similar question to gsitlani... I guess I might as well put it here rather than us having 2 posts going about similar topics. :)

I'm currently living in my parents' house. The last time I asked this question I got two different responses - either I could write down my parents' address, or I could write "to be determined later" or something similar. Perhaps I could add an attachment explaining that I will secure an apartment prior to him moving here, but am currently living with my parents to save money? I don't want to have too many attachments for them to get confused by... but I don't really feel comfortable writing my parents' address since that's not where he intends to live.

K-1 Fiance(e) Visa Process & ProceduresPassport Style Photo
If it were only the SIZE of the photo itself, I'd say bring it to a photo place and see if they can adjust the size while keeping the quality of the picture somehow. But since the facial profile is also larger... I suggest seeing if she can get the photos re-done correctly.

I was sitting here thinking, "Wow, how'd they do that? Well, maybe they noticed a pattern, maybe they order the same pizza on the same day each week, or something" and it wasn't until I read the other comments after it that I realized you were kidding. ... Or, weren't you kidding?

K-1 Fiance(e) Visa Process & ProceduresDo I even need a K1 as a Canadian?

American Samoa doesn't count as that is not part of the "United States" as defined in the INA...

Sorry, I just saw it was on a list of US territories.

Does the INA define Puerto Rico and the US Virgin Islands as part of the "United States"? Those were suggestions that someone mentioned earlier, and I've seen mentioned in the past.

Maybe Hawaii would be the safest since it's one of the 50 US States - shouldn't be any doubts about it being okay to go there, right? ;) Hawaii's beautiful anyway, it would still make for an incredible honeymoon, just without the risk of a dentention center/ban from the US on the way back.

K-1 Fiance(e) Visa Process & ProceduresDo I even need a K1 as a Canadian?
You're welcome! We here on VJ try to help as much as we can - but in the end, we're only non-lawyer humans so there's only so much that we can do. 99.9999999% of my questions have been answered here wonderfully, but there was just one thing left that I got varying responses to and it wasn't a question that I could toy with - I needed a solid answer. But yet I couldn't afford to (and wouldn't want to if I could) pay $75 - $100 for a "30 minute consultation" with an immigration attorney - I only had 2 questions that would take a matter of minutes to answer! I found a link to Laurel in the forums here, and she was a huge help.

This whole visa process can make your head spin. Good luck with trying to get all of this straightened out. :)

I saw someone mention Puerto Rico and the US Virgin Islands as suggestions of places to go - how about Hawaii? That's totally American so even if you're not legally able to leave and re-enter the US you'd be fine, and that's just as beautiful as the Carribean. :D I think Guam is a US territory also... oh, and American Samoa. And some others that I've never heard of before.

Laurel Scott, an immigration attorney, has free chats on Wednesdays at 11am CST for "quick questions." So if you're not satisfied with the responses you're getting here and you can boil your confusion down to a few questions, maybe try that. ;)

K-1 Fiance(e) Visa Process & ProceduresPoint of Entry Question
I live in NY and my fiance will be flying into JFK because of convenience... there's a train station in my town that goes to Jamaica station, which has an AirTrain that'll take me straight to the JFK terminals. :D So if ya'll wanna wait a few months, I'll let you know if he gets it when he moves here.

If it's feasible to make the POE JFK, then go for it. If it's not feasible, I wouldn't go out of your way too much since it's only rumor and not a guarantee anyway. It's no harm to ask at the interview like William said. Does anyone know what this stamp is exactly? If the beneficiary knows what the temp EAD thing looks like and he/she doesn't get it at POE, it couldn't hurt to ask for it there, either. The worst they could say is "no" and at least you know you tried. :)

K-1 Fiance(e) Visa Process & ProceduresWhen to file

It may be safer for us to just wait the 3 extra weeks and file as soon as I arrive. We have waited so long already I'm impatient to get moving on this but don't want to risk any complications either.

I agree - that's what I would probably choose to do if I were you. It sucks to wait, but it'd suck even more if your plans of staying here with him for 6 weeks got ruined.

K-1 Fiance(e) Visa Process & Proceduresanother I-129F quick question

Click on "example forms" and open the I-129F. There you'll see that, in that line, they wrote "(ONLY complete for Naturalization Certificate)". So no, if you choose birth certificate you just check the box and leave that line blank. If you choose naturalization certificate, then fill that line out.

It's oddly worded on the form though. They should really specify "Give number of naturalization certificate" instead of just "give number of certificate." But then again, the USCIS doesn't seem to like logic too much.

So thats where I saw it!!! I thought it was a thread!!! Geez. :)

There's so much information on here, I've done that too. "I know I saw that somewhere but... was it in a post? The guide? The FAQ? Where?"

K-1 Fiance(e) Visa Process & ProceduresG-325A Signatures
My mom told me that his signature on any legal document needs to be legible, i.e. they can make out all the letters of his first and last name. But yet he never signs his name like that. He says it's his first initial and his full last name but honestly... *looks at the scribble*... I don't see it.

He's been "practicing" a new signature because of this, lol. I don't like the idea of him changing something as personal as his signature, though. So I'll tell him that, as long as the scribble you write looks like some sort of Roman letters and looks the same on every form you sign, just send it to me. ;) Maybe he can just slow down a liiiiiiiiiiiittle bit so the last name looks like what it's supposed to say.

K-1 Fiance(e) Visa Process & ProceduresDo you have to fill out every blank?

... If it tells you to fill out all questions and not leave any blank then dont leave any blank. ... Leaving questions blank could get you an RFE because the case worker may think you just skipped that question.

I just got confused, that made me think I had to re-do my forms to put N/A in everything I thought was supposed to be left blank. ;)
RosaMystica7FemaleFrance2006-08-07 06:27:00
K-1 Fiance(e) Visa Process & ProceduresDo you have to fill out every blank?
But look at the example I-129F. For question 10 they checked "birth certificate"... the field below it says to ONLY complete if you checked naturalization certificate, which I assume means you leave it blank if you chose birth certificate. The other two boxes below it were left blank. For question 17 they checked no and left the box below it blank. So it seems as though if you check the box with an answer that doesn't need to be filled into the space below it, you can leave it blank.

I guess there's no harm in putting N/A in them... but... I personally would prefer filling out my forms as the example forms show. :)

K-1 Fiance(e) Visa Process & Proceduresusps or courier?

Just my two cents. Send it 2-3 day usps priority mail for $4.05. Why waste your money? Most likely will arrive in 2 days but maybe 3. Getting that extra day or two really is NOT going to speed up the process. Save yourself the cash as this process is already expensive enough.

LS

I personally will be sending it overnight because I don't want all of this stuff sitting around for 2 - 3 days... both of our social security numbers along with other sensitive info. It'd be more peace of mind for me to know that it was out of the mail as fast as it could be. ;)

I did hear something weird about VSC that maybe someone could clear up for me... I heard that if you mail it FedEx it goes straight to the service center, but other ways and it goes to a nearby town.
