K-1 Fiance(e) Visa Process & ProceduresTSC Texas service center
TSC doesn't process K-1 petitions. They recieve the K-1 petitions and then forward them to CSC (California Service Center). So check CSC's processing times. :)

K-1 Fiance(e) Visa Process & Proceduresgetting ready to file

1. I have 2 x 2 passport pictues frontal view... Is this correct?

Yup.

2. The Adobe G325A form I filled out was giving me trouble and the dates would not fit in the space provided. I typed all other information and wrote in the dates with pen and initialed each page. Is that sufficient?

That's what I did, and I've heard of others doing the same here with no problem. ;)

3. Are copies vs. originals of my boarding passes and itineraries acceptable?

Definately! Don't send originals of ANYthing except the papers you have to sign - letter of intent, I-129F, and G-325A. The rest just make copies - birth certificate, passport, evidence of having met, etc. You most likely won't be able to get back anything that you send to them and you need to send the originals over to your fiance(e) for their interview.

4. I live in Ohio and Nebraska is listed as my service center, but I have read that they are being forwarded to California. I am planning on mailing to Nebraska but I was just wondering if I was missing something somewhere.

Nope, you send it to Nebraska and they do the forwarding. Lesson #1: The visa process is inconvenient and, for the most part, does not make sense. ;)

What else can I tell you... double check the G-325A's, make sure you have all 4 pages for both you and your fiance(e). Double and triple check all the forms for signatures. If you included any attachments make sure they're signed and dated. Make sure you include and sign the check - I've seen people here get the package sent back to them because they forgot the check, or didn't sign it!

Good luck!

Thanks all! :D

Congratulations!!!
I've read your posts for weeks now so it's always great to see someone get approved.
I couldn't believe it when I got my NOA2 and then when we got our RDJ number from NVC I cried again. And my friends have gotten just as exicted as I have!!!
:crying:

I've been kicking around this website since December 2005 planning to send the petition. First I got sick for months, then I couldn't find a job, then the job I did find wasn't good enough, then I had to interview for 2 more months before I could find a job that was good enough... ei yai yai! A year later, we get our NOA2! I hope this means he'll be able to move here in February... it's gonna depend on the wait time for an interview in Paris. February will be 14 months since we've been together in person, that's long enough for us!

I'm trying to finish an assignment for my sociology class... couldn't figure out why I couldn't read the book... then I realized... it's up-side-down! Oh man, ya think my mind is elsewhere right now? What a night to have final projects due!

Come move to Long Island, friends are welcome! :D Brnidokiegurl I see you got 3 touches in a row and then silence. Well I got 2 touches in a row and then silence. There's something good about that pattern!

Pfft, I'd settle for 0.5 as long as the word "approval" and not "request for further evidence" was in it!

I am so excited for you that I too want to scream!

 Awww, you're too cute! Just give my parents and parrot advanced notice so you don't scare the living bejeebers outta them like I did!

K-1 Fiance(e) Visa Process & ProceduresAPPROVED!
Thanks so much! :D

To be honest with you, I was getting worried. I know the VSC journey is nothing compared to what you CSCers go through, I don't mean to diminish that at all. But 2 people with NOA1 dates after me have already gotten approved and the 1 month mark was coming up, VSC people seem to get approved in 2-4 weeks so I was starting to get worried that maybe I had done something wrong or there was a problem or whatever. At the time of the approval e-mails I was PMing people I found through the timeline search who have NOA1 dates similar to mine! If I got this worried, up-tight, stressed, etc. I can only imagine it's 10 times worse for the CSC folks and my heart really goes out to you guys!

So I just got off the phone with my fiance. I sent him a text message saying "call me now" and when he called me I was crying so hard I couldn't talk. I kept trying to say "we're approved" but he couldn't understand me and was trying to console me. Finally I yelled,"You don't get me, do you? We're AP-PROV-ED!" And he started screaming right there in the train! It was too funny!

Oh man. I can't believe I'm crying like this. I'm not a big crier LOL. I really scared my parents!

Congrats! I got approved from VSC yesterday, too! :D

Please do fill in your timeline. For people with timelines who didn't get their NOA2 yet it says "your case may be adjudicated as early as ___", which is based on other people's timelines. Mine said January 19th when I got approved, lol. More current, faster timelines will drop that number for other waiting folks. :)

K-1 Fiance(e) Visa Process & ProceduresI-129F

If your fiance(e)'s native alphabet uses other than Roman letters, write his or her name and address abroad in the native alphabet.

Hmm, I see how this can be confusing. If he wrote his name and Chinese address in Arabic... what good would it do for the USCIS? Then again, we can say that about a lot of things in this process. But that's besides the point.

Luis&Laura's answer makes sense. If they're going to mail your fiance something in China, how would they need to write his name/address? I think the USCIS is assuming that most fiances will have lived in this foreign country for their whole lives, so their native alphabet is how their name/address is written on mailings.

I'm not sure myself, though... just an opinion.
RosaMystica7FemaleFrance2007-01-06 10:05:00
K-1 Fiance(e) Visa Process & ProceduresG-325A previous marriage date and place box
Definately use a supplement sheet, as was said above. If you shorten or leave out info you could risk a RFE. Just make sure you sign and date ALL supplemental sheets. ;) How I laid it out was:

G-325A SUPPLEMENT FOR [FIRST/MIDDLE/LAST NAME]

Section x, question x: Question repeated here?
- Answer

_____________________ ______________________
Signature [-----------------------------] Date

Minus the [---] of course, that was just to do the spacing in this post. Then I signed and dated on the lines. It made it easier for me when I was double and triple checking the whole packet to make sure I signed everything that needed a signature.

Edit: Oh, and for a supplemental sheet for the G-325A - do FOUR copies, one for each page, each one signed and dated. Each page of the G-325A goes to a different place, so each one needs the supplement sheet.

K-1 Fiance(e) Visa Process & ProceduresBirth Certificates at the interview
My opinion... fax or e-mail over copies of the front and back just for him to have so you two will feel better, and get a certified copy of your birth certificate and put it in the mail to him - now. It may not make it in time for his interview, but should they ask to see the original - which they can do if they want to - at least you'll know it's already on its way down to Brazil. In that case, the visa would just be delayed til he could show them your birth certificate, so having it already on its way would save you two some time. :)

K-1 Fiance(e) Visa Process & Proceduresmeeting requirement
Well, I think she said that he previously had a tourist visa BUT he didn't use it. If I read that right, I don't think that'd either help or hurt his chances of getting a tourist visa again. Though I'm hoping that, since he got it once, he'll be able to do whatever he did last time to get it again.

I think that's a question more suited for the regional forum, so she can talk with others who have dealt with getting tourist visas from Mexico before. :)

K-1 Fiance(e) Visa Process & Proceduresmeeting requirement
I know the nosiness here has pissed me off, but saved me twice. There were two times that I was going to send out the petition - January and around August - that if I had sent it out we would've been screwed, there's no way he would've gotten the visa. It would've been a waste of our time and money, and even if he did get the visa I was in no shape to support him. I got really angry when people asked me if I had a job, and my income, and "how the heck do you think you're gonna support two people in an apartment with THAT salary?" Yes I was livid. But once I stopped being so angry I thought about it... and as badly worded as the advice was, it was true.

So people here generally mean well, it's just sometimes they word their advice all wrong. As much as we need to grow thicker skin, people also need to be more careful with how they say things. Yes this is the internet, but we're talking about sensitive issues to real people who have feelings. A little politeness could go a long way. ;) And that's not aimed at anyone in specific. Just a general comment.

K-1 Fiance(e) Visa Process & Proceduresmeeting requirement

I once read that something like 40% of K1 visas are never even activated.

Wow, that's nuts! I wonder why? Maybe all the stress and confusion of the visa process breaks up the couples that never would've made it through marriage in the first place. That's still a crazy statistic, though... wow.

It's okay Phedre LeCroix, bostonparis just understood a few things wrong. :) Easy to do in a thread that changes gears between the original post (you asking about the waiver) and the outcome (you learning that him getting a visitor visa is ok and deciding to go that route).

You know what I learned on the off topic forum? You know what a penguin that sits on ice for too long has? Polaroids. So corny I found it funny, it actually made me laugh.

We're all under a lot of stress here - it comes with the visa process, so put a lot of stressed out people together and kaboom if we're all not careful. So... let's all keep this post on a good track. :)

K-1 Fiance(e) Visa Process & Proceduresmeeting requirement
Bostonparis, she was asking about the waiver only because she was under the impression that him visiting her in the States would be fraudulent, and she is physically unable to go to Mexico. Now that she's realized that it won't be fraudulent for him to visit her, she said they'll go the route of getting him a visitor visa so they can spend some time together. So they're going to meet in person before doing the K1 shebang. ;)

LOL Thingee, I'll try to type slower for you. :P

Yeah, the last time my fiance had to go back to France... oh did we sob... and sob... and sob some more... it was just so depressing. But just know that after that visit, if you choose to file for a K1 or K3 visa, the NEXT time you see him again there will be no more goodbyes. (F)
RosaMystica7FemaleFrance2007-01-06 15:16:00
K-1 Fiance(e) Visa Process & Proceduresmeeting requirement

My question simply was on the waiver bit, and can he come here first to visit on a tourist visa even if we plan to be together permanently.

Like I said before, I dunno about the waiver bit, but about the tourist visa yes - he can visit you, as long as he goes back to Mexico before his visitor visa expires. It would only be fraud if he got the visitor visa intending to marry you and adjust status and never leave the States... but it's fine for him to use the visitor visa intending to leave the country before it expires and come back to the States eventually on a K1 or K3 visa as your fiance or husband to live here permanently.

Short answer - yes, get him that visitor visa and spend some time together, it's not fraud as long as he leaves before the visitor visa expires! :D
RosaMystica7FemaleFrance2007-01-06 14:50:00
K-1 Fiance(e) Visa Process & Proceduresmeeting requirement
I can't help on the waiver part of it... but he can come over on the visitor visa AS LONG AS he plans to return to Mexico for the time being (not permanently). It only becomes fraudulent if he uses the visitor visa intending to marry you and immediately adjust status, without ever returning to Mexico. But visiting you, filing for a K1 or K3, returning to Mexico before his tourist visa expires, going through the visa process, and returning to the States to live here permanently is okay to do. :)

So I don't know about the waiver part of your question, someone more knowledgeable than I will come along. But if you choose to go the route of meeting in person to fulfill the requirement, try the route of getting him a visitor visa so he can come and visit you for a week or something.

K-1 Fiance(e) Visa Process & ProceduresARGH! trying to call the VSC.

What is it that you need them to check? If you have already been approved and you want to know if your file is at the NVC, send them an email, and give it 2-6 weeks to get there and processed.

Ashp's NOA2 is from 11/29, no sign of it at the NVC, and if I counted right it's coming up on 6 weeks. :(

K-1 Fiance(e) Visa Process & ProceduresWhile you're waiting for NOA2: Talk to your boss!

I checked, and Roissy is where the DHL warehouse is. So they are delivered there, then they ship out to the Embassy.

I didn't notice that about calling the embassy for a fee. That sucks. If I don't hear anything by mid-week next week, maybe I'll call. Because I'm an impatient girl.

Aaaah, ok, so good news then. :) I checked from December 26th til yesterday and there's only been 2 France deliveries, I would think they've gotta be us. Wouldn't that be funny, the only two France deliveries in this time frame and we meet ONLINE? I also think it's funny that NVC told us both the 28th, and DHL is saying 27th and 29th.

If you do call the embassy, can you ask if the packet 3 forms can be sent to the embassy before the Frenchie fiance recieves packet 3 in the mail?

I happened to jump ahead...I ask my HR Dept, cause I knew my boss often ask more question then necessary and everyone told me it took a while...They turned it around in 2 days and I ended up sending it in with my I-129F application...and I had my office notorize 2 copies for me...Now I will be glad when the NOA2 comes...

You sent it with your I-129F? Wow, I hope that works out ok. I suggest sending one of those notorized copies over to your fiance for their interview. :) The boss I asked is the boss of the HR department, but she had to go to the vice president of the organization for permission first.

K-1 Fiance(e) Visa Process & ProceduresWhile you're waiting for NOA2: Talk to your boss!

Since you and BostonParis' petitions were probably shipped in the same batch, chances are your fiancés will have their interviews on the same day.

I'll probably get to the US through JFK too (long story). Who knows...maybe I'll arrive on the same day as your fiancé :D

LOL that would be very cool! And if you go through JFK, too, keep us posted - maybe you can join our VJJFK party.

The France embassy page is ... I don't want to say worthless exactly... but it doesn't have NEARLY the information that some other embassy web pages have.

Aaaah, glad I'm not the only one that thinks that about the embassy's website!

Angilla, yes, he did live in London! :)

LOL I'm sending you a PM about that.

I did a search, and there were two packets delivered to Roissy, France - one shipped the day before they said mine shipped, and one shipped the day after mine shipped. But nothing said they were delivered to Pars, to the address. Oh, well.

And, of course, they do not accept email inquiries. Sweet.

Yeah I tried searching around and saw those two deliveries to Roissy, too. Isn't Roissy where the Charles de Gaulle airport is? Would the packets be sent straight to the embassy in Paris, or would something involving that airport happen?

And yeah, no e-mail inquiries and the VJ embassy page says there's a fee for calling the embassy - to talk to an operator it says there's a 14.50€ fee! That's sickening! I guess our best bet is to wait for our fiances to get packet 3 in the mail. :(

K-1 Fiance(e) Visa Process & ProceduresWhile you're waiting for NOA2: Talk to your boss!

My fiance lived in England for 2 years, too, but that was just a few years ago. His accent is definitely all French. When we first met, my girlfriend (who was with me on a vacation to Paris) had to ask me to translate his English because she couldn't understand him. Granted, this is the same girl who called Champs Elysees "Champs Eloise".

Was it London that he lived in? Because if so, that's just another freaky similarity between our couples LOL.

You speak French, eh? That's good. I'm trying to learn, I've given up til he moves here and I have a "live-in tutor" lol.

That's a piece of good advice..!

Soon after I sent in my I-129F, I did that. I'm lucky, I work for a small company (200 people) so I walked in to the CEO's office with the I-134 instructions and spoke with him. When we got back from holiday, and I had received my NOA2 on 26 December (what a Christmas gift!), it was a simple matter to send them an e-mail and the "reference letters" were ready the next day. I asked for six copies; one set for my copy of the I-134, and two for Bobbie's use...

That's good. :) Six copies? I asked for 3, plus my boss gave me a photocopy of what was inside the sealed envelopes so I could read them. :)
