Hello Everyone,

As some of you may know, my 864 got kicked back to me with a checklist for some errors.
When I looked, they were indeed errors-stupid ones-and my fault as I was so twisted and bent over this form...
Anyway, I had some corrections to do, which I did-but I have a Q.
Is it OK to just place "strike" marks on the incorrect ones, or should I strike them and initial them??

As you see, I am being overly paranoid again-but any info to alleviate my neurosis would be helpful.
I just want to get this thing back on track again.

You have to get an NOA2 to begin the next step, which is sending your approved petition to NVC for further processing....

Hi,

For peace of mind, just give them a phone, speak with an operator who can give you details. More than likely, it's just a case of poor communication between offices (the 864 goes to one, and the ds-203 to another-sometimes, they are a day late of one another, and a "checklist" gets created.

In our case, our 864 had a small problem which was corrected inside of one week. I called, found out what happened, and was able to take steps to fix it BEFORE it hit my door, and turned it back out the same day. Don't panic, chances are it's the former and not the latter.

Listen to your mum-she's right :yes: ( I always tell my wee one that!)

Bring a copy of all phases (USCIS to NVC completion) of the paperwork...if they lost something, you have a back up plan. Make 2 copies...send one to him, and keep another set for yourself-just in case they get lost in transit, or held in customs for some reason.

Look at things from a pessimistic view and account for anything that may go wrong. Then, do what you can to prevent it while being prepared that anything can happen...but, you'll be ready for it if you cover yourself.

I am still waiting for a Postal money order to be sent to me via "snail-mail" and am hoping that a personal check from my U.S. bank is acceptable for the IV fee since if my wife was the "agent" she would not have direct access to U.S. certified bank checks or USPS money orders.


I'm quite positive that personal checks will not be accepted by NVC. Needs to be a certified check or a money order. Perhaps you can have a relative from the states get the check and then send them the money from london



Unfortunately, a personal check won't be accepted. :( A certified check or money order is what they ask for on the bill.

The caveat to the K3 getting approved first is that AP must be granted in order to travel, EAD must be granted before she can work.


Actually, the K3 visa does not require filing advance parole paperwork in order to travel. It is a multiple entry visa that is good for two years.

So I figured being able to point to the instructions on a form would help if that happened. They might be closed on Monday for the holiday. ;) When you go bring the I-134 instructions and just point it at it. My bank only has my last 6 months of deposits on file so they had to request to have the 6 months before that faxed to them, they said it'll take at least a week. It's ok... I shouldn't need a co-sponsor but I've got one just-in-case, and I'm still waiting for her to get all her I-134 stuff together and mailed to me so I have to wait for that anyway.

I'm heading out to the bank now to request that letter, which they said can take up to a week for them to do.

I didn't get a bank statement - I don't think I need to because of my salary, bank accounts, etc. This isn't a requirement, right?

Take a look at the I-134 instructions under II. Supporting Evidence:

A. Statement from an officer of the bank or other financial institutions where you have deposits, identifying the following details regarding your account:
1. Date account opened;
2. Total amount deposited for the past year;
3. Present balance

As to whether or not it's a requirement, that'd be a good question to post on the foreign embassy forum. ;) I've just assumed that, since it's listed there and doesn't say "If you are using your bank account as an asset" or anyhting like that, it's something that I should do. As my high school band teacher drilled into our heads many times... it's better to be prepared and not have the opportunity than it is to have the opportunity and not be prepared. I'd rather send too much than too little. :)

I don't think he was around then - I didn't realize that there was a mandatory enlistment in the last 25 years or so. So he didn't need to get a waiver.

My fiance's 28. I've tried doing some Google hunting to find out what on earth he's talking about... haven't been able to find anything yet.

I just realized that the I-864 has to be notarized. I sent him an un-notarized copy. Have to re-send now with a notary!

Oops. Did you send him an updated letter of intent? I keep reminding myself to do that, I have a feeling I'm gonna forget.

I'm sure it'll all get figured out, plus we have plenty of time since we have to wait for the UK police certificate anyways.

You have plenty of time, we don't! We want to get the required forms out in the mail Monday, if possible. All we need is for me to do my paperwork and send it over before his interview, thank goodness his time living in England was before the age of 16... and the only other place he's lived besides Rambouillet and Versailles was the USA which doesn't need police certificates from what I've read on VJ. My parents got the certified copy of my birth certificate for me yesterday, I'm heading out to the bank now to request that letter, which they said can take up to a week for them to do. I'll fill out things and take em to be notarized today. It's all stuff that I should've done already. :blush:

I can't believe that's the thing that's going to hold us up. And it's OUR fault, not theirs!! How ironic.

Was your fiance around back when joining the military was mandatory for all males around the age of 18? My fiance got out of that requirement, so that's why I'm wondering if he needs to bring the letter stating he was waived from the required enlistment... I'm wondering if the consular officer will see his date of birth and say why didn't you serve like you were required to. Then again, I also don't know much about this required enlistment thing as what he's told me has been sorta confusing.

Yes, it's circled with French writing. I filled out the I-134 and the I864. It seems that they are looking for the I-864, but he now has both. With them, I sent him a copy of my 2005 tax returns, plus a letter from my employer, pay stubs for the last several months, and the last two months worth of bank statements. I earn well above the poverty line, and have enough in a savings account plus 401(k), so I assume that's all he'll need.

I remember that one girl over on the French/America couples post that brought both and they took the I-134... so yeah, I'm preparing both also. I make nearly $10k over the poverty guideline, but I only have a few thousand in the bank so that won't mean much asset wise. I also have only had this job for 2 1/2 months. I'm sending a copy of the one tax return I did file within the last 3 years (haven't filed this year's yet) and will write a letter stating that I was a student/volunteer missionary during the other times and had no income. My paystubs - haven't figured out how many of them to send yet... will go to my bank for that letter today... I'll see what else I have to do, I'm gonna fill the forms out today (I should've done them before :blush:). I've got a co-sponsor just in case, but she's only filling out the I-134. The wording on the I-864 is just too scary, I couldn't ask her to fill that out.

2) There are a couple of forms, and it's not indicated when he should send/bring to Embassy. At the bottom of DS-2001, it says "Do not send any documents to this office unless you are specifically requested to do so by this office." So, they enclosed the forms but don't say whether or not to send them... :unsure:

I'm still a little confused, I see Optional Form 156 Part 1... but the instructions on the checklist say to send OF-230 Part 1. I see DS-230, but I don't see a OF-230. The embassy page here on VJ says to send back the DS-230 so... maybe it was just a typo on the checklist? Or are the 2 forms the same thing? Whatever it is, that and the checklist do appear to be the only 2 things to send back to the embassy.

I understand your frustration-really I do. I was there myself, and it is a hellish place to be.
The good news is that it does pass.

There is something in the law called "dual intent", and by filing a K1, you have demonstrated that your intent is to be married and stay. The filing of the K1 proves this, and can lead to all kinds of issue. The simplest being a VERY difficult AOS, to worst case-a revoked green card and a ban.

Not worth it in the end.
Time passes. All of this is temporary.

I agree, 65 days is a long time for a K1 in Vermont.

In my case, I did a CR1, and sent it off 1st week in December. And I KNOW that I will be getting just as annoyed as you are in a few weeks time, and the LAST thing I'd wish to hear is someone unsympathetic. As I have said before, all of us here are in this together... That being said, support for each other is imperative.

I have gone through Amsterdam and Iceland, and have always gotten stamped in either Aberdeen or G'gow, which have been my final destinations.

I went with the wine stoppers as you'd have to order them in the UK for a UK wedding and in the US for a US wedding.
:( They won't allow seeds to go across, which sucks...

While not typically British, Graham and I had heart shaped wine stoppers. I ordered them in the states and brought them with me. Apart from 3 of my own ppl, all the guests were Brits, and had never seen wine stoppers given as favors.


The ones we got were especially nice, rather inexpensive and easy to transport without the fear of breakage.

Yes, I agree about of the good things that make up for the taxes...Coram wasn't my favorite place either. I was there for about 18 months, and began my migration westward-ended up in Merrick-which is OK-I simply stay here for the school system for my little guy. Like I say, that taxes here are a joke...I could go on for hours about those ridculous taxes, but I see you can relate !


Ahhh ! I am so happy to hear that I can get my husband some branston pickle. It has been a concern of his, as he finds a way to put it on virtually every sandwich he seems to eat. It is actually quite comforting knowing he can get some here...
