Oh carp, sorry to alarm... this was all self-inflicted pain! and it wasn't about our background checks, as we actually got the approval. No, we wrote to withdraw the petition, never heard a peep, called and were told it wasn't withdrawn, in the interim we had a big change of heart... petitioner wrote again and asked to stay in the game, and shortly after our approval appeared and our case went to nvc so we pursued it and paid the fees (thinking we were a-ok). Then the case disappeared, and we have tried to confirm (what we know) that it is because of letter #1; and to see if there was anything we could do to stop the revocation. Yeah, we messed up! and we don't want to wait 4 mos to have them say sorry, start again, we're just going to start again now.

Wow, that sucks! So what are they saying, it was denied?

They won't say anything really. It was approved, and then *i think* withdrawn but I can't get anyone to tell us. My beef is really why they say online that something was mailed, with "call in 30 days if not received" but then the guy tells me on the phone "it says here you shouldn't call for 120 days" HUH?

We have been waiting for 2 responses from CSC since August. We haven't gotten anything, so I called the 800# and heard "Status for this receipt # cannot be found at this time in this automated system... If you have questions about your case status, please contact the service center where you submitted your application."

Gripe #1 Why do they suggest contacting CSC when you can't call them? you can't email them? and writing them has gotten us nowhere? How do they imagine this mystical "contact" will take place?

Ok, I am really steamed today so bear with me.......

This has been the longest 30 days of my life and now today I called and was told by customer service that CIS wants 120 more days to let us know anything. This is NEWS to us!! four months to respond? WHY WHY WHY would we do that?

Why did online status tell us they mailed something Aug 25, and Sept 8 and then today they say "wait 120 days"

The friendly customer service person told us that we can reapply. He put me on hold to confirm that, and came back to say YES! you can reapply! Yeah, makes more sense than waiting 4 months for nothing doesn't it? AACK.

This whole thing has caused so much stress in our house..... it's just been a really bad week. :crying:

Seriously, why do they have a form in place to change it if it doesn't work?

We have refiled again as DCF so I don't care if they have our address at CSC anymore, it's just humorous that they mailed a "change of address form" to our new address, saying they don't have our new address. Silliness!!

I mailed, faxed and phoned in our new address in August. I even got a "confirmation number" from a live operator that they had our new address.

We had touches in Aug Sept Oct, and all of them said they'd mailed us information. We received nothing so I knew in my heart they were mailing whatever-it-was to our old address.

After all the letters were bouncing back to them, they finally mailed this mystery information to the correct new address.

what was it?

A change of address form.

It's kinda funny, isn't it?

Waivers (I-601 and I-212) and Administrative Processes (221g)Drafting/Going to spouse's orignal country.

I just wanted to add, that the American trying to become a landed immigrant in Canada needs to also meet certain education qualifications to become a landed immigrant.

Just wanted to say I just completed the Canadian imm. process and didn't have to meet any educational qualifications. I did an outside app, completed in 3 months (they strive to complete all straight forward cases in under 6 mos) from initial mail-in of app to visa granted. Outside applying, must be apart for several months, inside applying you get to be with spouse and can work, but no travel priviledges. Just depends on what you want to do and how long you are willing to be apart.

Buffalo is farming out the apps to other embassies in many cases to expedite. No interview either. Just wanted to post in case anyone is interested in this route.

Edited to add, they did reduce that fee from $900 to half that. Anyone who applied and paid the full 900 got half of it back as a refund as of May 06

So, first does anyone know just how slow the Mail is in Canada ---

MAN it is slow. I am from the US and I can say I will never, ever complain about US mail ever again since dealing with Canada Post LOL.. Also remember, CP doesn't deliver mail on Saturdays, so only count the weeks as 5 days (in US mail delivers on saturdays too).

Theirs took 7 months to approval. I am not sure if each case is different based on what the reason for the waiver is though.

Did your wife have an actual visa? I am just wondering as Canadian don't accrue unlawful presence in the same manner as other countries, so I assume she overstayed an actual visa or date to return... ?

Waivers (I-601 and I-212) and Administrative Processes (221g)Overstay Qu.
Yes what EMT said, not about luck at all. (well except lucky our Consular knew about the advisory opinion)

In our case, I met my husband in US and he had been here several months. He went home for a wedding but wanted to come back because we were all googly for each other wacko.gif When he got to the Toronto airport they asked him what he was going to the US for. He said MY GIRL IS THERE!! and then proceeded to tell them all the wrong things (the truth). They allowed him to retract, sent him back to Ottawa and stamped a piece of paper (because this was before passports).

He did not attempt return until he flew down here to help me move to Canada. MAN he had a hard time. He had every piece of paper possible to prove I was moving to Canada with him because he knew they'd see his previous issues and probably stop him. They wanted to deny but he just kept pulling out more evidence mover's contract, my Canada PR approval, and lots of stuff to convince them. They finally let him in.

Anyways, blah blah, yes that advisory opinion saved us. The Consular did say, "Oh I see you were denied entry" (because we had to say he had been denied before on application)... and that was it. Never brought up the previous overstay at all.

All 3 lawyers had no idea about Canadians and overstay. I paid $ to have them tell me he was subject to the ban, he would need a waiver and that we should have the waiver with us at time of interview. I had to do my own research to find out they were wrong (and I should have used Shusterman would have saved me a lot of $).

We declared all of my husband's previous stay, one which was over 180 days and it wasn't even mentioned in our interview. I lost sleep over this and paid 3 lawyers who told me he would be denied. DH, Canadian with no I94, considered violation of stay but with no judge ruling and was not discussed in interview with Consular.

I mailed the $70 to NVC with a Canada Post money order in U.S. funds. Will they accept that? THe tracking shows it is going to get there Monday, but if they won't accept it, I'd rather re-generate the form and send again Fedex overnight, I don't want to get an rfe for something this stupid

Well I got through and after 1-1/2 hrs of hold time, the Immigration Officer has no idea why it was returned. It doesn't show up on their end, and NVC is saying they have no idea either.

This is just mind numbing. Somebody had to request it was shipped back, but even the IO said she couldn't believe we'd already been at NVC and assigned a case # and that it would go back. :(

It can be a pain to get through. Try this number I found on the CIS website: 785-330-1048. It provides automated case status (no operators) and will hopefully get you the info you need.

Best of luck.

Thanks VP, well I am a BIG FAN of technology, but especially today. I purchased a microphone and D/L'd Skype and I'm on hold for an immigration officer right now!! and I can play computer games while waiting, that is just lovely.

Thanks for your help though! I did try that auto number but it doesn't give any other info than the website case status.

The phone number for CIS headquarters in Washington, DC is (202) 514-4316.

This is the phone number someone from outside the US needs to call to reach immigration. From what I hear, it's more helpful and much better than the (800) number anyway... so maybe everyone should use it! ;)

that doesn't work either. I am so frustrated. I called 800 411 and the lady said they don't list government 800 #s I asked if she could connect me, (i thought it'd be worth to ask) she said no "most gov't 800 #s are not accessible in canada"

You can call a 800 number from outside the U.S.

Here is how: Replace 800 with 880.

I have done this successfully from numerous countries.

Hope your situation gets straightened out.

Hmm, evidently not in canada. I tried it and get a recording saying I need to add "1" (even though I did) or Zero before the number, tried that too :(

I tried 880 with my cell phone too, no go. damn.

Edited to add: I don't get why I can dial my long distance access number, which is 800, but not the USCIS number. This makes no sense....

National Visa Center (Dept of State)NVC sent case back to CIS
I am so frustrated, I've been crying all day... the automated response says they sent the case back to CIS. I can't call CIS as I'm in canada with my husband and the 800# doesn't work from here. Back in April we had written asking to cancel our petition but after I arrived in canada we had a change of heart. Since the app made it to NVC we began paying the fees, etc. We have been extremely happy that we got the approval. :crying:
I never completed the canada immigration because we got the NOA2 right after I got here and decided to go with it.

I understand this happened due to what we did (or I assume so) but I am so frustrated sitting here unable to call and ask for sure why it was sent back. The NVC operator said she couldn't say why and gave me the automated number.

I can't find any info online about reinstating a cancelled petition, but my gut says they're going to say we have to start from scratch.

We're going to drive to the border in the morning and see if I can get a cell phone signal to try dialing the 800# as I still have my US cell phone active.

Pity party, I know, but I'm home alone and so down and out, I just wanted to post I guess.

Obviously Borat's a troll, but I wanted to say THANKS for pointing this out! I agree that the frustration of this process can make us do really silly and stupid things. Cry, rant, drink booze, fight with spouse (or friends who don't understand) etc. etc.... yep, it really does bring the worst out of us sometimes.
