IR-1 / CR-1 Spouse Visa Process & ProceduresChange of Address Forms????????

Hi All,
Just a quick question?
Is there a USCIS, Official Change of Address Form,
For the USC to fill out when moving House?
Our I- 130 was Approved 21st August 2006,
My wife NorthernGirl is moving house at the end of this week,
And need to know if there is a form that she can download,
To send to USCIS.
Any input or information would be greatfull.
Cheers
Paul

I called USCIS about this as I moved while the NOA2 was enroute; it caused it to be bounced around before it finally got to me.

Once the app is approved they won't even accept a change of address at the service centers (that's what they said to me at least). It's more important now to contact NVC and make sure THEY have your new address as they'll be the ones mailing to you now.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuick (and stupid?) Question on Barcodes...

For the AOS Fee Bill, the numerics for the barcode I need to generate are the numerics from the new NVC case number that is generated? And pretty much this is the same for all barcodes that need to be generated in the process?

YEP change the MTL123356 or whatever it is, to your new NVC case number.

Hi fortune, ours took 7 months as well.
It was approved July 21 and was at NVC August 1, your mileage will vary of course, but just an idea.

IR-1 / CR-1 Spouse Visa Process & ProceduresMajor Decision Making Time

My husband would go crazy if he was here for months with nothing to do while I'm at work all day.

That was an issue for my husband as well. I think if I was the one who wouldn't have been able to work, it would have been okay and I fully appreciated his feelings on this....

IR-1 / CR-1 Spouse Visa Process & ProceduresMajor Decision Making Time
Tracy it can't hurt to let both ride at the time and make your decision based on which one gets the interview first. One main advantage of going with the CR-1 is the ability to work immediately upon entering the U.S. For some this a deciding factor in itself. If you read some of the posts of people waiting on their AOS and EAD you can see some get very frustrated (especially when it is the husband that cannot work).

IR-1 / CR-1 Spouse Visa Process & Proceduresmarried name or maiden name on DS-230

Hi everyone,

I am little bit confused. My wife has changed her name after sending the papers to NVC, becuase NVC told us name should reflect marriage. Name change happend after I send the DS-230 to NVC.

Now She got Packet 3.5 from embassy and they are asking again DS230, now which name I should use.
married or unmarried. All her correspondence from embassy + NVC are on maiden name.

please also tell me what information is enough to provide financial information. The embassy wants to have current information at the time of interview according to the NVC letter that I received.

Thank you
Sham

I had this question and was told that everything should match the passport. So if her passport has maiden, you should use maiden.....

Predictions are impossible, IMHO
I saw people get NOA2 in 4 or 5 months out of the same service center as ours, and ours took 7 months.
Every case is different, wish there was a real way to predict, but I personally don't think there is.

Thanks.

So for the NVC stuff I can only tell if I've been touched through the phone service, is that right?

Yeah, you won't really get touched, you'll just hear "we have accepted your Choice of Agent" and things like that. The recorded info won't change until each event takes place...

The NVC case number is not accessible with the USCIS online thingie.

You can now call a ph # and get your current info via telephone auto-response

NVC 603-334-0700

"NVC - Please hold"

"For english press 1"
(for operator press 5)

Options:
Want info press 1
If you Know case # press 1

the rest is service center specific

IR-1 / CR-1 Spouse Visa Process & ProceduresOMG - Unbelievable -- I130 Approved !!!!

Congratulations!! I have a silly question.... since I did the same thing (filed I-130 and then I-129F for K3), IF my I-130 gets approved before the K-3, should I abandon the K3?

I've came across James' shortcuts numberous times in different forums. Are the shortcuts only applicable to the I-130? Please advise.

Thanks!!

Yes James' are for NVC with the I-130
Seems like the best idea is to let them both race to the finish line. Go with the one that gets there first.

IR-1 / CR-1 Spouse Visa Process & ProceduresThrowing in the towel, starting from scratch on our CR-1

Very sorry to hear this. Good luck with the DCF.

Thanks guys, it's really about whether they'll accept my app with such a short stint as a resident. There is nowhere written that Toronto has a time limit on the residency, but it has been implied that they "may" require 1 year. We're just going to try really hard to convince them to allow us to do it with less than the year under the belt.

IR-1 / CR-1 Spouse Visa Process & ProceduresThrowing in the towel, starting from scratch on our CR-1
Well after much research I am 99.99% sure they have revoked our I-130, due to a withdrawal letter I wrote way back when (and subsequently wrote another letter asking them NOT to acknowledge letter 1), our case was halfway thru NVC and we were told to just go ahead and pay the IV Bill etc. and to contact CSC to say we no longer wanted to withdraw (which as you know, is like trying to contact God himself).

Anyway, they won't tell us anything via email, phone, and they supposedly sent me a "response" on Aug 25 which we didn't receive (our mailing address is a 15 min drive from Laguna Niguel CSC). We did get a change of address letter that was mailed out 9 days later (after the important letter) and so I just know in my heart they mailed the response we needed to my old address.......

We have to move on.... not being in control of this has made us insane. We're going to re-apply from scratch in 3 weeks if this mystery letter hasn't arrived. Like I said, I am 99% sure we have had an "automatic revokation" as per 8 CFR 205.1 (Chapter 20.3 Petition Revocation)

and we will NOT receive a letter of intent to revoke (which is what I was praying for)....... the frustration of not knowing where we stand is making me insane. It's my own damn fault, since I never got a response back when I first asked to withdraw, and also received no response when I wrote saying we had made a mistake in withdrawing and wanted to continue the process; well... I should have known not to get our hopes up. :crying: Once we got our NOA2 we were on Cloud 9 as it appeared they ignored our withdrawal.

So I believe 9 months are down the drain....... we're going to try to DCF in Canada, if they won't allow that we will be starting from super-scratch in Vermont. I :crying: had imagined being home by christmas, but that pipe dream is gone.

IR-1 / CR-1 Spouse Visa Process & ProceduresAPPROVED!! But really worried about Interview. Help!
It is my understanding through reading many posts on this subject, that it is very common during this process for spouse/sig others to be refused, and unless it was something more drastic (like frauding at border or misrep) just answer honestly and tell her not to worry. I assume she was allowed to withdraw and didn't get any kind of serious ban, and like I said, that's very common with spouses during the wait.

I have read tons on this, because my husband was refused entry in Toronto and allowed to return back home, allowed to withdraw. He has since visited US without issue (he came next time with piles of proof showing ties).

I worked at reopening our first (revoked, don't ask) case for 3 months, if that gives you any indication. Just trying to get USCIS to respond to me took 120 days. In hindsight those months would have been better spent waiting on a new app to process.

Did you move? is that why you didn't get your notice?

Hi all,

Not sure where to post this question so i'll try here.....my wife and I are married but se is still in philippines awaiting her interview. She andher daughter of course do not have social security numbers yet. How should US income taxes be prepared? Can my wife and daughter be claimed? I do support them. Do i claim married? or head of house hold?....not sure how this works being married to a foriegn national....anyone have som thoughts, been through this already?

Jazzy

I filed married-filing-joint when my husband was still in Canada. You have to apply for an ITIN number ITIN faq
it is a number assigned for the sole purpose of filing taxes if you don't have a Social.

You mail it in with your taxes, it does add a little time to your refund mailing, but for us it made for a much nicer tax return so it was worth the hassle. I'm not sure on the daughter, you'll have to wait for someone else to help with that.

IR-1 / CR-1 Spouse Visa Process & ProceduresDenied at POE

Not enough evidence to prove I have ties in Canada. Not working at that time, not renting (living w/ parents), no return ticket.

My husband was not only denied entry to US for not enough ties, but was held in customs for 5 hours, sent back, and then put on the "watch list". Although he wasn't given an actual ban, he couldn't get over the line even to just go to a border town. He was granted his visa and the Consular only said casually, "Ah, stopped from coming over I see? Yeah, that happens a lot"

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230, if your spouse has an ITIN ?

Make sure you contact IRS once you are assigned an SSN.
You can contact the ITIN office by calling 1-215-516-4846.
http://www.irs.gov/p...s-pdf/p1915.pdf
What steps do I have to take when I have an ITIN and become eligible for a Social Security Number?
Make proper application for an SSN and upon receipt of the SSN advise the IRS ITIN Unit of your new SSN. The new SSN will become the primary number and must be used for all future filing purposes. The IRS will void the ITIN. All prior tax information under the ITIN will be associated with the new SSN.

Thanks for this info, that is exactly what I was worried about, the two being out there concurrently.

IR-1 / CR-1 Spouse Visa Process & ProceduresUnintentional Overstay??
QUOTE (Chris Parker @ Mar 6 2008, 01:12 PM) <{POST_SNAPBACK}>
Unlawful presence doesn't matter for petition approval (in fact, they will approve the petition for someone who is clearly inadmissible for overstaying), but you will need to provide this information again on your visa application where it will be considered for overstay determination purposes and you probably want the information on your visa application to be consistent with the information on the approved petition sent to the consulate.

"Canadians who lawfully enter the U.S., but who were not given I-94's, are treated like status violators if they overstay or fail to maintain status. They do not accumulate unlawful presence, and the 3 and the 10-year bars do not apply, where neither the USCIS nor an Immigration Judge has made a determination that the person has violated status."

K-1 Fiance(e) Visa Process & ProceduresThe Wedding

I agree with that! It is most important! I wish the process didnt have to be so complicated but those are the rules and we just gotta deal. It's hard to keep waiting considering my fiance just last night told me he thinks our relationship has grown about all it can while we are apart. We thought about the k-3 but he doesnt want to wait any longer to be together. He wont do it. He has to be together with me for our love to continue to grow. I sure do have lots of respect for ppl who persue cross-border/country relationships. It's not an easy thing and you sure do test ur strength level, dont you?? I want my wedding to be something special and not something that is thrown together at the last minute, you know? I think its more than likely we will end up having a civil ceremony or eloping to fulfill the visa requirments and then having a bigger celebration later on for family and friends. That way I can wear my dress too :D Thanks to everyone for their thoughts/ideas/support. It means mroe than you guys know.

Well the reason we went with k3 instead of k1 was because I am from california and I didn't want to sit in that traffic jam there. So there is a benefit to filing at the chicago lockbox. We decided pretty much on a whim to get married in canada and then do Wedding #2 for the family.

My problem now, is my very cute mother, with all good intentions, cannot stop talking about wedding #2. I told her I can't plan it until I absolutely know everything is ok and i don't really even want to think about wedding 2 because I'll lose my mind!!

We were going to do the civil ceremony in Ottawa but I found a lady who was so great, she was just a little bit more $ than justice of the peace, and she came to our location, so we got hitched in our honeymoon suite LOL! I can refer you if needed!!

Also, can I ask you cali, how do you know you got the border ban? did they give you something on paper? I was just wondering as my husband got stopped in toronto and was held for 5 hours but they didn't tell him squat, they just returned him to ottawa and wouldn't let him travel. We've been wondering all this time whether he has a ban.

So when you call they have no record of your petition?? sounds strange. If you have your noa1, you have a case# so you do exist in the system. Have you called 1-800-375-5283? You should call & speak to someone right away

Yeah, well it's a real bummer, cuz when you call you punch in the receipt # on the phone and it tells you that you're nobody. And you get that online too. It was very difficult for me to get to talk to a real person, because it asks if I have a receipt #, well yes I do, but according to you people I don't exist! and when I finally did get a guy, just seemed like he was pulling my chain. Said, OH if it shows Jan 30 in the processing dates, it really means Dec 30. and "don't pay attention to the online thing, we don't update it." But he did supposedly "see me" in the system, so I got that goin.

K-1 Fiance(e) Visa Process & ProceduresARRIVING 5 MONTHS AFTER VISA GRANTED

I have just a general question while WASTING time WAITING for CSC.

My fiance may not be able to enter USA until 5months after receiving the VISA(because preparation and finances that we have agreed upon)

My question is : When must the marriage occurr? Is it prior to the 6months given to arrive in the USA or is it 90 days after the POE (point of entry stamp).

No, I do not have an NOA2. Just trying to think of questions ahead of time. Today is my first 30 day anniversary of NOA1 received.

THE WAIT IS STILL ON FOR ME

Your fiance will have up to six months from the issue date to enter the United States, and then you two will have 90 days from entering with the k1 to get hitched.

" On ______, we responded to your request for more information concerning your case. If you have not received our response within 30 days from this date, please call customer service at 1-800-375-5283. " ?

We did mail in our amendment letter, and in a very timely manner we received this email update.

so if you call because of problems with a RFE or any other questions about your case except of asking them when you will get approved finally it can be helpful.

PJ+R

I am not sure I agree... There are *certain* topics on the 800# that can trigger connection to the Service Center, and an RFE is one of them.

if you read the Instructions on How to Get Through to a Service Center (PDF) created by USCIS, it shows RFE as something you can get help on;

Also:
PR who doesn’t have PR card yet
Case approved but didn’t receive post approval docs in 30 days
I-129 approved but POE or Consulate not listed on petition
Pending case where companion cases are separated
Pending I-129 where changes to petition (add/remove beneficiaries) are needed

My beef is that those are not the ONLY problems that need Service Center contact. It's nice they allow you to get straight through for those problems, but there are more problems that arise besides just wanting to know if your approval is coming.

BTW, that 800 instruction sheet is so handy to have in front of you when punching the numbers.... ;)

Although I agree that CSC shouldn't become a "complaints department" (and that they'd never get anything done), I don't think it is at all right that there is NO way to contact them. Having no working email, having an address you can mail to but they won't read, and an 800# that is known for giving out wrong or misguided info, well it just ticks me off.

I'm on a role with these csc graphics, it is very therapeutic for me today.
