I was told by another here doing canadian/u.s. that I could submit the "souvenier" certificate you get the day you get married and get the app all the way to the NVC, then I'd get RFE'd at that point... because it takes 12+ weeks to get your real marriage cert. when you get married in Canada, you can file to get the ball rolling knowing you'll be RFE'd.

I got an email from NVC say to mail them a formal request to withdraw, including copy of NOA2

I realized last night that since I only mailed our Solemnization Record (canada non-legal marriage cert) in with both our apps that I'll be getting an RFE for both, so they can't go too far in to the system without my response with our real marriage certificate. I was told by another poster that NVC wouldn't send it to the embassy until they receive the marriage certificate -

Where is your K3 right now? At NVC or embassy? If at NVC just call them and let them know. They are pretty squared away.

We just got the NOA2, so it is heading to the NVC. I will give it a little time to get there and then call.

I am so happy for you guys but I am also a bit envious as well :D It's just sort of ironic that you guys have your I-129F NOA2 and you don't need it, and all of us poor slobs who are waiting with baited breath can't seem to get a break from the INS Giants. Is this just a letter writing thing? Should I wait until the app gets to the NVC to cancel the k3?
(our I130 is just sitting in CSC, so I know that one isn't going anywhere fast)

I am concerned as we are now applying for me to get a Canada visa. At first we thought we'd just let them dangle out there and leave our options open, but I am thinking this might not be very smart.

As I've posted, I'm moving to michigan to be closer to him in August and I want him to have NO PROBLEMS entering the US (via land) to help me move. (I would think that would look rather fishy if they looked him up, after he tells them he's help me go that way).

If it is a letter writing thing, do they send you anything *official* to show you withdrew the app? (for future proof if he has trouble at a border?)

I have a question as my I130 had been approved a couple of weeks ago and so far we just have our case number and no other action. Today I got the I129F approval document. Is there a way to say or anyones recent history that if we do what we are suppose to, how soon before we get a interview date?


Click on "immigration timelines" above, and search for people from your area. That'll tell you a rough guesstimate of when you would have an interview. You mileage may vary though.

Your I-130 will be approved, but when you get to the Embassy, that is where the ConOff will decide whether you can/can't get visa. At most embassies you can submit the waiver same day. The waiver would need to be submitted after the denial though, not before.

OH gosh, I had a bad UPS experience at my last office; it was the worst customer service experience I ever had. They said we overlooked an invoice for $11.00 - they said if we didn't get the $11.00 to them within 24 hours they would close our account (keep in mind that we were HIGH volume shipper, so that 11 bucks was almost comical).

Anyway, they told me to send it to them UPS. I did. They signed for it. They then closed our account for not sending it. They accused us of not sending it, when I used THEIR service and THEY signed for it (I even had the sig from the webpage). Ridiculous. It was like they were admitting they sucked... and willing to lose business over it.

I am so sorry this happened to you. :(

I'm new to this board. I'm very discouraged because i've noticed that many people have had their I-130 approved already, even those processed after mine. I sent my I-130 to vermont service station in late June and rec'd NOA on July 7th and check was cashed. It has not moved since then. I noticed that you sent yours in after mine, and you got approved so quickly... we never rec'd any issues in the mail or email about mistakes or anything, so I'm wondering what could be holding our case? I'm Canadian married to a US citizen -nothing complicated at all. Our I-129F has been recently transferred from National Benefits Center to Vermont, but other than that, no other movement. Are you dealing with a lawyer? We have completed and sent our papers on our own....

You'll make yourself crazy trying to compare your case to others. Every case is different. My hubby is canadian, I am US our I-130 (first one, not the one we're working on now) took 7 months. Try not and get discouraged and just ha ha, be patient. It'll happen....... the only time I would think to panic would be if you never received an NOA, but since you've got that it's just about tick tick tick waiting it out. good luck.

We discovered two errors on our G325 shortly before our interview. I was very concerned as one of them made no sense (ie, it made it seem like my husband lived in two countries at the same time due to an error on the dates). Anyway, I brought it to the attention of the person who checked us in at the embassy and went through our stuff before being interviewed by the Consular. They just pulled out a red pen and made the change right on the form. You can bring any mistake to their attention BEFORE it is brought to your attention by them. I would not follow advice to just "ignore it" as you made an honest mistake.

DCF if possible. As soon as wife has residency in Canada, file DCF. Please confirm with Embassy that they still allow Canadian PR person to file the DCF with less than 1 year residency. (I filed it with 2 days residency, not kidding)
EDITED to add: I just poked around on the DCF board and see that they've changed the requirement since we filed; the US citizen has to live in Canada for a minimum of 6 months. So this means your wife gets her residency, and 6 months after that date you can file for DCF.

First want to know - on your wife's Cdn application, did you file it when she was in US, and then she came to "visit" you? (ie' outside applicant?) or did she come there and then you filed as "inside". Just wondering as if you filed "outside" you might get that residency much faster....

I filed Canadian as outside, and drove over the border to live with my husband while we waited for my residency. Things didn't work out for me there and as SOON as I had the residency card, we drove to Toronto and I filed DCF for him to come back to US. Because I had moved out of US and became a Cdn resident, I had to get my brother to sponsor us.

Same as it takes any couple, see the guides for timelines. You'll want to request your Cdn marriage license if you haven't done so that adds LOTS of time to the process!! They are slow (we had to get an Ombudsman to step in after waiting and waiting for mine)

5) How much income does she need to have to show that she can support me in the US?
If she is living in Canada and doesn't have established job, this is a moot point. You'll need a sponsor

6) I have a lot of family there as well, but all are distant cousins, all willing to sponsor me, does that help?
Yes, ask them pretty-please to sponsor you in

7) How much is the average cost for the whole process?
I haven't file in a while but we are still paying off, it all adds up, photos, bio, medical, applications, blah blah blah

8) Should I pay the extra money and get a lawyer? Is this process really that complicated in the US?
Not in my opinion, unless there's something funky about your case. If it is straightforward you can do it yourself!!

9) Do I need to give up my Canadian Citizenship when I get approved as a US immigrant?
No. You'll be a resident in US. Re: Citizenship, I just found out that even though you will denounce Canada, Canada will still love you.

10) Can I still keep my Canadian Health insurance and come back to Canada if I have a serious illness?
This is questionable. You'd want to post this on the Canada board. If you are not a resident in Canada, but are a Citizen, can you get health care?

11) I want to make sure that I am working at all time because my wife cannot support the two of us and I don't want to be a burden on her parents or any one else. So keep that in mind so I am not left in USA waiting to be allowed to work, (like my wife is here in Canada).
You will have a bit of time here while you wait for your social sec# to be able to work. My husband and I came back in Dec 1 2005 and he wasn't able to work until about February due to Social Sec office losing his #.

I used the Assembly guidelines from VJ and it states the use of ACCO fasteners (I clicked the link in the info for filing I-129f for a K3 on the guides)

Might be something to post here, that I just noticed on the instructions from USCIS website for assembly for things going to the Lockbox (I129f goes there) they state:

Please refrain from using “ACCO” style fasteners and/or staples (However, it is ok to staple the fee to the top of the primary application package.)

We have had a crazy day, our I130 came back from the dead unexpectedly. I am totally out of the loop on US Immigration as I removed that part of my brain and replaced it with Canadian Immigration. Now I am relearning all the steps! ack!

Anyway, my hubby is now in London, our app to US used his "perm address" which is his mother in Ottawa. Even though we're in same province, the mail forwarding takes time. WE HAVE NO TIME LOL I'm sure you understand. We don't want to have to wait for her to get it, then forward.

Can I notify Montreal of his address change? should I? is that a bad idea, will it add confusion? I already contacted NVC for change of addy on Petitioner.

We DCF'd in Toronto and in a sheer panic I had to re-write our G-325's at the counter. We had a lot of info, i was shaky and trying to make sure not to goof! oooh the pressure.

When we left they gave me my original nicely typed out G-325 and said we could keep that as our copy.

I just glanced at it and see that one of the hubby's employ dates got filled in wrong, it says 9/05 instead of 9/04 (which makes it so it seems like he was claiming to be in Canada when he was really in the U.S. in '05)

Also, he has a new job since submission of the G-325.

Should we bring a new (correct) G-325 to the interview next week? or should we just point these issues out to the Consular?

We cancelled a case that had reached the embassy, had to write a letter requesting it (we sent that via certified mail and kept signed, returned receipt - came in handy when husband traveled to US later), then they called us to confirm on the tele to make sure it was true before they cancelled it. It gets sent back to where it originated and then it is revoked. We were able to re-file no problem, just had to show we had applied before and the outcome of that application....... (but we were not affected by IMBRA so I can't comment on that.)

Sorry this happened to you... happened to me too, someone stole my purse in 2005 and within hours spent $1000 on gift cards. Luckily they used my credit union visa and they were very good about removing that debt from my account with proof of police report.

I've had fraud alerts placed on my reports ever since. I got a call from LAPD that they arrested a woman who had a checkbook in her possession with my drivers license # printed on it. Weird. I explained to them that my purse had been stolen in 05 and that gift cards were purchased. They said the woman they busted had a long history of gift card purchases and they were trying to convict her of a it.

Fraud alerts are a pain in the booty if you ever want to try and get instantly approved but I would rather have the pain of that then of id theft.

Since meeting my husband I have traveled more than I have in 10 years. Seriously! His job has moved him all over canada and visiting him seems to be in a new place every time.

He got sick of the travel and overwork (they didn't believe in days off at his last job) and he is starting a new position in London. I am embarrassed to say when he called to tell me, I thought he meant London England.

I am going to visit him the weekend after Valentine's. It is a new town to him too, so if anyone has any sightseeing advice, I'd love to hear it!!

My fiance (US) has also called them and always got great service (they're the ones who told us all about I-129F and K1 & K3.....it was like a foreign language until they helped us........we didn't know about this wonderful site at the time :no: ). I had applied through the mail to Thunder Bay for my birth certificate on Dec. 5, 2005. I still had not received it by Jan. 30th, 2006. I called to inquire and they told me to go in person to the office in Toronto becaue it could be another 6 weeks till I get it.
I went with a letter from my lawyer on Feb. 1 and had the certificate in my hands on Feb. 3rd.
I wasn't aware online was an option but if you are in a hurry I really recommend going to Toronto.


I wonder if that applies for marriage certificates too... going to toronto I mean.

Can you explain this to someone NOT from Canada?
I was married in Ontario Dec 30 05 and expect to receive an RFE any week now for the Marriage Cert as I filed with just the Solemnization Record (just to get things rolling, expecting the RFE about the time I could get my hands on the Marriage Cert)

I am just having so many problems in the states getting my name changed completely over w/o the certificate. Social accepted the Solemnization, DMV will not, Bank did, IRS did not,
just a pain in the booty.

I don't know what a "rederal MP" is
or "provintial mp in Thunder Bay"

I googled and found some people had sent over their applications to thunder bay long before the 12 weeks were up... was thinking about doing that.

I did find a page from googling where people had used an Ombudsman to get things cracking with their certificates but don't know how to go about it.

I really APPRECIATE further explanation on what you did. thanks.

The Visa wait times (typical wait for Visa Interview) posted on the Dept of State website, are those just inaccurate?

It shows Montreal as 34 days and Vancouver as 45 days

I thought it was more like 3-4 months for Montreal? and shorter for Vancouver.... :huh:

It might seem funny but when you've lived your life in a place that rarely gets below 50 degrees it takes getting used to. I walk around feeling like my face is going to crack and fall off and it's almost embarrassing because most people don't even "look" cold. Well maybe on the -20 day, but I really am a big chicken and this is all new. Add to that the what-the-hell-do-you-wear to a fancy function, and well ha... yeah.
