She is applying for the visa and wanting to gain entry to the U.S. Typically she is the one to go, alone, to be interviewed. It is HER interview. Having said that, and as others have stated up thread, sometimes it is allowed for the petitioner to be present. Sometimes mandatory. And sometimes the petitioner is not allowed to be present at all.It is really up to the embassy to make that call. Many folks here will agree that if you are there, even if only for emotional support, it cannot hurt and could be beneficial. I know of one friend whose wife, then fiancee was being questioned pretty hard until she finally said, "if you don't believe me ask him, he is just outside". Visa was approved.

Look at this logically, if you can. The embassy NEEDS your paperwork to review your files BEFORE the interview. The CO NEEDS to understand your case BEFORE your interview. And YOU NEED time to gather all YOUR paperwork to be ready for the interview. This is simply not the case of just showing up at the embassy door and saying "here I am ". Do you really think the CO is going to reply "oh, sure Jane and John, let me go back to the office and get your stuff, oh we do not have your stuff, have no idea who you are, your background, your issues, but I will just ask some questions and give you a visa"? I think whoever is feeding this information to you is way out of line. Remember the NVC only approves the petition, the embassy approves the visa.

If you can go online and download all the forms, and the listing of the documents you will need ( med exam, police report and so forth), you should be good to go. Yes. He must arrive here before his 21st birthday. Not a day later. He can adjust his status and then wait for his GC. Although he could travel with an AP, he would have to return for his interview, if he does have one. Better to wait for his GC. Further, he cannot be out of country for more than 6 months. I am not sure about any kind of waivers for an extended overseas stay for schooling. Maybe some one else can answer that. I know that Gary and Alla had a son who was going to school in Moscow and traveling back and forth. You might try and reach them.

Rich I think you did ok. You have about 6 months to have his interview. It is still possible. I would stay on top of this. As Gary had mentioned, once you have the NOA2 get on the phone with the consulate and ask about an expedited interview.Have all his papers (police report, medical) ready to go as soon as possible. You may be able to tell them you do not need to go through the packet 3/4 process as you did it before and are ready to go. Bottom line, he needs to be on U.S. soil by August 11.

The more times you meet and the longer time you spend together will strengthen your case for a bonafide relationship. A number of people only visited for one week.

The K1 VISA, when issued, is good for 6 months. You have that time to enter the US. It is, as others have said, only good for a ONE TIME entry. Once here it is invalidated. It is replaced by the 194 paper which is given to you when you enter. THAT is good for 90 days, the time you need to get married. After you are married, you then need to file for your AOS.

Forget the binder. Just use some paper clips to keep the pertinent pages together. Once received, they only put it in the order they want anyway and will throw the binder away. Use a cover page that shows your contents in the order you placed them. That's it. Give them what they want not what you think they need, unless you are coming from a high fraud country then some additional info may be in order.

Your K1 visa expired when you entered the country in December. It is only a ONE entry visa. It was replaced by the 194 paper in your passport which gave you the 90 days to get married. By now you should have been married and filing for your AOS, which makes even the 194 irrelevant. You are fine if you have done this.

There is now a provision in the law where a person entering on a K1 can adjust status without marrying the petitioner. It's not an easy thing to qualify for, but it does exist.

I have to add, as flight crew, there are two airports in the U.S. I try to avoid due to frequent delays 1) Chicago O'Hare and 2) JFK....in that order. I have not travelled to or from the Philippines but I do travel from NC to Thailand, out of RDU (Raleigh, NC), to visit my fiancé several times a year. I have entered (POE) at Detroit, Minneapolis, Washington D.C., and Atlanta with no problems. I would leave 4-6 hours for her to enter, clear customs/immigration and go through another security screening and make a connecting flight. I highly recommend no matter where she enters you be there to meet her and help her connect. To clear up something posted earlier Delta does not have their own customs/immigration hall. These are government facilities are used by all airlines. As for you helping her with her bags I don't think you will be able to do that unfortunately. After clearing customs she will have to claim her bags from the belt....in the customs area (there are carts down there and sometimes a few sky caps hoping for a tip when they help you). If she doesnt connect to another flight she will pass by more officers pulling people/bags for random screening then come out where the public meeting place is. If she has a connecting flight before you see her she will take her bags to another area, not far away, to be re-checked to her final destination.....they pull random bags for screening here too. There will be airline agents helping people re-check bags/scan bag tags for tracking. Then she will come out to the public area. These days even though you just came off a flight, on landing in the U.S., she will have to get re-screened at a security checkpoint before taking a domestic flight. These lines can be very long just like the customs lines. It just depends on how many flights arrive at the same time. They try to space them out to prevent traffic jams but planes get delayed and sometimes several arrive at the same time. I personally use kayak.com to find tickets and check schedules. You can also use e-skyguide.com for checking airline schedules (no buying tickets here) between airports. It shows every airline and every flight they have between city pairs and can be helpful too. 4-6 hours seems like a long time but it beats missing your flight or being stressed about time. Hey, if she gets lucky and breezes right through then just check the monitors for an earlier flight go to that gate and list yourself standby for that flight. Touring the city she lands in could be fun. Just remember after a long flight and major time change she will have a hard time being awake to enjoy those tours. For me going West I adjust pretty quick. Flying East is always much harder on my body clock. As for the drive from NYC to NC I think you know I-95 ain't no country drive....lol. And traffic around D.C. Can be a nightmare. The drive from Washington to NC isn't bad and if you live in ILM there are probably direct flights (there used to be anyway). Good luck!

Another piece of advice. If you find a ticket on a cheap airfare website and price on the real airline website is only a few bucks more.....buy from the airline. I had a bad experience once not being able to pick seats and when I needed to make a change the airline told me to call the website I bought the ticket on. It was horrible! The website was vayama.com.


The point here is that many airlines use the international terminal and you could have 20-30 flights all landing within an hour of each other and the lines can be quite long. The Delta terminal has its own ( yes it is still the government) immigration and not nearly the same number of flights landing close to each other and therefore much shorter lines.

Delta has their own immigration stations. Its not like the international terminals that has a ton of flights arriving every 5 minutes. It could go faster than expected. However, they have 2 terminals ( next to each other a 7 minute walk) and it is possible that a connecting flight might mean moving baggage from one to the other. But since I made the suggestion to you to stay in NY for a few days, maybe you will not have to do this? :whistle:

Anyway, I'm going to find a flight with about 4 - 6 hours of layover at the POE.

I know JFK well. Connecting times can be brutal. You need more than 2 hours. Four would be a minimum to be safe. As others pointed out, she needs to clear immigration, get her papers, then baggage, then customs, and there is no way you can be there. You will first see her coming out of the secure area with a ton of baggage. I do not know what airline she is flying on but I would bet she will arrive in the main international terminal, but may have to go to another terminal to pick up the connecting flight to NC. That is not difficult, but for a person not familiar with JFK, it can be very daunting. You must be there for her. Period.

Now a suggestion. I suspect you both will want to be "back home" as soon as possible, but have you considered taking your time doing this? She will be arriving in NY, one of the greatest cities in the world ( I am a New Yorker :) ) so why not take a day or two to see this city? The ride back to NC passes our Capital, and can be a great time to talk in the car while driving through some beautiful countryside. When will she have the chance to do this again?
