Not to mention how on earth you will be able to make trips to see this woman, and if things go well, begin a visa process, all of which will cost thousands of dollars, if you cannot afford to pay the child support.You really need to clean that mess up first. As some one said up thread, try to get a personal loan and pay this off. May cost a bit more in interest charges but you will have your life back.

In the U.S. a Christian ceremony ( Catholic or otherwise) IS A LEGAL CEREMONY. The minister ( priest or otherwise) has the power to pronounce you man and wife. YOu sign papers in the church. I cannot speak for other countries, but you need to be very careful here. Don't screw up something you waited so long for just because mama "needs" or "wants"  to see her baby in a white dress. Or your fiancee just has to have a ceremony over there. You should have discussed this a long time ago.

What is done is done. You cannot change what happened. Do not compound this by trying to change anything or lying. That is the worst offense. They will not do any medical of any kind at the interview.

The medical report will be reviewed before your fiancee even steps foot into the embassy.Some opinions about being issued a visa will be formed before hand.

There will only be 3 outcomes.

1. she will be outright denied
2. She will be approved
3. she will be given an opportunity to further explain herself.

Be prepared for all three. If the medical report shows negative, but does show a verbal admittance of past usage, and she is asked to explain herself, I hope that saying that she indulged with friends some 2 years ago at a party but never did it again ( only as an example..speak the truth here)it is possible the CO may give her the benefit of the doubt. It is really up to the CO to make the call.

I cannot speak to the Phils or other Asian countries, but in the Russian countries you do not need to be "engaged". The government does not ask about "engagement". Only that you meet the requirements of the K1 process. Having met in person within two years, have a bonafide relationship, show that there is intent to get married in the 90 days after arrival. My wife and I were never "engaged". We simply had a proven relationship and then got married once she was here.

Assuming you are getting a connection to Pittsburgh, and that you will be needing to go to another terminal to pick up a different carrier, 4 hours should be good. The average time I have seen for the initial visit thorough immigration/customs is about 2-2.5 hours. Really depends on how many flights are arriving at the same time. Connections at JFK are easy if you take the train that runs between terminals. At the POE you can stand ( really) on just about any line as all officers can handle the paperwork. They have people who can direct you. They will do a quick scan of fingerprints, open and look at your paperwork and if everything is good, they stamp your passport and then go to customs. Not a big deal, especially coming from the UK. My wife and I came back together and I asked if we could stand together on the US citizen lines and it was "sure, no problem" and off we went.

Lawyers tend to muck up things. This is a perfect example. I hope the rest of your paperwork is correct.  Letters of Intent do not need an address, nor be notarized.  Additionally there is no need to mention your nationality, where you live, where you work. Just I (name) will marry him (name) within 90 days of my arrival in the US. They are VERY simple letters

The children should have been listed in the original 129F petition. This way the embassy knows that there are K2's which will be following you. Packet 3 is for you only unless all of you are going to the interview at the same time. Then you will need their medical and police certificates, etc with you. If the children will be staying behind ( follow to join)then they will need to have interviews scheduled for them separately and therefore their own packet 3 and 4. Keep in mind that once you receive your visa they MUST have their interview completed within one year of yours. And I would not wait until the last few month since any thing can happen such as scheduling snafus, it takes time to request the packet 3, do the forms ( your ex may drag his feet again) and get the interview date. I do not know the ages of your children but also most important is they arrive here before their 21st birthdays.

Our government at work. SO..it only takes a few minutes to approve a petition? And the delays are basically just not enough workers to handle the volume? Incredible. My wife needs to travel back to Belarus to accompany her son to his K-2 interview, which is not yet scheduled. The issue we have is that she needs her AP to do so. It has only been one month since we sent out her application ( along with her AOS and EAD and have recieved back the I-797's)but because her son will age out soon, we need the AP in about another month, and cannot afford to wait for the normal processing times.I think, and would appreciate advice on this, about going for an infopass appointment, but will it make a better case if we did ask for an interview date and bring that with us to the infopass appointment? Any help is welcome. Thanks.

I have since spoken to several immigration lawyers on this. They all say the same thing. The LAW is that k-2's do not age out as long as they are on US soil before they turn 21. They are issued valid visas by a US embassy. AOS is not important in this regard. However....the USCIS, in their infinite wisdom, has chosen to ignore this and repeatly denied AOS if the adjuducation takes place after the child is 21. There are several cases in circuit courts that have reaffirmed the law and had the USCIS reinstate residency. All because of a memo written by some Head honcho at CIS some time ago and it was never rescended. So it is possible to file for status, maybe do an infopass to hurry it up and also possible it may be approved but the general consensus is it will be denied and I will have to go to court.

I married his mother only a short while ago. He was (is) 20. He will be 20 when he arrives. even if I file his AOS before he turns 21, it cannot be approved in time. But I dont think he must return to his home country immediately. I am hearing many stories about when the AOS is denied, if it is, we can still take this to court and many of these cases are ruled in favor of the child.In the interim he remains.

It has to do with finances.The longer I can hold off, without creating a problem, the better. My understanding with aging out is that the law says as long as he is here before 21, no problem. But the USCIS has a different mentality. They want his AOS approved before 21, which cannot happen. So his AOS may be denied and then I am looking at a court procedure.

Here is what I have gone through over the last few days. It appears the embassy in Warsaw can no longer find any record for her son, closed the file and sent it back to Washington or wherever. I was told the "son can no longer come to the US". HUH? I was adivised to call the DOS. I did that and they say they have no records on this and to call the NVC. I did that and they say once the visa is closed their is nothing more they can do and they have no record of this file and to call the USCIS. So I called them as well and no help there either.

So I went to visit my local congressman, spoke to a wonderful woman who asked I document everything for her. It's interesting that I show her son on the original 129, and an email from the embassy stating they received her petition and her son and further the letter confirming her interview date with her sons name listed as travelling companion. How the heck can they now say, they did not know about her son? this is crazy!! Additionally the son has one year to get to his interview after his mothers so you would think that this file would remain open for at least one year and closed after the time has elapsed or he goes for his interview.

So my congressman now has a letter explaining everything, all supporting docs I could find and I am hoping he can do something before I have a very serious age out issue on my hands. I am hoping he can convince the embassy they screwed up and get this resolved ASAP. Man, what a mess.

Do any of you feel that an infopass appointment would be of value here or leave it in the hands of the congressman? Would it be over kill or better safe than sorry?

Just to make sure things are not complicated enough...will this ever stop?... an attorney I just spoke with tells me that since I had married his mother, and he was older than 18 , that she is no longer considered a K-1 and therefore her son no longer a K-2 and so even if I applied for an interview, the K-2 process is no longer valid. :wacko:

All the packet 3 forms, that were sent to the mother, were sent back to the emabassy before her interview this past Jan. Including her sons info. We have no further documents. I assume a "new" packet needs to be requested for the sons interview? I just called the DOS and they said once the records from the embassy are closed and sent back to Washington its over and my only option is to contact the NVC and ask, grovel, beg, them to resend the original application back to Warsaw so they can open a new file. I am trying to call them but dont have a lot of faith in this process.When I called the embassy I spoke to some woman who appeared to research this and then asked to speak to a consular officer but was not able to do so.

When I applied for my original 129, I listed my now wife as the K-1 and her son as the K-2. All went well. All emails and letters from the Warsaw embassy showed both of them on the paperwork. Her son could not attend her interview, but would follow a few months later, because he was in the army and now that he is out I asked the embassy to schedule his interview.

When I called today, I was told the they have closed the file, sent it back to Washington and her son cannot apply nor is eligble for the K-1. They said that they have no record of the son even though I told them I have all their letters showing the son's name. Basically they said too bad.

Even worse, the son will age out shortly, this Novemebr, so I dont even have time to file a new application if I even knew how to do this.

Can anyone give me some solid advice here?

We are preparing for a K-2 interview. Packet 3 received and returned. But when packet 4 arrived it asked us to fill out a DS-156K and a DS-156, which are Fiancee forms not for a K-2 ( deriative of his mother, who is already married). The info they ask is quite confusing for a K-2.

My question is do K-2's need to fill out/present any other paperwork other than the usual police reports, medical, affidavits of support and so forth? Thanks.

When my wife came over, she did not have a copy of the records from the visa medical exam over there. Only her personal medical records, contaning the vaccinations. But they were in Russian and useless to the doctor over here. So I had to pay for blood work to prove all her vaccinations were current. Now when her son comes over, I won't make that same mistake and will ask for a complete copy, in english, of his medical exam.

Don't waste money calling the Russian Embassy the 202 number given is in the states and might be helpful but the pay number at the Embassy only has info on non-immigrant VISA issues.

FYI Belarus doesn't have a way, they don't process any VISA's, most immigrant are done in Poland and a handful are done in Moscow. They both use NVC process and the checklist on the Embassy website, after the appointment is scheduled you just show up with the list of documents on the website, no packet is mailed to you. For the medical it seems there is one agency that returns results in 2 days and one if you can get an appointment in the morning that will give you results in afternoon.


Most K1's do use packet 3 and 4. And most of my married friends went through that process. The assumption was that Moscow was similar. For Belarus this procedure is required for K1. And unless you make some specific arrangements, which are rare, all interviews are done in Warsaw, Poland.

You said that you have all your papers finished but dont want to wait for packet 3. Packet 3 contains all the items you will need for your interview. It is an important document. If you have everything, just check off all the boxes and mail back. They WILL NOT schedule an interview until they have this packet back. They need to know you are ready to go. Once received you are put into a date/time slot for an interview about one month later. It is almost impossible to RE-schedule when you don't have any schedule yet. Also, the embassy receives both an electronic and paper copy from the NVC. The electronic version gets there pretty quickly. A few days. The papers can take a few days more. Then they will need to review them before sending out the packet 3. I know there are reason you want to be here quickly, but sometimes these things take time and better to do it properly then rush and something gets messed.

YOUR CHILD IS A US CITIZEN ALREADY, BY FACT THAT HIS FATHER IS A US CITIZEN. The choice of citizenship was decided when he was born. End of story. Finished.

Filing a CRBA is not mandatory. If you do file he will receive a US passport. He can then come to the US, AS A CITIZEN. If you do not file, he cannot come here. Explanations are listed above.

The only choice left, and it is HIS decision, is to renounce his US citizenship when he is older.

We all understand that you love your country and would like to have your child to be a Peruvian citizen but that possibility is now his decision. Not yours.

In direct response to your question, "why did the tier two officer tell you what they did"? NO ONE KNOWS. No one here can read the mind of this person. So this question cannot be answered with any level of confidence. I have spoken to these people before and their answers were sometimes right and sometimes wrong. I would suggest you make an infopass appointment as soon as possible ( sometimes they can be made same day, next day) and get in front of another officer and/or the supervisor in charge and ask again.

Everything takes time and everyone is different. My wife and her friend were both in the same timeline starting out with the 129. One step took us only a few weeks, but it took them a few months. Another step took them a few months and us almost one year. Hopefully you will be together for many many years, so don't get upset over timelines here and there. Often times the NVC will concentrate on one type of visa to the exclusions of others and then vice versa. Sometimes the timing can be an issue ( more visa applications during the summer vs winter as an example). All sorts of stuff. Just relax. They will notify you when you least expect it.A few extra weeks or even a few months here and there mean nothing compared to a life time together.

Part of the process is that the beneficiary must produce a police report. Either it will state that he was arrested and the disposition of the charges or there will be no record and the document will state that. Have him go to the police station where all this took place and ask for the report. I doubt if the US is going to check every police record in his country so what he produces is what they will go by. However telling the truth is always best. Usually small criminal charges of drug possession will not prevent approval. Moving a few kilos of heroin is quite different.Lets be honest here, the USCIS does not look favorable on "criminals" entering the country so it is up to you to prove that any charges were insignificant to warrant denial.

I concur. You have to wait outside. Sometimes it could be an hour and sometimes more depending on the number of people going through the process. If she has a cell to call you at least you can communicate, but many areas do not allow their usage either. Bring flowers !
