Is your new address still in the same District Office jurisdiction? If so, then I wouldn't think there'd be a delay. If not, then you will have to wait for the case to be transferred and a new interview scheduled.

The fact that you and your husband won't be living together when you have your interview could be an issue since you are applying under the 3 year rule.

We never got the "yelloe letter" but there is a conflict between the interview notice itself and the I-659. The interview notice says to bring any passports used to enter the US. The I-659 says to bring ALL passports including expired ones. We're going to follow the I-659 since it is more expansive. Better to have too much than not enough and be missing something the IO wants to see.

We will be bringing originals. We'll also bring copies of any original documents we don't want USCIS to keep.

When we received our interview letter, there was an N N-659 Naturalization Interview Document Checklist enclosed instructing us what to bring.

Key things we're bringing include...

green card
our birth certificates
our passports (current and expired)
our marriage certificate
birth certificate of child
tax return transcripts covering past three years
proof of marital union and residence for past three years
- current and prior leases for past three years
- bills in both our names
- joint bank statements
- car title showing joint ownership
- letter from our pastor
originals of any other documents we submitted as part of the N-400 application

It appears your options are to either wait until you naturalize or file an I-90 to get the green card re-issued in your married name.

Depending on where you live, doing a name change as part of the N-400 may (or may not) delay the Oath because a federal court has to administer it.

It has a checklist starting after page 47 that lists the things you need to send with your application. The items may vary depending on your circumstances so you may stil have some questions to post after reading that. It would help if you told us whether you are applying based on five years of PR status or if you are applying after three years based on marriage.

The OP does raise a legitimate point. Some people who have had to wait months or even years for particularly slow DOs to process their AOS applications then have to fall in line for citizenship behind people who applied for AOS after them but whose AOS cases were processed more expeditiously and approved sooner than theirs.

I've always thought AOS approval dates should be backdated to the Received/Priority Date on the receipt notice. That way, the applicant wouldn't be penalized for the USCIS' lack of efficiency in processing certain applications.

The way I see it, as long as the filing is well organized and USCIS can make sense of what we're sending them, why not let them do the hole punching, tabbing, ACCO fastening, etc... After all, we're paying them almost $700.

The document checklist at the back of the Guide to Naturalization may give you some clues how to organize your evidence. We put a table of contents at the front of our filing. We ddin't use any fastener clips. We just put the filing in a file folder.

I would answer "no" to the questions you listed. If it was your spouse applying, they might have to answer yes to 23 and 24 depening on what they told the US authorities when they applied for the visa and when they entered the country.

However, you might have to indicate on the form that you have committed a crime or offense for which you were not arrested, because harboring an illegal alien with the intent to help them evade immigration law is against the law.

You should consult an attorney before you file.

There's a difference between a rejection and a denial. If they reject it, they are aupposed to return the file without cashing the check. If they deny it, then the applicant forfeits the fee and has to pay again.

If they rejected the case but cashed the check, then the OP can send evidence that payment was already made when re-submitting the filing.

IF they rejected it, they should have returned the check uncashed to the OP. IF they didn't return it, then the OP should put a stop pay on that check and send a new one with the resubmitted application.

To me it seems a better option than potentially being charged twice for the same application.

I beg to differ. According to the I-659 checklist the focus is on residency and marital union if applying under the three year rule. The stuff they look for to prove marital union is pretty much the same stuff they want to remove conditions.

You have two options.

1) Cross out the five, write in "three" and list the total days outside US for the past three years

2) Take the question literally and put the total number of days outside the US for the past five years, but include a separate statement explaining this and giving what the total number of days outside US would be for three years. If you give them both figures, then they can use whichever number they want.

My first thought was to ask why you wouldn't dress up for an Oath Ceremony, but I realized I'm not much of one to talk. I was in Rome back in 2003, and I decided to crash a Papal Mass at the Vatican without a ticket. I'm sight impaired, so I took my white cane with me. Whenever they checked for tickets, I showed them my cane. I ended up sitting five rows back in the VIP seats surrounded by bishops, cardinals, and dignitaries. I had expected I was going to be in the back of the crowd somewhere, so I was wearing khakis and a blue polo shirt. I'm really surprised they let me in the VIP section dressed like that. Funny thing though is that on the Vatican website, they have an overhead photo of the platform with Pope John Paul II and the VIP section. There is a see of black suits and a bright blue shirt in the 5th row that sticks out like a sore thumb. If I had dressed up, I would not have been noticeable from the rest of the crowd, but that bright blue shirt is hard to miss. smile.gif

Well, in any event, we had nothing to worry about. My wife came prepared with a binder full of documents, but the IO just asked to see her driver's license and green card. After reviewing the A file, he didn't ask for any additonal evidence.

I think I'm mainly worried about being asked for stuff that we previously submitted for earlier applications that isn't included on the interview checklist. My wife's birth certificate is a good example.

I guess I thought getting a "yellow letter" would be a good thing because it means someone actually located the file and looked at it. I've heard too many stories of missing or incomplete A files. As long as my wife's case file actually makes it to the District Office for the interview, then I'll be happy.
