Removing Conditions on Residency General DiscussionCheck your receipt number!
Receipt number on biometrics notice is different than the one on NOA1. The fine print on NOA1 says to use the number on the biometrics notice, not the one on NOA1. I recall reading somewhere that USCIS is putting temporary receipt numbers on NOA1s to expedite the process of getting caught up with them.

Removing Conditions on Residency General DiscussionNOA for I-751 Notice Date 10/19/2007, no ASC letter?
My ASC notice was sent from CSC, not the local ASC. That said, scheduling depends on the workload at the individual ASC. Each ASC is supposed to reserve a certain number of slots for different types of applications.

Better to check on the status than risk being denied because the biometrics notice got lost in the mail.

Personally, I found the title of this post a bit misleading. I was expecting to read that the OP had sent a very small set of documents and still got approved. I suppose it comes down to what one's definitions of "little evidence" and "lots of evidence" are.

Way to go Vermont. They seem like they're one of the faster service centers.

One of our accounts is an online only account, so we sent in the printed PDF statements. I don't think it's going to be a problem since you only have to send in copies anyway.

We did not send any pics. In addition to apartment leases, insurance policy information and extensive financial and tax records, we sent medical records showing that my wife is pregnant with our first child. We also sent a letter from our church showing that we are registered parishioners there.

There's no requirement to file right when the window opens. However, the later you file, the more risk you run of having to file late if your application is rejected on the first try.

Removing Conditions on Residency General DiscussionQuestion about my drivers license, while waiting for I-751
Glad to hear about a good experience at the VA DMV.

When my wife and I moved to Colorado, she was pleasantly surprised to get a full five year license when she traded in her VA license. I guess they assumed she was legit if she'd managed to get a Virginia license. So that's one less hassle we have to worry about while her paperwork is pending.

It comes down to what they SHOULD accept vs. what they WILL accept. The only way to find out is to go to your local DMV and ask.

You should have the NOA1 letter for the I-751, this extends the green-card for a year, and most states DMV will accept that letter as evidence of legal presence.

That assumes the person at DMV knows what they're doing. In Virginia, they're notorious for not accepting anything other than a green card or EAD and tend to look suspiciously at NOAs. It's one of the downsides of having DMV staff with no immigration experience charged with enforcing legal presence statutes.

I'm not that surprised. I noticed our AOS file was in a different order when we had our interview.

They have a standard way of organizing the files. I suppose it would make sense to have every file follow the same format to make it easier to adjudicate.

I recall reading that once the packet arrives in the mail room it is sent to mail assembly group, where they put it into the format they want. After that it goes to the data entry group for receipting or rejection.

Good luck with round two.

Removing Conditions on Residency General DiscussionHelp! She has biometrics tomorrow...
My wife is scheduled for biometrics tomorrow morning. However, she was hospitalized today after having several contractions. They let her out this evening, but the contractions are continuing about once an hour.

What do we do if she can't make the appointment? I can mail the reschedule request, but by the time the ASC actually receives it, I'm afraid the CSC will consider the application abandoned because she's a no show tomorrow. There's no way to call the ASC to explain the situation and my previous experiences with the NCSC 800 number leave me with zero confidence that they'll give me sound advice.

Any suggestions?

I wouldn't beat yourself up about it. It happens to a lot of people. My wife's EAD application was rejected because we forgot to check a box. You would have thought they could have just checked the right opttion since we filed it concurrently with our AOS app, but no... they returned it back to us. Fortunately, the EAD is one application you can e-file, so we only lost a couple days. Still I remember how much of a bonehead I felt like for making such a dumb and obvious mistake.

One thing I"d be curious to find out is when you resubmit, whether they'll honor the date it was originally received or if your receipt notice will have the date it was resubmitted. The reason I ask is because our EAD packet had a mail room stamp on it and I always wondered if we could have kept our place in line if I'd just resubmitted the packet after correcting it, rather than filing a completely new application.

Best of luck.

That's what a rejection is. It means they return the packet to you without receipting it. It is not the same as a denial.

When someone asks for advice because they don't understand what is being asked of them, it's not really helpful advice to simply tell them to "give them what they want". if you get a notice from USCIS that you don't understand or think is too vague, you can at least try to get them to clarify it by making an InfoPass appointment.

After my wife's AOS interview early last year, we got a notice telling us to appear for biometrics. She had already done her biometrics and they had not expired, so we wondered if they'd sent the notice by mistake. We wrote a letter to the officer who interviewed us and asked for clarification. He called my wife and explained to her that her biometrics weren't in the computer for some reason so she had to redo them, but that she was approved. Knowing she was approved made the trip to get biometrics redone a little easier. It never hurts to ask if you don't know what they want or why they want it.

Jim, Is that what you would really do if you were in the OP's shoes? Something tells me you'd do your homework and figure out exactly what they need - especially in light of your recent experience with having your I-751 rejected. sad.gif

If the address on the notice is wrong, I suggest setting up an InfoPass appointment and try to get clarification on what the problem is. It wouldn't make any sense to guess and get denied as a result.

If the expirations on the green cards are different then yes they need to file separately. It doesn't matter that they arrived in the US at the same time. What matters is when they were granted conditional residence.

Good question. The instructions on the latest version of the I-751 state that:

QUOTE
The documents should cover, but not limited to, the following examples...

On the one hand they refer to examples, but on the other, they say your evidence should cover what's listed. Now, something like a birth certificate wouldn't necessarily apply to everyone, but in the case of a lease or mortage contract, I would think that would apply to everyone since USCIS wants to see iron clad proof of joint residence.

Not having your name on the mortgage may be a problem since they specifically ask for evidence of that as part of evidence of relationship:

QUOTE
2. Lease or mortgage contracts showing joint occupancy and/or ownership of your communal residence.

http://www.uscis.gov.../I-751instr.pdf page2

You may want to include something from your husband explaining why he has chosen not to put you on the mortgage.

My hope is that your daugher's birth certificate will trump not having your name on the mortgage, but you never can tell. It all depends on the person reviewing your petition.

I wouldnt't expect my wife to put an immigration filing together on her own, not just because she's only been here three years, but because it's just not something she's good at. Removing Conditions on Residency General DiscussionI-751 renewed
Perhaps I assume too much about what may or may not be obvious... In an attempt to see things from your point of view, I re-read the I-751 instructions and didn't see anything in the Processing Information section advising about a one year extension being granted upon acceptance of the petition.

The way the process works is this. After you file the I-751, you get a receipt notice (the letter you just received) extending your status for one year. In a few weeks you should expect another notice telling you to appear at an ASC for biometrics. Once that's done, you may get a request to send additional evidence if USCIS feels it is necessary to adjudicate your application. Once USCIS has all of the evidence they need and makes a decision, they will send you a notice informing you that they have approved or denied your case. If they approve your case, they will then send you a green card valid for ten years.
