Keep in mind you have a 90 day window within which to file. You might try scheduling your filing so that the biometrics would happen after your vacation.

I have similar worries. My wife is expecting a baby in January, but they might induce labor in late December, wihich is when I'm anticipating her biometrics to probably be scheduled for. I'm hoping they get it scheduled quickly so that she gets that done before the baby comes.

Supposedly you can request that the appointment be rescheduled, but you always run the risk that the right hand doesn't know what the left hand is doing at USCIS and your case gets denied because you didn't keep the biometrics appointment.

Why wouldn't an announcement like this be posted on the USCIS site? If NSC filers can file direct with CSC, it would save USCIS time and money because they wouldn't have to waste resources on forwarding petitions to CSC. Plus, the filer would probably get a biometrics appointment faster because the lag time between NSC and CSC would be eliminated.

If she's out of the country for a year or more, then she would have a problem unless she applied for a re-entry permit before leaving the US. If she's gone less than a year than it would not be a problem provided you're with her for most of that time so you can show USCIS concrete evidence that the marriage is bona fide when you apply to remove conditions. That said, the amount of time spent outside the US will have an impact on when she will be eligible to apply for citizenship.

According to the form instructions, they make exceptions if you're overseas on active military duty or official government orders. It doesn't say anything about extended vacations:

You might be able to mail the filing from overseas, but the way I read the rules, you'd have to come back to the US to do your biometrics.

If they want W-2s or tax transcripts, then they should change the instructions on the form to state that. The instructions as written say nothing about tax transcripts or W-2s.

My understanding is that AOS required W-2s and/or transcripts because part of the AOS decision is determining the sufficiency of the affidavit of support. I don't see what purpose they would serve in the removing of conditions phase, because the goal is to determine whether the marriage is bona fide.

I called the NSCS and told them I was calling because NSC has already issued receipts for cases received a week after ours. The people I talked to, including a supervisor, told me they don't care what the USCIS website says. They said it's not updated and stuck to that even when I told them I was referring to the latest receipt update posted on Friday They told me they will not make any inquiry about a receipt until 90 days have past since the date we submitted the filing. The supervisor said it doesn't matter what the website says because the guidance they have from USCIS has not been updated with them. He told me if I have a problem with that to make an InfoPass appointment.

My main concern is getting biometrics done. With our luck it could get scheduled while my wife is in the hospital having our baby... But I guess we'll just cross that bridge when we get there.

Perhaps I didn't phrase the question as well as I should have. My question really is, which set of receipting stats should I be looking at? NSCs or CSCs? NSC is past our receipt date, but CSC isn't there yet.

I think if both centers dates pass our received date, that's when I'll call.

My wife and I filed our I-751 two weeks ago with NSC. They received it on November 5th. According to the latest receipt notice update on the USCIS site, NSC has issued receipts through November 12th for the All Other category.

I know from VJ that our case probably will be transferred to CSC, which is most likely why we haven't gotten a receipt yet. The thing is that the USCIS site doesn't say service center's receipting stats you should follow if your case is sent to one service center and receipted by another. So I don't know if I should follow the receipting timelines for NSC or CSC.

The USCIS website says to contact them if your case was received prior to that date and you haven't gotten a receipt. However, the automated phone system says to complain only if you filed over four weeki back but haven't received a receipt. So what to believe, the guidance on the phone system or what's on the website? Do you think it is worth my time to call them?

I took a closer look at the front of the check (I was looking for a receipt number on the back) and there are some numbers handwritten there, but nothing that matches the format for a receipt number. If I add up the various numbers they put on there it adds up to over 20 digits in lengh. All numbers, no letters.

You don't need to refile for removal of conditions. If the extension expires without a decision, make an appointment with your local USCIS office to get an I-551 stamp. She can also file for citizenship as soon as she's eligible. That will force them to make a decision on the I-751.

We got our receipt notice on Friday from CSC. The notice date was November 5th - the date our petition arrived at NSC. Now we wait for the biometrics notice.

Nebraska is not processing new I-751s. All newly filed petitions are being transferred to CSC for receipting and adjudication.

Why does it matter? The clock started ticking toward eligibility for citizenship when your conditional green card was approved. smile.gif

If it weren't for the fact that we're expecting a baby and want the biometrics out of the way before the little guy arrives, I'd be just as happy to forget about Removal of Conditions now that we've met the requirement to file for it.

That said, in practice, USCIS tends to reject cases or send RFEs when something is missing, rather than denying them outright. If they do reject your case, hopefully you will have enough time to refile before your green card expires.

I've heard of that happening. You could make an InfoPass appointment to check on it. The 1-800 number seems to be pretty worthless so I wouldn't bother with them.

You could also try going to the first biometrics appointment and take both notices with you.

Check the fine print on the receipt notice. Ours specifically stated that we would not be able to look up the case until getting the biometrics notice. Once we got the biometrics notice, we used the number on that (which is different than the number on the NOA) to find the case online.

Has anyone gotten an RFE on an I-751 because they didn't submit W-2s with their tax returns?

I know this happens sometimes with AOS cases since the W-2s and returns are used to determine the sufficiency of the Affidavit of Support, but I'm curious if this matters quite as much for the I-751 where the goal is to prove the marriage is bona fide.

We submitted the paper copies of our federal returns (without W-2s) from our tax preparer. The copies are not signed and dated because we e-filed. However, we also submitted printouts from the Virginia tax website confirming that we e-filed our state taxes.

I'd be surprised if we got an RFE given how much other evidence we submitted, but I'm just curious what the chances might be.

Detroit is covered by the Nebraska Service Center. Recently, they have been transferring all their I-751s to California, but who knows what the procedure will be next June. Unfortunately, this far out it's pretty much impossible to predict what the timelines will be like. It all depends on the volume of applications they have and the resources they have allocated to process them at the time you file. From reading posts here it can take anywhere from a couple months to over a year. The good news is that the countdown to eligibility for citizenship is tied to when your conditional green card was issued, not to when the conditions are removed. So, even if it takes awhile to get the 10 year card, you really don't lose anything in the end.

Receipt number on biometrics notice is different than the one on NOA1. The fine print on NOA1 says to use the number on the biometrics notice, not the one on NOA1. I recall reading somewhere that USCIS is putting temporary receipt numbers on NOA1s to expedite the process of getting caught up with them.
