I called USCIS yesterday and asked if they could tell us whether the category code on my wife's green card was correct or not. We don't want to file an I-90 unless we know for sure there is an error on the card. The 800 number's response was that we have to make an Infopass appointment to find that out. What a bunch of #######. They have immigration officers who they could transfer me to who I'm sure could answer the question.

Even if you send in additional evidence you won't necessarily see a touch. During the AOS phase, my wife and I sent a certifed marriage certificate to replace the photocopy we originally included. We didn't know whether it made it into the file until we had our inverview. My wife saw it in the packet as the officer was flipping through it.

I can't speak to whether the letter was normal or not, but at least you know USCIS received your file from the POE. The next step should be for them to send your conditional green card - conditional because you arrived in the US less than two years after you got married. That means you and your spouse will have to file an I-751 petition sometime in the three months before your conditional green card expires.

I was doing some searching on the USCIS site and found this:

Section 264 of the Immigration and Nationality Act provides that, "Every alien in the United States … shall be issued a certificate of alien registration or an alien registration receipt card in such form and manner and at such time as shall be prescribed under regulations...." It also states, "Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him.... Any alien who fails to comply with [these] provisions shall be guilty of a misdemeanor" and may be subject to fine and/or imprisonment upon each conviction.

So, as much as I don't like the idea of having her carry her green card on her, the law seems pretty clear about it. I'm not sure whether a photocopy would suffice or not.

We went ahead and filed an I-90 citing option 'd' for an incorrect card. We submitted evidence of the error and the correction needed. We then included a letter requesting a waiver of the requirement to return the original card because it was lost/stolen. We also included the mailer the card came in.

I figure it's worth a shot. The worst they can do is reject the application and send it back. We'd just be out the money for postage. The error isn't just on the card, it must be in their system since her conditional card had a similar error on it. Perhaps what we sent will be enough to get it fixed.

I know we need to file I-90. What we're trying to avoid is having a new card issued with the same incorrect information on it (inccorect category code). So which reason do I check on the form? That the card was lost? That is was issued with incorrect information, or both? We have to send the application to a different location and include different evidence depending on the reason we select.

My wife had just gotten her card and hadn't had a chance to photocopy it yet (she carried a photocopy of her previous one. She was going to have it copied the day her wallet went missing. It was just her lucky day I guess.

Thanks for the information. In our case, we filed the I-90 with option 'd' (because the category code on the card is wrong) and included an explanation that the card was stolen so we couldn't submit it as evidence of the error. We sent the application to the CSC. I'm assuming the application will most likely be rejected without the card. Since we have the card back now, I'm not sure whether to mail it separately in the hopes they put it with our application, send a letter withdrawing the application, or wait until they send us an approval or denial and re-apply. If they issued receipt numbers for I-90 option 'd's, it would make life easier.

Is there a time limit to apply for replacement of an inccrrect card and still get the fee waived?

If you have enough other evidence you shouldn't need tax transcripts for your I-751 filing. We sent copies of our returns without the W-2s and were approved with no RFEs.

Transcripts are more important in the AOS phase when you're having to show the sufficiency of your I-864.

Personally I think people should be eligible to file the I-751 as soon as they hit their second wedding anniversary. Why should an applicant be penalized for the slow speed at which USCIS processes adjustments. Unfortunately that's not how the system is set up.

You might try to get in touch with your Member of Congress to see if they can help you get a waiver from the Air Force. I would think that with things the way they are, the military would take all the help it can get.

Unfortunately, you can't file for a waiver based I-751 until a divorce is finalized. If there's any chance you and your husband can work things out then the two of you could file the I-751 jointly.

If you're 100 percent sure you're getting divorced, then get one as soon as possible. The longer you wait the greater the risk you could wind up in removal proceedings for failing to file the I-751 in a timely manner.

Unfortunately, before you can file an inquiry, you'll have to wait until your NOA date is 30 days past posted processing times. In other words, if the processing dates show a date of August 18th, 2007 or later, then you can call the 800 number or make an InfoPass appointment and have them file an inquiry. I know it sucks seeing other people who applied after you approved before you, but that's how they do things.

CF1 is the correct code on a 2 year conditional card for K1 adjustments. IF1 is the corrrect code for a 10 year card obtained via adjustment from K1.

We had my wife's category corrected by USCIS because they had the wrong code in the computer and we were worried about the error causing problems later on.

I'd suggest an InfoPass to see what they show in their systems.

This may sound like an obvious question, but when does USCIS mail the green card? Do they send it after you get the email saying "card production ordered" or after the email that says, "card mailed"?

I ask because my wife's conditional and permanent cards both arrived the same day we got emails about approval notices being mailed. This time, we got the email about her corrected card having been mailed, but nothing has shown up in the mail yet.

I'm nervous because our post office lately has been very picky about delivering mail to us when the name doesn't exactly match their records, and USCIS has a habit of mailing things to my wife using her first and middle initials instead of her full name.

If a card is returned to USCIS as undeliverable, will they attempt to resend it or do you have to file an I-90 for an undelivered card?

On second thought, if USCIS reviewed the I-90 and didn't change the category, then they must think it is correct. After all, there isn't much difference between an IR6 and an IF1.

When we filed the I-90, my wife couldn't return the card because she had lost her wallet. A couple weeks later, she recovered her wallet with the green card inside.

This makes me really scratch my head and wonder why they went ahead and issued the new card without charging a fee if they didn't think there was anything wrong with her original card and we hadn't sent the card in to begin with. Shouldn't they have told us to re-file an I-90 for a lost card instead?

Not that I'm complaining. My wife was really worried about carrying her card with her all the time, but now that she has a spare, she can breathe easier about it.

So USCIS sent my wife a new card after six months of waiting for her I-90 to be processed. The new card has the same incorrect category code as the old one. The only things different are the issue date and expiration date. So, they gave her another six months validity for free, but didn't fix the error.

I don't understand why they would issue a replacement card if they don't think there was an error on the old card. Shouldn't they have just rejected the I-90?

The card is the approval notice. They often seem to send the email about it being mailed after you receive the card. If you have the card, don't expect to receive a separate approval notice.

In my case, the email I got was worded slightly differently. It said, "Card Mailed".

Well, six and a half months after filing a no fee I-90 to correct the immigration category on my wife's 10 year card, we got an email last night informing us that USCIS has ordered production of a new card!!!. We had given up on the application because when we went to an InfoPass a couple months back, they didn't have any information about the I-90 in their system.

Hats off to the USCIS California Service Center!!! Way to go!
