I'm not sure why the petition was approved so fast. Do they ever approve them within a week of receipt?

As for the visa itself, I called and emailed the embassy and even paid them a personal visit to have my Affidavit of Support notarized there. I never asked them to expedite - just asked about the status. After my visit to the embassy, they scheduled an interview appointment so fast that my fiancee missed the interview because she didn't get the notice in time. They rescheduled it five days later.

What was really strange was that the embassy sent me a personal email to inform me when they issued the visa. They must have really wanted me off their back.

Given that our K1 case was apparently expedited (one week from date of filing to petition approval, two and a half months from petition approval to K1 issuance), I can attest that the squeaky wheel sometimes can get things done faster. So, it doesn't hurt to try.

Get a letter from her doctor to give the embassy with your request to expedite. There's no guarantee that they will expedite, but it doesn't hurt to ask.

Your third question could be in reference to a couple things.

One is the Packet 4 for the actual visa application. This is handled somewhat differently depending on the embassy/consulate.

The other possibility is the POE package your fiancee gets if the K1 is approved by the embassy/consulate. In addition to the visa itself, the embassy gives the visa applicant their entire application package in a sealed envelope. This package is turned in to the officer at the point of entry.

Here's what I did when I was in your shoes.

I prepared the I-134 and gathered the evidence of income and assets that it requires, including obtaining letters from my 401k plan and my bank.

I made a copy of the I-129F petition filing for her to have.

I visited her in Manila for a week. While not required, this gave us a chance to see each other again and provided her with additional evidence of relationship for her interview.

I had the I-134 notarized at the US embassy while I was there - having it notarized there wasn't a requirement, but it was a nice touch.

I called and emailed the embassy long distance way too many times to find out when her interview was going to be. smile.gif


Your fiancee can have her teeth checked, but unless she has some transmissable disease that's causing the problem, the health of her teeth won't have an impact on getting a medical clearance. Her time might be better spent getting some of her vaccines taken care of.

AOS stands for Adjustment of status. It costs $1010. You file it once she's here and you've gotten married.

My wife has a friend in a similar situation. The friend cannot even apply for a visa because the birth cert doesn't match the information on other records. She'll need to get the certificate corrected, which is not an easy thing to do in the Philippines apparently, but she really doesn't have a choice.

Commission on Filipinos Overseas is a part of the Department of Foreign Affairs. Any Filipino K1 should be familiar with them. The CFO has a mandatory seminar that all K1s must take before being allowed to leave the country.

One thing they could do is make AOS approvals retroactive to the date of application. It doesn't seem fair that some people get approved months ahead of others just because of where they live. If they made the approval retroactive, then applicants wouldn't be penalized because their local DO happens to be really slow. I figure if Social Security can do it using Protected Filing Dates then why can't USCIS?

I really can't complain though. My wife's I-129F was approved a week after it was receipted. That made her wait for a K1 much shorter than it could have been.

It would probably be a good idea not to wait until the last day the I-94 is valid to get married. Delays can happen and you don't want to cause yourselves any problems.

My wife and I got married a little more than halfway through the 90 days. That way we had time to get married and submit the Adjustment of Status paperwork before her I-94 expired.

The key is that the letters you submit from others should not simply attest to the existence of your relationship, but should speak to your intent to marry within the prescribed 90 day limit. For example, we submitted:

a statement from my wife's parents stating their approval of our engagement
a letter from the marriage preparation coordinator at our parish indicating our registration there
email correspondence between my mom and my fiancee
email correspondence between me and my wife's sister

In your case, getting a letter from an ordained minister might be helpful if they are the one who will perform the ceremony.

Have you considered the fact that you have 6 months to use the K1 once it has been issued? That in effect gives you almost nine months to have your wedding once you get the visa. So, if you need more time to plan your wedding so family can attend, perhaps you might consider delaying your arrival in the US by a few months. To me that woudl seem a better solution than living apart after you are legally married.

Living apart before you are married legally would not be a problem. However if you continue to do so after, it could potentially be an issue for USCIS because you have to show that your marriage was bona fide from the date on your marriage certificate to the time you are interviewed for adjustment of status. Living apart after you are legally married could be misinterpreted as a sign of potential immigration fraud. I suppose it would depend on how long you plan to continue living apart prior to your big wedding.

Have you looked into whether you can pull off a simple wedding within the 90 days? My wife and I received special consideration from my parish because of the 90 day requirement. We got a wedding date within two months after she got here. We would have normally had to wait at least a year. It was a small wedding with no music, but we made up for it by getting married in the oldest Catholic chapel in Washington DC.

Check your receipt and approval notices for the previous I-129F. There should be an A# on them next to the beneficiary's name.

We sent copies of our tax returns, not transcripts. We didn't include our W-2s, but we were still approved without any requests for evidence.

I think tax transcripts are more important during the adjustment of status phase than during removal of conditions.

Having a baby certainly helps. When we filed, we sent in medical records showing my wife was pregnant. When she gave birth I had debated whether to send the birth certificate with a request to have it added to the file. I decided it wasn't worth the trouble. Looks like the documentation we originally sent them was enough.

Even though we had plenty of other evidence, we chose to go ahead and send the affidavits. We figured they could only help our case. I have no idea what weight they carried with the adjudicator, but our case was approved within two months of having been received by CSC.

All I can say is use your best judgement. Maybe go ahead and submit without affidavits and only send them if you get a request for additional evidence.

I think this may be a case of me just knowing too much about immigration stuff for my own good. How many average green card holders know or even care what their category code means? The basis of the adjustment is different. For a CR6 or IR6, the adjustment is based on an approved I-130. For a CF1 or IF1, the adjustment is based on an approved I-129F. Hence, a CR6 or IR6 classfication for an immigrant who entered on a K1 would be incorrect.

My wife was misclassified as a CR6 on her conditional green card instead of a CF1, even though she adjusted from a K1 visa. We wrote USCIS and alerted them to the error right away, but did not file an I-90 to get the card corrected, since all the other information on it was correct.

My question is whether they are likely to correct the mistake and issue her 10 year card as an IF1. I forgot to include a note with our I-751 filing about this. I'm not sure if they review the entire file (which shows she adjusted from K1) or just the evidence we submitted with the I-751 (which doesn't show what she adjusted from).

I know it's a small detail, but I don't want it to bite us later. Anyone else adjust from a K1 and end up as CR6 or IR6?
