Check the link titled "USCIS Processing Times Spreadsheet" on my blog. It is evident that I-130s have not been processed for some time, according to the USCIS Processing Delay updates that USCIS publishes weekly.


Delicia, do you understand what the processing times as stated by USCIS mean? The processing times mean they are processing cases AT LEAST that old.

You still haven't shown me any official word that USCIS has halted the processing time of I-130's in favor of other petitions.


Rebeccajo - What Delicia and others in our position at the moment are referring to are the current unusual delays (on top of the wait that everyone experiences) because of the huge backlog generated by thousands of people trying to beat the price rise. She's not just talking about the USCIS processing times which reflect as you correctly say "cases at least that old" but this separate delay which we check every week on a different USCIS page - receipting delays

As you can see the I-130s are right at the bottom of the processing priority. The other visa types have been slowly advancing but the I-130s seem to be stuck miles behind the others. It appears that they are processing in some kind of order and have put the married people who are just filing for CR1s at the back of the queue. In my case at Vermont for example, the center is still only opening and data inputting info on applications for I-130s up to the end of July. It has been stuck on that date 29/07/07 for about seven weeks now! I think our cheque is going to expire before the application has even been added to the system AND THEN we all have to start the countdown which everyone else on here is used to ie we then start looking at the standard processing times on USCIS, which as you know can be six months more onwards.

It is significantly worse at the moment in terms of waiting times for those of us who filed after the middle of July than it has been for a LONG time. So can I ask those of you already almost though the system - particularly those of you with your partners by your side over the holiday season to show a little compassion on these boards to those of us with this long wait ahead of us and be understanding when people rant a little.

Hi - I notice you sent in to Vermont originally - I wonder if those who posted to Vermont originally are still about a month behind the California lot - when they were transferred over the Vermont applications were from the end of July the California ones were the end of August - so it could be that the Sept people who are getting them now were non-Vermont people? Perhaps they are just slightly ahead in the receipting process at the moment.

Actually Marlita is right - there are many people filing K1s who tell us that on here they already have their NOA1s even though they filed after July/August/September etc.

K3 seem to be facing the same delay as us on CR1/IR1s.

Even Vermont seems to be not to bad with K1 delays.

It seems as though K1 is treated very differently than the CR1/IR1 or K3s. But as it is a different visa so that makes sense. Although as Marlita says, it is very unfair!

Me too! I'm an October filer and got my NOA1 on 10th Jan - still can't access my file online - it seems to be the CR1/K3 filers at Vermont who have this issue. I'm not expecting to see anything before the end of Feb or even the end of March. Although it doesn't stop me trying it every day!

On the original topic - I entered the US successfully today under the VWP for a two week visit to my husband. POE was at Dulles airport. This is how it went:

IO: Purpose of visit?
ME: Vacation
IO: Who are you staying with?
ME: My husband
IO: (Deep stare at me) How long are you staying?
ME: Two weeks
IO: Have you ever lived in Florida
ME: No (thinking - what?)
IO: Do you have any relatives in Florida
ME: No (what?)

IO then stamped all the forms and told me to have a nice vacation. Simple and quick. I was very pleased and surprised. I didn't have to show any of my evidence for return to the UK. For reference I had:

Return ticket
Letter from work
Rental agreement letter
Old passport to show good history of short stays and returns to the UK

So for those applying for a spousal visa and able to use the VWP it can be done. I'm now going to enjoy two weeks with my husband!

Well, as has been stated, simply getting married is absolutely allowed. Realize that, especially due to this recent event, the burden of proof is definitely on your fiance to show that it isn't his intent to stay illegally.

I moved from Southern ON to VA outside DC. Six years later I can safely say that you will be surprised no matter how much you think you've prepared. What no one realizes is you are comfortable in Canada, you've lived with certain attitudes, read the news papers, watched the news.....you know the status quo and how everything works. Upon moving everything is new right down to where the cereal aisle is at the grocery store.

 

I thought I was ready because I had visited so much before we were married, but it all felt slightly different when I wasn't 'going home' after my visit. Little things pissed me off - like having to fill out paper work as a new patient because I was going to new doctors.....I found it oddly unconstitutional to have to provide my SSN every time I filled out paper work (exactly who needed this info and were they tracking our every move?) ! I hated having to fork out a $20 copay for every doctor's visit. I had to fill out a freaking deposit slips and write checks (aka cheques!)something I hadn't done in years at TDCanada Trust. After about 2 months of feeling like a fish out of water where little stuff drove me nuts, I was insanely homesick by Christmas. I had a few meltdowns and I am surprised my husband didn't send me home.

 

Wow - you pretty much described my exact experience. The bank stuff (and cell phone companies) drive me crazy here - the land of the customer service and it feels like the dark ages for the customer with bank charges all the time and terrible contracts with charges. And cheques! I hadn't used cheques for about ten years before I arrived here. 

 

I arrived in 2008 and have a big bout of homesickness about every two years - something different sets it off each time. 

 

And I'm another Virginia resident - just over an hour from DC.

Also in 2007 - there was a huge spike in all immigrant visa applications when they put the fees up and hundreds of thousands of people applied in a rush to beat the fees. I remember a news report saying there were a million more applications that year than usual.

For fiance and spousal visa that meant a huge backlog - much much worse than the waiting time today - and VSC was the WORST.

We waited over 90 days just to get our NOA1 - and our NOA2 took over ten months and was only processed when VSC finally gave in and sent a bunch of files to CSC for processing.

So those of us in that backlog and big surge in applications all entered the US 2008-2009 and are all now removing conditions in 2010 / 2011 which I think is possibly also why they are again so slow for our particular applications.

Did you include joint credit cards? And did the bank accounts cover the whole two year period?

For all the financials we sent a couple for each year covering the two year period. For the photos we printed about 20 onto normal paper with captions saying where and when - they also spanned the two year period and included a variety of our relatives in them too - so my parents - his parents etc

Car titles?

Pensions showing each other as beneficiary

Health insurance documents?

And at this point it might not hurt to include a couple more notarized affidavits from family/friends who know you well and are part of your lives. I was going to get my mother-in-law whose farm we live on, and our closest couple friends to do one if we had got an RFE.

I found that it was useful to have a plastic folder filled with any important documents I could think of plus photocopies of each one, and photocopies of other important documents. It just makes it easier for all sorts of occasions not just ROC.

Think about what you might need to deal with any issues from your home country - bank account stuff, taxes etc, and also any documents to help you with everyday life stuff in the US - id for opening bank accounts etc (I needed my marriage cert to be added to my husbands account)

I used one of those folders with different sections and included things like:

Marriage cert
Birth cert - short and long form
Photocopies of passport page
National Insurance details
Pension plan documents
A copy of at least one statement from each of my bank accounts
Photocopy of driver's licence from home country

As you were both interviewed separately it's possible that the denial is based on more that just your financial issue.

You should both write down all you can remember about your separate interviews - questions and the answers you gave. There may be a series of discrepancies about your answers about your lives they may be basing your interview result on.
