Im not really sure what to think anymore, I have lost so much sleep over this and is causing a lot of stress for me and my fiance.

We were really hoping to be married on Valentines Day but the way things are looking Im not sure Ill be able to make it out on time. Still trying to be optimistic though.

It's very stressful...for us as well. We're just a couple of boring middle aged people who love each other, and would like to be together, legally.

I don't know why it's all turned into this insane dog and pony show.

Yep! with you on that one. Stress - now I truly know the full meaning of the word.

We are nearing middle aged, not boring though! jest.gif Not yet.

Hey Guys....Im not sure if I should be dancing right now as their email was not very specific, but we emailed NVC last week if our case was sent out yet and this is their message below:

Good Day,

Your inquiry has been received at the National Visa Center (NVC).

This petition is now eligible for further processing. The petitioner,
beneficiary, and/or attorney of record will receive further instructions
regarding the processing of this petition.

What do you all think, does is sound like they are done with administrative processing and our case is now being forwarded to the Manila Consulate. We will call and follow up when my fiance gets out of work....

Oh I'm not sure?!?!? It sounds alot like that I'm told on the phone. I'd call them again before getting my hopes up. I hope it's good news for you though.

I called again today. Same ole story.

He just kept repeating his request.

"You are unable to answer my questions, so I need to speak with someone who can. Please escalate my call to a Supervisor."

We've done that twice so far.

I will give that a try, don't want to upset the though. I think the person on the end of the phone reads the answers off a sheet.

We have been placed on hold - but only for 10 seconds or so. No paper noise for us. mad.gif

My fiance said there is a power outage in New Hampshire.

This is getting to be very frustrating, it doesnt help any when you're a very impatient person.

It does look very bad there. Still and all I'm fed up with waiting. I'm getting quite discouraged really.

I am with you completely..... sometimes I feel like why us!!!!

We havent even called at all, we figured we would just wait on their reply to our email.

I wish this waiting would end.... it feels like a nightmare I cant get out of.

They are changing their story as of tonight.

All along they've been saying 2 to 4 weeks. Now we're told they cannot estimate.

We would be there 4 weeks on Dec 18.... I did a little more research on old timelines for K1 from 2 years ago and I actually came across one that lasted 3 freakin months......

Mostl people were usually out in about 4-6 weeks though... like I said I am giving them till month end to get our file out.

Hang in there cdneh, I know it's frustrating, I wish there was something we could all do.......

3 months isn't too bad blink.gif

It's the not knowing at all that makes the whole thing worse.

What are you going to do at the end of the month? Just curious. star_smile.gif

Were really not going to do anything...hehehe, but WAIT even more.
I guess I was just giving us a date to kind a look forward to in hopes that by this time it would be done....if it is, it would be a GREAT New Years present... not calling everyday like we used to was really hard at first, but after a few days we've gotten used to the idea not calling till month end.

Do any of you have any idea what could be causing the delay...such as common name, somthing in your past, backround checks that would cause a red flag... no need to go into details but seems to me there has to be a reason for them to be holding on to our files....

For us I can think of a couple.... like recent divorce and previous arrest from 16 years ago of a misdimeanor minor offense which according to their questions on the application doesnt apply as a cause for concern....sooooo I thought, well that has to be it for us....not sure boutthe rest of you.

Regardless, I am glad that we have each other to keep company, thank you all

We had our NOA2 in Sept, so we are expert at WAITING!!! headbonk.gif

Yeah, we try and call every other day now.

All I know is that it's checks, well that's what they told us at USCIS - we where held up there too! As for the NVC, I only guessing it's the same. Names or something. I wonder if we will ever know....

If it's the same thing we were held up at USCIS for that would make me frustrated - why can't the clip/attach the evidence already found.

Too right!

They won't even tell me how long we have been in AP. I do know it's a been roughly 5 weeks though.

We found out how long when he escalated to a supervisor. They kept telling us that no, we weren't in AP, no, there wasn't anything untoward with the case, they just hadn't got round to sending it.

She told him in spite of what the Level 1 people had told us, and in spite of the 2 letters dated the 24th and 26th November that said our case would go out to the consolate in a week, that we were in AP and had been since the 21st November.

Yes, we had a similar story. Told it was being sent. Nothing wrong with the case....everyone goes though this....blah.

We have put in service requests and had letters back saying that they will let us know once the case has been forwarded on to London. Huh! Waste of paper.

How did you get to a supervisor? We have asked and told it wasn't possible.

I wonder what the longest wait has been?? Doesn't bear thinking about.

I looked at the immigration timelines on here and I saw one for 6 weeks...it seems they eventually get sent out..letsa hope onece its at the embassy level it's a smoother ride for us all.... lets keep track of each other... we used to call just about everyday but we havent called since we found out we were on AP...

Well 6 weeks isn't all that bad, right? I think I might have seen a 3 month NVC/AP somewhere, not sure though. Ick!

We are just over 4 weeks now. Plus - we where held at CSC for extra processing too. More ick!!!

The numbers they wrote in her passport where they stamped the denial will give you answers. They are a series of numbers relating to the "offenses".

A denial will NOT have a negative effect on your immigrant visa. The best one, so I here is the CR-1. K3 isn't so good. Do some reading and asking questions, before you throw $$ at a lawyer.

Good luck to you both.

Thank you!

The numbers that were written are:

8 CFR 217.4 (o)(1) ... and then her alien number

I looked up section 217.4 and it looks like (o) doesn't exist, but (c ) does. The paragraph reads:

QUOTE
(c )(1) Removal of inadmissible aliens who arrived by air or sea. Removal of an alien from the United States under this section may be effected using the return portion of the round trip passage presented by the alien at the time of entry to the United States as required by section 217(a)(7) of the Act. Such removal shall be on the first available means of transportation to the alien's point of embarkation to the United States. Nothing in this part absolves the carrier of the responsibility to remove any inadmissible or deportable alien at carrier expense, as provided in the carrier agreement.

Unless there is actually a (o) section, it seems that all that was written on her passport was that she is being removed at her own expense because she is inadmissable.

This doesn't say anything about her (possible) "misrepresentation". Does this mean that she wasn't charged as such?

Thank you for your help. This forum really is a great place...

I don't claim to know a huge amount about these cases, but a little. Is the (o) an (a)?

I suggest you get some advice my friend.

US Embassy and Consulate DiscussionQuestions about NOA2 to Interview
QUOTE (KnightAndMagpie @ Oct 1 2008, 10:35 PM) <{POST_SNAPBACK}>
Hi, I got a letter today from NVC saying that within a week they'd send the packet my fiance' needs in order to fill out and do. About how long does it take for them to process this packet and when roughly do you think the interview will be? It's the London Consulate.
And will it be possible for her to reschedule her appointment at a later date, possibly a month or so? She's under the iron stranglehold of some very unforgiving South Asian parents that firmly believe in arranged marriages and me being the white devil they'd never live that down, but the problem is that she is going to be in a bind finishing her final year of school if she's kicked out of her home and has nowhere to really go. The fear here is that she's afraid of being sent off somewhere on a whim with her family some time in the next few months, and if they staple that visa into her passport and her family decides to whimsically travel out of England and her parents see it, she's going to be in a world of not-very-nice-things.

Thank you for your help! I wish they would update the instructions so they don't confuse people!

then it would appear that you would be one of the few people around here that actually read the instructions... smile.gif

Yes, the instructions on the website have not been updated to conform to the instructions on the latest form. I'd use the form instructions. Do make sure you use the new form with no space for a Notary to sign.

I also read. It seems they have updated some of the instructions, not all. It states here...

Prior versions are also acceptable.

I have the previous copy of the form ready for my interview.

SNAFU!
Says the I-134 needs to notarized in one place but the new form doesn't have a place for it to be notarized!
To file this form, it needs to be sworn to or affirmed by a USCIS Officer at any USCIS Office, by a notary public, or other official authorized to administer oaths for general purposes. If the sponsor is outside the United States, the affidavit must be sworn to or affirmed by a USCIS Officer or Consular Officer at any U.S. Embassy or Consulate.

SNAFU! Old saying! Situation Normal All Fooked Up! headbonk.gif

The version of the form and its corresonding new instructions are in conformance. There is no mention of a need to be "sworn or affirmed" etc. No SNAFU in this case. I believe the acronym was popularized in an age when the F represented "fouled".

I have just sent by FEDEX to my fiancee in the Philippines the I-134 and used the new form. I did not have it notorized due to the statement that it was not necessary but also read the instructions and it satates the form needs notorized. This is very contdicting but there is no space for a notory to notorize as with the older I-134 forms. Her interview is January 23. Now I am having second thoughts after reading all the responses here and am wondering if I should print another I-134 and have it notorized and FEDEX over to her?? Can someone that "KNOWS FOR SURE" let me know if the form needs notorized or not?

There is no space for the notary. If in doubt, you could always get the stamp on the back.

I think it's best to get all the documents as son as possible, then there is no rush at the next step.

Wait until at lease the embassy have told you P3 has been sent out. You still have to go though NVC and there are sometimes hold ups there.
