Hi all,

I know this is a topic that gets a lot of coverage, but despite attempts to find the answer in previous threads I am still unsure.

So my problem is:

I am a UK citizen living with my US spouse in London. She is leaving the UK on 01/29/2013 and returning to live with her family (parents and 1 sibling). I have my interview with US Embassy on 02/04/2013 and intend to move in with my wife's parents (until we get our feet on the ground) after I get visa.

As my wife and I, whilst employed in the UK, do not have jobs in the US, her mum is providing the full income for I-864. As far as I understand it, my wife fills out an I-864 stating 0 income and her mum then also fills out I-864. No I-864a needed. We have all tax returns, W-2's etc. etc.

However, what should my wife, and her mum fill out in terms of household size? My wife is not and has not been financially dependent. She is not on her mum's tax returns, and will only of been living with her mum for a few days at the time I am at interview.

I thought that maybe my wife's mum would classify my wife under 21e but I am not sure if that is the case. I suppose this is also important because it effects whether we fill out I-864a or not.

Any help greatly appreciated.

Pretty much cleared it up.

However, one other question;

In what you have described, and where mom files taxes jointly but exceeds income requirements to be the only sponsor, what should be entered on Question 23 "My current individual annual income is...", question 24c "Total household income" and Question 25 "Federal income tax return information".

As far as I understand it I enter her individual annual salary supported by evidence from pay stubs and employment contract on Question 23, repeat that figure for question 24c, and then I put total income on joint-tax return for three years into each line of question 25. For the latter I provide mom's W-2s to prove her individual income.

Is that correct? Is the discrepancy between incomes in Q25 and Q24c/Q23 OK?

Hi all,

Quick question.

I am currently in the midst of completing I-864 forms. As we are using my wife's mom's income to meet the requirements, and as my wife has recently moved back home with her parents, we are doing this both with mom as joint-sponsor and mom as household member. We thought we would cover all bases to be ready for any eventuality at interview.

We get how to calculate household size for joint-sponsor purposes but we are a little baffled on how to complete this when using the I-864A.

The main concern is that;
My wife is not on her mom's tax returns and, thus, is not formally a dependent. When we move to the States we will be finding employment and hope to only live with wife's family for a month or so. So in terms of the I-864A stream, my wife will put on her I-864 that her household size is me, herself, and- selecting 21g (parents with same principle address combining income and submitting I-864A)- her mom, i.e. 3. Thus her mom's income only needs to be enough to support 3 people. However, her mom's current household is herself, her husband, and her daughter (wife's younger sister). Taking that into account her actual household, including my wife and I, would be 5. Our issue is not whether she has enough income to support 3 or 5 household members, as she has enough to support both. Our issue is; should this somehow be represented in household size under option 21g when my wife fills in the I-864 when using her mom's income as a household member?

It seems like a loophole that if using the I-864A stream her mom could have, say, 10 other dependent children but need only have enough income to support herself, the immigrant, and the immigrants petitioner.

Then you should be fine; I believe someone else was on here a while ago asking about misrepresentation from the UK, and since it only carries a maximum punishment of a year then he qualified for the "petty offence" exemption.

Is it your only CIMT? If so, how old were you when you were convicted and sentenced, and what was your punishment?

Hypons..Thanks for the quick reply....yes it is only CIMT i have in my life..i was 24 and the disposal was caution....police kept me in the station for few hours and released me with a caution...

hello guys please need your help. we are about to file i-130 and i am british citizen.the problem is that i have clear police record apart from only one police caution (2009 for false representation and also mentioned on ACPO police certificate) and that comes in the category of (CIMT).what are the chances of approval on the embassy stage?
just to check all i have already police certificate from ACPO and also subject access report and both have same thing mentioned(caution for false representation ,year 2009 and number of offenses 1)

this question is for one of my mate,his joint sponsor is from new york but he want to go chicago(he wants his POE chicago).can he do that or he have to go new york?reason for making POE chicago is his joint sponsor is on holidays in canada for few months...
obviously if he is allowed to make his POE chicago than can he tell immigration officer for his new address for green card and ssn delivery?..please need your help with authentic information...that he is allowed any POE in USA or only the one where joint sponsor lives or previous addresses given on ds-230 forms...

OK, I heard somewhere about conditional permanent residency...what the heck is it, and does it apply to me??

Due to immigration fraud, the CIS gives ALL immigrants by marriage a conditional permanent residency green card unless the couple has been married for over 2 years at the time of interview. The conditional permanent residency green card is valid for only 2 years from issuance (the day your passport is stamped by customs or CIS), and the couple must file an I-751 form to remove conditions 90 days before the 2 years is up, or the immigrant will lose his/her green card For more information on Removal of Conditions go here.

Hi,

I am a Newbie here and am living in the UK. Me and my wife who is a US citizen married in the UK in July 2012. I went to visit her for 2013 new year's holidays and we decided to start filing for my migration to the USA. After reading few topics here on this site we have decided to file for IR1/CR1 spouse immigrant visa.

Saying that, I read about the differences of these two visas and trying to figure out which one of these visa's I finally will get if I we start the process using I-130 form. I am fully aware of the CR1 visa condition and the requirement to change it to PR within 90 days of the expiry to avoid any problem. Although there is not much a difference between these two visas in term of entry permission and the time takes to get any of these but since I am running my business in the UK and need to sort everything out which takes time, I would probably be married for 2 years at the time of the entry to the US if not at the time of my visa interview. But some topics say you get IR1 visa if married for 2 years at the TIME of VISA INTERVIEW and some say at the TIME of ENTRY.

So I appreciate if I get some answers on my questions below;


1- Do I need to be married for 2 years or more at the time of IR1/CR1 visa interview at the consular to result in 10 years Green Card after entry to the US, or do I need to be married for 2 years or more when I ENTER USA on my IR1/CR1 visa to get a 10 years Green Card?

2- To be qualified for an IR1 visa, do we need to show that we lived together all or part of our past 2 years of marriage? So far we have only had chance to spend family holiday time twice, once in the UK and once in the USA for a total of 3 month. (we have lots of true evidences about the Bona fides of our marriage)

Hello everyone,
i am an italian citizen living in England to complete my studies,i met my husband, a US citizen,two years ago, we got married in march 2008 and filed for I30 and 129F spouse visa in may 08 through a lawyer in the US. My husband lives and work in the US and i am here in the UK. The lawyer advised me to not visit him in the US until the approval of the spouse visa, as once started the process for a visa it is better not to challenge immigration. I have heard that normally it takes between 6-8 months. I will be finishing my studies in February 2009 and i hope that by that time my visa will be approved.. i miss my husband incredibly and i cant wait to be reunited with him in the US.
Can anybody tell be if they have had a similar experience(european beneficiary and US sponsor);how long did it take and what happened after the approval at the US embassy in the country where the marriage took place.
I29F receipt on the 29/05, when do you think we will get an approval and more importantly what 's the next step,our lawyer was telling my husband about a package and blah blah... can anyone explain it to me in an easier way.. as i am really confused.

So I just paid $404 and received an email titled "Receipt for IV Case." I know the next step is sending in a DS-230 packet. But where is the instruction. Where can I find what to be included in the packet besides the DS-230 form. Will NVC inform me about this? I'm so confused and behind. Please help. Thanks.
