IR-1 / CR-1 Spouse Visa Process & ProceduresHusband admits during medical he smoked weed 4 years ago
Impressed as I am with outraged sense of honesty displayed in this thread I am somewhat confused about the original logic. If the act of simply *admitting* having taken a bit of weed in the past results in a one year ban then as such an admission would be true 12 months later too so then that's effectively a permanent ban. A blood test which confirms the fact you may be a current consumer is of course a different matter but did the OP confirm that a blood test was being done ?

At the very least I'd like to thank the OP's SO as it tells me that should one have partaken then one might well be careful how the question was answered.

IR-1 / CR-1 Spouse Visa Process & ProceduresDX Envelope with passport/documents

It does contain my passport, 100%, as I can also feel it floating around in the sealed plastic bag. Hence still very confused as I can't leave the UK without presenting a passport I'd think....

oh i see sorry i didnt catch that part :bonk: ... soooo you are talking about the envelop that the DX handed you???? if so then you should open that cuz it has your passport in it  the sealed envelop is always inside the first package .
open the first package and keep the sealed envelop safe :)
good luck

IR-1 / CR-1 Spouse Visa Process & ProceduresDX Envelope with passport/documents

Dear All,

Has anyone recently been approved in the UK and has received a delivery with their stuff from DX? If so, what do you do with the sealed plastic envelope? Reason I am asking is that no one told me on my day of the interview, and there is no instructions on the outside of the plastic envelope.

As for now I haven't opened anything but I must wonder how I'd be able to leave the UK if the plastic envelope remains sealed as I will be asked to show a passport upon leaving the UK I'd assume...

Any answers, especially from people with recent experience being granted a CR-1 in the UK and already in the US are much appreciated!!!

Thanks,

Josef

hello dear friend
pleaseeeee do not open anything before you are sure of what you should really do !!! i was approved a k1 visa in american embassy in London and no one told me anything on the day about the sealed envelope either and i got the same plastic envelope with no instruction on it (to do not open i mean !) so i opened it and i got myself in a big s***t ,and it resulted them canceling my k1 visa and asked us to re apply again :((
i guess i wasnt the only person to get such an envelop !!
please do not open it and even if you have to take it to the embassy and show it to them and ask them what to do !
good luck to you

IR-1 / CR-1 Spouse Visa Process & ProceduresChoice of Agent

Whilst most seem to get a response within a couple of days of their email, there are some that have waited a week or more. You can scan/email or fax the DS-3032 that you received to your spouse, have them complete, sign it and then scan/email or fax it back to you so you can send it off to them straight away. This is what we did. Meanwhile you may just receive the confirmation email from NVC of your email. It wont matter if they get it twice as this doesnt appear to be a big deal with the 'Choice of Agent' hence why they have also been accepting this process via email.

So then my husband (who posted this original question) could sign/date the Choice of Agent form he received in the mail in the UK and send it to me (the USC) to send back to NVC on his behalf. Right?

Thanks as always!

IR-1 / CR-1 Spouse Visa Process & ProceduresI-184 Questions

??

Arent W2's only necessary if you filed previously jointly with a previous spouse and you need to separate your income from the spouses.

You would show on the 864 what you declared for tax urposes. You cant say that you earn so much, and show a different number as your gross income for tax purposes.

I had a different job in 2005 with a regular salary structure, so there won't be any discrepancy between my taxes and what I report as current salary + commission. I just got this new job recently.

I think you may be right...I thought you only had to provide W2s if you filed jointly, but I've seen conflicting information lately. I think I'm going to stick with the tax transcripts. Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresI-184 Questions
Hi Everyone,
I am getting my I-864 ready and have a few questions:

1) Do I have to provide my W2s? I can't find them. Will tax transcripts be enough?

2) My income is a base salary plus a guaranteed commission. Should I show the total, or the base salary only? (I meet poverty guidelines either way, but tax year 2005 was bad for me, so I feel the need to make this year look as good as possible.) The I-864 form doesn't really allow enough space to show them separately, but a letter from my employer would break out the base and commission as separate. I don't want to cause confusion by listing the grand total on the form while having two separate figures in the employer letter. What's the best approach?

Any guidance is appreciated.
Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresEmployer Letter for I-864
Hi everyone,
I'm preparing my I-864. I will soon ask my HR department for the "employer letter" and want to be sure I am including all the right info. Based on previous posts, it looks like the letter should include:

1) My job title
2) Length of time at the company, including start date
3) My current standing (e.g. "In good standing")
4) Current salary

Is there anything else I should have them include?

Also, should I have them list the NVC mailing address in the header or does it matter? (Being paranoid, per usual.)

Thanks for your help.

IR-1 / CR-1 Spouse Visa Process & ProceduresLong wait and More questions
Hello Guys,

So happy to be part of this great group , with all the information i have gotten from this site, i must confess, my confidence has increased. I am currently based in the UK ,I got married to my wife last year and I am originally from Nigeria, but currently based in the UK studying. We waited 5 months after we got married, before filing for the i 130 (January 2012) and i129 (Feb 2012). Now , this question is directed mainly at UK based filers:
1)I want to know how early i can apply for my police report (I have lived in the UK for 5 years).
2) Are there any vaccinations I can right now have before my medical is scheduled? I was thinking , this will make my medical easier.

Thanks for the reply.

E.

Wuhan, I am in the same boat and i used a lawyer, only difference is my lawyer still replies me. My i130 and i129f were approved in 4 months and now my lawyer is suggesting that if i want to be with my spouse real quick, we should go the i129f route. Pls can u instruct me on the next step, so i can decide on what to do. Its seems most lawyers dont update themselves.

hey Guys, my case is the same. I got approved i129f and i130 on same day. The complication here is that my wife got a lawyer and the lawyer is so confident that my i129f will scale thru faster. I know you all say they take around the same time, but if my i129f scales thru first , i see myself doing my medical and interview before the end of July. All i want now is for us to be together as soon as we can. thanks

Not quite correct, administrative closure of the I-129F filed to start the K3 process occurs when the NVC receive both petitions at the same time or if they receive said I-129F when they already have an approved I-130 on station.

I have been calling the NVC to ask if my case has gotten to their desk. I call every other day. Initially, i was calling to enquire about both the i130 and i129f, but in the last 3 days, i have been calling to enquire about only the i129f. I really pray this is approved first, so my process can move on faster. Its been 18 business days and 24 days since my NOA2 on my i129f and i130 and nothing yet from the NVC. VERY WORRIED!

Hi Guys,

I am quite confused and i will be most greatful if my query can be answered. I got my i130 and i129 approval on the same day, last month (29 may) and me and my spouse are using a lawyer. There is a twist in the advice the lawyer is giving, this is why i am making this enquiry. The lawyer advises that if i want to be with my spouse real quick, i can proceed with the i129 and i will get an interview earlier than using the i130 route. I also saw something on the NVC wiki, regarding actually using the i129 approval to fasten your i130. I am confused. I do hope my request is explicit enough?

THANK you folks for you ridicule , comments and inputs. Most of us have gone through critical stages of our visa journey, and sharing such experience is the reason this site exists. If the answers to the question posed were on the site, i would not have asked (at least i can read). I am assuming my own case is special, since reading guidelines on the site, i have not come across my own situation (having used an attorney). If u cannot help with questions asked, no need to ridicule me.

Best of luck in your respective endeavors, but remember, the journey does not end here...

IR-1 / CR-1 Spouse Visa Process & ProceduresHELP LAWYERS MERRY GO ROUND
Hi Guys, my wife has never really believed in the authenticity of the Visa journey site. Despite several attempts ;to convince her that it was okay to pursue the whole process by ourselves, being a pessimist, she decided to engage a lawyer. What i soon found out was that, by following threads from all the folks on the visa journey site, i was always several steps ahead of the lawyer. The most annoying part was when the lawyer kept on insisting that the k3 route which we started in January 2012 was still in existence. Based on advice from the lawyer, we applied fro the i129f and the i130 , one month apart (i130 in Jan and i129 in feb). Our petitions got approved jointly on May 29th. Based on tips from the visa journey site, i kept on calling the NVC until we got our case number and IIN. Still nothing from the lawyer.

Based on advice from the visa journey site, i came to understand that because the 2 petitions were approved together, the i129f will be closed administratively.

My wife came over to spend 2 weeks with me and while she was here, we decided to call the lawyer . By then the NVC had sent the IIN, NVC case number and AOS and IV BILLS to me, my wife and the lawyer. The lawyer asked us not to pay these bills and kept hammering on the fact that that the NVC had not closed the i129f and that it was our right to choose which petition to follow.

I told my wife what i learnt from the site, but of course, she had the notion that the lawyer was better informed ( since law was not my field). WE waited 3 whole weeks doing nothing (actually we did loads of travelling across the UK during the wait - London, Aberdeen, Edinburgh).

Finally, the annoying lawyer, came back and told us the same thing folks on the visa journey had been hammering since.I felt annoyed and disgusted, now the idiotic lawyer wants us to pay the 2 bills and i am asking myself, what really is his role?

The question i have here is that on our invoice page we have been asked to make 2 payments , one for the AOS and the other for the IV. All the threads i have been reading on the visa journey site, most folks paid one bill, waited ,for it to show paid, then got instructions from NVC and a packet before paying the second. Why have we been asked to pay both bills at the same time?
I will be most grateful if the VJ member can help answer this question?
