Got my K1 Visa interview coming up in the London Embassy. On my form it says bring DS-260 but then it says DS-160 ONLY for K Visa applicants. Does that mean only k visa applicants bring DS-160 or does it mean k1 visa applicants bring only DS-160? I get different answers on different sites. PLEASE HELP!!!

Thanks for your help in other areas and I appreciated the link but this was a new question to which I didn't appreciate the catty phrasing. 

 

Anyway, to anyone who wants to the know the answer to my question in the future. You CAN pay in cash on the day if you haven't already pre-paid for whatever reason. They have a cashier who takes your money and gives you a receipt. That being said, it is advised that you pay in advance as the woman who took my documents yesterday didn't seem happy that I hadn't pre-paid.

 

Also to anyone who's helped me here, I want to say a big thanks as I got approved and will finally be with my fiancé in April.

I have my k1 VISA interview tomorrow and from what I've read online the fee is $240 can anyone confirm this? Also are there any other fees that I should be paying?

 

Not only that but I'm going to be paying in cash. Is that okay? At what point do I pay that? Also I assume it's okay that I pay in sterling?

Just looking at the K1 VISA that they printed in my passport it has an expiration date of 8th May. I remember being told that I had to travel by the 8th of May but I just need to make sure that I have remembered correctly.

 

I also think I was told that we have 90 days to get married after moving to America. Has this been the experience of everyone else on this VISA?

Hey everyone,

 

I've gone and done it! My Fiance and I are now my Wife and I.

 

Firstly I just want to make sure that the only think required of me within the 90 days is that we get married. I'm now under no strict time limit as to what happens next?

 

Also a couple of other questions. I have my I-485 form which I need to fill out. When does this need to be handed in by?

 

And I've been waiting for my social security card for about 8 weeks now. When I go to the social security office, which I've done a few times now, they tell me to wait longer. Originally they told me it should be around 4 weeks. Has anybody else had problems getting their social security number through the post?

Hey,

I applied for my social security number about 8 weeks ago. I got a letter through the post yesterday saying that they couldn't process my social security number the problem is my I-94 expired the day before. I think the reason it couldn't be processed it a clerical error by them placing my middle names as my first name.

I've just been to the social security office for the third time. They said there's nothing they can do because my I-94 has expired now. I need to update it or get a new one. How do I do this? Can I do it online?

Also I haven't sent for my change of status yet. My wife keeps telling me that we need to get a social security number before I send this off. If we file for it now we need to file for it a second time when I get the social security number? Is this true? I'm nervous because, although we married well within the 90 days, my I-94 has expired so I'm kind of floating in limbo.

We had the same advice... from a lawer.... We didn't follow it, and decided K1 was the best road to go. And having read a lot of threads about this on VJ, I believe we were (very) right!

For questions regarding forms, we followed every step of this:

SO usefull. There are examples forms so you know how to fill them, and it list everything you can add in your package, how to send it, label it, etc.

Hey there!

My names Klaire, and I live in London, England and my fiance James lives in Maryland, USA. We have just recently got engaged, and are all ready to set the ball rolling. Our plan is for me to travel the the US where we will marry, and live together.

I've had (what I believe) to be some bad advice, and I was told to just enter the country on a standard ESTA, marry there, and then apply for residence. I was told that this would be the easiest, fastest, and cheapest way to do it, but is not completely lawful... and that leads me to believe that it is NOT infact the easiest, fastest, or cheapest thing to do.

So, we've decided that applying for a K1 visa is the way to do it! So, I'm looking over the I-129f form, and filling in the 'fiance' part, so I can email it to James and he will just have to do his own but, and it has me a little confused.
Q,8 is asking for my U.S SS# and Q.9 asks for my A#

How should I go about filling those two questions? Thanks for your time :D

With regards to the police cerificate for the UK you should be able to obtain one from ACRO- www.acro.police.uk

 

It'll tell you how much it costs etc. I didn't have to wait too long for my certificate.

Im in the same boat as you mate, however as the other peeps here have mentioned this is a petition. The proof of meeting within the two year period is the most important. Just make sure you include passport stamps from the POE, boarding tickets, credit card statements, 4-6 photos of you and your fiancee and any receipts you kept.

I personally will be sending secondary evidence like mobile phone bills (various dates), emails and letters. The MSN and FB logs is far too long winded to prepare at this stage, just wait until the interview! I will be sending mine on Friday to my fianceé so she can sign and complete the petition!

Now is a good time to send it as apparntly this is a 'quiet' period for them according to the operator she spoke to last week!

There is nothing worse than stress and panic. File your petition first, then if you have a co sponsor who meets the income requirements just bring all the evidence for your interview and you should be fine. If there is something missing then you can worry or best try to supply them with what's missing... You didn't even send the petition and you are already panicking, I can tell you one thing, it's not good for your health or the process that's ahead of you... Just read the guide and follow the steps and you'll be fine!

I have reported this to the administration. It is wrong. There can be ONLY one co-spomsor for an I-134 (you can have more than one for an I-864 but you do not use that form for a visa) and they need to specify what they mean by "government benefits"

I apologixe for this misleading information but that is why we have public forums.

You are right, I do need to understand more about the US definition of welfare, but it does say other government benefits, so surely disability benefits would be under that? I will get my fianceé to call them today to see if they can give us an understanding of this. When I do, I will post it back so the support page can be updated...

There are no I-134 "files" or guidelines. Typically the consulates use the I-864 guidelines. Not sure where you are looking. There can only be ONE co-sponsor for the I-134/visa. Better not use that source any more, it is not accurate.

The "government benefits" you refer to would be welfare benefits. Disability is not welfare and is acceptable income. If the disability itself is enough you do not need a co-sponsor.

What you SHOULD do is get yourself more educated on the process, which you are doing now, and be careful what you read and assume.

THINK I AM ROYALLY SCREWED!! I was just looking at the I-134F files to see what we need to fill in after the I-29F gets approved and according to the guidelines:

Not having adequate income will not usually be a problem if you have a co-sponsor, according to experiences posted on the newsgroup, as long as the co-sponsor has adequate income/assets. Be aware that the co-sponsor must have enough income/assets for both your fiance, any fiance children that will be immigrating, and his/her own household. However, that IF the US fiance has been on welfare or other government benefits for a lifetime or has no plans to work actively, the consulate can still deny the visa based on the likelihood that the foreign fiance will become a public charge. Just having a co-sponsor may not be sufficient. An actual case has been documented wherein a fiance visa was denied because the petitioning fiance was on government benefits and would not be working, even though the US fiance had two co-sponsors.


So because my fiancee is disabled and is claiming benefits from the state of TN, we will get instantly denied?! This is really not fair and is outrageous, we even have a co-sponsor! All I wanna do is to look after her. What should I do?! Should I get my fianceé to call them and explain the situation? :crying:

I did post this on my I-129F post however, I feel that this needs to be on a seperate topic because this has nothing to do with the I-129F...

You'll see it when you fill out the VJ timeline. When you receive the NOA1, it will note the date of acceptance as well as the Service Center -- Vermont (EAC) or California (WAC) -- that will process the petition.

Welcome David!

Have no fear, I am from the UK as well and just about to send off the I-129F petition form real soon!

First of all, you only need to send ONE I-129F form as it is about you and your fiancee, the G-1145 is a notification form to recieve updates from either email or text (personally I would allow all notifications to be sent to your US fiancee) so you only need to send one version.

The G-325A however you need to do one and your US fiancee needs to do one because it is a more in depth report about your lives.

As for the I-846 forms, you DO NOT need to send those when filing the I-129F, that will come when your fiancee will recieve the NOA2.

Mine was like a total of 112 pages (20 of them to prove that my fiancee was disabled and could not work), and the majority of the pages were photocopies of evidence of our relationship:

  • 30+ photocopies of my passport, even though they were blank!
  • 20+ pages of my bank statements (credit & debit)
  • 10+ photocopies of airline tickets, hotels, musicals & WWE shows we went to
  • 5 picutres of us from each trip, signed and dated from both of us

What I am trying to say is even though 200 pages can seem a little OTT, sending too much evidence is better than sending too little, getting an RFE (or an RFCS in my case :rofl:) and then waiting to see if you have corrected the RFE.

Just dont forget to enclose a check for $340 (NOT $350, $330, £240, $300.........$340!!!!) :bonk:

You list ALL children on the 129f form, regardless of their immigration intent.

You then list only those children that you wish to have a K-2 issued on the DS-156K form....and you list whether they are To Join or To Follow.

Then if they are To Join, you get a medical done for them and bring them along for your interview.
If they are To Follow, then when you are ready for them to come, you notify the Embassy to schedule their interview, have a medical done for them and then have them attend their interview.
